KATHMANDU: Dalit rights activists stressed on the need of identifying
reasons behind the decline of Dalit population every year.

It was said at an interaction organized by National Census Dalit Watch
on Tuesday to review the campaign of Dalit population assurance in the
national Census initiated with the slogan 'Let not be repeated and
left out'.

Constituent Assembly (CA) member Khadga Bahadur Basyal argued the
present Census may also show the declining trend of Dalit population
since most of the youths residing in cities from various parts of the
country do not tend to show their ethnic identity.

No participation of Dalit in preparing the questionnaires for Census
has resulted in this problem, he added.

Director General of Central Bureau of Statistics (CBS), Uttam Narayan
Malla underlining the need of conducting separate Census for bringing
out statistics of nationalities and language users said the
preliminary report of the Census-2068 will be unveiled by mid-June,
2012.

Chairperson of National Dalit Commission, Bijul Kumar Biswokarma,
Dalit rights activists, Hira Biswokarma, Ganesh BK, among others urged
all Dalits to move ahead with unity for their rights.

Indian Untouchables Become Millionaires

It is now the 20th anniversary of economic reforms that converted
India into a miracle economy, growing at 8 percent per year in the
last decade. Critics complain that this has benefited only a few
upper-crust millionaires, bypassing poorer groups. This is simply
wrong. The poorest, lowest of all Hindu castes -- once called
untouchables and now called dalits (meaning the oppressed) -- have
started spawning millionaires too.

The Federation of Indian Chambers of Commerce and Industry (FICCI) is
India's oldest business chamber. Dalits have now set up a Dalit India
Chamber of Commerce and Industry (DICCI). This is no more than a
start: dalits continue to remain at the bottom of the social and
income ladders. But at long last some have ceased to be objects of
pity and become objects of envy.

Many dalit entrepreneurs came from the lower middle class, got a
decent education, and then made good. But others came from laborer
families, and their rise is especially heartening.

Ratibhai Makwana's father, once a farm labourer, later made leather
pickers, used in textile machinery. Dalits have traditionally had the
dirty task of disposing of dead animals, and in the process have
become leather workers. Ratibhai greatly expanded his father's small
business by getting into plastic intermediates. His family now runs a
sugar mill in Uganda and plans a cement plant there too. His revenues
exceed $80 million a year.

Sanjay Khsirsagar came from a lower middle class dalit family. His
first venture was in high-end sound equipment. Later he created a
construction company, APA Infraventure, which has become big in Mumbai
slum redevelopment. He is now building himself a penthouse by
redeveloping the very slum he grew up in.

Bhagwan Gawai once worked alongside his father as a construction
worker. But he got a decent education and joined a government oil
company, HPCL. He was not well treated there, and successfully sued
the company for caste discrimination. His lucky break came when he was
posted in Dubai by HPCL. There he developed new contacts, and started
a plastics trading business with Arab partners. This business now has
a turnover of $20 million.

Ashok Khade's father was a cobbler, working under a tree in Mumbai.
Ashok went to college, and then joined a government company building
offshore platforms, Mazagon Docks. He acquired skills in offshore
maintenance and construction. Today his company DAS Offshore is a
major offshore services company, and he now plans a jetty fabrication
yard that will employ 2,500 workers.

Sushil Patil, another son of a laborer, was lucky enough to go to
college (which waived his last year's fees). Bitten by the
entrepreneurial bug, he started several ventures, all which failed.
Yet he persevered, and ultimately struck gold by setting up a
construction company, IEPC. This now has revenues of $ 65 million.

Another dalit, Balu, made good after much travail with a soldering
equipment business. He says 32 girls in a row rejected him as a
marriage partner because of his poor prospects! He claims many dalit
businessmen still hide their caste name to avoid discrimination.

In all these cases, education helped dalits rise. But rural government
schools are pathetically substandard, leaving most dalits barely
literate. Even so, they have made astonishing strides, according to a
seminal study by University of Pennsylvania Prof. Devesh Kapur and
others.

This study looked at dalit outcomes over the last 20 years in
sub-districts of west and east Uttar Pradesh, India's largest state.
The proportion of dalits owning their own business was up from 6% to
36.7% in the west, and from 4.2% to 11% in the east. The proportion in
non-traditional occupations (like tailors, masons etc) was up from 14%
to 37% in the east, and from 9.3% to 42% in the west.

