[ZESTCaste] Anna Episod: A way to introduce SC/ST reservation Bill in parliament

          Tomorrow the Indian parliament will discuss the Jan Lokpal Bill prepared by a group of civil society. As we all know that the UPA government could not pass the SC/ST reservation Bill-2008. Now dalit society should prepare a reservation bill and ask the government to pass it in parliament. Mr. Uditraj can do something in this direction. Friends think over it?

Anna Hajare is being used and promoted by the organiasation that want india as Hindu Nation (Rashtra) where in King-ruler is obedient to priest-the Brahman. The way Anna hajare speaks as if he is above the govt. and gives orders to it means he is talking in the terms of Hindu Nation which RSS wants. In a Speech by ex-RSS chief Sudarshana in 2006 had said that year 2011 is important for Hindus and this statement is not of a person. It is of the organisation and that is why RSS is controlling and guiding the Anna team. Kejariwal was in the committee of BJP for reveiwing the constitution and he also was against Mandal commission it is said .

Dalits, backward castes and minorities came together against Team
Anna's Jan Lokpal Bill on Wednesday. They held a rally from India Gate
that grid-locked peak hour traffic, proposing a Bahujan Lokpal Bill.
"We will draft the Bahujan Lokpal Bill within two to three days and
submit it to the Parliamentary standing committee," Udit Raj, chairman
of the All-India Confederation of SC/ST Organisations, said.

"We want our representative in the lokpal committee as and when it is formed."

"We neither support Team Anna's draft nor the government's draft of
the Lokpal Bill," he said. "While the former will make the lokpal
authoritarian, the government draft is very weak."

Confederation member Indira Athawale said, "This civil society (Team
Anna) comprises people opposing reservation. Moreover, they want to
create a lokpal that would be over and above the Constitution."

The Madras High Court Bench here today dismissed a writ petition
against a circular issued by the Central government to banks that
provided for reservation /concession for Scheduled Caste, Tribal and
Other Backward Class people in the absorption of temporary employees
in jobs such as messengers/sweepers.

Justice S Manikumar dismissed the petition filed by S Valayapathy,
Executive Member of the All India Indian Overseas Bank SC/ST Employees
Welfare Association.

"It is unfortunate that the petitioner himself, being the Joint
Secretary of the Central and State government SC/ST Employees Welfare
Association also, had chosen to file the writ petition" (and attempted
to prevent others getting employment), he said.

Justice Manikumar also ruled that the petitioner had no locus standi
to file the writ petition as he had not been personally affected by
the impugned order nor had his fundamental rights been directly or
substantially invaded.

The contention of the petitioner that his promotion would be affected
if temporary workers, who belonged to SC/ST and OBC category were
absorbed as employees in jobs such as messengers and sweepers, "was
misconceived," he added.

"The temporary workers being absorbed are not going to be stumbling
blocks for the petitioner to go up the ladder as per the regulation.
They are lower level posts. To say that they would affect the
petitioner's chance of promotion is not right," he said.

Besides, chances of promotion was well settled in law and was not a
right that could be enforced in a court of law, Justice Manikumar
said.

The impugned circular was issued on Feb 17 of this year. The
petitioner had said he joined as a typist and was now a clerk and if
the recruitment was made through the impugned circular then it would
block his entire promotion avenue.

NEW DELHI: The Concerned Citizens of India for Social Justice has
called upon the government to include the representatives of
Scheduled Caste, Scheduled Tribe, Others Backward Class and Minorities
in formation of a comprehensive Lokpal Bill.


"Government's version "Lokpal" and Team Anna's "Jan Lokpal" have short
comings and draconian clauses. They need to be debated" it said.

In a Joint Statement Concerned Civil Societies said that a concerned
citizens belonging to SC/ST/OBC and Minority communities, they thought
that a Lokpal Bill must propose a Lokpal, consisting representative
member from SCs, STs, OBCs and Minority religious communities.

They said that the presence of the representative of SC, ST, OBC and
minority communities is important because the caste prejudices of the
members would work against the weak and vulnerable in the process of
their work as public functionaries.

"Even the members of the Lokpal are subject to such caste and
religious prejudices" the statement said.

"Within the Lokpal there should be checks and balances. As we are
aware that in this country caste and religion is important agencies
that aid and abet corruption and also checkmate it. It is, therefore,
important that the Lokpal should have members coming from the SC, ST,
OBC and Minority communities to balance it with a principle of social
justice".

The Government Bill proposes that the selection committee will consist
of 5 members of which 3 will be the Government nominees and 2 will
come from the civil society. In effect the Government selects the
Lokpal. "This method of selection must change".

