India is aiming to be the world's top outsourcing destination, not
just in software services but in manufacturing as well, but what's
being proposed by the ministry of corporate affairs (see
http://www.financialexpress.com/news/cos-must-set-aside-specific-csr-spends/680213,
Sept 11) is a bit too much. It's actually trying to outsource
governance to India Inc. Sadly, this is not the first time the
government is trying this. In recent times, there have been
obligations on telecom companies to provide phones in rural areas, on
companies to hire people who are SC, ST and OBC—CII's southern
companies have declared that around 15% of their workforce is
SC/ST—the list goes on.

The corporate affairs ministry's proposal, based on the
recommendations of a parliamentary standing committee, is to mandate
that companies with a net profit of more than Rs 5 crore (that's
pretty much everyone) must spend at least 2% of their average net
profits on Corporate Statutory Responsibility—that's what Corporate
Social Responsibility (CSR) is called when you take the voluntary out
of it. The ministry has also set a net worth (Rs 500 crore) and a
turnover (Rs 1,000 crore) criterion since, like the original Direct
Taxes Code, it seems to think companies habitually lie when it comes
to net profits. Given that bureaucracy expands to fill up
responsibilities available, it's likely that at some point the
bureaucracy will want to certify the CSR expenditure is kosher and
perhaps even specify what qualifies as CSR—no, we don't think extra
payments to tribals for their land qualifies as CSR, or maybe it does.

Another recent example of the government wanting to outsource its work
is the Right to Education Act (RTE). We all know that education is the
single-biggest antidote to poverty, so it's good that the government
has made education a constitutional right, but why ask the private
sector to fulfil this responsibility for it? Under the RTE, private
schools have to reserve a fourth of their seats for poor children and
they'll get paid a fee for this which could be their costs or the
costs the government incurs in its own schools, whichever is lower in
classic bureaucratese. What this means is that, over a period of time,
bureaucrats will monitor schools, as well various caste commissions to
ensure, for instance, that an upper caste poor kid doesn't get into
Delhi Public School while the OBC kid gets only into Ram Public
School, assuming there is one by this name. Worse, since all schools
will have to be 'recognised' after three years, this means
unrecognised private schools that provide a large part of schooling to
the poor will have to pay higher salaries to teachers, have bigger
buildings and so on—in other words, they'll have to either go out of
business or pay higher bribes to school inspectors.

The mandatory 2% figure, presumably, comes from the view that the
private sector just makes horrendous profits but doesn't give back to
society. This, it has to be recognised, is complete
I-can't-find-the-polite-word-for-it. Of the government's total tax
collections of Rs 7.46 lakh crore, just Rs 1.20 lakh crore comes from
private individuals. The rest all comes from India Inc. Corporate tax
collections rose from Rs 1.44 lakh crore in 2006-07 to a budgeted Rs
3.01 lakh crore this year, excise duty collections from Rs 1.17 lakh
crore to Rs 1.32 lakh crore, import duties from Rs 0.86 lakh crore to
Rs 1.15 lakh crore. Surely all of this is enough for the government to
fund its basic governance duties? Assuming it isn't, and the high
fiscal deficit tells us it isn't, why not go ahead and clean up the
tax concessions that are almost as high as the total tax
collections—just read the Receipts Budget book in the latest Budget
document if you don't believe it. Indeed, that's why this newspaper
criticised the government for its copout on the Direct Taxes Code
(http://www.financialexpress.com/news/fe-editorial-the-muddle-path/673392).

Interestingly, while the government wants more out of India Inc—more
taxes, more jobs—it is doing precious little to enable this. Forget
about hire and fire, that old CII staple, the textiles association had
an interesting proposal. Since export orders tend to be quite seasonal
in this business, textile/garment firms have always wanted freedom to
hire temporary workers, after all, Wal-Mart may want those 2,00,000
jeans this month but then may not repeat the order for another 6
months, or may not at all. As government policy doesn't allow firms to
have a very high proportion of temps, the association suggested a
textile-MNREGA of sorts—allow us to hire temps for 200 days a year
(MNREGA is for 100) and at higher wages (Rs 100 is the MNREGA
ceiling). But, no, the government didn't allow it. And yet it wants
more out of India Inc.

