'Deputy Commissioner has failed to protect Dalits'

The Federation of Dalit Organisations has accused Gulbarga district
Deputy Commissioner R. Vishal of pursuing anti-Dalit policies and not
taking concrete steps to prevent recurring incidents of atrocities on
the community.

Members of the federation staged a demonstration here and demanded the
transfer of Mr. Vishal from the district. They marched to the Deputy
Commissioner's office, shouting slogans against the Deputy
Commissioner for his alleged anti-Dalit stance.

In a memorandum addressed to Governor H.R. Bhardwaj and submitted to
the district authorities, the Dalit leaders said the district
administration had failed to prevent the increasing cases of
atrocities against Dalits in the district. They said the Deputy
Commissioner had neither paid a customary visit to the victims of
atrocities nor had he provided compensation to them.

The failure on the part of the Deputy Commissioner to deal with the
perpetrators of attacks on Dalits firmly had only emboldened vested
elements, they said.

They referred to the attack on Dalit youth, Kiran Jadhav, on July 17,
by a group of persons led by the former Opposition leader in the city
corporation, Vijaykumar Sevalani. Although the police belatedly filed
a case of attempt to murder, the accused had not yet been arrested.

The federation accused the Deputy Commissioner of foisting false cases
against those who questioned his acts.

LUCKNOW: Denied ticket by the party for the forthcoming Uttar Pradesh
Assembly elections a sitting MLA of Samajwadi Party today joined the
ruling BSP.

"Expressing faith in the policies of BSP chief Mayawati and expressing
faith in her leadership SP MLA from Kisni in Mainpuri Sandhya Katheria
has joined the party," BSP state president Swami Prasad Maurya said.

On being asked whether she would be named as BSP candidate from Kisni,
senior leader and cabinet minister Naseemuddin Siddiqui said let the
time come.

After joining BSP Katheria said other than Mayawati no other political
leader was fighting for the cause of dalits, backwards and
downtrodden, however, she refused to cite the reason for leaving SP.

Katheria, who was elected on SP ticket in the last assembly elections,
was denied ticket this time and the party has named Brijesh Katheria
as its candidate.

Saif Ali Khan is known for his humoristic attitude and cool-dude
behavior. The latest development to prove this is his take on the
opposition by Dalit group on his character from the movie,
'Aarakshan'. Saif claims that he is not offended by the opposition and
would take it in a positive sense.

A Dalit group is upset with Prakash Jha for casting Saif Ali Khan, as
a Dalit, who is a royal in real life. However, Saif feels that the
Dalit group would not find anything wrong in the movie once it gets
released.

"Being an actor, I don't think I should be offended by the opposition.
I think discrimination should not happen and particularly the Dalits
should not be in favor of it as they know how it feels to be
discriminated. Nevertheless, I will take it in a positive way as I
feel the Dalit group is worried about how the movie will turn out.
After watching the movie, the Dalits will understand why Prakash Jha
chose me for the role," explained Saif.

'Media pays little attention to the issues of rural Dalits'

Mumbai-based Anand Teltumbde is a leading scholar-activist who has
written extensively on issues related to caste, class, imperialism and
globalisation.

In the second part of an interview with Yoginder Sikand, he talks
about the Dalit media, the influx of NGOs and the impact of Dalit
capitalism on the movement.

Read Part I: 'Most Dalit groups remain fixated on reservations'

How do you assess the role of the Dalit media in raising and
communicating these issues which you feel Dalit groups have failed to
take up?

There is not much of a Dalit media actually. There are several small
magazines and periodicals run by Dalits all over the country. Some of
them do raise valid issues faced by Dalits, but many others are simply
tails of this or that political group. This connection may not be
always visible but it does exist in terms of direct or indirect
support coming from these sources.