The concerned civil societies, totally disagree with selection
committee recommended by the Government and also Team Anna. 'They do
not represent SC/ST/OBC and minorities and the bill will be bias to
address the corruption based on social and justice'.

They said that while accepting the conditions of looking at the
integrity aspect of individuals being drawn into the Lokpal, the
social justice principles must be followed in Lokpal as well as the
Selection Committee.

The concerned civil societies also objected Team Anna's absolute claim
of civil society representing whole nation. "The supporters are upper
caste, middle class and elites, who do not represent 85% of SC/ST/OBC
and minorities. Such movement is threat to Indian secularism and
democracy".

The signatories include Dr. Udit Raj– National Chairman of All India
Confederation of SC/ST Organizations, Prof. Kancha Ilaiah - Director
for the study of Social Exclusion and Inclusive Policy, Maulana Azad
National Urdu University, Hyderabad, Dr. Joseph D'souza, President of
All India Christian Council, Dr. John Dayal – Member of National
Integration Council, Vidhya Bhushan Rawat – Director of Social
Development Foundation, Sunil Sardar – Director of Truth Seeker
International and Madhu Chandra – Spokesperson of North East Support
Centre & Helpline

Mumbai: A delegation led by Republican Party of India (A) president
Ramdas Athawale met Maharashtra Governor K. Sankaranaryanan yesterday
and demanded that some places be reserved for weaker segments of
society in self-financed private universities.

The delegation told the Governor that the Self-financed Universities
Bill recently passed by the Maharashtra Legislative Assembly did not
provide for constitutional safeguards to the weaker sections,
including Scheduled Castes (SC), Scheduled Tribes (ST), Vimukta Jati
and Nomadic Tribes (VJNT) and other backward classes (OBC), guaranteed
by the Constitution of India.

Athawale demanded private and unaided universities should ensure
reserved spaces for the weaker sections of society, as the provisions
of the Maharashtra Universities' Act 1994 also did not reflect this.

The new bill is meant to promote higher education and encourage
participation by the private sector in setting up self-financed
universities in the state. This step has been taken by other states
like Punjab, Haryana, Himachal Pradesh, Assam, Gujarat and Karnataka.

Pressure

Though this move will not put a financial burden on the state
exchequer, Athwale earlier alleged that the passing of the bill in
haste indicated that the state government was working under the
pressure of education barons and industrialists.

Many politicians of Maharashtra are education tycoons who have built
an empire but there remains a shortage of seats in medical,
engineering and technical courses. This forces students to pay very
high prices to be admitted.

The delegation also told the Governor that the decision-making
authorities of the self-financed universities including the governing
body should have representation of SC, ST, and OBCs.

Athawale also wants private universities to be brought under the
control of the University Grants Commission and Human Resources
Development ministry.

Newly-married inter-caste couple are finding themselves at odd due to
non-implementation of an incentive scheme run for them by the Social
Welfare Department (SWD), Warangal.

On May 16 this year, the state government had hiked the cash incentive
for inter-caste marriage from ` 10,000 to ` 50,000 through a GO.

Under this scheme, a marriage between two lower castes or between one
high caste and another low caste would still be eligible for the
incentive, which can be claimed on production of a marriage
certificate and photograph to SWD.

However, dalit organisations, particularly the local chapter of
Buddhist Society of India and SC/ST District Vigilance and Monitoring
Committee members, said that incentive remains on paper due to lack of
budgetary allocation to the SWD.

According to Thipparapu Laxman, member of SC/ST District Vigilance and
Monitoring Committee, 216 applications for grant of incentive to
inter-caste couple are pending with the social welfare department in
Warangal. "I had raised the issue of non-implementation of the
incentive scheme in the last meeting with officials, but to no avail
even though only ` 10,000 per couple has to be paid under the old GO,"
he said, while expressing doubt over the incentive payment to the
newly- married inter-caste couple under the new GO.

As family members of inter-caste couple often shun them for breaking
the caste barriers, Dalit leaders want the government to treat their
cases on a priority basis. "Earlier, such couple were given jobs and
house plots, but now they are given only cash incentive but no
priority is being given to release the amount despite the fact that in
inter-caste marriage, the couple set an example for others in the
society," said Bommala Kattaiah, state president, Buddhist Society of
India.

New Delhi : India Gate on Wednesday witnessed a protest that was
against activist Anna Hazare and his version of the Lokpal Bill.

Udit Raj of the All India Confederation of SC/ST Organisations, who
led the protest, demanded a specific anti-graft law for backward
communities. The rally he led wanted to present a draft of the Bahujan
Lokpal Bill to Prime Minister Manmohan Singh.