Political parties have long promoted government job reservations for
dalits as the way to social progress. Yet, the study shows the
proportion of dalits in government jobs in Uttar Pradesh has actually
fallen from 7.2% to 6.8% in the east, and risen marginally from 5% to
7.3% in the west. Clearly, job reservation has not driven the state's
social and economic revolution. The main drivers have been the new
opportunities arising from economic reforms, plus the rise of dalit
politician Mayawati. She has been Chief Minister of the state four
times in the last two decades, and done much to raise their status and
reduce historical discrimination against them.

Critics complain that India's economic reforms have created new
inequalities. They may even criticize the rise of dalit millionaires
as a new sort of inequality. Nonsense. Viva la such inequality!

The Bhahujan Lokpal Bill will be submitted to Parliamentary Standing
Committee tomorrow at 5 PM.

The versions of Jan Lokpal Bill by Team Anna, Lokpal Bill by Union
Government of India and National Campaign for People's Right to
Information are incomplete versions to deal holistic aspect of
corruption in India. The biggest issue of corruption is the 3000 years
old caste system within Indian societies. The current form of three
versions of the Bills does not address the issues of SC/ST/OBC and
Minorities.

The members of Dalit Bhahujan communities seek for the inclusion of
monitory corruption, socio-political corruption, education/economic
corruption, religious based corruption and communal base corruption in
strong Lokpal Bill.

NEW DELHI: The Centre is set to make it compulsory that 4% of its
annual purchases be made from the units run by dalits and tribals, in
what will be its strongest bait for classes which hold the key to
political battles at the Centre and states.

The 4% purchase quota proposal from ministry of micro, small and
medium enterprises (MSME) is part of the policy that 20% of government
procurement be done from MSMEs.

Preferential procurement has been an early poll promise of UPA and its
delivery after seven years in power is set to be seen through the
prism of Uttar Pradesh elections where Congress is vying with dalit
czarina Mayawati to recapture some political space after decades in
wilderness.

Activists have believed that mandatory purchases from dalit units
would boost entrepreneurship among poor classes with assured state
clientele and without the fear of competition from entrenched
businessmen. The demand gained ground in the new economy where job
quota was shown to have limitations of reach.

The quantum of business available for dalit entrepreneurs may be big.
An OECD estimate had suggested that government purchases amounted to
30% of GDP, thereby making business of Rs 94,000 crore available for
dalit units. But even by the lower estimate based on Centre's spending
pattern, Rs 25,000 crore may be available to units set up and run by
SCs and STs.

This year, the Centre budgeted to spend around Rs 12.5 lakh crore, of
which defence spending and interest payments add up to Rs 5 lakh crore
while subsidies are estimated at Rs 1.4 lakh crore. So, procurement by
MSMEs would be around Rs 1.2 lakh crore.

It is not a small figure going by Centre's first tentative steps after
years of reluctance in the face of strong lobbying over the years. A
sub-committee of the cabinet committee on dalit affairs in UPA-1 had
recommended that 30% of government purchases be made from SCs/STs. The
inspiration for purchase quota comes from Digvijay Singh regime in MP
where it formed part of state policy after Bhopal declaration.

The move, at once part of affirmative action plan, is bound to attract
attention of social justice observers. For Congress, it would be a way
to blunt the criticism among SCs/STs after failing to extend the
frontiers of job reservation to private sector as promised in UPA-1.
Its proposal for 5% quota in private enterprises which availed
government funding met with lukewarm response and has been put in deep
freeze.

If enacted now, Congress could use it as a weapon to contrast its
achievement with the work done by Mayawati regime for dalits, a
segment Rahul Gandhi has been trying hard to woo from its first choice
BSP. Congress needs big ticket decisions to back its chances in April
polls in UP and is working hard on a clutch of measures including a
new land acquisition bill.

If all goes well, by next year, Jamia Millia Islamia will have a
state-of-the-art residential coaching academy for underprivileged
sections of the society. The centre for coaching and career planning,
which trains minorities, SC/ST/OBC and women students for civil
service examinations and
other competitive entrance exams free of cost, will get a swanky
building with a hostel and will be rechristened residential coaching
academy. Currently, the centre is working out of an old SRK building
within the Jamia campus.