Telecom is a great way to conclude this story. Since 1994, when
private telecom was allowed, the government has laid down mandatory
rollout obligations, so many phones in rural areas, so many in
district headquarters and so on. Not one of these targets was met and
finally they were scrapped. Yet, as the urban market started getting
saturated, private sector telecom firms started getting serious about
that market and today firms like Bharti, Vodafone and even Idea/Spice
have more rural subscribers than the government-owned BSNL does.

Moral of the story: India Inc will start spending more on CSR when it
finds it has no other way to do business, when it finds it needs to
develop schools or redevelop land for the local community to trust it
enough to sell it land. Manmohan Singh famously quoted Victor Hugo to
say "no power on earth can stop an idea whose time has come". So why
not wait for the time to come?

Hisar: The situation across Haryana remains tense. Protesting Jats
continued with blockades in parts of Hisar and nearby districts today.
Many see the amnesty by the government as a sign of weakness,
prompting a virtual free for all, with many protesters attacking and
looting banks and private property as well.

Jat villagers remain belligerent defying a call to stop violence from
their own leaders. The protesters blocked the national highway linking
Delhi to Hisar for several hours today.

Ajit Singh a Jat villager from Hisar said, "We will continue this till
the situation is not sorted out and we don't get the OBC status".

But that's not all that is at stake. The rioting, since Monday, has
also been accompanied by looting. A State Bank of India branch, less
than 300 meters from the army Cantonment, was set on fire by rioters
after the mob took out and looted the ATM machine.

Even a private textile mill was not spared. Uday Singh, security
in-charge of the HP Cotton Mills in Hisar said, "1,500-2,000 people
came, beat up the guards, and then set the factory on fire. They also
stole our computers from the offices."

Several vehicles were set on fire along the highway.

And what's fuelling the protests further is what many see as the
buckling under by the state government which in a desperate bid to end
the violence announced an amnesty on Tuesday for all those who were
involved in rioting. The government has also suspended the Hisar SP
Subhash Yadav and filed murder charges against him for ordering police
action in which a youth, who was part of the mob, was killed.

The Sangharsh Samiti has declared a truce with the government but it
seems that other Jat leaders don't want to back down just yet. And
with police forces already spread thin, the worry is that the fire and
protests from Hisar could spread to other districts as well.

CHANDIGARH: Delhi government might have to tackle a different flood
during the Commonwealth Games if the reservation tangle of Jats is not
resolved by October 3.

Jat community bodies, agitating for reservation under OBC category,
plan to buy tickets to CWG in bulk to facilitate disruption of the
games at different venues.

The Jat plan is simple — why clash with security forces outside CWG
venues when they can enter venues easily and then play the spoilsport.

"As it is, over 15 lakh security personnel would be pressed into
action for the CWG, whereas we have a population of five crore in
India. Also, we have enough resources to purchase tickets in bulk. We
may boycott by not making it to venue leaving it almost empty or can
protest there," said Yash Pal Malik, national president of Jat
Aarakshan Sangharsh Samiti.

Speaking to The Times of India, he said, "We would wait till October
3, the deadline given by us to Central and Haryana governments to add
us in OBC quota. Else, we would go ahead with our agitation plan.''

Referring to their action plan, Samiti's Haryana state president Hawa
Singh Sangwan, said Jats were willing to take on anyone to get the
reservation and were in no mood to relent, even if it led to a huge
embarassment with CWG getting disrupted. Sangwan said that the
agitating Jat groups also have plans to cut supplies to Delhi and
create all kinds of obstructions during the games. Haryana and Uttar
Pradesh are the main suppliers for provisions and milk products.

All India Jat Mahasabha (AIJM), which also has plans to agitate on the
quota issue before and during CWG, has decided not to indulge in any
kind of violence. "Our agitation began long ago. We would oppose the
Queen's Baton and CWG, but in a peaceful manner," said AIJM state
president Om Parkash Maan.

