'Atrocity' case quashed
TNN, Aug 9, 2010, 09.54pm IST
BELGAUM: The high court circuit Bench of Dharwad has quashed the
criminal case filed by the police department against two Belgaum
journalists under SC/ST (Prevention of Atrocities) Act, saying "there
is no question of atrocity arising in accident cases".
Marihal police had registered an atrocity case against journalists
Vilas Joshi and Ramesh Hiremath on June 9, 2009. In the chargesheet,
it was mentioned that the duo had "allegedly" assaulted a truck driver
belonging to Scheduled Caste and abused him in filthy language. This,
they did, after the truck driver "allegedly" hit their car in Belgaum
(North) traffic police station limits.
Dismissing the case, Justice Huluvadi G Ramesh said journalists "were
purposefully implicated in the case by the police department". As
there was no old relation or individual identification between the
complainant and the journalists, no question of atrocity exists here,
he added. The court also took the police department to task for
building a "false case" against the journalists.