During the last decade, a curious development took place in
Maharashtra in this regard. Some Dalits started daily papers, one
after another. Today, there are at least half a dozen full-sheet daily
papers run by Dalits in Maharashtra. They do satisfy rhetorical need
of having our own media. One does not know how their economics is
managed, however, given that newspapers basically run on advertisement
revenue, which is largely absent in their case. The content analysis
of these newspapers does not indicate that they have significantly
contributed raising the live questions of Dalits or catalysed any
movement around it. They just meet the identitarian need of having
'our' own media.

I do not know whether a media owned and operated by Dalits could
really be called a 'Dalit media'. Most Dalit papers reflect the
concerns and interests of their readership -- the 'reservationist'
middle-class -- and that is why they deal mainly with religio-cultural
issues, besides, of course, reservations. They pay little attention to
the issues of rural Dalits. Many of them are averse to taking up
economic issues or to considering the need for a contextually-rooted
class-cum-caste analysis of Indian society. Basically premised on the
identity of Dalits, they often ignore other issues.

The media reflects to some degree the state of our intellectual
activism. The tragedy is that we have few organic intellectuals who
can articulate the concerns and interests of the Dalit masses.
Instead, we have a whole lot of cut-and-paste intellectuals whose only
task, it seems, is to rehash what others have written before them,
refusing to engage in any creative intellectual work. The Dalit media
eventually mirrors it.

'Influx of NGOs complicated the matter'

In recent decades, a number of NGOs have taken up Dalit issues and
concerns, and Dalits are one of their major 'target' groups. How do
you see the impact of this NGO-isation process on the Dalit movement
in terms of highlighting Dalit issues and empowering the Dalits?

In terms of highlighting and even internationalising Dalit issues, I
think many NGOs have played an important role. Even documenting Dalit
problems and issues I think is a major contribution, given that little
of this sort was being done by others. But, beyond that, especially in
political terms, I think that, barring some cases, the role of NGOs
has been problematic. At a fundamental level, NGOs depend upon donors,
and, according to the dictum 'He who pays the piper calls the tune',
they have to eventually conform to the agenda of their donors.

And the fact of the matter is that NGOs have been deliberately
promoted as a vehicle of 'globalisation' in the context of the
declining role of the State in the social sector. Naturally then, NGOs
work, by and large, to depoliticise radical people's movements.

They work in a fragmentary manner, taking up discrete issues, and this
promotes fragmentary consciousness in people around them, which is
what neo-liberalism wants. By remaining confined to funded projects,
they inherently lack a macro political-economic perspective, which
again serves the interests of global capital.

Moreover, they also attract youths who might otherwise have gone into
people's movements or radical politics, by providing them salaries and
job security, and in this way also work as agents of depoliticisation.
You are right in terming this the NGO-isation of the Dalit movement.
Before the Dalit movement could introspect on its degeneration, the
influx of NGOs complicated the matter and made any such review
extremely difficult.

'Dalit capitalism is sponsored by Western organisations'

In your writings, you argue that globalisation spells doom for Dalits.
In this context, how do you see the argument, made by a group of Dalit
'intellectuals' who have been much highlighted in the mainstream
media, of the need for the State and multi-national corporations to
promote what they term as 'Dalit capitalism'?

I think this argument is completely fallacious and dangerous. It buys
into the imperialist logic, and is geared to serving the interests of
foreign capital and the Indian ruling classes, who are well aware of
the pauperisation of the Dalits and their mounting opposition to the
system that is destroying their already shattered lives in the name of
'development'. This slogan of Dalit capitalism is being actually
sponsored by some Western organisations linked to global capital.
There is not much of guess work needed to see who the sponsors and
supporters of this idea are.

As a matter of fact, the idea has been floated by a bunch of
individuals who are projecting some Dalit entrepreneurs as though they
were the new breed produced by globalisation. And this is being
propped up by the mainstream media, which is otherwise shy of touching
anything Dalit.

As for the Indian State, the Planning Commission, which otherwise
refuses to move on the continued stealing of special component monies
meant for Dalits, has been enthusiastically considering how to channel
the public funds to these Dalit capitalists. It is a pity that Dalits
do not see through the game and, instead, are getting enamoured with
the idea because of their identitarian fixation.