The rally, which stalled traffic at India Gate and Connaught Place,
demanded that the Prime Minister listen to their issue.

"Of course there is rampant corruption and price rise. But the fight
against it should not undermine the Constitution drafted by B R
Ambedkar," Udit Raj told mediapersons.

Citing his differences with Hazare's agitation, he said: "There are
difference of opinions between what their (Anna Hazare) and our Bill
seeks. We are afraid that in future, people like Anna Hazare can ask
the government to do away with reservation under the threat to commit
suicide or fast-unto-death. This is unacceptable."

The rally took off from the Amar Jawan Jyoti around 5 pm with
protesters carrying photos of Dr Ambedkar.

Madan Gaura, a Class IV government employee who had a flag wrapped
around him, said: "I have one question for Anna Hazare. Why is he
targeting only the three pillars of democracy — the Nyaypalika,
Karyapalika and the Vidhaikpalika (the Judiciary, Executive and
Legislature)? Why is he not including media under the purview of
Lokpal? Is media not corrupt?"

Udit Raj told the gathering that NAC member Aruna Roy was supposed to
address them, but could not join them. He later claimed that the Prime
Minister had agreed to meet four representatives with their demand for
a Bahujan Lokpal Bill, inviting applause from the people.

Traffic congestion was reported in Connaught Place area as the rally
went off route.

Instead of going straight to Parliament Street, the protesters went to
Connaught Place instead, where the Udit Raj supporters lay down on the
road, blocking traffic. Vehicle movement was affected for around 45
minutes.

The situation became tense as a dozen of Anna supporters on
motorcycles tried to disrupt the rally. The police sent them back and
controlled the situation. The rally then went on further to Jantar
Mantar.

Mangalore, Aug 24: The dalits created uproar at the Mangalore taluk
panchayath meeting hall for not beginning the meeting on the said time
on Wednesday August 24.

The meeting was scheduled to be held at at 10.30 am to discuss the
progress of grants allotted to SC and ST, however the meeting did not
start even till 11.45 am.

Furious at this sluggish attitude of the concerned, the dalits
boycotting the meeting shouted slogans against Mangalore tahshildar
and taluk social welfare officer in front of the Taluk Panchayath
office.

As per the Government record the time was mentioned as 10.30am. But
dalits were informed the timing as 11 am and accordingly they came to
the meeting at 11 am. But president of the committee and vice
president did not turn up. Social welfare officer Reddy said that
tahshildar will arrive in 10 minutes and the meeting can be started.
They waited till 11.45am and the tahshildar did not turn up.

The Dalits lamented that if the meeting was started late they would
not be able to put forth all their grievances. The meeting is convened
once in three months, yet the officers show negligible attitude. Later
though tahshildar arrived did not speak to dalits, instead
straightaway went inside the meeting hall. However the dalits were
sturdy in their decision and told they do not want to take part in the
meeting.

Justifying himself later, the tahshildar Ravichandra Nayak said that
as per the direction given to him by the DC he had gone on another
emergency duty. By the time he left from the work, it was late. He
also apologized for the inconvenience but everything went in vein as
hundreds of dalits returned home with their application and issues.

New Delhi In the unseen and unheard margins of Team Anna's Ramlila
Surge, there's a growing sense of disquiet —especially among minority
and marginalised groups.

Despite carefully choreographed images of Muslim children publicly
breaking their Ramzaan fast with Anna Hazare, prominent Dalit, Muslim
and Christian leaders are deeply suspicious of the faces on display
and the voices emanating from the crowds.

They argue that Anna's ends — fighting corruption — is undoubtedly
justified, they condemn his arrest and the decision to send him to
Tihar Jail. But behind his cause, they see a clear disdain for the
very institutions crucial in safeguarding democratic freedom and
rights. In Team Anna's contemptuous indictment of Parliament, they see
a tarring of representative politics and, in effect, an indictment of
the vital safeguards of minorities.

In fact, so strong is the suspicion that even Prashant Bhushan's
left-liberal credentials as one who played a proactive role in the
Gujarat riots cases isn't dispelling these fears. Varun Gandhi's
much-hyped appearance at Ramlila today only reinforced these — in his
hate-Muslim election speech in 2009, he had threatened to "cut the
hand" of anyone who "raises a finger at the Hindus."