Meanwhile, greeting the Queen's Baton on September 26 with black flags
at Sirsa would be Jat Aarakshan Sangharsh Samiti's first protest in
their run up to CWG. "We would line up on both sides of the road from
Sirsa to Delhi, waving black flags till the Baton reaches Delhi,''
said Hawa Singh Sangwan, Haryana head of the Samiti.

Mysore, Sept 16, DH News Service: Maadara Channaiah Swamiji of Maadiga
Gurupeetha in Chitradurga was accorded a warm welcome at Krishna Dhama
–– where Pejawar Seer Vishwesha Teertha is staying currently as part
of his Chaturmasya celebrations –– and also at Krishnamurthypuram,
where he undertook a padayatra and visited some families.

Following a padayatra by Pejawar seer to the Dalit colonies in the
city, Maadaara Channaiah Swamiji had offered to go on a padayatra into
Brahmin colonies as part of his attempt to steer the social change
further.

He arrived in the city on Tuesday night and stayed as a guest at the
residence of a Brahmin family. Next morning, before setting off on the
padayatra, he came to Krishna Dhama and met the Pejawar Seer.

During the interaction, Pejawar seer stressed on the fact that Dalits
were indeed part of Hindu religion and had to stay as members of the
faith and Maadara Channaiah Swamiji said Dalits had bigger issues such
as dignity, discrimination, hunger and livelihood as their priority
and hence, conversion was something that was not of immediate
importance.

Minister Suresh Kumar joined the padayatra for a brief while at 8 am
when it began.
Post-padayatra, the Maadara seer along with Pejawar seer addressed the
gathering at Rama Mandira and said he was happy with the enthusiasm
among people to bring about the social shift.

Later, he addressed a gathering of members of Samarasya Vedike and
Rashtriya Swayamsevaka Sangha at RSS main office Madhava Kripa here.

Dalits have bigger issues at hand: Channaiah swamiji

Mysore: When the much awaited meeting between Pejawar mutt seer
Vishvesha Teertha Swamiji and Maadaara Channaiah Swamiji of Maadiga
Gurupeetha, the discussion centred around the welfare of Dalits as
against the overall welfare of Hindu dharma.

While Maadaara Channaiah Swamiji maintained that Dalits had bigger
issues at hand with their dignity and lives being threatened with
repeated attacks on the community members, Pejawar seer said
conversion into other faiths would not serve as an answer to the
existing problems.

In an interaction meeting with Pejawar seer Vishvesha Theertha
Swamiji at Krishna Dhama, Pontiff of Maadiga community stood his
ground and said conversion into Christianity or Buddhism was
'individual preference'. "Issue of conversion is not of paramount
importance for Dalits, as they feel they are being discriminated
against, by upper castes all the time," he said.

In all his concern towards Dalits, Pejawar Seer, who has held
padayatras in Dalit colonies in an attempt to end centuries of
discrimination and humiliation against Dalits, offered to give 'Bhakti
Dikshe' to Dalits. This would be an attempt to restrain them from
converting to Christianity or Buddhism either by force or through
enticement in view of protecting Hindu culture, as conversion would
put an end to their native culture by imposing its own practices on
them. To a query pertaining to the attempt being a move to strengthen
Bharatiya Janata Party (BJP) vote bank, Pejawar seer clarified that,
his initiative was devoid of any such motives. "I am not responsible
if politicians use it to their benefit," he asserted. Prior to that,
prominent members of Brahmin community in the leadership of MLA S A
Ramadas welcomed Maadaara Channaiah Swamiji at Krishna Dhama, where
the Pejawar seer is camping as part of his Chaturmasya celebrations.

Villoor Dalits facing peculiar problem

The Dalits of Villoor village under Kalligudi taluk near Thirumangalam
in Madurai district are facing a peculiar problem as they are not
allowed to ride two-wheelers along the street (Periasamy Koil Street)
of caste Hindus.

Those who defy these norms are being attacked and ostracised by the
dominant caste in the village. A few villagers and a shopkeeper on the
street said that the practice had been there for a long time.

In the recent past, a Dalit youth, G. Thangapandian (24), who had
completed teacher training and spent most of his time in urban living
conditions, invited the wrath of caste Hindus when he rode his
motorcycle through Periasamy Koil Street. The caste Hindus interrupted
him and questioned his behaviour. A minor scuffle ensued and he was
allegedly beaten up by a caste Hindu youth. When Thangapandian tried
to file a complaint at the Villoor police station, he was prevented
from doing so by caste Hindus.

