Ex gratia for SC, ST students' parents

BHUBANESWAR: The State Government had decided to pay ex gratia to the
parents of the Scheduled Castes and Scheduled Tribe students if they
die in accidents or of diseases during their stay in hostel while
pursuing their studies.
The students will also be eligible for getting compensation if they
become permanently disabled during the study period.
Announcing this here today, Minister for Scheduled Tribe and Scheduled
Caste Development Bijay Ranjan Singh Bariha said it has come to the
notice of the State Government that many SC and ST students die in
hostels because of diseases, snakebite or other accidents or become
permanently disabled. The Minister said that keeping this in view, the
compensation amount has been fixed at Rs 50,000 for the parents of the
students who die in hostels. Similarly, permanently disabled students
will receive Rs 25,000 as compensation. This will benefit students of
eight ME Schools under the department, 11 Ekalabya model schools, 19
Orissa model tribal education society and hostels managed by the ST
and ST Development Department in schools under the School and Mass
Education Department.
In case of a death in the hostel, the headmaster or headmistress and
hostel superintendent will have to bring this to the notice of the
district collector, village health worker, government hospital or
police station immediately.
Compensation will be paid after approval of district collector, he added.

NEW DELHI: Allahabad High Court will now decide in four months the
legality of huge spending from public exchequer, alleged to be over Rs
2,000 crore, by the Mayawati government on building memorials for
dalit leaders and installing their statues in numerous projects at
Lucknow.

On Tuesday, a Supreme Court Bench comprising Justices H S Bedi and A K
Patnaik transferred PILs to the HC and requested the chief justice
there to constitute a separate Bench to hear them along with all
pending matters and decide the issue within four months.

Several petitions had been filed before the HC following which the
state government had approached the apex court seeking transfer of all
of them to one place, preferably the Supreme Court.

Transferring the petitions to HC instead, the Bench said, "We are not
inclined either to interfere with the interlocutory order passed by
the Allahabad HC or to direct transfer of the writ petitions pending
in the Allahabad HC to this court."

The Bench clarified that during pendency of the petitions in HC, the
apex court's earlier interim orders completely stopping construction
activity at the 24 projects in Lucknow would remain in force. However,
it permitted the state government to carry out minor maintenance work.

The permitted works range from removal of stone waste, unused
construction material, scaffolding, temporary constructions and labour
hutments to planting of new saplings, grass, fixing of leak in water
supply line. The state had sought permission for carrying out these
works at Kanshiram Smarak Sthal (Lucknow), Ramabai Ambedkar Maidan and
Dr Bhimrao Ambedkar Sthal.

Satisfied with UP chief secretary's affidavit that no work was carried
out after the ban, the Bench discharged the contempt notices against
him, which was issued after the court formed an impression from media
reports that construction at project sites continued despite interim
orders.

Suggesting that the concession to carry out minor maintenance work did
not apply to all sites, the Bench said, "We have perused the list, but
we are not inclined to permit the state government of Uttar Pradesh to
carry out all the items of work mentioned in the list. In the name of
repairs, the state government had submitted an exhaustive list of
works to be carried out at the sites."

'Benefits' of being Brahmin

When the government employment quotas are first reserved for people of
other castes before allotting them to Brahmin and Chhetri castes, when
international and national non-government job advertisements announce
that priority will be given to Dalits, Janajatis, Madhesis,
underprivileged and the marginalized, when scholars discourse,
sometimes on shaky foundations and flabby logic, against Brahmins, I
as a Brahmin, feel utterly discriminated. I, as a Brahmin (spare me
this repetition for I must confess that I am one), feel more inclined
to exploring factors that made my caste seem so powerful and
indefatigable to castes of other people, and politics that has made it
seem such a deplorable appellation of our times.

In Nepal, Brahmin or Bahun for that matter, is an imported idea or
personality. It is hard to tell who the first Brahmins were and when
exactly they came to Kathmandu valley. Their emergence had begun in
India as early as 2000-1500 BC along with Aryan invasion. They could
have entered this land in different phases of history thereafter. But
they first came to Nepal in significant numbers in the 5th century.
Then they were welcomed and given privileged positions.

The Lichchhavis and the Guptas maintained them as their personal
priests. This enabled them to upgrade the upper class Khas, Magars,
and Newars as Chhetris, which they did by constantly demanding a high
fee from them. Influx of Brahmins in Nepal began again at the end of
the 12th century propelled by Muslim conquests in Northern India. As a
result, many of them found refuge in the Kathmandu valley. As if to
encourage them into permanent settlements here, King Jayasthiti Malla,
who ruled between 1380 and 1394, introduced a definite Brahmin
predominance. He formulated rules of caste system including the ones
related with wearing of clothing and ornamentation which, according to
the chronicles, he had accomplished under the guidance of five Indian
Brahmins.

