Census question over caste identity divides India

TIM SULLIVAN | May 27, 2010 07:25 AM EST |

NEW DELHI — Bollywood's biggest star has an answer ready if census
workers ask about his caste: "Indian."

"My father never believed in caste, and neither do any of us," Amitabh
Bachchan wrote in his obsessively followed blog.

Comments like Bachchan's are common in modern India, which prides
itself on how it has transcended some of its most rigid traditions –
and those beliefs are being heard more often as the government debates
whether the national census should delve into caste.

But Joseph D'Souza doesn't believe such talk for a moment.

"There's a lot of lip service to saying 'I'm an Indian first,' and 'I
don't believe in caste,'" said D'Souza, a prominent campaigner for
dalits, as India's "untouchables" at the very bottom of the caste
system are now known.

"When it comes to sharing power, to interaction, to sharing social
status, low-caste Indians are very much marginalized," he said,
arguing the census could provide firm data about the vast divisions.

India's census, being held in stages over the next year or so, delves
into the wealth, living conditions and other personal details of the
country's 1.2 billion people. But still undecided is one question –
"What is your caste?" – that has infuriated much of India's elite,
energized caste-based political parties and left in doubt millions of
government jobs and university slots.

Story continues below

The debate has also made very clear that caste, the Hindu custom that
for millennia has divided people in a strict social hierarchy based on
their family's traditional livelihood and ethnicity, remains a deeply
sensitive subject.

"The biggest issue (with the census) is the inability of India to come
to terms with this really ingenious form of discrimination," D'Souza
said.

Bachchan, who has dominated Bollywood for decades, proudly says his
family has married across India's vast geographic spectrum – with a
Bengali, a Sindhi, a Punjabi and a Mangalorean. But D'Souza notes that
none of those relatives are low caste and that the movie industry has
not one dalit star.

The question's fiercest backers include India's most powerful caste
politicians, who believe they could use the census data as fodder for
votes and government funding.

Its bitterest opponents include much of the establishment. "At one
stroke, it trivializes all that modern India has stood for, and
condemns it to the tyranny of an insidious kind of identity politics,"
Pratap Bhanu Mehta, a prominent Indian commentator, wrote in the
Indian Express newspaper.

The last Indian census that measured castes was in 1931, when colonial
Britain still ruled.

The founders of modern India – nearly all high caste – were, at least
publicly, staunch believers in a caste-blind society. While many would
have been aghast if one of their children had married a dalit, they
also fought hard for dalit rights.

Most felt that counting caste sizes in a census reinforced a tradition
they wanted to fade.

It's an argument still heard today.

"No one denies that there are a lot of problems in India, that there
is social discrimination," said Barun Mitra, who runs a New
Delhi-based research center. But "this process of identifying caste
with a census is unlikely to help."

Like many critics, he also worries about the rise of the caste-based
politicians.

"What purpose would it serve by drawing and redrawing the identity one
more time, particularly when it is politically motivated?" he asked.

In recent decades, some of the sharpest edges of caste traditions have
been softened by urbanization and economic growth. Inter-caste
marriages are now fairly common, and there are powerful low-caste
politicians and businesspeople.

But caste also remains a deeply felt part of Indian life. Brahmins,
the highest caste, still dominate everything from politics to
journalism. Caste-specific marriage advertisements are newspaper
staples. Studies show low-caste Indians and dalits face daily
challenges for decent schools, medical care and jobs.

"Caste is part of every social agenda, every political agenda," said
Shaibal Gupta with the Asian Development Research Institute. "Even
when someone is considering a neighborhood, caste is an important
consideration."

But caste calculations have become far more complicated, with jobs and
university slots reserved for lower castes and a new generation of
politicians learning to use their lower-caste backgrounds to create
massive vote banks.

Laws give specific breakdowns of those reserved positions, but since
the numbers are based on the 1931 census, their accuracy is
questioned. And protests have been violent as caste leaders try to
have their group's status officially lowered to be eligible for
reserved jobs and school slots.

For some opponents, complexity alone makes caste an impossible census
question. While there are just four main castes, there may be more
than 20,000 sub-castes. Then there are the sub-sub-castes, clans and a
multitude of other variations.

But for proponents like D'Souza, such arguments prove the necessity of
the question. In a country where caste is so important, he asks, how
can India not know the facts?

"You can't hide it and put it under the carpet and say caste is not
there," he said.

[ZESTCaste] Orissa to open special courts for ST & SC atrocities cases

http://www.dnaindia.com/india/report_orissa-to-open-special-courts-for-st-and-sc-atrocities-cases_1388184

Orissa to open special courts for ST & SC atrocities cases
PTI

Wednesday, May 26, 2010 21:03 IST

Bhubaneshwar: Under attack for huge pendency of cases related to
atrocities on scheduled tribe (ST) and scheduled caste (SC)
population, Orissa government today decided to set up three special
courts to expedite justice to the victims.

