Dalit seeks non-Brahmin judge for fair trial in HC

AHMEDABAD: A Gujarat high court judge got offended and dismissed a
case filed by a dalit when his lawyer requested the judge not to hear
the case and shift it to some other bench because the judge himself
was a Brahmin and that he would not be able to do justice in the case.

The petitioner, Ajit Makwana, had filed a complaint against the
Junagadh district judge who, he said, was favouring only Brahmins for
posts of Class III and Class IV staff.

Makwana's lawyer, A M Chauhan, told the court that nearly 60% of
selected candidates were Brahmins. The petitioner accused the judicial
officer of promoting Brahmins and in doing so, he conducted interviews
twice and deprived him of the opportunity.

However, Chauhan's accusations on behalf of his client, Makwana,
stunned Justice R R Tripathi. The advocate submitted: "The surname
suggests that Your Lordship also belongs to the same community and,
therefore, I want that this court may not hear this matter."

Justice Tripathi could not take it anymore and mentioned in the order
that he had come across such an argument for the first time from any
advocate after he assumed office as judge of the high court.

The judge thought that this was a "fit case" for issuing "notice for
contempt" against the advocate, and if he was saying so on instruction
from his client, then against him also.

However, he restrained himself.

Justice Tripathi dismissed the case with the observation that the
statement was made only with a view to either bring pressure on the
court and obtain a favourable order, or get the case out of this
court. "The court deems it proper to dismiss the matter so as to
discourage such a practice."

Lucknow : The Uttar Pradesh Forest department is drafting a proposal
to rename its famous Dudhwa Tiger Reserve and National Park after Dr B
R Ambedkar. According to sources in the department, the officials have
been asked by the state government to prepare a draft for renaming the
park. As soon as the draft is cleared by the department, it will be
presented in the state cabinet for approval.
However, sources said Union minister for Environment and Forests
Jairam Ramesh has already expressed his displeasure over the
government move and has written to Chief Minister Mayawati to rather
name the park after late wildlife activist Billy Arjan Singh.

Currently, the officials are busy drafting a proposal for renaming the
park as Dr Ambedkar National Tiger Reserve. According to sources in
the department, the officials have been asked to prepare a fool-proof
draft which keeps in mind all the probable hassles. The officials are
tight-lipped about the proposal and refuse to comment much on the
issue at the moment.

"We are just preparing a draft. The Dudhwa National Park was declared
through a notification on February 1 in 1976 and since then, the name
Dudhwa name has stuck on to the area," said an official. He said the
name Dudhwa was given to the National Park because of a local story.
"It seems the area was famous for milkmen and hence the name Dudhwa.
When the national park was notified, it was decided that it would be
called the Dudhwa National Park," he said.

However, a section of wildlife enthusiasts are of the opinion that the
park should be renamed after Billy Arjan Singh.

Incidentally, Singh had played a significant role in getting the
forest area declared as a tiger reserve and spent his life here. The
enthusiasts have also approached Jairam Ramesh, who is said to have
expressed this to the UP chief minister through a letter, written on
Friday. An official said since the Minister's note is just a
suggestion, the state government will see what best can be done.

Sources in the Forest department said the state government wants the
renaming to be done at the earliest.

"We have been asked to prepare the proposal in the next two months.
Earlier, it was also thought that the park would be renamed after
former BSP leader Kanshiram but since Ambedkar has been a national
leader, his name sounded more appropriate," said an official, who
looks after the management of the park.

The upper castes, it seems, are not the only ones who discriminate
against Dalits. Three Dalit men in Rajasthan were fined R15,000 each
by their Muslim sarpanch (village headman) for drinking water from a
public tap on Wednesday evening in Randhisar village, 90 km from
Bikaner town in the northwestern part of the state. The trio, Beer
Balram Meghwal, Sattu Ram and Nandu Ram, has lodged a police
complaint.

"We were drinking water from the public tap used by our Meghwal
caste," Beer Balram said. "Gheesu Khan (another villager) was filling
his pots nearby. Some water splashed on to his pots and he started
fighting with us. He then called the sarpanch, Gope Khan, who fined us
R15,000 each."

When the Dalit community protested, some members were allegedly
roughed up by Gheesu Khan and his cohorts. There are around 200
families in the village from the Rajput, Muslim and Meghwal
communities.

Police have been deployed in the village to defuse tension. Bikaner
Superintendent of Police Habib Gouran said cases had been filed
against Gheesu Khan, Khanu Khan, Ramne Khan and Ghulam Khan.

