MLAs want official jailed for misuse of atrocities act

Mumbai : Chief Minister Prithviraj Chavan's proposal to let off a
tribal official with a warning for apparently filing a 'malicious'
case against the Leader of the Opposition Eknath Khadse under the SC,
ST Prevention of Atrocities Act, was rejected by the Assembly on
Wednesday. MLAs demanded that the official be sent to jail for his
action so that a strong message was sent to the bureaucracy.
Speaking on behalf of the Privileges Committee, Jaiprakash
Dandegaonkar (NCP) said that the Project Officer of Integrated Tribal
Development Project (ITDP) at Yawal (Jalgaon), G N Walvi, had filed
the case and also moved the Aurangabad Bench of the High Court against
Khadse, after Khadse had demanded action against him, for being
allegedly involved in irregularities in the ITDP.
Chavan then moved a proposal that Walvi be summoned to the House and
reprimanded.
However, several MLAs, including Subhash Desai (Shiv Sena) and Gopal
Shetty (BJP) said the punishment proposed by Chavan was very mild and
that the erring official be sent to jail.
Speaker Dilip Walse-Patil said that Walvi's contention that he had
been targeted because he was a tribal was wrong and that while dealing
with officials, things like caste and tribe were not taken into
account. He said that the report of the privileges panel could either
be accepted or referred back for revision as the House could not
change it. He adjourned the House for 15 minutes to discuss the matter
with group leaders. Later, he said that considering the chairperson of
the privileges committee Gopaldas Agarwal was absent and the members
wanted a revision in punishment, the proposal be referred back to the
panel.
He added that it was a fundamental issue and a serious one if officers
started misusing laws like the atrocities act against legislators.
Walvi, incidentally, is under suspension.
