CHENNAI: Paving the way for the appointment of 1,077 SC/ST candidates
in existing village administrative officer (VAO) posts, the Madras
high court has permitted the Tamil Nadu government to release the
results of the written examination conducted in February. Though the
results of the examination for 1,576 general category candidates were
declared earlier, due to an order of stay the results for the 1,077
backlog vacancies for Dalits could not be declared.

Justice KN Basha, passing orders on Monday on an implead petition
filed by a Dalit candidate, said: "The respondents shall publish
results of the examination and proceed with the filling up of
vacancies to the posts of VAOs for SC/ST candidates, notified as
shortfall vacancies. The appointments are subject to the final
disposal of the writ petitions."

In his petition against the categorisation of 1,077 vacancies as
backlog posts, R Santhoshkumar of Madipakkam had submitted that a
high-level committee constituted by the government in July 2000 to
review all posts in each department and suggest the number of post to
be notified as backlog/shortfall vacancies is yet to complete the
process and it was yet to identify SC/ST shortfall vacancies. Claiming
that only 197 vacancies were SC/ST backlog vacancies, he said the
posts had been grossly over-estimated.

In his implead petition, A Arul of Dharmapuri district contended the
government order and Rule 22 of Tamil Nadu State and Subordinate
Services Rules approval from the high-power committee was not
required. The writ petition had been filed only to cause detriment to
SC/ST candidates who were awaiting declaration of results, he said.

Jaipur: Acting under the Supreme Court's instructions, the state
government cleared the way for pending promotions of Rajasthan
Administrative Service (RAS) officers and thousands of government
employees, on Monday.

The government had stalled the promotion process in December last year
after the apex court upheld Rajasthan High Court's decision to quash
its notifications for quota in promotions of government employees.

The government also withdrew the two notifications, dated December 28,
2002, and April 25, 2008. While, the notification of 2002 allowed
benefit of reservation in promotion and consequential seniority to the
scheduled castes (SC) and scheduled tribe (ST) employees, the 2008
notification discontinued 'catch-up' rule (Regaining) that allowed
general and other backward classes (OBC) employees to reclaim their
seniority over junior employees from reserved category who were
promoted on quota seats. The matter is likely to come up for hearing
in the High Court on Tuesday.

However, the general category and OBC employees are unhappy as the new
notification issued by the department of personnel on Sunday
maintained the policy of reservation in promotion and consequential
seniority.

The new notification issued on Sunday says: "Reservation for SC/ST
employees, with consequential seniority, shall continue till the
roster points are exhausted and adequacy of promotion is achieved."

However, promotion quota will be capped at 16 percent for SC and 12
percent for ST.

In simple words, the SC and ST employees would not get promotion in
excess of their allotted quota.

This could be a quota with a difference. The government's proposal to
make 4% of its annual purchases from dalit- and tribal-run units, if
properly executed, can open up new avenues in affirmative action. It
has the virtue of breaking away from the tired paradigm of expanding
job- and education-based quotas. By integrating dalit- and tribal-run
businesses into the supply chain and thereby boosting entrepreneurship
among India's disadvantaged sections, it will serve to integrate them
into the vibrant sectors of the new economy. It is well known that
more and more dalits have been shifting from traditional agriculture
to small businesses. To help them forge linkages with industry and
government, various economic forums, like the Pune-based Dalit Indian
Chamber of Commerce and Industry, have emerged. The going however has
been tough. Financial bottlenecks and lack of government support have
hindered the budding entrepreneurs.

The Centre's latest proposal, even if with an eye on next year's UP
elections, can undoubtedly assist struggling entrepreneurs as well as
job creation. Dalits need to find their place in the mainstream
economy. Given yawning fiscal deficits, not to mention imploding
education and job reservations for more and more social groups,
there's no more scope for expansion in government jobs. The present
quota regime has outlived its utility. Rather than extricate SCs/STs
from poverty and backwardness it has created elites within target
groups, the benefits barely trickling down. Clearly, affirmative
action has to move from dole to economic empowerment. The present
proposal could fetch dalit enterprises business to the tune of Rs
25,000 crore to Rs 94,000 crore. Having made the right intervention,
the government should now ensure its implementation.

Death toll goes up to six; police say situation under control in
violence-affected areas

Even as an uneasy calm prevailed in many parts of Ramanathapuram
district on Monday, a day after the police opened fire on Dalit
protesters at Paramakudi near here, the death toll went up to six.

After post-mortem, the bodies of two of the victims were taken to
their respective villages from hospitals in Ramanathapuram and
Parmakudi under tight police security. The last rites were performed
in the presence of a large number of police and revenue personnel.

Five Point Junction, which bore the brunt of the violence, wore a
deserted look. A large number of stones were strewn along the arterial
roads of the town, particularly the Madurai-Rameswaram highway,
Mudukulathur and Ilayangudi roads.