"It is unfortunate that 63 years after Independence we are have not
been able to bring about equality in society," Bikaner MP Arjun Ram
Meghwal of the BJP said. "The sarpanch should be punished. I will
raise this issue in Parliament."

Despite several attempts to contact him, the sarpanch could not be
reached by Hindustan Times.

Hyderabad, Oct. 16: Mahishasura is usually seen as a cruel demon
killed by Goddess Durga, but Dalit research scholars of Osmania
University have strongly opposed this saying that he was actually a
Dalit king killed by Aryans.

The scholars have urged the Dalit community not to celebrate Dasara
since it lauds the killing of Mahishasura and portrays him as a demon.

In fact, activists of Dalit Shakti have decided to make Mahishasura their icon.

They put up a larger-than-life cutout of Mahishasura in the OU campus,
garlanded him and also offered prayers.

Dalit Shakti has also decided to oppose Diwali celebrations in the
present form and is getting ready to explain the "real" story behind
it to the masses.

The subdued, mature response by all manner of people and organisations
to the recent Lucknow High Court verdict on the six-decade old
Ramjanmabhoomi-Babri Masjid dispute has been rightly read by political
commentators and media pundits alike as sign of a new India's desire
to move beyond divisive politics to more progressive, development-led
agendas.

And it seems the desire to 'move on' has been particularly strong with
India's young population for some time now. The country's young
demographics, over 65% of the population under the age of 35, is our
biggest calling card, not just in terms of achieving the much avowed
global economic stardom, but critically the nature of polity that we
ultimately become.

Let's look at some proxy indicators. A massive survey of India's youth
last year by the National Council of Applied Economic Research for
National Book Trust throws of some very interesting findings. The
survey takes the National Youth Policy's definition of 13-35 years as
youth. The survey, undertaken as part of the National Youth Readership
Survey 2009, interviewed over 3,11,431 youth in 432 villages and 199
cities/towns, the biggest by any survey so far. The survey results are
for literate youth, who constitute around three-fourths of 459 million
youth in the country.

Lest we assume that we're now a country of atheists or 'non-religious'
young people, the survey says that a overwhelming proportion, over
three-fourths, of India's literate youth (333 million) said they were
religious, with the count of atheists at 2% and non-religious at 15%.
These numbers are roughly similar across gender, faith, cities and
villages and level of education.

But it seems being 'personally religious' (the specific question was
"Irrespective of whether you attend religious services, would you say
you're a religious person?") does in no way come in way of embracing
progressive thoughts and rejecting dogmatism.

Under 1% of literate youth in the country is associated with any
political party as a member, lower than memberships for apolitical
organisations like self-help groups and youth clubs. The study trashes
the 'fairly competitive and intense student politics at the university
and college level', as non-representative of 'the political
orientation of the literate youth in India'. After all, only a third
of all 333 million literate youth in India are students, and less than
one in ten literate youth go to colleges for higher education, so
indeed why should 'students politics' in big cities based colleges be
marker for all youth in the country!

Clearly, Indian youth and not political creatures in the sense of
belonging to one group or the other, or espousing one ideology over
another, but that doesn't mean they're apolitical. Far from it. Over a
third are interested in politics, higher than the proportion that
shows interest in fashion. And a high number (72%) is interested in
news &amp; current affairs making them aware citizens.

A large majority (67%) of literate Indian youth support reservation
for women in Parliament and state assemblies. And around half are
aware of developmental programmes like NREGA and Sarva Shiksha
Abhiyan, pointing to a growing trend towards supporting gender &amp;
economic inclusiveness.

Importantly, even while two-thirds of India's literate youth fall in
the SC/ST/OBC category, the proportion that support the current
caste-based reservation in higher education is under half (47.7%). And
this, even when unemployment remains high (around 10%) amongst
graduate/post-graduate youth. What this points to is a losing traction
for caste-based politics of the Mandal kind that tore through the
country's social fabric in the early 1990s. However, a caveat here is
in order. The NCAER-NBT survey is for a period in time (2009) and we
don't have time series figures to compare it with, 1990-91 for
instance, the year of the anti-Mandal agitation against OBC
reservation. Nonetheless, available anecdotal evidence suggests that
indeed caste-based reservation is losing its potency to rally people,
for or against it.

What is also important to bear in mind is that a large part of
literate Indian youth (75%) still lives in a joint-family, with around
three generations under one roof. With conformism a social behaviour
even with young people in India, undoubtedly, the general
family/elders view has a bearing on the youth's responses and
opinions. In that sense, what the youth of India is articulating here
points to a vastly changed India. And that, in a sense, proves that we
as people are surely moving away from the bitterness, insularity and
parochialism of the past, and for the better.
