Dear donors and friends,

I do not how I could thank Prof Shiva Shankar of Chennai Mathematical Institute. Soon after I sent a donation request, he jumped into action. By now (not even 24 hours since I sent), he had sent individual emails to 90 people he knew. Several others may follow. Is writing 90 individual emails an easy task?

 

What a blessing to have such a committed friend?

 

I hope other donors and friend of FFEI write atleast one email to another person informing about our work (need not ask for donations). If you believe we are doing moderately good work (despite all constraints), please do this small help to FFEI. We need your help. Isn't every drop of water makes up a mighty ocean?

 

Please help us as our needs are so great. Last year, we took responsibility to support 50 small kids (apart for other scholarships) through our Educational Adoption program. If we do not support them, they dropped off the school.

 

So, please give generously, advertise among known people, and help us help the people who not yet see the benefits of 8% economic growth in India and who could not participate in "Shine India" campaign.

 

They are poor, impoverished, marginalized, and innocent victims of society. Is it not the responsibility of every right thinking person to come to their aid?

Land Rights activists belonging to National Land Alliance went on a
Padyatra to highlight the issue of land rights of dalits and tribals
in the Tarai region of Uttar-Pradesh and Uttarakhand in December last
year. Tarai is a fertile belt on the foothills of Himayalas and
consist of districts like Shaheed Udham Singh Nagar, Lakhimpur Khiri,
Pilibhit, Baharaich, Gonda districts of Uttarakhand and Uttar-Pradesh
states. The Padyatra started from Golbohji forest village in Palia
district of Uttar-Pradesh on December 13th, 2008. After traveling
20-25 kilometer a day, the Padyatra finally culminated at Harinagar
village in Kundeswari (kashipur), Shaheed Udham Singh Nagar today on
December 28th, 2008. During these 16 days, the marchers did social
audits of various villages, addressed village community meetings and
talked to students in different colleges and schools. They talked
about human rights, humanism and challenge of climate change and
threat to our environment. Some of the activists well trained in
miracle exposure programmes also displayed their skills in these
educational institutions and village Panchayats. During these 16 days,
the Padyatris stayed at village Panchayat Bhavans, slept in the tribal
areas and visited large part of those villages which are still facing
discrimination and exclusion in their daily lives either from social
system or from the government departments.

The main reason of this Padyatra was to highlight the importance of
land and livelihood issues of the Dalit-tribal communities in tribal
region of Uttarakhand and Uttar-Pradesh. Communities such as Tharus,
Boxas (a Primitive Tribal Group), Tongiyas is a matter of great
concern as they remain isolated and excluded in the general set up of
both the states. The condition of these communities is particularly
alarming in Uttarakhand because of lack of understanding of
Dalit-tribal culture and popular mass support. In the Tarai region the
sale-purchase of tribal land is prohibited yet most the tribal land
today has been transferred to dominant communities here. The tense
peace exist here as these communities are so well oppressed that they
find it difficult to explain their conditions to outsider as the goons
of the powerful communities and land mafias always spy upon them. Both
the Tharus and Boxas are victim of the forest department also and
border police also.

In its last leg, the Padyatra reached Harinagar ( Kundeshwari) today.
After 16 days and crossing over 350 kilometer of Uttarakhand and
Uttar-Pradesh state, the reason of culminating the Padyatra in
Harinagar, Kundeswari was to support the demand of over 150 landless
Dalit families who have been fighting for their land rights for the
past 20 odd years when they were brutally thrown away from the land
they had been tilling for many years and which was declared ceiling
surplus by the Commissioner of Kumaon, Nainital. Despite favorable
verdict from the highest courts of the land, the government of the
state did not have the courage to implement the ceiling act there and
provide land to these peace loving people who had shown their faith in
the constitution of India and did not resort to any unlawful
activities. Social Development Foundation has gone to Supreme Court
against the empathy of the Uttarakhand government against these people
but shockingly the government of the state in a brazenly shameless way
suggested that the Dalits do not hail from the district. In the same
affidavit the government justify giving land to those Sikhs who were
declared encroachers by the Supreme Court and who actually were
responsible for excluding and discriminating against the Dalits. We
ask the question to the state government as how come these people got
land under ceiling act and what was the criteria used for them ?

Now, based on our experiences and fact finding during the Padyatra, we
have produced a 35 minute documentary ' Tarai main Dalit Adivasi
asmita per badhta sankat' i.e. 'Threat to Dalit-Adivasi livelihood in
Tarai'. The documentary is based on direct interviews with victims who
have lost their land to various dominant forces in the region
including land mafia, forest department and irrigation department. It
gives you a live picture how Tharu, Boxa villages are on the verge of
extinction and how the Dalits despite court's order have not been able
to get their legitimate due.