Almost all shops and business establishments in Paramakudi town
remained closed for the second consecutive day. Similarly, fearing a
backlash, most of the shops put up the shutters in Ramanathapuram,
Tiruvadanai, Parthibanur, Abiramam, Kamudhi, Kadaladi, Mudukulathur
and other areas. Schools and colleges remained closed. All TASMAC
shops in the district have been closed indefinitely.

Bus services to various sensitive places were suspended for the second
consecutive day. There was no movement of public transport to
Paramakudi, Mudukulathur, Kamudhi, Parthibanur and other places. Bus
connectivity between Rameswaram and Madurai, via Ramanathapuram and
Paramakudi, also remained suspended. However, services between
Rameswaram and Tiruchi were resumed.

Additional reinforcement of police personnel, including Deputy
Inspector Generals and the Superintendents of Police, drawn from
various districts of the State, have been sent to places which had
witnessed caste violence in the past. Mobile parties, with Armed
Reserve police, have been asked to monitor the movement of anti-social
elements.

Rajesh Das, Inspector General of Police, South Zone, who held several
rounds of meetings with police personnel at Parmakudi, told The Hindu
that the situation was under control. All experienced officers had
been brought to the district for bandobust. Adequate police strength
was drawn from various parts. There would not be any more incidents.

Asked what prompted the police to open fire, Mr. Das said since the
matter was to be probed by an inquiry commission it was not proper for
him to speak about it.

Collector V. Arun Roy, who visited the injured at the hospitals, said
that normality was restored in the district. The revenue officials,
with magisterial powers, have been posted at many places.
Attempt to set bus on fire

Virudhunagar Staff Reporter writes:

Miscreants attempted to set afire a State-run bus and smashed the
windscreen of another vehicle in the district on Monday.

Timely intervention by the Fire and Rescue Service personnel saved the
bus from being charred.

The police said that the fire was noticed at around 2 p.m. on the
Virudhunagar-Sankaralingapuram town bus parked in the Old Bus Stand.
Local people alerted Fire and Rescue Service personnel who rushed to
the spot.

Earlier, a mob of around 20 persons destroyed the windscreens of a
town bus near Sivakasi. After intercepting the Sivakasi-Sattur town
bus at Mayiladumparai, the mob broke the windshield with clubs and by
throwing stones. No passenger was injured.

On Sunday, incidents of damaging two buses, one at Amathur and another
at Soolakarai, were reported in the district.

Over 500 persons blocked the Virudhunagar-Srivilliputtur road at
Senkundrapuram on Monday morning demanding Rs.10 lakh compensation for
the families of those killed in police firing on Sunday at Paramakudi.
They also sought release of all those arrested.
Three bodies sent amid tight security

Staff Reporter from Madurai writes:

Post-mortem was conducted on the bodies of three Dalits hailing from
Ramanathapuram district, who were killed in Sunday's police firing,
here on Monday even as scores of Dalits gathered at Government Rajaji
Hospital (GRH).

The bodies were later sent to the victims' villages amid tight
security. While Vellaichami (65) of Chatrakudi succumbed to bullet
injuries in hospital, Theerpukani (27) of Melakodumanur and Muthukumar
of Kaattuparamakudi were brought dead to GRH.

Balakrishnan (19) and Jayaprakash (19), who suffered bullet injuries
in the police firing at Chinthamani in Madurai were shifted to a
private hospital after their relatives complained that the treatment
was unsatisfactory.

Eleven persons who were injured in police lathi charge at Paramakudi
and 13 others who sustained injuries during police action at
Chinthamani were also treated at the GRH.

Members of the Communist Party of India (Marxist), led by former MLA
N. Nanmaran, and members of the Tamil Nadu Untouchability Eradication
Front visited the hospital.

P. Sampath, president, TNUEF, said that the injured were not being
treated properly. "One of the injured, Chaturagiri (22), told us that
the bullet which had pierced his left leg was yet to be removed."

Both CPI (M) and TNUEF condemned the police firing saying it could
have been avoided. "It was not at all wise on the part of the police
to arrest Dalit leader John Pandian on the guru puja day, when so many
Dalits had gathered at a single spot," said Mr. Sampath.
"Police showed restraint"

S. George, Additional Director General of Police, Law and Order,
visited two private hospitals in the city and met three police
personnel injured in the rioting. He said that the situation was under
control in Paramakudi and adequate police personnel have been
deployed.

Asked what actually happened in Paramakudi, he said that the police
had shown much restraint while facing the violent mob. "The situation
went out of control and we had to open fire."

As many as 99 persons have been arrested in connection with Sunday's
violence at Chinthamani.