Towards the 19th century, they became instrumental in establishing the
legitimacy of contemporary regimes. They could change positions and
status of kings and maharajas. They changed the caste of Junga
Bahadur. He was a Khas, a Kunwar but they had him, perhaps on his will
and behest, adopt the title of Rana by developing a fictitious
ancestry of Rajput origin from the southern plains of India. Perhaps
for this favor, Jung endorsed their privilege in Muluki Ain (Legal
Code) of 1854, which was strictly enforced during the Rana era and on
which most of the present legal system of Nepal is based.

But there were also some prescriptions he had set for Brahmins to keep
the purity of their caste. For example, the Muluki Ain decreed that
any Brahmin belonging to Upadhayay class could not consume onion,
garlic, mushroom, tomato, rice cooked in the kitchen defiled by birds
or animals and from the hands of anyone other than Upadhaya Brahmins,
among others. If a Brahmin did so, he would be deemed to have
committed an impure act and would be punished. Likewise, he was
strictly forbidden to indulge in sexual liaison below his caste. With
'untouchables', it was much more blasphemous and would entail serious
punishments. These prohibitory orders, however, applied on him only if
his wrongs were known.

Brahmins of today are not to blame for what they are today. Brahmins
of Nepal are the result of the historical wrongs and the ruling
classes' whims and interests.I remember the story of Dalan, a serial
that is being retelecast on Nepal Television every Thursday night at
10. I have found it to be an eye-opener to history. The story begins
sometime before 1950 in a certain western district of Nepal. Anti-Rana
revolution is gaining momentum in the capital and its waves are
penetrating even the remote villages. Hari, a Brahmin youth, falls in
love with Tulki, a Damini girl. The liaison becomes public and a local
talukdar and Hari's father send him to Benaras to avoid further
scandal. But Hari, being passionately in love with her, returns. Then
the pancha banishes him from the village in charge of polluting the
caste. They have his head shaved on all four sides, take his janai
(sacred thread) off, made to shoulder a piglet in a basket and then
finally sent across the Bheri river with Tulki. From this point on, he
and his descendants become Damai.

Notwithstanding this historical reality, Brahmins have served as
political elites of this country. They functioned as sacred elites and
also had a monopoly of the legislative and judicial functions for
long. After the political changes of the 1950s, the "ever-resourceful
Brahmins", who traditionally performed the intellectual functions in
the Hindu social system, lost no time in becoming the avid patrons of
the secular liberal Western style educational system in Nepal. And it
is a reality that this legacy has continued to this day. Even today,
they enjoy liberties and privileges because of their caste. Being a
Brahmin allows you to indulgences, which the caste unjustifiably
justifies. He can marry a Chhetri girl or a Matwali but he will still
be Bahun. In death, birth and wedding rituals, his words become law.
Here I am talking about purohit bahun. He may declare the wedding over
or he may call it not to have begun yet.

The people belonging to lower castes put so much of trust upon him
that he can mould their innocence into anything. He is the sole
authority in declaring an ominous/propitious time. In villages, a
literate Brahmin, the one who can recite verses, rules over the people
of other castes. They throng to his house to ask for a propitious time
before they begin any work of great significance. He might, then,
order his client or yajaman to perform certain rituals whose
facilitator and beneficiary he will be.

But history is eternal witness. A great deal of historical, political
and legal factors account for their present status. Therefore,
Brahmins of today are not to blame for what they are today. Brahmins
of Nepal are the result of the historical wrongs, they are products of
the ruling classes' whims and interests, they are the manifestation of
privileges bestowed on them, perhaps despite their wishes, or the
advantages of the kindness rendered to them for their helpless
situations. They could have been anybody like Damai or Kami if their
indulgences, which could have been many, with the people of lower
caste were revealed to the authority. Brahmanism is not the choice of
any Brahmin. I was not born a Brahmin; I knew that I was one much
later.

study on the Dalits -- the so-called "untouchables" of India --
reveals widespread caste-based discrimination in every aspect of daily
life, according to Christian Davenport, professor of peace studies,
political science and sociology at the University of Notre Dame's Kroc
Institute for International Peace Studies and one of the co-authors of
the research report.

"Dalits are widely abused, and they live lives of constant
humiliation, indignity and violence," Davenport said. "They also are
often deprived of water, food and health. It really is a kind of
institutionalized, slow genocide."

"Understanding Untouchability: A Comprehensive Study of Practices and
Conditions," just released by the Robert F. Kennedy Center for Justice
and Human Rights and the Navsarjan Trust, uses data from 1,589
villages and 5,462 respondents in Gujarat, the westernmost state in
India. The three-year study combined the efforts of academics, human
rights activists and lawyers.

The report reveals that — despite Indian and international laws that
ban discrimination against the Dalits — the practices of segregated
housing, drinking water wells, places of worship and seating
arrangements in schools and public events are nearly universal. The
study also shows a pattern of "horizontal" discrimination among
sub-castes of Dalits.

