Shocking UN report on human rights defenders in India

The UN Special Rapporteur on Human Rights Defenders Ms. Margaret
Sekaggya has released a report with a strong focus on the dire
situation of Dalit human rights defenders, following her 2011 visit to
India.
Ms. Margaret Sekaggya has devoted a sub-chapter of her report to
stressing the unacceptable situation faced by Dalit human rights
defenders due to threats and serious human rights abuses based on
caste discrimination and failing systems of justice. "Dalits' rights
activists strive for the promotion and realization of Dalits' civil,
political, economic, social and cultural rights. The range of human
rights violations they suffer is appalling," writes the Special
Rapporteur.

During the 19th session of the Human Rights Council, on 7th and 8th of
March 2012, two side events will be held on the report. One is
focussing on human rights defenders with regard to tribal and labour
rights, The North-East of India, corporate accountability in Orissa
and the situation of Dalits. The other one focuses on Dalit human
rights defenders.

New report: Violence against Dalit women rarely punished

The Indian organization Navsarjan Trust, in collaboration with
Minority Rights Group International, has recently released the study
'Gender Violence and Access to Justice for Dalit Women'. The report
finds Dalit women face severe difficulties in accessing justice and
are extremely vulnerable to violence, sexual abuse and other
atrocities.

"If it is a crime to be born a woman in society, it is a bigger crime
to be born a Dalit woman. This, at least, is what a study by human
rights organisation, Navsarjan Trust, says.
While women are normally considered to be vulnerable to atrocities,
women belonging to Scheduled Castes (SC) and Scheduled Tribes (ST) are
more prone to various crimes. The study shows that it is more
difficult for Dalits to get justice in the court of law for their
traumatic sufferings.
The study indicates that in the cases of violence by non-Dalits on
Dalit women, no non-Dalit accused have been convicted so far, and in
cases of violence by Dalits on Dalit women, there have been
convictions only in six cases.

ILO report 'Buried in Bricks': wide-spread (child) bonded labour in
Afghan brick kilns

Bonded labour of adults and children in brick kilns is one of the most
prevalent, yet least known forms of hazardous labour in Afghanistan
says the ILO.
A new ILO study on the phenomenon marks the first attempt to provide a
better understanding of the dynamics of bonded labour in two provinces
of the country. The majority of the workers in the brick kilns are

Quota case: SC stays HC order

JAIPUR: The Ashok Gehlot government was saved from an embarrassment on
Monday when the Supreme Court stayed the Rajasthan High Court's last
week order wherein the state's two top bureaucrats were held guilty of
"willful contempt of the court" in the quota in promotions case.

The high court was to award punishment to chief secretary Salauddin
Ahmed and principal secretary (personnel) Khemraj in the afternoon.
However, in the morning, the apex court stayed the high court's
proceedings till March 20. At the same time, the top court also stayed
execution of the notification issued on September 11, 2011 that the
state government had been citing as compliance of the high court order
of February 5, 2010, which led to the contempt proceedings.

After this, the high court also deferred hearing in the matter till
March 26 and directed the state government to submit before it the
apex court's stay order of Monday on oath by then.

The case pertains to the legal dispute on the quota in promotions
constitutionally allowed to state government employees belonging to
the Scheduled Castes (SC) and the Scheduled Tribes (ST). Even as the
non-reserved categories employees, including those from the Other
Backward Classes (OBC) category, opposed the quota alleging that the
apex court guidelines were not adhered to, in doing so, the state
government reasoned how it has now fulfilled all the legal
requirements in granting the benefit to the SC/ST employees.

A division bench of Justice NK Jain and Justice RS Rathore, however,
rejected the state government's plea that it has abided by the high
court order of February 2010 by gathering the quantifiable data
through the Bhatnagar committee to support the quota for SC/ST
employees and, thereafter, issuing the notification of September 11,
2011. The Samata Andolan Samiti, one Bajrang Lal Sharma and others, on
other hand, moved contempt petition and alleged that the government
attempted to "overreach" the February 2010 judgment by forming the
Bhatnagar committee and issuing the notification that would protect
the "illegally promoted" SC/ST employees. The Samiti reasoned before
the apex court that as compliance of the high court judgment, the
state government ought to have issued revised seniority lists of its
employees from April 1, 1997.

The high court had summoned chief secretary Ahmed and principal
secretary Khemraj at 2 pm on Monday to hear the punishment for
contempt. But, on the basis of a special leave petition moved by the
state government against the high court's contempt order, the Supreme
Court intervened and stayed the proceedings.

'Yes, Mayawati has performed but we will not vote for her'

Despite Mayawati's role in bringing about development, caste seem to
rule supreme over voting preferences

"You must visit Shamli to know the real mood of the Jat community,"
someone told me in Muzaffarnagar. "Everywhere else you get eight karat
Jats, in Shamli it's the 24-karat ones," said another from Lucknow. So
visiting Shamli was crucial for checking the election barometer among
the sugarcane farmers of Western UP. Several questions such as how are
the Jat farmers looking at Ajit Singh's new alliance with Congress, is
reservation still an issue, how is the sugarcane business surfaced in
my mind. However, what really interested me was to know if after five
years, Mayawati has managed to gain any acceptability among the Jat
farmers—the traditional vote bank of Ajit Singh's Rashtriya Lok Dal?

