[ZESTCaste] Donations for 2010

Dear donors, friends, and well-wishers,

It has been over a month since I came from India. I am still busy with my personal matters (my brother's death is still bothering me a lot) and so I could not devote time to give information on my Indian trip or work on FFEI projects. I have yet to finalize the accounts for 2009. I will complete it ASAP.

 

I am thinking of sending donation appeal after finalizing accounts; but time and tide wait for none.

 

So, I am appealing for donations for 2010. Please send them as early as possible so that we will make arrangements. You have been patronizing FFEI (Ambedkar Scholarships) since 2003 and I expect the same this year as well. Our responsibility has greatly increased as we have adopted kids for education at 5 different states and we need your help. Please come forward with whatever you can spare. We need your help.

 

In the past one month, the following activities have been taken place:

 

We sent advertisement to all schools in AP and expecting to get the applications by the end of October.

 

We disbursed Rs. 1,00,000 to Sakya Hostel for its maintenance.  As the funds are running out, its maintenance is worrying its managers. I was very impressed of its working when I visited the hostel. Thanks to Prof Shiva's initiative, the donation was made by Prof David Mumford of US. Thanks to both.

 

We disbursed Rs.50,000 to a microloan project (called "Centring" in building construction), thanks to Prof Anandswarup of Australia.  A group of 10 construction workers will become owners with this donation in a year or so. I met them, listened carefully the proposal, and requested help. Prof Anandswarup, as usual came forward. Thanks Professor.

 

We also planning to buy a computer for the library in Veluru, again with the donation of Rs.20,000 by Prof Anandswarup.

 

We are pleased to announce that Dr Siddoji Rao, Director, AP Study Circle (IAS coaching center run by AP Government) is willing to associate with FFEI. He is a young and dynamic. He studied in JNU, USA, Australia and gold medalist all through his academic career. He was a dean in an Australian university before coming to India to do social work.  I saw his dedication and sincerity from close quarters. We may officially induct him at a later date. Thanks, Dr Siddoji for coming on board.

 

I have been in dialogue with individuals and organizations I visited during my trip on how we can work together to help the most needy children.

 

So, friends, please come forward with you generous donations for 2010. We have 501(c)(3) in USA and your donation is tax deductible. We are hoping to get Income Tax exemption in India as well, most probably by the end of this year.

 

We are planning to wind this drive by Dec 31, 2010. Please rush your donations.

Chandigarh, Oct 7 (IANS) Tension prevailed in a village near Bhiwani
town in Haryana Thursday after villagers found the burnt body of a
Dalit youth.

Haryana police officials said the body of the youth, Sanjay, who used
to work in a roadside eatery (dhaba) was found near Digawa village
near Bhiwani, 300 km from here.

Villagers told the police they suspected that someone had thrown the
youth into a clay oven (tandoor) Wednesday night to kill him.

A team of doctors has been constituted by the district authorities to
conduct a post mortem on the body to know the cause of death.

SC to decide on migrant Dalits right to reservation

NEW DELHI: The supreme court on Thursday referred to a "Bench of
appropriate strength" for deciding whether a Scheduled Caste candidate
in a particular state is entitled to the benefits of quota in
employment in another state.

A Bench of Justices B Sudershan Reddy and S S Nijjar passed the order
while dealing with Uttarakhand government's appeal challenging a
ruling of the High Court that if a SC candidate migrates to another
state he or she would be entitled to the benefits of reservation.

The state took the stance that an SC migrating from one state to
another would not be entitled to the benefit unless the community to
which the candidate belonged was also listed under the category of
Scheduled Castes in the migrating State.

The high court had earlier directed the state to reinstate certain SC
candidates from UP, Bihar, Tripura as Assistant Professors in the G B
Pant University of Agriculture and Technology after they were removed
on the ground that though they were treated as Dalits in respective
states, yet the communities were not listed as Dalits in Uttarakhand.

The apex court, while dealing with the issue, referred to the
Constitution Bench ruling in Mari Chandra Shekar Rao case (1990)
wherein it was held that an SC candidate cannot derive the benefit of
reservation in another state unless the community was listed as
Scheduled Caste on the basis of the Presidential Order under Article
341 and 342.

A similar view was held by a three-judge bench in S Pushpa V
Sivachanmugavel (2005) case by relying on the Constitution Bench's
earlier ruling.

However, the three-judge Bench's ruling was ignored by a two-judge
Bench in the Subhash Chandra Vs Delhi Subordinate Services Selection
Board case in 2009 which took the view that the earlier direction by
the three-judge Bench was only an obiter dicta (suggestion) and was
not binding. It took a contary view that an SC even if he/she migrates
was entitled to the benefits of reservation.

The apex court today took exception to the two-judge bench's ruling
and said "in our considered opinion, it was not open to a two-judge
Bench to say that the decision of a three judge Bench rendered
following the Constitution Bench judgements to be per incuriam(a
mistake and not binding)."

The apex court, citing a Constitution Bench ruling, said the law laid
down by a larger Bench is binding on any subsequent Bench of lesser or
co-equal strength.