Says Akhtar-ul Wasey, Director, Institute of Islamic Studies, Jamia
Millia Islamia: "The issue of corruption is such that there's
tremendous pressure to join the crowd. Because if we oppose this
particular movement, they will say we are corrupt. Price rise,
corruption and unemployment have given a fillip to such forces.
Corruption ki aarh mein, (in the garb of corruption) they want to push
all kinds of defeated and empty slogans and agendas. Now the
government's timidity in the face of a crowd is fanning this
instability. Muslims, of course, want corruption to end but don't want
to make common cause with elements that want to rock the system, the
only preserve of our rights and freedoms."

No wonder that Deoband's new Mohtamim, Maulana Abul Qasim Nomani, has
said that they have not supported this movement: "The movement is
basically suspect. The security and protection of Parliament and (to
honour the) glory of democracy is the duty of every citizen."

Mahmud Madani, MP and a leader of the Jamiat Ulema-e-Hind, the only
prominent Muslim face among the 20 founders of India Against
Corruption — Team Anna's virtual platform — is now in Saharanpur and
practically in communicado. Zafaryab Jilani, member of All India
Muslim Personal Law Board, has made it clear that the Board has
nothing to do with this agitation. Says Maulana Ahmed Khizar Shah
Kashmiri of the Tanzeem Ulema-e-Hind: "The idea behind this campaign
is to weaken Parliamentary system and democracy and this is a blow to
secular India."

Maulana Umer Ilyasi of the India Imam Organisation has called the
campaign a "political conspiracy" saying: "There is no question of any
one person being above the country's Constitution and Parliament.
There is no question of Muslims being part and parcel of this."

This chorus is heard the Urdu press as well. The Mumbai, Kanpur,
Bareilly, Lucknow and Delhi-based Inquilab on August 17 interviewed
several prominent community leaders, including chief of the
Jamat-e-Islami, Maulana Jalaluddin Umri. Their refrain: We agree with
the need for a strong Lokpal but not with the method of pushing it
through.

Critics are also wary of those who have clambered aboard the Anna
bandwagon. Ramdev may have stepped back but there are questions about
the more urbane Sri Sri Ravi Shankar and his Art of Living and youth
factions who shared the stage with the anti-reservation Youth for
Equality. Less than 10 days ago, they took part in the Hindu Unity
Day, in Texas. Also present was Subramaniam Swamy, most recently in
the news for writing that Muslims should be denied voting rights if
they do not accept their "Hindu legacy."

Indeed, reflecting this unease, Dalit activists and writers including
Udit Raj, Kancha Ilaiah, John Dayal and Joseph D'Souza, have argued
for reservation in the Lokpal set-up for SC/STs, OBCs and minorities
"to ensure that there is no injustice done to the backward and
marginalised."

The politics of Arvind Kejriwal and Kiran Bedi may be fuzzy but their
association with certain "causes" has raised questions, too. Last
year, Kejriwal and Bedi herself led the drive to target the Chief
Information Commissioner and insist that Bedi be made the CIC. In
fact, when then CIC Wajahat Habibullah resigned last year and there
was a chance that M M Ansari (now Kashmir interlocutor) would take
over, Kejriwal lobbied with Leader of Opposition L K Advani keen to
ensure that his name not be accepted.

Kejriwal and Bedi have also shared platforms put up by Youth for
Equality and Art of Living. On March 1 in 2009, for example, Kejriwal
and Bedi addressed the Youth for Equality and talked of both terrorism
and corruption. Youth for Equality has blamed reservation for
shrinking opportunities.

Archbishop of Delhi Father Vincent Concessao, a founder-member of the
IAC, is nowhere to be seen. Contacted, he told The Indian Express:
"This is pressure and a fast unto death is suicidal...there is no way
we will allow for our established Parliamentary practices to be
bypassed. We are with the issue but not with the means. How can they
say only one particular version of the Bill is to be followed?"

Chennai, August 24 (TruthDive): Anna Hazare effigy was burned by an ex
Congress MLA and supporters of Dr Ambedkar citing that the Gandhian
was subverting the Indian constitution created by their leader. Ex
Congress MLA and party functionary Ku Selvathanthai along with members
of the apex body Ambedkar Desam of all pro Ambedkar organizations
turned up near the statue of their leader near the Nehru stadium and
burned the effigy of Anna Hazare. They shouted slogans saying that the
constitution framed by their revered leader to protect the oppressed
classes was being subverted by upper class led agitation.

The supporters then garlanded Dr Ambedkar statue and marched away.
They pointed out not a single Dalit was in the panel for drafting the
Jana lok Pal bill. They termed it as an upper caste agitation. While
effigy of Manmohan Singh are burnt elsewhere the novel protest from
Dalits evoked curiosity. As reported earlier Christian- Muslim
organizations have kept away from the fast. Shiva Sena Chief Thackeray
asked Anna to hand over the baton to Kiran Bedi and other team members
to carry on the protest.