The struggle for social justice continues in this hostile region of
India where political parties, social action groups, media have kept
conspicuous silence on non implementation of land laws including
redistribution of land and implementation of land ceiling act. Our
effort is to bring these ugly facts to you so that as activists,
jurists, media persons, government officials, political leaders, you
would be able to take it further. It is a voluntary effort hence we
have not been able to create more CDs. We request your support for it.
Those who would be interested can write to me for CDs and DVDs. The
contributory price for CD would be Rs 200/- and for DVD Rs 500/-.

We would be screening the documentary at different places including
colleges, social action group's programmes. Friends, who would be
interested to organize any event or discussion on issue are welcome
and can contact me for the same.

Rajkot : Clashes between two scheduled caste groups at Chasiya village
in Jasdan taluka of Rajkot district has left the locals tensed for two
days.
Security continued to be tight for the second day on Sunday following
the boycott of Dalits by the Kolis. But both the Congress and BJP have
been accusing each other of adding fuel to the fire.

The Rajkot rural police are on the trail of seven people accused in
two different incidents. Hemant Savaliya, who had allegedly attacked
one Hada Vala (40) for preventing entry in a temple, is one of them.
The six others had given a boycott call against Dalits in a Koli
dominated village.

It all started when Vala was attacked with an axe on December 8 at the
temple premises. He was admitted in the Rajkot Civil Hospital. On
December 11, Gyanshyal Vala registered an FIR against six people for
giving a boycott call against Dalits, that they be given nothing from
shops and no rides in public vehicles. The six named in the FIR are
Kadva Jograjia, Zaver Rathod, Kunwar Jograjia, Lagharabhai Sarviya,
Mansingh Khisadia and Mohan Suvan.

"The situation has now limped back to normal. Dalits have not been
facing any problem. Our teams have been monitoring the rationshops and
temple. There has been no complaint in the last two days," said A F
Sindhi, DySP, SC/ST cell and investigating officer.

Sindhi said that Hemant Savaliya will be arrested by Sunday night and
that priority was given to set the things in order in the village. The
officer added: "I have not seen rivalries among scheduled castes. This
is the first time that I have seen Kolis opposing Dalits."

Meanwhile, the BJP and Congress leaders accused each other of
instigating the two communities. "For the first time since
Independence, Congress has lost Jasdan Assembly seat. They have
instigated the Kolis to create the problems. A similar thing may
happen in other villages," said Jasdan BJP legislator Bharat Boghra.

On the other hand, Rajkot Congress MP Kunvarji Bavalia, said that the
BJP are making a mountain out of a mole. "Otherwise, such rivalries
are not seen," he added.

RAJKOT: Two days after the incident of a Dalit man being attacked with
an axe for entering a temple in Chhasiya village in Jasdan taluka in
Rajkot district, another FIR has been lodged by Ghela Punja Vala of
the same village on socio-economic boycott of Dalits by villagers
following the temple entry issue.

According to police officials, Hada Vala, 40, was attacked on December
8 when he had accompanied his nephew Devji to the temple to seek
blessings on the eve of latter's marriage. As Hada climbed the steps
at 11.30 pm, he was stopped at the entrance of the temple by Hemant
Sarvaiyya, a Koli by caste. Sarvaiyya allegedly hurled casteist abuses
at Hada and dealt a blow on his head with an axe. Hada was provided
emergency treatment at Vinchhiya primary health centre and then
shifted to Rajkot Civil Hospital for surgery. Police have booked
Sarvaiyya for attempted murder and under relevant sections of Atrocity
Act.

According to police officials, Ghanshyam Vala filed an FIR against six
people in the village alleging socio-economic boycott. He said in his
complaint that on December 9, large number of people gathered in the
village and announced that Dalits would be boycotted in the village.

The complaint names six accused Kadva Jogarajia, Zaver Rathod,
Kunvrabhai Jogarajia, Lagharabhai Sarviya, Mansingbhai Khisdia and
Mohan Suvan. The complaint alleged that the accused have declared that
Dalits would not be given anything at shops, will not be allowed in
rickshaws, among other things.

After the incident, police force has been deployed in the village to
avoid any untoward incident. "We have visited the village and have
lodged the compliant as well. The accused are on run, but we will soon
nab them'', said investigating officer and deputy superintendent of
police A F Sindhi.

Senior police officials have conformed the 'boycott' of the dalits in
the village by so-called upper caste residents. "We are trying to
solve this problem with both communities amicably,'' said officials.

Lucknow : The Youth Congress is finding it difficult to enroll new
members under the Scheduled Castes and Scheduled Tribes categories —
the backbone of the ruling BSP — in Uttar Pradesh.
The reason: Many SC/ST applicants have failed to submit their caste
certificates with their enrollment applications, saying that it was
difficult to get the certificates issued from the government
officials. As a result, all such applications are yet to be approved.