"The university grant commission has sanctioned Rs 5 crore for setting
up a residential coaching academy at Jamia Millia Islamia. We have
already allotted the work to the Rail India Techno Economic Survey
Limited to a construct hostel and academic blocks for students
preparing for various competitive examinations," said Professor Anis
Ur Rehman, director, centre for coaching and career planning.

The building, which is coming up near the academy of third world
studies, will have separate residential and academic blocks with a
computer lab, seminar hall and an exclusive library for civil service
aspirants.

The management is in the process of hiring full time faculty for the
institute. "We have started hiring the best of faculty to coach our
students. Faculty from other universities and institutes will also be
coming to teach the students. The vice chancellor wants it to be the
best residential coaching academy for the underprivileged in the
country," said Mohammed Tariq, coordinator of the centre.

"Currently, the students are staying in a transit hostel. Next year
we'll also double the intake from 100 to 200 seats for civil
services," added Tariq.

Madurai, Aug 31 (PTI): BSP state unit has filed a petition in the
Madras High Court bench here, seeking facilities like drinking water,
food stalls and information booths at the memorial of Dalit leader
Immanuel Sekaran in Ramanathapuram district on his 54th death
anniversary on September 11. BSP State General secretary E P
Jeevankumar submitted that police are not permitting even food stalls
at the venue, which would be visited by about 15 lakh people and that
denial was a violation of human rights. Sekaran was born Oct 9 1924.
He participated in the Quit India movement when 18 and was arrested
and detained for three months. Then he joined indian army and later
became a youth congress leader. He worked for the promotion of social
justice and equality of the down trodden until he was killed in a riot
in 1957.

New Delhi Disbelieving the prosecution theory of honour killing, the
Supreme Court has acquitted a man charged with smothering to death his
niece Lakshmi for marrying a Dalit boy.

A bench of justices H S Bedi and Gyan Sudha Mishra set aside the
concurrent findings of a sessions court and the Andhra Pradesh High
Court which, relying on the circumstantial evidence that the duo were
last seen together, held that the accused Dandu Jaggaraju had indeed
committed the murder.

According to the prosecution, Lakshmi, who was a Kshatriya, had
married a Dalit boy in 1996 against the wishes of her family due to
which her family, particularly Jaggaraju, was angry with her.

The post mortem report revealed the victim died of asphyxia due to
smothering as her 'chunni' (scarf) had been thrust into her mouth. It
was alleged that earlier too an attempt was made on the life of the
victim, which she survived.

She was allegedly murdered on August 14, 2002, and some gold ornaments
from her body were taken away by the accused.

Setting aside the conviction, the apex court said "there is, however,
no documentary evidence to that effect. We, therefore, find it
somewhat strange that the family of the deceased had accepted the
marriage for about six years, more particularly as even a child had
been born to the couple.

"In view of this, the motive is clearly suspect. In a case relating to
circumstantial evidence, motive is often a very strong circumstance
which has to be proved by the prosecution and it is this circumstance
which often forms the fulcrum of the prosecution story," the bench
said.

The apex court said the only other piece of evidence against the
appellant is the recovery of the ornaments allegedly taken from the
deceased.

"We find that the jewellery is of the variety known as 'disco
jewellery' and is commonly available to all and sundry.

"It is also difficult to believe that the appellant, who statedly
killed his niece on account of family honour, would act so low as to
take the jewellery which was little more than trinkets from her dead
body," the apex court said.

The apex court further said it was completely unacceptable that though
the incident had happened on August 14, 2002, the accused had
continued to move around with the jewellery in his pocket till its
recovery from him on September 7, 2002.

"We also see from the record that the jewellery had not been recovered
under a disclosure under Section 27 of the Evidence Act but was taken
on a search of his person.

"This circumstance, therefore, does not even remotely support the
prosecution story in any manner. For the reasons recorded above, we
find that the judgements of the courts below cannot be sustained.

"We, accordingly, allow the appeal and order the appellant's
acquittal," the bench said in its order.

