[ZESTCaste] MTT Newsletter:40 - Why War Envelops the US Homeland?

These articles are only to read, not to copy and publish in your sites without providing a reference back to our website.

On November 5, Major Nidal Malik Hasan, while shouting "Allahu Akbar" (God is Great), opened fire on his fellow soldiers at Fort Hood, in a US military base, killing 13 and injuring more than 24 persons. After fourteen hours, two people were killed and six were hurt in the second mass shooting in the United States in Orlando, Florida. But the deadliest incident especially at the US military base is shocking for every person, belonging to any religion.

Major Hasan was an educated American national who was brought up in the modern civilization. One of his cousins said that after 9/11 attacks, Hasan, a Muslim, complained of being harassed by some service members for his religion, and wanted a discharge. While a co-worker told that he had also expressed anger about the US involvement in Iraq and Afghanistan, and apparently did not want to be deployed to Afghanistan. Hasan spoke of the need for Muslims to "stand up and fight against the aggressor," and the US.

However, this mayhem made it clear as to why the American war on terror has enveloped the US homeland. It needs an appropriate analysis so that American policy makers could change their ill-conceived policies, grasping reality.

Notably, in the US, Jews who control the media and every successive administration owing to their strong financial position influece the internal and external policies of the country. They were already in collusion with the Indians to exploit American strategy against the Islamic World, while the September 11 tragedy had provided them with a golden oppurtunity to manipulate the same against the Muslims in order to fulfill their collective designs against Pakistan, Palestine and...

'Bid to keep Dalit out of apex court'

CHENNAI: If the petitioners seeking to implead in the case relating to
the controversy over the land in Kaverirajapuram in Tiruttani taluk in
Tiruvallur district are allowed to do so, then it will open the
floodgates for such petitions in future, advocate N Jyothi warned on
Thursday.

Resuming his arguments against the impleading petitions from People
Watch, Human Rights Advocacy and Research Foundation and others,
Jyothi, representing a shepherd in Kaverirajapuram, told Justice K
Suguna that the signatories of the petitions, carrying criminal cases
on their shoulders, could not talk about purity in justice.

A group of advocates met the judge in her chambers, after the orders
were passed on the batch of writ petitions from the villagers on
November 6. If the court allowed some people to interfere in this
manner, it would set a bad precedent. The court should not be allowed
to be used as a platform for such things. The order was passed in the
presence of the counsel of both the sides. Three days later, a
congregation of minds took place and now they want to implead in the
matter. "Who are these people? What is their reputation? What is their
antecedent? Why they are filing and what are they going (achieve) to
do?'' he wondered. "They don't want a Christian or a dalit (to become
a Supreme Court judge) and it was their agenda,'' Jyothi alleged and
added that in the process, an innocent shepherd, owning a piece of 50
cents of land, was affected.

What was the nexus between his claim of patta for the land and the
Supreme Court and its collegium, Jyothi asked. Earlier, senior counsel
for the writ petitioners N R Chandran said that the scope for review
was very limited. It could be done so only in exceptional cases and
when a doubt about the validity of the order arose and not merely
because some 'busybodies' filed impleading petitions.

An order, which was unpalatable to a group, could not be a ground for
reviewing the order. He also said that the order of the District
Collector was not final. The attempt of the collector to invoke the
rules in respect of 'anadheenam' land was impermissible in law.

[ZESTCaste] SC/ST allottees may not be able to sell DDA flats for 15 yrs

http://www.indianexpress.com/news/SC-ST-allottees-may-not-be-able-to-sell-DDA-flats-for-15-yrs/540804/

SC/ST allottees may not be able to sell DDA flats for 15 yrs

Mandakini Gahlot Posted online: Friday , Nov 13, 2009 at 0031 hrs
New Delhi : The Delhi Development Authority (DDA) has proposed that
the allotments of flats to the Scheduled Castes and Scheduled Tribes
be made with a precondition that they will not be able to sell them
for 15 years.
A proposal it made to the Urban Development Ministry requests
permission for allotment to SC/ST categories only on leasehold, thus
putting a check on the resale.

The proposal was submitted immediately after the draw of the 2008
Housing Scheme held on December 16, 2008. The allotments had been
delayed by a year, owing to irregularities detected later. The case is
still under investigation and the idea was to avoid a similar
situation in the future.

"Essentially, the DDA's suggestion is to insert a clause in the
allotment procedure so an SC/ST candidate will not be permitted to
sell the house for the next 15 years," said an official.

Since flats are allotted by the DDA on a freehold basis, successful
allottees are free to sell their flats as and when they choose. "This
leads to speculative applications by people who sell the flat
immediately after allotment for a profit," an official said.

In case of SC/STs, the DDA maintains, this happens on a regular basis
as they have a priority quota and stand a better chance of getting an
allotment.

"This is what happened in the applications that came in last
December," the official said. Investigations into that draw revealed
that a cartel of property dealers coaxed people from the SC/ST
category — many of them residents of Rajasthan — to apply for the
draw. The modus operandi, the official explained, was that the
candidates merely signed the application. The property dealers made
the payment for the flat on their behalf, and if they were successful
in the draw, sold the flats for a profit.

The Economic Offences Wing of Delhi Police is still investigating the
case and nine people have been arrested so far.

Referring to the DDA's proposal, the official said: "This is not a
draconian measure. It will help us to curb exploitation of SC/ST
candidates at the hands of speculative buyers."

If a successful allottee in the SC/ST category wants to transfer the
flat's ownership in the name of a relative, "then of course, we will
make provisions to allow that," he added.

The DDA is also mulling whether it should ask the ministry to allow
only the residents of Delhi and NCR to apply for future draws.

"Since Delhi is a Union Territory, people from any part of the country
can apply, but not all of them intend to stay in the allotted houses."
the official said. "We have been discussing this issue for a while."
While a proposal along these lines is yet to be made, officials said
the matter might be discussed with the ministry.

Apex court rejects Maya's plea on statues row

STAFF WRITER 13:47 HRS IST

New Delhi, Nov 13 (PTI) The Supreme Court today rejected the plea of
Uttar Pradesh Chief Minister Mayawati for permission to undertake
maintenance and certain other works at the controversial Rs 2,600
crores Ambedkar site in Lucknow.

A bench of Justices H S Bedi and J M Panchal felt that there was "no
change of circumstances" to grant any such relief to the state
government which was earlier restrained by it from carrying out any
further activities at the site.

The apex court, however, said it would examine the plea on merits when
the main matter relating to the issue would come up on November 30.

The state government had filed an urgent application seeking
permission to go-ahead with the maintenance work on the plea that
lakhs of people would be thronging the site on December 6 on the
occasion of the birth anniversary of B R Ambedkar.