"Three special courts will soon be set up at different places to
dispose cases registered under Protection of Civil Rights Act, 1955
and SC & ST (Prevention of Atrocities) Act, 1989," chief minister
Naveen Patnaik told reporters after a state level high power vigilance
and monitoring committee.

The state level committee's meeting was held after a gap of two years.
As 2009 was an election year, the state government could not hold the
meeting last year.

While directing the police to expedite probe into such cases, Patnaik
said district welfare officer and the collector would be held
responsible for not holding monitoring committee meeting regularly.

While the Orissa State SC & ST Youth and Students Council claimed that
about 10,700 cases of atrocity on ST and SC people were pending for
disposal, the state government said 614 cases were pending in courts
by end of 2009.

While 6136 cases under SC ST PoA Act was registered in Uttar Pradesh
followed by 4174 in Rajasthan, only 1355 cases could be made in
Orissa, said SC & ST development and minorities minister Bijay Ranjan
Singh Bariha.

The minister, however, claimed that low disposal of atrocities cases
were due to lack of special courts for the ST and SC people besides
inadequate number of deputy superintendent of police rank officers in
the state.

"We have been seeking a provision for allowing inspector rank officer
to probe into the atrocities case instead of DSP rank officers,"
Barhia said.

This apart, the state level high power vigilance and monitoring
committee also decided to launch awareness campaign among the ST and
SC populations so that more cases could be registered in the state.

As Orissa has more than 22 per cent of ST population, the committee
recommended translation of the acts into 10 major tribal dialects so
that the people could be made aware of their rights, the minister
said.

"Legal aid cells will be opened in each block to help the victims in
getting support from government," the chief minister said adding
awareness was the key to bringing down atrocities on the ST and SC
population in the state.

A toll free number (155335) was also installed at the state capital to
receive complaints on ST and SC atrocities, an official said adding
that 37 cases were registered through free telephone facility within
two days.

[ZESTCaste] Scheduled Caste candidates reserve date in IIT history

http://www.dnaindia.com/mumbai/report_scheduled-caste-candidates-reserve-date-in-iit-history_1388294

Scheduled Caste candidates reserve date in IIT history
Mihika Basu / DNA

Thursday, May 27, 2010 1:17 IST

Mumbai: Probably for the first time ever, seats reserved for Scheduled
Castes (SCs) in various centres of Indian Institute of Technology
(IIT) will be filled up from the word go.

This became evident after the joint entrance examination (JEE) results
were declared on Wednesday.

The IITs, this year, will not have to prepare a separate preparatory
list for SC candidates as the number of successful candidates is more
than the available seats reserved for the SCs.

Preparatory list includes those candidates who did not score enough in
the JEE to make it to the reserved seats and are given further
relaxation on the grades so that they could be put through training
and admitted to the IITs to fill the quota.

"To my knowledge, this is probably the first time that we have not had
to prepare a preparatory course list for SC candidates," said IIT
Bombay director Devang Khakhar."This year, we have more SC candidates
qualifying than the number of seats available." IIT Madras director,
MS Ananth, concurred with him that this could be a first.

SC/ST candidates along with students with physical disabilities (PD)
get 50% relaxation from the general category candidates.

A further 50% relaxation is given to those who do not qualify so that
they can be sent for the preparatory course. In 2009, a little over
1,000 SC and ST seats had to be converted to the preparatory course as
not many could qualify.

All the IITs, IT-BHU and ISMU-Dhanbad conduct a one-year preparatory
course for SC/ST/ and students with physical disabilities who do not
make it to the common or the reserved category merit lists.

This year, of the 42,800 SC candidates who appeared, 1,773 have
qualified to seek admission to 1,426 seats, ie 15% of the total number
of reserved seats — 9,509.

Of the 1,773 SCs, around 120 made it to the common merit list. The
remaining 1,653 qualified for the reserved seats after the prescribed
relaxation of 50%.

Kanishak Kataria, with an all-India rank of 44 topped the SC category.
(From IIT Bombay zone alone, 404 SCs qualified, of which 22 got into
the general category and 382 made it to the reserved seats.) In 2009,
only 967 SCs had qualified all over India. Another 473 SCs qualified
for the preparatory course.

As far as ST candidates are concerned, of the 15,975 candidates who
took JEE, only 517 qualified to seek admission to 713 seats. Of these,
scores of 498 had to be relaxed by 50%. Another 262 have qualified for
the preparatory course.

[ZESTCaste] CASTE SPLITS CABINETOVER CENSUS PLAN

http://epaper.mailtoday.in/epaperhome.aspx?issue=2752010

CASTE SPLITS CABINETOVER CENSUS PLAN

By Sowmya Aji and A. M. Jigeesh in New Delhi

Quota brigade claims Group of Ministers route is adelay tactic

THE Union cabinet which met on Wednesday is said to be divided on
caste lines over the politically- sensitive issue of a caste- based
census in the country.