Dalit leaders to meet Singhvi with their Lokpal draft

NEW DELHI: There is now a fourth Lokpal draft that the standing
committee may need to consider. A delegation led by Udit Raj, chairman
of the All India Confederation of SC/ST Organisations, will meet
Abhishek Singhvi, chairman of the parliamentary standing committee on
law and justice to hand over a copy of the Bahujan Lokpal Bill - their
version of the legislation for an anti-corruption ombudsman. The bill,
according to Raj, will address issues of corruption pertaining
specifically to the socially deprived classes.

"The most important demand that we are making is that there should be
representation of dalits, minorities and backward classes in the
Lokpal to ensure that socially victimized are not made victims in
this. We are also demanding that embezzlement of funds meant for
uplift of dalits, backward classes and tribals should be included in
the ambit of corruption. Huge amounts of money are released for
schemes like the Special Component Plan and the Sub-tribal Plan which
is misutilised, embezzled or returned unspent," Raj said.

He demanded that the Bahujan Lokpal Bill too should be looked at by
the panel before pronouncing its recommendations on the Lokpal draft.
Dalit activists and some sections of Muslims have been upset with the
Anna Hazare movement because of lack of representation from the
communities and they even held a protest rally at India Gate during
the fast. To counter this perception, Team Anna chose a dalit and a
Muslim girl to help Hazare break his fast on Sunday.

"The existing versions do not take into account issues pertaining to
dalits and minorities. That is the lacuna that we hope our bill will
fill," Raj added.

Casteist slur leads to clash in Gr Noida village

GREATER NOIDA(BADALPUR): Panic triggered in Greater Noida after a
clash occurred between two communities over a casteist slur made
between two persons involved in a road rage incident on August 29. One
of the persons involved is a resident of Dujana village. Six
motorbikes and a car were damaged in the incident. A panchayat was
later held to calm the situation. Sensing trouble, three units of PAC
were deployed in the area while the police have registered a case
against 77 people.

SSP Jyoti Narayan said that the police have also lodged a case against
one of the persons under the SC/ST Act. Cops said Karan Singh Jatav, a
native of Dujana, was on his way to drop his son Pramod at Maripat
railway station in Dadri on his motorbike. On Dadri GT road their bike
collided with another driven by Sachin Nagar and this led to a heated
argument. The enraged Jatav called his supporters and they thrashed
Nagar.

Nagar soon began to search for Jatav's residence along with his
supporters. "On Thursday morning, Nagar got a tip-off about where
Jatav lived and he rushed there with his friends. They misbehaved with
Jatav and his family and damaged six motorbikes and a car in the
process," said a police officer.

Soon, a war-like situation ensued and senior district police and
administration officials reached the village. Additional security
forces were also deployed. Jatav then registered a complaint with the
Badalpur police station citing that Nagar and his associates used
casteist words. The police have registered a case under the SC/ST Act
on 77 persons.

Dalit leaders to submit their Lokpal draft to Parliamentary
Parliamentary Standing Committee

NEW DELHI: Claiming that the versions of the Lokpal Bill with the
government are "incomplete", a group of Dalit and minority leaders
will tomorrow submit their version of the anti-graft law to the
Parliamentary Standing Committee dealing with the issue.

The delegation led by Udit Raj, Chairman of All India Confederation of
SC/ST Organisations, will meet Standing Committee chairman Abishek
Singhvi and submit their version of the proposed law -- the 'Bahujan
Lokpal Bill' -- for consideration of the Parliamentary panel.

The group will seek the inclusion of monetary corruption,
socio-political corruption and religion-based corruption besides other
issues.

"The versions of government, Jan Lokpal Bill by Team Anna and NCPRI's
bill are incomplete versions to deal with corruption holistically.
These versions do not address the issues of SC/ST/OBC and minorities,"
a statement released by the group said.

The Dalit and minority community activists had earlier complained that
their voices were being ignored both by the 'civil society' and the
government.

"Our draft will protect minority community by bringing the funds
allocated for minority welfare also under the ambit of Lokpal," Raj
said.

The Bahujan Lokpal draft envisages bringing NGOs, corporate houses and
media under the ambit of Lokpal. Another provision includes
reservation for minorities in the 11-member Lokpal Committee.

Raj said they wanted their draft also to be considered by the
government and they were for a final version of the bill that
incorporates provisions from the Jan Lokpal draft, the Government's
draft, the NCPRI draft and also the Bahujan Lokpal society draft.
