Cabinet approves settin up of SC ST Commission in Goa

Panaji, March 12 - Goa cabinet today decided to set up a commission
for Schedule tribe and schedule caste. Cabinet also took a decision to
enhance enumeration of college teachers who are employed on contract
and lecture basis to the tune of Rs 21,000 and 27,000.

Chief Minister Digamber Kamat briefing media about the decision taken
in cabinet meeting, said that the government had assured to ST and SC
community in the state to set up a commission for them. Bill to this
effect will be tabled in the coming session of state assembly
commencing from March 22.

Giving relief to hundreds of college teachers cabinet today decided to
enhance their salary. Those teachers who are without NET/SET
qualification will get salary of Rs 21,000. Presently they are getting
monthly salary of Rupees Rs 8,000. Teachers who are having NET/SET
qualification will get salary hike upto Rs 27,000 per month. Presently
they are getting salary of Rs 15,000, CM informed. This is applicable
to teachers who are on contract, he mentioned. Remuneration per
lecture is also hiked by Rs 250 for teachers who are employed on
lecture basis, CM said.
Cabinet also approved amendment to The Rent Act so as to make divorced
women eligible for availing tenancy rights. Cabinet gave its nod to
the centrally sponsored ``Rashtriya swasthya Bima Yojana`` for people
under below poverty line.

Cabinet relaxed the retirement benefit to the anganwadi workers and
helpers. Presently only employees who have completed 20 years of
service are getting retirement benefit. Henceforth workers completed
15 years of service will also be entitled for retirement benefit,
Kamat noted.

Cabinet gave green signal to create traffic cells for Ponda, Curchorem
and Calangute. There was demand from people to create such cells on
account of increase in traffic in these particular areas, CM argued.
Cabinet also agreed to recruit 79 police drivers.

Mar. 3: The Madras high court has held that the SC/ST candidates
cannot claim it as a matter of right to provide reservation in
promotion to a particular post.
Justice K. Chandru dismissed the petition filed by Madras Refineries
SC/ST employees welfare association (now Chennai Petroleum Corporation
Limited), Manali, seeking to quash the proceedings dated January 29,
2010 and consequently direct the CPCL to earmark two posts of General
Manager to be filled up by promotion from among the SC/ST candidates.
According to petitioner, when the vacancies arose, petitioner
association sent a representation dated January 11 asking the CPCL
whether reservation was made for filling up the post of GM. In its
reply dated January 29, the CPCL negatived their claim. Hence it filed
the present petition.
The judge said Article 16 (4) of the Constitution providing for
reservation in promotion was an enabling provision. It was for the
state to make appropriate Rules consistent with Article 16 (4) and 16
(4-A) and Article 335 to make appropriate Rules by grant of due
representation in various posts.If the state wants to make a
provision, it was to collect quantifiable data showing backwardness of
the class, inadequacy of representation of that class in public
employment and mandatory compliance with Article 335 of the
Constitution.

* Hearing transfered in MP assault case

The Madras high court on Wednesday ordered the transfer of the hearing
on the anticipatory and bail petitions filed by some of the accused
allegedly involved in the assault on AIADMK MP O.S. Manian, from
Nagapattinam district sessions court to Thanjavur sessions court.
Justice R. Regupathy ordered the transfer on a petition filed by
Manian, seeking to transfer the petitions from Nagapattinam district
judge, against whom some corruption charges were alleged, to some
other court.
The judge said the petitions were directed to be transferred to the
court of sessions at Thanjavur and the Thanjavur court was directed to
dispose of the petitions on merits in accordance with law without any
delay. According to Manian, Palaniappan and his men assaulted him at a
marriage function on January 28 at Nagapattinam district and he gave a
complaint. The Madras high court had dismissed the anticipatory bail
petitions filed by three accused in the case.

The then Nagapattinam sessions judge M Lakshminarayanan also dismissed
the anticipatory petition of Palaniappan and bail petitions of his
men. Subsequently, Lakshminarayanan went on leave and Mr Chandrasekar,
Thiruvarur district judge, took additional charge of Nagapattinam
district sessions court. Mr Chandrasekar was facing several
allegations and enquiries were pending before this court.