Following this a peace committee meeting was called for by the caste
Hindus to which Thangapandian's brother G. Murugan was invited.
Fearing reprisal, he avoided the meeting and as a result, the caste
Hindus laid a siege to a town bus on September 4, demanding that
Dalits should come for talks.

However, the caste Hindus, with the intervention of police, later
agreed for an alternative route to the Dalits, which is circuitous.
The officials in the police department said that the practice of not
allowing two-wheelers was age old, which had been internalised by the
Dalits and nobody stopped them from riding two–wheelers but they
themselves had refrained from doing so.

The Revenue Department officials, when contacted, said that the police
had conducted talks with the villagers and once "they send the report
we will forward it to the Special Tahsildar, Adi Dravidar Welfare, for
perusal." One of the officials said that the problem of separate
routes for Dalits had already been an issue in 2000 and now it had
come up again.

Two routes have been identified by the Revenue Department. Eastern
Puliyampatti Vilakku is a route which has been suggested by the Dalits
but the problem is that the route passes through patta lands of the
caste Hindus and so it is a difficult task for the administration and
the other route, the Maravapatti route, could be cleared for the use
of Dalits.

The village has a major population of a dominant OBC caste and Dalits
are in miniscule number. They are secluded in the eastern part of the
village (Kizhakku Theru). Most of the Dalits are part of agricultural
labour force and a few among them are engaged in making broomsticks
during off-season.

SC/ST panel issues notice to VC of UAS

Bangalore: The Karnataka State Scheduled Castes and Scheduled Tribes
Commission has issued notice to the Vice-Chancellor of the University
of Agricultural Sciences for keeping promotions of 29 assistant and
associate professors in abeyance.

Commission member M. Kumbaiah said in his notice that promotions had
been given to 29 people only after the commission had directed the
university to do so. The promotions and revised salaries were given a
month ago.

However, now with the promotions kept in abeyance once again, Mr.
Kumbaiah has said that the action of the university attracts
provisions of the Atrocities Act.

Muzaffarnagar, Sep 16 (PTI) A local court has issued notice against
army officers of a military training centre, including a Lieutenant
Colonel for passing derogatory and casteist remarks against a dalit
military servant here today. Baljit, working at the army training
centre alleged that the four army officers had beaten him up and
passed casteist remarks against him after he declined to cut
government trees at an Army centre in Purqazi town in the district on
September 2, 2009. According to the prosecution, notice has been
issued against Lieutenant Colonel Rajesh, Subedar Major Godhram, Nayak
Naveen, storekeeper Shive Charan and the four have been directed to
appear in the court on October 15.

Dalit organisation seeks action against legislator

HYDERABAD: Ambedkar Yuvajana Sangham, a State-level Dalit
organisation, condemned the allegations of sexual abuse made against
M. Malyadri, founder of Siria Orphanage Home and School,
Vanasthalipuram, and demanded that the persons behind it should be
arrested under the SC/ST (Prevention of Atrocities) Act.

At a press conference on Wednesday, I. Maisaiah, president of the
organisation alleged that a local legislator had an axe to grind
against Mr.Malyadri over a personal dispute and that the news channel
and the police officials "acted on his behest to harass a Dalit".

Citing the report by a fact-finding mission by various Dalit
organisations which concluded that the allegations against Mr.
Malyadri were made with malafide intentions, Mr. Maisaiah said six out
of seven girls included in the FIR vouched for the founder's
integrity.

"We demand that the legislator either resign or be sacked from his
position immediately. The police officials and people responsible for
the news report should be arrested. Mr. Malyadri and the orphanage
home should be given protection by the government," Mr. Maisaiah
demanded..

Madiga seer undertakes padayatra in Mysore

MYSORE: As a response to the "social initiative" taken out by the
Pejawar Mutt seer Vishvesha Theertha swamiji to eradicate
untouchability by visiting the Dalit colonies in Mysore, Basavamurthi
Madara Channiah swamiji of Madiga community Gurupeetha conducted the
"Samarasya Sadbhavana Nadige" in Krishnamurthypuram, here on
Wednesday.