"Approximately one out of every six people on earth is Indian, and one
out of every six Indians is a Dalit," Davenport said. "That's a
population that is roughly the equivalent of two-thirds of the United
States. This is no small problem of discrimination. It's a massive
human rights tragedy taking place in the world's largest democracy and
one of the most important countries in the world."

The research was envisioned by 2000 RFK Human Rights Laureate Martin
Macwan and RFK Global Advocacy Team members, including Davenport and
his collaborators Allan Stam at the University of Michigan and David
Armstrong at the University of Wisconsin.

"Having solid data and clear evidence of discrimination against the
Dalits is critical so that government officials, religious
organizations and human rights activists inside and outside of India
can address the 3,000-year-old problem," Davenport said.

Davenport is a scholar of political conflict who is working on
projects involving repression and state-dissident interactions in the
United States, Rwanda, India and Northern Ireland. He joined the Kroc
Institute in 2008.

government to remove the construction material and clean the premises
of Dalit memorials in Lucknow, but issued strict orders against
carrying out masonry work on the structures.
Construction at the memorial sites had come to a halt after the apex
court in September 2009 took suo motu cognizance of news reports that
the work was going on in violation of an earlier Supreme Court stay
order. The ban was re-imposed and a contempt notice issued to the then
Chief Secretary of Uttar Pradesh.

A Division Bench of Justices H S Bedi and A K Patnaik on Tuesday
permitted the government to recommence the maintenance of the work,
including removal of unused construction material and debris, planting
and watering of grass and trees and mending of leaking water pipes at
three sites — Kanshiram Smarak Sthal, Ramabai Ambedkar Maidan and Dr
Bhimrao Ambedkar Sthal.

Earlier, the Bench had asked state Acting Chief Secretary V K Sharma
to apprise it through an affidavit on the various works that the
government wanted to undertake at various memorial sites.

With this, the court made it clear that it does not fully agree with
the list of works earlier submitted by V K Sharma in an affidavit.

"We have perused the list of the works that need to be done at
different project sites," said the Bench, adding that "it, however, is
not inclined to permit the state government to carry out all the works
mentioned in the list".

While allowing minor maintenance jobs, the Bench transferred all
lawsuits opposing and supporting the construction of the memorials to
the Allahabad High Court.

The Bench asked the High Court to form a special bench to resolve the
issue, preferably within four months after its reconstitution.

Rahul Gandhi told to marry Dalit girl
Mumbai, Feb 9, DH News Service:

Rattled by Congress general secretary Rahul Gandhi's highly successful
'local train yatra' in Mumbai, Shiv Sena chief Bal Thackeray on
Tuesday fired a fresh salvo against him for calling Mumbai as 'Bombay'
during his recent public meetings.


"During his speech here, Rahul Gandhi repeatedly called Mumbai as
Bombay. Those who want to break Mumbai away from Maharashtra call
Mumbai as Bombay," Thackeray said in an editorial in party mouthpiece
"Saamna."

The 39-year-old Rahul's Mumbai visit was like the "funeral procession
of Congress" taken out by Marathi people, Thackeray commented,
ridiculing the massive police protection deployed by the Maharashtra
government for the "Congress Yuvraj."

Thackeray also blasted the state's minister of state for home Ramesh
Bagwe, who was seen carrying Rahul's shoes, apparently for
safe-keeping, during the Congress leader's visit here. "The minister
should be ashamed to stoop so low," the Sena chief said, telling him
that "Rahul Gandhi is not Mahatma Gandhi so that his shoes should be
held close to the heart."

The paper also targeted management guru Arundam Chaudhuri, who
favoured converting Mumbai into a separate state or union territory,
out of Maharashtra. Chaudhuri, Editor-in-Chief of 'The Sunday Indian',
has said in an editorial in the latest issue of the magazine "Hats off
to Shah Rukh Khan for standing his ground! It's now time to end this
hooliganism once and for all and make Mumbai a union territory!"

The Sena mouthpiece quoted Chaudhuri's words in its frontpage story
and said he has "insulted Maharashtra by spewing such venom." "Saamna"
also reported that during a recent TV debate, Chaudhuri deliberately
called Mumbai as Bombay. Last year, Chaudhuri's IIPM roped in Shah
Rukh Khan to host its annual quiz.

Social revolution

If all this was not enough, the Republican Party of India leader
Ramdas Athawale also jumped into the controversy and asked Rahul
Gandhi to marry a Dalit girl and bring in a social revolution.

"The casteism and social disharmony will not go away just by visiting
Dalit colonies or shaking hands with Dalit people... Rahul should
marry a Dalit girl to bring in a true social revolution. I shall ask
Sonia Gandhi to select a Dalit girl for Rahul," Athawale said at his
party's convention.