Expressing dismay that large number of Group C and Group D posts meant
for Scheduled Castes and Scheduled Tribes have not been filled up in
railways, a Parliamentary committee on Thursday asked the ministry
concerned to make concerted efforts to fill the vacancies.

"It is a matter of great concern that the vacancies of 61 SCs and 73
STs in Group C and 121 STs in Group D during the year 2009 are still
to be filled up and no serious effort seems to have been made for
clearance of vacancies reserved for SCs/STs," the report, submitted by
the committee on Welfare of Scheduled Castes and Scheduled Tribes,
said.

The committee, headed by Gobinda Chandra Naskar, in its latest report
has impressed upon the Railway Ministry to make credible and concerted
efforts so that vacancies reserved for SC/ST are not carried forward.

The committee has also noted that not a single SC/ST official has been
selected to the posts of Vigilance Inspector/Investigating Inspector
in South Western Railway.

The committee, therefore, recommends while appointing incumbents for
these posts, SC/ST employees having the requisite qualifications
should not be ignored just because there is no reservation but should
be given fair opportunity to occupy such posts on ex-cadre tenure
basis.

The committee said despite a well placed method of recruitment adopted
by the Railway Ministry and South Western Railway, the desired
results, especially in the matter of recruitment of sufficient number
of SCs/STs in Group C and Group D posts, have not been achieved.

New Delhi: The Supreme Court today fixed March 18 for hearing the
Uttar Pradesh government plea for lifting the stay on the work for
construction of statues and memorials for Dalit leaders at a park in
Noida near here, which, the state claimed, was causing a loss of Rs
three lakh everyday.

A Special Forest Bench headed by chief justice KG Balakrishnan said it
will give a full day hearing to decide the contentious issue involved
in the matter.

Uttar Pradesh Government, which has claimed that it was losing Rs
three lakh everyday on the project, has said that the Ministry of
Environment and Forest (MoEF) has filed an affidavit which favours
that the stay on construction at the site be lifted.

"The MoEF has filed a decent affidavit. The land in question does not
come under the forest area," senior advocate KK Venugopal, appearing
for the state government, said, while opposing the plea of advocate A
D N Rao, who sought adjournment for a week.

Rao, who is assisting the court as amicus curiae in the matter, said
the issue was not only limited to the MoEF affidavit and that waiting
for a week more will not make much difference.

Additional solicitor general Indira Jaising, appearing for the Centre,
said the issue involved interpretation of laws and the notification by
MoEF relating to the use of forest land for construction activities.

She said it has to be determined what the expression built-up area
means to adjudicate whether the constructions were in accordance with
the law and permission under the notification was required.

Bishops, pastors and lay leaders of Catholic and Protestant Churches
joined in a seminar seeking ways to overcome socio-religious
discriminations of dalit Christians.

The top two Church bodies of the Churches-the Catholic Bishops'
Conference of India and the National Council of Churches in
India-organized the last weekend seminar in New Delhi.

They discussed "Building Inclusive India: Overcoming Social and
Religious Discriminations" in the particular context of inequality
suffered by dalit people.

Father G. Cosmon, secretary of Indian bishops' commission for dalit
Christians and other oppressed class people, said the seminar
primarily aimed to seek ways to press the government to extend quota
for dalit Christians.

The government tabled in parliament its own commission's report that
suggested extending the benefits to dalit Christians but "it is being
neglected."

In December 2009, the report from the National Commission for
Religious and Linguistic Minorities, popularly known as the Ranganath
Misra Commission, was tabled in parliament.

It said denying quota right to dalit among Christians and Muslims on
the ground that their religions do not practice caste system violates
justice. It recommended quota for these groups.

Jesuit Father A.X.J. Bosco, convenor of National Council of Dalit
Christians, said "it is very important to carry on the momentum of
Christian community" in the context of tabling the Misra commission
report.

Satish Deshapande, who teaches in Delhi University, who studied Dalit
in Muslim and Christian communities said, the gap between rich and
poor in Muslim community is narrow, while the gap between rich and
poor in Christian community is wider. "So, in Christian community
there is no larger consensus with regard to fighting for reservations"
to improve their dalit's future.

Some in the seminar suggested intensifying the lobbying with
parliamentarians. They also suggested putting political pressure by
garnering public support.