The Kollywood protest too had only Suriya and Arjun from the actors
while it was mostly directors and producers of yesteryears who took
part in the one day fast. Superstar Rajnikanth in an email supported
Anna for his non violent movement against graft. Three thousands
students in Chennai marched towards Rajaji Bhavan without disturbing
traffic in support of Anna.

The AIADMK ministry is playing a cat on the wall. Police booked the
organizers who held the first Anna support movement in Chennai for
violating rules like not getting permission etc. Now it is just a mere
onlooker.

A day after the All India Confederation of SC, ST Organisations
(AICSO) asked Dalits to keep away from Anna's agitation, parties
identified with Dalit politics dubbed the movement as anti-backward
classes and anti-reservation.
While the Dalit protest was unfolding at India Gate, a
corruption debate in Parliament turned into one on 'protection of reservations'.

In Rajya Sabha, LJP leader Ram Vilas Paswan said Hazare's campaign was
raising doubts and concerns among Dalits and minorities.

"People from SC, ST and OBC communities are afraid if similar
movements will be launched to take away reservation and other benefits
provided to them by the Constitution."

Paswan's concern found chorus in Lok Sabha where BSP leader Dara Singh
Chauhan said Dalits had been left out of the Lokpal Bill. "We will not
allow tampering of the Constitution," Chauhan said, adding,
"discrimination against Dalits is also a form of corruption".

AICSO took out its 'Save Constitution' rally against the Hazare
campaign. Udit Raj, chairman AISCO said the rally was to protect the
constitutional safeguards for SC/STs, which, he alleged, Team Anna was
trying to "dismantle".

"It is being propagated that the nation is with Anna. Then, how is it
possible that out of nearly 85% population constituted by Dalits and
OBCs there is none in their company," Raj said.

The organisation points to the involvement of Youth for Equality, an
organisation opposed to reservations in central educational
institutions, in the Hazare campaign.

Dalit intellectuals from JNU and Delhi University criticised Hazare's
methods. "The agitation is not representative, both caste and issue
wise. They lack confidence in the Constitution and question
Parliament, which gave a political identity to SCs and STs," said
Vivek Kumar, associate professor, JNU.

"Our attempt is to inform the nation about the real intentions behind
the corruption camouflage used by Team Anna."

"There are no honest people there. This movement is latently against
reservation and the interests of other backward classes," Raj added.

Dalit woman raped in UP

Rampur(UP), Aug 25 (PTI) A Dalit woman was allegedly murdered after
being gangraped in Shabhad tehsil of Rampur district, around 60
kilometres from here, police said.
The victim''s half clad body was recovered from a field on Wednesday,
they said, adding, the post mortem report has revealed that she was
murdered by strangulation.
Neeraj alias Geeta, wife of Sanjeev, who was a state appointed
''Asha'' in the village, was returning along with her husband after a
medical check up, when six persons, equipped with fire arms, abducted
them.
The miscreants looted mobile phones of the couple besides Geeta''s ear
rings, they said, adding, the group later tide Sanjeev with a tree,
before raping her.
As soon as the report of the incident reached divisional and district
headquarters, Inspector General Police M K Bashal visited the site.

NEW DELHI: A group of about a thousand Dalits on Wednesday gathered at
India Gate and marched to Parliament Street to protest against the Jan
Lokpal bill proposed by Anna Hazare and his team.

The protesters, led by Indian Justice Party president Udit Raj, under
the banner of "Samvidhan Bachao" (Save Constitution), shouted slogans
against Team Anna and said they would not allow anyone to "tinker"
with the Constitution.

The protesters blocked traffic on the India Gate roundabout for half
an hour saying they won't allow anyone to pass till there was some
communication from the Prime Minister. Udit Raj said, "I have been
writing to the Prime Minister to get an appointment but we never got a
chance. On the other hand, ministers in the government go to the
airport to talk to Ramdev and they are negotiating with the Anna team.
We are denied because we are Dalits."

He said they are against the bill on corruption, pointing out that "no
SC/ST member is part of the panel which is not giving any priority to
the minorities." Lashing out at the bill proposed by Anna and his
team, Udit Raj alleged that the Jan Lok Pal bill has been designed in
a manner which would enable it to target Dalit and Muslim officials.

The protest march resulted in long snarls around India Gate. Similar
jams were reported on Ferozeshah Road, Barakhamba Road and all roads
close to Connaught Place and Mandi House.