Jaipur: The members of Dalit Mahila Manch, Rajasthan, joined by
People's Union for Civil Liberties (PUCL) and Vividha, an NGO, staged
a dharna at the Ambedkar Circle on Monday in Jaipur. The protestors
condemned the Congress legislator Raghu Sharma's alleged derogatory
remarks about Bharatiya Janata Party (BJP) Member of Legislative
Assembly (MLA) Promila Kundara on August 29 in the state assembly.

They raised slogans and demanded for a public apology from Raghu Sharma.

"Raghu Sharma's remark in Rajasthan Legislative Assembly on August 29
is an insult for all women. We want him to come out in public and
tender an apology for his comment. Apparently, he is ignorant of the
Indian culture, which treats women with dignity," said Suman
Devathiya, convenor of the Manch.

PUCL general secretary Kavita said that it was an attack on the
dignity of women. "Such things should not be tolerated. A party that
is run by a woman, should not let such incidents happen that attack
the dignity of women. The comments were unparliamnetary and it is a
serious matter," Kavita added.

The protesters also sent copies of the memorandum to Congress
president Sonia Gandhi, speaker of state assembly, the governor and
leader of opposition. They threatened to intensify their protest if no
action was taken.

Chennai: A day after the police firing incident that killed six people
in Paramakudi in Ramanathapuram District, the situation on Monday
still seemed tense but under control with the prohibitory orders under
Section 144 still in place.

Ramanathapuram District Collector Arun Roy said, "At present the
situation is under control. Following the firing, there were isolated
instances of stone pelting etc but by yesterday evening normalcy was
restored. We are prepared for anymore acts of violence. We hope
nothing happens but we are prepared for it."

There was a meeting in memory of Dalit leader Immanuel Sekaran that
turned bloody on Sunday afternoon. When the situation went out of
control, the police resorted to lathicharge and tear gas and then
opened fire.

G Gunasekaran, who lost his father in the firing, said, "My father had
come to distribute invitations for my wedding. He was going to my
uncle's house and was crossing the place of gathering when he got
caught in the crossfire and was shot."

The police department has come under sharp criticism - so much that
Chief Minister Jayalalithaa who had initially defended them was forced
to order a judicial probe.

"The protestors indulged in largescale violence and torched police
vehicles. Police opened fire in self defense to protect public
property. The protestors were dirupting law and order...political
gains of some persons," Jayalalithaa said.

However, not everyone is blaming the police. Some eye witnesses say
that the police was patient and trying to calm the crowd.

"If not for the police the protest would have spread into the whole
town and everything would have been burnt and ruined," said an eye
witness.

Even as several questions are being raised on the police's proactive
decision and timing of detaining John Pandian, which was the actual
cause behind the whole incident, for the moment normalcy seems to have
returned to this already communally sensitive area.

With Jayalilathaa now announcing the revival of peace committees in
each district, the locals are hopeful that communal clashes will soon
become a thing of the past.

Indore: Whether it is Malwa or Bundelkhand, when it comes to the upper
caste's violent intolerance to a dalit youth riding a horse to take
his bride, they are the same. In the 64th year of India's
independence, at least seven examples of dalit groom being obstructed
for riding ceremonial horse are on record in MP last year.

A voluntary organisation, Jan Sahas has recorded seven marriage
processions across the state, which were disrupted and the grooms were
harassed.

"These are the cases where we are providing legal and other assistance
to the victims. All of the cases are under trial. Actual numbers could
be many times more," said Asif Sheikh of Jan Sahas.

The cases include two each in Dewas and Damoh and one each in Ujjain,
Chhatarpur and Shahjapur district. "When Ganesh Ahirwar of
Chhatarpur's Sulwa village went to complain to the police, the station
officer at the Buxwaha police station advised him to better adhere to
the custom prevalent in his village", said another activist associated
with Jan Sahas, Sajjan Singh.

Later action was taken against the station officer. Damoh's Paramlal
was not only pulled down from his horse but was thrashed by the
influential people of his village during his marriage procession, said
Sheikh.

"The socio economic conditions of these people is such that a majority
of these cases remain unreported and to avoid any troubles during
marriage. These poor people agree to the terms imposed by
influential", Sheikh told DNA.

John Pandian arrested again

Immediately after his release, John Pandian, president of the
Tamizhaga Makkal Munnetra Kazhagam, was arrested again at Vallanad in
Tuticorin district on Monday morning.

Since he expressed his wish to reach Paramakudi for paying homage to
Immanuel Sekaran, the arrest was made.

Tuticorin police arrested him on Sunday when he was proceeding to pay
homage to the Dalit leader on his death anniversary at Paramakudi.
Since the Collector of Ramnathapuram had promulgated a ban order under
Section 144 of Cr. P. C. to prevent him from entering the district, he
was denied entry. Four other party cadres were also detained along
with Mr. Pandian.

Adequate security forces have been deployed at Vallanad to prevent any
untoward incident.

On Monday, a group of lawyers from Tuticorin district court staged a
protest against the police firing.