'Majority of Dalits still live in horrendous conditions'

I do not think there is anything intellectually appealing about the
notion of Dalit capitalism. I would rather say that this notion is
itself a contradiction in terms and smacks of ignorance of both Dalits
as well as capitalism. The Dalit entrepreneur is not a new species.
Dalits have historically been entrepreneurs, grabbing whatever
opportunities that came their way and made progress. Rich Dalits are
also not a new phenomenon. There have been many rich Dalit individuals
since colonial times. So, to claim that Dalits have only started
progressing now as a result of supposedly benefitting from
globalisation is a simple and pure falsehood. To impute the progress
that a small number of Dalits have made in recent years to Dalit
capitalism is fallacious.

Although, knowing the systemic character of capitalism, I would never
be a votary of capitalism, I am not so dogmatic as to discard it
either merely for ideological reasons. After all, there is a
dialectics that will determine the time of its death. I do not have
any quarrel, therefore, about Dalits becoming big capitalists and
amassing their billions. But what irks me is this motivated attempt by
the proponents of the notion of Dalit capitalism to create a patently
false impression that Dalits have benefitted by globalisation, that
Dalits have now 'arrived', that Dalits have abandoned socialism and
have embraced capitalism.

The vast majority of Dalits still live in horrendous conditions in
villages and urban slums as the wretched of the earth, and their
conditions are, as I said earlier, going from bad to worse, rather
than improving, as a result of the ravages of capitalism and
globalisation.

The relative distance between Dalits and others on most developmental
dimensions was reducing until the 1990s but the recent trends clearly
show that the gaps are widening. By the World Health Organisation's
standards of body-mass index, Dalits would be a famine-stricken
community. To speak about such people in terms of Dalit capitalism is
nothing but an unpardonable, cruel joke.

Mumbai- Ajai Sinha's film Khap—A Story of Honour Killing which hit
theatres on Friday is under controversy. The director along with the
entire cast and crew of the film are under threat in Haryana.

The Khaps in UP have boycotted the screening of the film in theatres
across Haryana and Punjab. Naresh Tikait, Bharatiya Kisan Union and
Baliyan khap leaders have suggested banning the film on charges that
the film has dishonoured the Khaps.

It is likely to have a harmful impact on brother-sister relations.
Leader of Gadwala khap—Har Kishan Malic as well as Choudhry Suraj Mal,
leader of Battisa khap have threatened to begin an agitation against
the screening of the film, which revolves around honour killings.

Sinha admitted that he received numerous threatening and unpleasant calls.

In what is believed to be an honour killing, a 27-year-old woman was
murdered by her father-in-law in Sante Beedi in Varthur on Tuesday.

The incident happened around 1.30 pm just a stone's throw away from
Varthur police station. In the cold-blooded murder, the accused,
Nagarajan, who had opposed his son's marriage to the deceased a year
ago, first smashed his daughter-in-law's head and then poured kerosene
on her before setting her ablaze. He fled the scene after the murder.

Identifying the deceased as Vijayalakshmi, a software company employee
who was on maternity leave, police said she died on the spot. Her baby
girl, born three months ago, suffered burn injuries. The infant was
admitted to VIMS Hospital, and is reported to be out of danger.

Vijayalakshmi's husband Raja Kannan is also a software company
employee. They fell in love while studying BSc in Madurai. Their
parents opposed their marriage, as the two families belonged to
different castes.

The couple got married despite the opposition in July 2010, and moved
to Chennai to work in private firms. They moved back to the city five
months ago.

On Tuesday, Nagarajan entered the house around 1 pm when his son
Kannan was out on work. Before murdering her, he had an argument with
his daughter-in-law.

Police said that neighbours heard Vijayalakshmi scream, and saw
Nagarajan run from the house, his clothes stained with blood.

Police said that a team has been formed to nab Nagarajan.
Kannan's mother and brother were also staying with him in Varthur. At
the time of the incident, the mother and brother were away at their
native place.