Providing the SC/ST certificates with the application forms is
important for two reasons. First, the membership fee for SC/STs is
only Rs 5 as against Rs 15 for others. So any person unable to submit
the certificate has to pay Rs 15. But more importantly, the SC/ST
candidates without the required certificates will be enrolled under
the general category and this will debars them from getting the
benefit of reservation in important posts of the Youth Congress.

In an attempt to empower the Dalits, the Youth Congress has, for the
first time, provided reservation for SC/STs at all levels of the
organisation, beginning from panchayats to Lok Sabha constituencies.

The reason behind the outfit's insistence to attaching the SC/ST
certificate is that it wants to ensure that the organisational reform
actually benefits the SC/STs. But with just two days of the membership
drive left, the party has thousands of application forms filled by the
SC/ST members minus the caste certificates.

The caste certificates are issued by the local tehsil administration
but the Youth Congress has told the applicants that it would also
accept those certificates which have been issued by gram panchayat
secretary or any authorised government official. This, too, has not
helped the candidates. "We are trying our level best to help such
members, but they say panchayat secretaries and officials at the
tehsils are not issuing the certificates. We cannot accept these forms
under the SC/ST category. We estimate that if the problem persists,
then it would reduce our SC/ST membership by 50 per cent," said Arvind
Chaudhary, state returning officer of the Youth Congress.

If the candidates are unable to submit their caste certificates by
December 15, their applications will be accepted under the general
category. "We did not face such problem in other states," said
Chaudhary, who actively took part in organising Youth Congress polls
in Punjab and Gujarat.

Rajesh Rathore, returning officer for Mohanlalganj Lok Sabha segment
said that little could be done for those without the caste
certificates as almost the entire enrollment process has been
computerised. "Even if we accept these forms without caste
certificates, they will be rejected during scrutiny," Rathore added

Sources said that in Rae Bareli Lok Sabha segment, around 800 forms
submitted by SC/ST youths are without caste certificates. In Dariabad
Assembly segment of Faizabad Lok Sabha area it is 450 and in Kannauj
Lok Sabha segment the figure stands at 1,000. A district
administration official in Lucknow, meanwhile, said the procedure of
getting the caste certificate that entails submission of an
application with an affidavit at the tehsil office followed by
verification, generally takes a month.

Abolish the caste system now

Court rulings that do not find killings on caste lines an exceptional
crime inviting the extreme penalty amount to further subjugation of
victims from the lower strata of society, especially since India has a
whopping 170 million Dalits.

By any stretch of imagination and fair play such rulings are not fit
to remain alive in the case law as the accused would use them as a
mitigating circumstance to avoid the capital punishment.

This discussion is related to an exceptional Supreme Court (SC) ruling
of December 10 commuting to life the death sentence of four convicts
of a disgraceful "honour" homicide.
The homicide was orchestrated and executed by a man and his friends to
avenge the marriage of his sister to a "low caste" Keralite in Mumbai.

The trial court and the Bombay high court rightly did not show
leniency to the so-called upper caste killers migrated from Uttar
Pradesh (UP) and ordered death. Things, however, changed in SC.

"If he (the brother) became a victim of his wrong but genuine caste
considerations, it would not justify death," ruled the SC bench of
justices S Sirpurkar and Deepak Verma.
A few days ago, another bench of SC justices Dalveer Bhandari and AK
Patnaik had reversed the acquittal of six persons in a caste-related
crime.

The judges held that "unfortunately, the centuries-old Indian caste
system still takes its toll. This case unfolds the worst kind of
atrocities committed by the so-called upper castes (Kshatriya or
Thakur) against the so-called lower castes in a civilised country".

They said it's absolutely imperative to abolish the caste system as
expeditiously as possible for smooth functioning of the rule of law
and democracy in our country.
These rulings must be viewed against the backdrop of the national
scene. The National Crime Bureau showed two years ago that UP topped
the list of atrocities against SCs and STs, with 2,113 cases of the
9,819 cases nationally. The data also indicated a 10.2% increase in
crimes against the two oppressed communities at the national level.

It's also reported that cases relating to crimes against the deprived
and oppressed section of society, 'Dalit', do not reach courts. If
they do, the most likely outcome is acquittal. Official data reveals
that between 1999 and 2001, 89% of trials involving offences against
Dalits resulted in acquittals.

Mathura, Dec 13 (PTI) Marriage procession of a Dalit couple has been
disrupted allegedly by high caste people and two persons were injured
in stone-hurling at Bati village here.