When the padayatra led by Basavananda swamiji entered the
Brahmin-dominated Krishnamurthypuram in Mysore, the mood was upbeat.
Having arrived straight after meeting the Pejawar mutt seer at
Krishnadhama, the padayatris were given a warm welcome by the
residents of the area. The roads were washed clean and decorated with
"rangolis".

The seer was accorded the traditional ritualistic welcome by district
in-charge Minister S. Suresh Kumar, MLA S.A. Ramadas, G. Madhusudhan
and C.H. Vijayashankar, MLCs, Rashtriya Swayamsevak Sangh's (RSS)
southern region convener Venkataram and members of the Brahmin
community.

A group of women performed the padapooja of the seer. The sixth cross
of Krishnamurthypuram was decorated with saffron flags and buntings.

He was offered garlands by many residents. The seer visited houses of
several Brahmin families in the locality.

When he had arrived in the city last evening, the seer was given a
warm welcome at the house of Narayan, a resident of Vidyaranyapuram
and offered a "padapuja".

The padayatra indicated a healthy standoff between the Pejawar seer
and Basavananda seer. Earlier, the Pejawar swamiji was given a rousing
welcome by the pourakarmika Dalits.

At this some of the Dalit leaders had expressed doubts whether a
similar treatment would be given to the Dalit swamiji.

But all such doubts were doused as Basavananda swamiji was given an
apt welcome by the Brahmin community.

Sri Basavananda seer addressed a public meeting on the Ram Mandir
premises near K.G. Koppal Bridge in Krishnamurthypuram that was
attended by the Pejawar seer, Bhashyam swamiji and Ilai Alwar swamiji.

The court asked the Nodal officer to look into 43 cases of atrocities
against SC/STs cited by the PIL as well as into the whole gamut of the
Act to ensure that it was followed. The Court was hearing a PIL filed
by National Dalit Movement for Justice, an NGO, alleging that the
state was not interested in implementing the Central Act. The PIL
alleged that the state had not sent annual report to the Centre on
implementation of the 21-year-old Act in the last five years. It is
mandatory to send such reports which are placed before Parliament
every year, it said. However, Medha Gadgil, Principal Home Secretary
(appeals and Security) filed an affidavit with annexures affirming
that the reports had been forwarded to the Centre. The court said it
was satisfied that this rule had been complied with. The PIL brought
to the Court''s notice various gaps and negligence by implementing
authorities at different levels. It said the vigilance and monitoring
committees set up under the 1989 legislation were not properly
constituted. The PIL alleged the state was not performing its task
under the Act to review twice in a year the performance of
prosecutors, consider reports received and investigations made in
atrocity cases apart from ascertaining preventive steps taken by
police and magistrates and rehabilitation measures taken to help the
victims. The petition further alleged that in many cases, FIRs were
not registered at all. And in cases they were registered, proper
sections of the Act were not applied. Besides, the accused were also
not arrested immediately.

DHARAPURAM: Acting swiftly against a glaring instance of
untouchability in western Tamil Nadu, revenue and police officials on
Wednesday directed caste Hindus of N Kumarapalayam village, near
Dharapuram in Tirupur district, to remove two fences they had erected
to prevent dalits from using public roads.

About 150 families of caste Hindus erected barbed wire "untouchability
fences" on Friday to prevent over 50 dalit families living in the
Aandikattu Thottam village from entering two roads maintained by
Nanjiyampalayam village panchayat. The reason given by the caste
Hindus was that the roads passed through the graveyards of their
forefathers and the frequent movement of dalits may "pollute their
sanctity."

Despite a police crackdown, untouchability is still practiced in
several parts of Tamil Nadu. In a shocking incident over two years ago
in Uthapuram village in southern Tamil Nadu, caste Hindus erected not
just a wire fence but a concrete wall around a dalit colony to prevent
them from entering their area. However, the wall was demolished by the
district administration.

The fences erected on Friday forced the Dalit families to take a
detour of 3km to reach the nearest ration shop, school and market.