Vijayalakshmi's cousin Karthik filed a complaint with Varthur police,
who have registered a murder case. The post-mortem examination will be
conducted on Wednesday after Vijayalakshmi's parents reach the city.

Murders to keep honour intact
Two other cases of 'honour' killing were reported in the city this
year. The decomposed body of a 26-year-old man, belonging to a
scheduled caste family, was found in a storm water drain at
Devarabeesanahalli in HAL police station limits on April 11, in a
suspected killing.

Rajaiah, the father-in-law of the deceased, had hired a contract
killer to murder Umakanth for marrying his daughter Rajitha, 21.
Umakanth was kidnapped from near his house in Karimnagar district in
Andhra Pradesh on April 7 and murdered in Bangalore the same day. The
Andhra Pradesh police arrested Rajaiah who confessed to the crime.

In the second such case, in March, a 20-year-old woman and her
four-month-old son were found dead near Bangalore. The woman's husband
had accused her parents of the murders. The woman's family reportedly
objected to the alliance. Two persons were arrested on March 19 for
their alleged involvement in the honour-killing.

The incident occurred in Thammasandra village in Kanakapura Taluk on
February 27 in which Deepika and her four-month-old child were
murdered and their bodies burnt by her family members. The arrested
included Deepika's mother Gowramma and maternal grandfather.

Dalit boy found dead, police suspect honour killing

LUDHIANA: A 23-year-old Dalit youth was found murdered at Ladhaike
village in Moga district. The body was found on Wednesday but the
police claim the crime was committed a day earlier and suspect it to
be honour killing. The body has been identified as that of Inderjeet
Singh. The post mortem was conducted this afternoon and the body has
been handed over to the family. The post-mortem examination showed
Inderjeet received multiple injuries on his body, particularly on the
head, which could have led to his death. "The youth was attacked with

HYDERABAD: About 25 students of Osmania University Students Joint
Action committee staged a protest before Telangana JAC convener
Kodandaram asking him to explain why they were not consulted before
calling a Hyderabad bandh on August 8. A major section of OU-JAC had
called for a Hyderabad Bandh with the support of TRS, TDP and BJP on
August 8, in a discussion lead by Prof Kodandaram earlier on
Wednesday.

The protesting students belonging to dalit and BC communities said
that they were not consulted in an all party meeting that was held in
the city before calling a bandh on August 8. The students gheraoed
Kodandaram for about 30 minutes at Basheerbagh at around 8 pm on
Wednesday.

The students said that in the meeting that was held in the city, only
some section of Students' JAC affliated to TRS were called for
discussion. "A large majority of the students of Osmania University
campus and their representatives were left out of the discussion,"
said M Krishank, a student of the university. The students were also
irked by the fact that ABVP which had never participated in OU-JAC
agitations directly were calling in as an ally without consulting
them. The students have also submitted a four page petition addressing
the same concerns to Kodandaram.

Kodandaram later addressed the students and assured them that the
Telangana JAC had been in consultations with student leaders since the
very beginning of the agitation. The students were removed from the
spot by police at around 8.30 pm.

One person has been sentenced to life imprisonment and two others to
seven years rigorous jail term in connection with rape and murder of a
minor Dalit girl. In October 2002, an eight-year-old girl was
allegedly raped and killed by Dharmendra Dubey, Narendra and Sanwal,
all brothers, in
Munderwan area, government counsel Jai Singh said.

He said that after examining the charge sheet Judge Santosh Rai
sentenced Dharmendra for life imprisonment and also imposed a penalty
of Rs 50,000 on him here on Wednesday.

The judge sentenced Dharmendra's two brothers Narendra and Sanwal to
seven years rigorous imprisonment and directed them to pay a fine of
Rs 10,000 each, the counsel said.

New Delhi, August 01: Noting that the incident was 18 years old, the
Supreme Court has refused to enhance the five years imprisonment
punishment for three persons accused of strangulating to death their
sister and her boy friend Gurnam Singh in Punjab's Ferozpur district.