Superintendent of Police R A Aditya Verma said the trouble started
when few members of high caste tried to disturb marriage procession of
a Dalit last night.

Four persons tried to obstruct the procession by raising a blockade on the way.

When objected to, they hurled stones and attacked members of the
marriage party with sticks leaving two of them injured.

A case was registered, the SP said.

Court asks AIIMS to admit OBC candidate to course of choice

New Delhi, Dec 13 (IANS) The Delhi High Court has asked the All India
Institute of Medical Sciences (AIIMS) to allocate a seat, in the
course of his choice, to an aspirant who sought to appear in
counselling both under the general and quota seats but was not
allowed.
A division bench of Chief Justice Ajit Prakash Shah and Justice
S.Muralidhar, in a order passed earlier this week, asked the AIIMS to
admit Manish Patnecha, a candidate from the other backward class
(OBC), who was denied an opportunity to sit for second counselling
against the OBC quota this year after he opted for a seat against the
general category.

During the second counselling, he sought to appear against the OBC
quota so that he could get admission in a subject of his choice but
AIIMS debarred him, saying that would block two seats.

Patnecha then approached the court, contending a higher ranked
candidate belonging to reserved category should not be deprived of the
choice of either a seat or an institution vis-a-vis a candidate of the
same social class figuring lower in the merit list, while applying the
principle of reservation.

Finding the AIIMS decision unjustified, the court directed the
institute to offer Patnecha the seat in the course of his choice.

Earlier this year, a single judge bench had declined any relief to
Patnecha, ruling that the AIIMS could not be directed to have second
counselling again and allot him the seat in a course of his choice,
cancelling the allocation of the seat to another candidate.

IITs begin advertising to fill faculty quota seats

The premier Indian Institutes of Technology (IITs) are gearing up to
complete the implemention of the scheduled caste (SC), scheduled tribe
(ST) and other backward classes (OBC) quota requirement for faculty
positions from next year.

IIT-Kharagpur, IIT-Bombay and IIT-Roorkee, for instance, have started
the advertising and selection process for these reserved faculty
positions.

The IITs have been implementing the student SC/ST/OBC quota for the
last two years and are likely to complete the phased implementation
within a year.

Though the previous HRD minister Arjun Singh had asked the IITs to
introduce the faculty quota, the elite institutes were up in arms
against it. After much uproar, protest and candlelight vigils inside
campuses, they were directed by current HRD Minister Kapil Sibal a few
months back to toe the government line. The ministry has asked IITs to
lay down 15 per cent quota for SC candidates, 7.5 per cent for ST
candidates and 27 per cent quota for other backward classes (OBC) in
teaching positions.

A spokesperson for IIT-Kharagpur, said: "Without any compromise on
qualification, experience and competence, reservation, according to
the government of India rules, is available only at entry-level
positions of Assistant Professor. However, while recruiting faculty
for subjects other than science and technology, reservation shall also
be applied in full including for the posts of Associate Professors and
Professors."

IIT-Kharagpur has started advertising for fresh faculty intake and is
implementing the ST/ST/OBC faculty reservation from next year, but
primarily at the entry level other than the science and technology
stream which is the thrust area of any IIT.

IIT-Bombay is also implementing the faculty reservation quota from
next year. An official at IIT-Bombay told Business Standard: "This
time the advertisement inviting applications for faculty positions
clearly mentions the quota implementation. Our earlier advertisements
inviting applications from faculty never specifically quoted the
reservation but this time we have mentioned it to ensure there are
enough applications."

A professor from IIT-Roorkee, on conditions of anonymity, confirmed:
"We have started the process of implementing the SC/ST/OBC quota for
faculty positions. We have also finished the selection process for a
few teachers. IIT-Roorkee has over 350 teachers right now and it is
increasing the number."

Centre to de-reserve SC, ST quota in jobs

Dec. 13: The Centre has worked out a plan to de-reserve posts which
are otherwise meant only for those belonging to the Scheduled Castes
(SCs), Scheduled Tribes (STs) and Other Backward Classes (OBCs).
A ministry of personnel, P.G. and pensions, department of personnel
and training, office memorandum (OM) says such an unlocking of quota
could be done in the "larger public interest" as many posts in the
government lie vacant despite the numerous special recruitment drives
to hire SCs, STs and OBCs. The government, in its OM, has told all
ministries and departments that they might propose de-reserving such
posts.
While conceding that there is a "general ban" on de-reservation of
reserved vacancies in cases of direct recruitment, the OM, a copy of
which is with this newspaper, says: "How-
ever, in rare and exceptional cases, when a vacancy cannot be allowed
to remain vacant in public interest, the administrative ministry or
department may prepare a proposal for de-reservation of vacancy."
The government has left the issue to the subjective wisdom of the
authorities to take a call.