The UPA government, in an effort to buy time and paper over the cracks
on the issue, has referred the matter to a group of ministers ( GoM).
This is ostensibly to decide when to take up such a census across the
country.

Law minister M. Veerappa Moily's belief that the cabinet " has a
majority" in favour of the caste census — his is the main voice behind
the move for a caste census — appears to have been belied.

A senior minister said, " The Congress is committed to caste census,
so it should happen. But there was a division of opinion, and
ministers from the forward castes were not in favour of the caste
census." However, some cabinet ministers tried to play down the
differences.

One minister said, "There was consensus at today's (Wednesday's)
meeting. It is standard practice to send major decisions to a group of
ministers to work out the modalities and then implement the decision
properly."

There was an immediate reaction from the quota brigade — the Yadav
chieftains from the Samajwadi Party (SP), the Rashtriya Janata Dal
(RJD) and the Janata Dal (United) or JD(U) — who condemned the cabinet
decision as a delaying tactic.

SP vice-president Brij Bhushan Tiwari said, "The Congress and the UPA
government are not keen on a caste census. The cabinet discussed the
issue at two meetings and could not take a decision. The decision to
send the matter to a group of ministers is a ploy to delay the
census."

Sources said arguments for and against flew thick and fast on
Wednesday. Moily gave voice to those favouring the caste census and
home minister P. Chidambaram to those against. According to sources,
Moily, social justice minister Mukul Wasnik and power minister Sushil
Kumar Shinde spoke out strongly in favour of including caste in the
census. But Chidambaram put forth all the logistical arguments against
it, and he was supported by sports minister M.S. Gill, science and
technology minister Kapil Sibal and commerce minister Anand Sharma,
sources said.

Some ministers from the forward castes who backed the case for a caste
census did not speak up, according to sources. Meanwhile, several
backward classes ministers including the two DMK ministers M.K.
Alagiri and A. Raja, were not present, the sources said. Senior UPA
allies like Mamata Banerjee of the Trinamool Congress and Sharad Pawar
of the NCP did not attend the meeting.

Finance minister Pranab Mukherjee reportedly played the role of
peacemaker at the meeting. Sources said that he suggested the escape
hatch of a GoM and placated Moily by stating this group would decide
"at what point in the process of census the caste question should be
introduced."

Prime Minister Manmohan Singh reportedly nodded his assent to this
suggestion. The argument is that caste can be included in the other
stages of the census that is planned, like biometric identification
and the awarding of the unique ID, which is likely to continue well
into 2011.

A cabinet note on the subject makes the divide clear as it refers to
Moily's letter to Prime Minister Manmohan Singh on August 6, 2009
seeking a caste census as well as the objections from the Registrar
General and Census Commissioner, which comes under the home ministry.

Quoting from Moily's letter, the note says, " Unless the reservation
is based on precise and credible data, it may negate the social
justice spread to the weaker sections of the society. In the absence
of any other comprehensive survey, census alone can collect the caste
particulars." The census commissioner's note says, " The population
census is not the idea instrument for collection of caste details. The
operational difficulties are so many that there is a grave danger that
the basic integrity of the census data may be compromised and the
fundamental population count itself could be distorted." Tentatively,
the GoM will be headed by Mukherjee with Moily, Chidambaram and
defence minister A. K. Anthony as the other members.

The caste divide in the cabinet, however, appears to reflect Congress
strategy to ensure that the party does not lose its support base among
the upper castes — according to political observers, these castes will
suffer if the caste census takes place.

However, such a census is likely to benefit parties that derive their
strength from the OBCs, like the Bahujan Samaj Party ( BSP), the SP,
RJD and JD ( U).

Another view is that the Congress wants to hold on to the promise of a
caste- based census till the BSP, SP, and RJD — which support the UPA
from outside — support the government on Nuclear Civil Liability Bill.
If such support does happen, the caste- based census could be the "
reward". JD ( U) president Sharad Yadav, another vocal votary of the
caste census, said, " The Parliament had unanimously supported the
idea of a fresh count of OBCs in the country. The Prime Minister
assured the Houses that the government will do it. I don't understand
why the cabinet decided to delay it further." The RJD was still
hopeful.

Senior MP Jabir Husain said the matter had reached a point that the PM
would not be able to " go back on his assurance deviate given to
Parliament on the issue". The BSP was harsh in its criticism. " The
government doesn't want Indians to know about Indians. They want to
keep many Indians in darkness," senior MP Rajan Ambeth said.

There was also confusion on the ground. The door to door enumeration
process in the census has already begun and enumerators are asking for
caste details in some areas and not seeking this detail in others.