A bench of justices VS Sirpurkar and TS Thakur refused to interfere
with the Punjab and Haryana High Court order reducing the life
sentence to five years as accused Nishan Singh and two other brothers
could not control their anger after their sister Paramjit Kaur was
found in a compromising position with her boy friend Gurnam Singh.

"It was obvious that there was a sexual intercourse with deceased
Paramjit Kaur. Again, we are not satisfied with the explanation
offered by the prosecution for delay in sending the copy of the FIR to
the Magistrate on May 16, 1993, at 10.30 pm whereas the same was
registered in the morning at 9.15 am.

"We do not find any reason to differ with the conclusion arrived at by
the High Court that the offence was committed due to grave and sudden
provocation and would fall under first explanation to Section 300 IPC
and would amount to culpable homicide not amounting to murder," the
apex court said.

The order comes in the backdrop of the recent Supreme Court suggestion
for treating all honour killings as "rarest of rare" crime and death
penalty be awarded to the accused.

The bench rejected the argument of the state's counsel Kuldip Singh,
that the five-year sentence was ridiculously low as even according to
the high court it was a case of honour killing.

"The argument is undoubtedly correct. However, considering that the
incident in question took place in the year 1993 and thus 18 years
have passed.

"Further, considering the fact that the accused persons had not even
crossed the age of 25 years at the time when the incident took place
and considering the fact that they have already undergone rigorous
imprisonment for five years and have come out of jail, we are not
inclined to interfere with the quantum of sentence and would choose to
dismiss this appeal," the bench said. PTI

The Supreme Court today reserved its verdict on the dispute arising
out of reservation of OBC students in central universities across the
country on the 'cutoff' and 'eligibility' criteria during admission
process.

A bench of Justice RV Raveendran and Justice AK Patnaik reserved the
verdict on the matter after the counsels from all parties involved in
the case finished with their arguments. The bench has in the mean time
allowed all the parties to give their written submission before next
Monday.

Earlier the bench had refused from hearing the matter after senior
counsel PP Rao appearing for the interveners, submitted that the term
'cut-off marks' which needed to be interpreted was used by Justice
Dalveer Bhandari in the 'Ashoka Kumar Thakur Vs Union of Inida' case,
and thus should be heard only by a bench of which Justice Bhandari is
a member.

However, the Chief Justice of India referred the case back to the same bench.

PV Indiresan (petitioner), a former IIT Professor, had approached the
Apex Court seeking stay on the operation of the 7 September 2010 Delhi
High Court order which had declared that the minimum eligibility
criteria for admission of OBC students in JNU should be at maximum 10%
below the minimum eligibility criteria fixed for the General
(Unreserved) category.

Pursuant to the High Court order, admission for OBC students for the
academic year 2011-12 at JNU is being made through the minimum
eligibility criteria route.

The contention of the petitioner is that the admission process for
various courses in JNU has started and the university is admitting OBC
student under the 27% reservation according to the 'minimum
eligibility' method and not according to 'cutoff marks' method used in
Delhi University.

Hyderabad, Aug 3 (PTI) Congress MLAs belonging to Scheduled Caste and
Scheduled Tribe groups in Andhra Pradesh today sought statutory
protection to the sub-plans being implemented for the welfare of the
groups. "25 SC and ST MLAs have attended the meeting today. It was
felt that effective implementation of the SC sub-plan and ST sub-plan
is the solution to ensure the welfare of the SCs and STs. We want
legislative protection for that," state Primary Education Minister S
Sailajanath told reporters here. The SCs and STs would like to have
their share in "new economic resources like mining contracts,
industries and others," he said. The SC and ST MLAs felt that they
should mount pressure in pursuance of their demands, he said. The MLAs
would visit the birth places of legends from the backward classes like
B R Ambedkar, Babu Jagjivan Ram, Jyotirao Phule, and Komaram Bheem,
who fought against British in Telangana region, among others,
Sailajanath added. Assembly Deputy Speaker M Bhatti Vikramarka said
the objective is to ensure that the fruits of development reached all.
The sub-plans are being implemented since 1980 for the welfare of SCs
and STs.

