SC upholds OBC quota in Kerala local bodies

Thiruvananthapuram: The Supreme Court (SC) has issued notices to the
Kerala government for providing reservation to the poor among the
upper caste people.
In 2008, the government provided reservation at graduate and
post-graduate levels to forward communities at 10 per cent and seven
per cent respectively.
The Supreme Court has also upheld reservation for the Other Backward
Classes (OBCs) in local bodies. The court ruled that reservation for
the OBCs in municipalities and Panchayats did not violate the
Constitution.
The SC dismissed a petition filed by a private body questioning
whether the OBCs should be given reservation at Panchayat level. The
petitioners cited article 73 and 74 of the Constitution which provides
for reservation for the OBCs in Panchayats and municipalities.
The argument made was that the OBCs are entitled to reservation only
in employment and educational fields; there can't be political
reservations for them. But a five-judge bench, headed by Chief Justice
K G Balakrishnan, said reservation can be given to the OBCs at this
level.