The Supreme Court on Wednesday reserved verdict on petitions seeking
uniformity in the criteria for OBC admissions to central universities,
including the Delhi and Jawaharlal Nehru universities.

Last week a Bench of Justices R.V. Raveendran and A.K. Patnaik had
referred the matter to Chief Justice of India S.H. Kapadia for posting
it before another Bench. However, the CJI asked the same Bench to
continue with the hearing.

The issue is whether students from the Other Backward Classes should
be admitted on the basis of minimum eligibility marks or on the basis
of cut-off marks for the OBC category which would be 10 per cent less
than the cut-off fixed for the general category. The court was also
asked to examine whether the cut-off marks and the minimum eligibility
marks would be one and the same.

It was argued that the impact of providing 10 per cent cut-off marks
(viz marks of the last student admitted in the general category) would
be disastrous as it would take away the benefit of 27 per cent quota
for the OBCs.

What was contemplated under the law was that as against the cut-off
prescribed for general category candidates as a group, the cut-off for
the OBC would be 10 per cent below and not beyond. "Nowhere has it
been provided that the OBC cut-off will be 10 per cent below the marks
of the last candidate admitted in the general category," it was
submitted.

It was pointed out that in 2010-2011, out of 7,420 OBC seats in 31
colleges (out of 80) in Delhi University, only 3,396 seats were filled
and the remaining seats reverted to the general category. As the
cut-off marks for the general category were always higher (75 to 85
per cent), the OBC students could not meet the cut-off mark fixed for
them, though it was 10 per cent less.

It was argued that there was nothing wrong in institutions of
excellence fixing higher threshold marks to maintain standards, but
they could not operate the OBC reservation arbitrarily.

The Bench heard arguments from senior counsel K.K. Venugopal appearing
for the former Director of IIT, Chennai, P.V. Indiresan; senior
counsel P.P. Rao for one of the interveners, senior counsel
Mariarputham, senior counsel A. Subba Rao and counsel Sanjay Parikh.

LUCKNOW: Caught in the cross fire between the Bahujan Samaj Party and
Congress, vice-chancellor of the Chhatrapati Shahuji Maharaj Medical
University (CSMMU), Prof DK Gupta, on Friday announced series of
measures to help students belonging to Scheduled Castes and Scheduled
Tribes in academics and stop all kinds of discrimination, if any,
against them.

The teaching fraternity comprising of all castes and class welcomed
the steps for SC/ST students, but slammed political parties for
undermining the autonomy of the university and making it a medium to
serve their political interests.

Prof Gupta directed the deans, faculty of medicine and dental
sciences, and heads of all the departments to arrange extra classes
for SC/ST students who find it difficult to keep up with the regular
studies. He said that he has already written to the Medical Council of
India (MCI) to reduce the pass percentage for reserved category
students, as they are selected at a reduced percentage.

The VC said that answer sheets in the examination are coded in such a
way that examiners cannot identify the student whose copy they have
been given to evaluate, hence there is no scope of discrimination. But
still, he said, will implement the policy of having external examiners
for all exams to avoid allegation of discrimination. Prof Gupta said
that that theory answer copy of a student will be checked by two
independent examiners and the mean of two will be awarded to the
student. He also said that university has suggested MCI to split five
grace marks in more than one subject to help SC/ST students pass the
exams. He said that university will also provide financial support to
the students.

The meeting assumes importance in the light of July 26 visit of
Congress MP and chairman of National SC/ST Commission, PL Punia to
CSMMU. Dalits form the core vote bank of the BSP government in UP.
Punia, who is also working to woo dalits in favour of Congress, has
been accusing the state government of not doing enough for dalits.
Punia came to CSMMU following complaints by a section of SC/ST
students that they were deliberately failed in the examinations by
teachers.