The first thing that comes to mind while talking about the journey
from Muzaffarnagar to Shamli is 'pain'. Mayawati may have created a
new district for Shamli (called Prabudhnagar) but she completely
ignored the condition of the roads. Just like the roads from Kanpur to
Rae Bareli (another non-BSP bastion), these are potholed and heavily
damaged. A journey of 30 kms took us one and a half hours to complete.

Outside the Sir Shadi Lal Sugar Mill I meet a bunch of Jat farmers.
The former pradhan Kishen Pal initiates the discussion. "I will not
lie—Mayawati has indeed done many good things in the last five years,"
he says. Others nod in agreement. Pal lists out the good things done
by BSP government—prices of sugarcane was doubled to Rs 250 in two
years, a new bypass was constructed, Jat youth got employed in police
services without paying any bribe and a new district was created. But
then he leaves you surprised with his sudden conclusion: "But we will
not vote for her." Why, I ask? Ompal Singh who was constantly nodding
his head tries to answer the question. "Mere maan ka baat hai." (It's
a question of respect). I look at him inquisitively. But why, I ask?
Pal comes to the rescue armed with an answer: "Jaatiwaad hai" (there
are bearings of the caste system).

Earlier in the day I had met Rajveer Singh Mundet, a prominent Jat
leader and state president of Bharatiya Kisan Mazdoor Sangarsh Manch.
I asked him what chances did BSP had of winning from Shamli. "Not
much," he said. Why? "Look at the money she spent to built statues,"
he replied. But what about the increase in sugarcane prices, I ask?
"True she increased the prices but she also initiated a lot of
anti-farmer policies," he says. When asked to elaborate, he pointed
out towards the farmer agitation in Noida. I didn't ask him if his
opposition to Mayawati was casteist.

Coming back to my discussion with Jat farmers outside a sugar mill in
Shamli, once the issue of caste was out in the open, there were more
forthcoming with opinions. "Mayawati imposed the draconian Dalit Act,"
complained Ranveer Singh. Since the prevention of atrocities act aka
Dalit Act was brought in by Mayawati, the crime rate against Dalits
has come down dramatically. But the Jat farmers here complain that
this act is being misused against them. Pal adds another to his list
of complaints against Mayawati. "She is dictatorial. She doesn't allow
her ministers to act independently," he says.

Mayawati perhaps recognises the risk of caste being a determining
factor in elections. For once she is at the receiving end of this
social evil. BSP has fielded a number of Muslim candidates in the
area. Her rally on 24 February at Muzaffarnagar saw more Muslim
audience, a sizeable population in sugarcane belt, than the Jats. The
Jat farmers preferred to attend Ajit Singh and Rahul Gandhi's rally
across the town.

Akhilesh Yadav, president of the Uttar Pradesh unit of the Samajwadi
Party, tells Aditi Phadnis what his party's agenda will be if it comes
to power

Your party is seen as being opposed to big industries and anti-investment…
Not at all. It was during the regime of Netaji (former Chief Minister
Mulayam Singh Yadav, also Akhilesh's father) that Uttar Pradesh got
its first-ever Economic Development Council, which brought the top
people in the field into the state, including Nandan Nilekani, who was
then with Infosys, Kumaramangalam Birla and Anil Ambani. We conceded
it is possible that politicians don't understand business. So, the
Development Council was mandated with overhauling and tweaking
policies to bring investments to the state.

What we did specify was a positive bias to those industries which are
linked with the interest of farmers. So, our government set up 29
sugar mills, which could produce power from bagasse, and we exempted
them from taxes. The Tatas set up a bus plant, producing Marcopolo
buses. The Anil Ambani group set up the Rosa thermal power plant,
adding 600 Mw power with the provision of producing 1,200 Mw in the
future. It was our government that set up the Anpara-C thermal power
plant, given to Lanco, with 1,200 Mw capacity. Also, there is the
hydel power plant at Srinagar, which was given to the GVK group.

The Dadri plant could not come up because of the opportunist agitation
launched by V P Singh. Otherwise, Uttar Pradesh would have been a
power-surplus state.

During the same period, hotelier Lalit Suri suggested our government
should set up industries that involve skill development of young men
and women in the state. We thought if the state was able to set up 12
to 15 world-class hotels before the Commonwealth Games, it would boost
employment. So, we proposed hotel management courses as well as gave
land to the Tatas, ITC, etc, to set up hotels in the state.

But when the Mayawati government came to power, the land allocation
was cancelled, taking the case to the Supreme Court. The SC has now
ordered the Noida authority to charge an additional Rs 70,000 per sq
metre of land allotted for the 14 hotel sites. If the matter had not
gone to the court, the hotels would have been ready, up and running by
this time.

A charge often levelled against us is that we are against English. But
it was Netaji who set up the Amity University, which is one of the
finest universities in the region today. No one has been able to match
the private medical colleges set up by our government. But,
unfortunately, the government that succeeded us made a hash of medical
education. I only need to give the example of the medical college cum
hospital that was to come up in Azamgarh. The Mayawati government did
not allow it to happen. We have also set up universities for
minorities.

Many of these ideas came from a man, who you have now thrown out of the party…
There is good and bad in all of us.

Why does this perception still persist that the Samajwadi Party is
narrow and backward-looking, as well as opposed to modern ideas?
Take a look at our manifesto. We are offering inter-colleges and
midday meal schemes, especially in endemically backward areas such as
Mirzapur and Bundelkhand. We are offering laptops with Hindi and Urdu
softwares to students. We will build roads and increase connectivity,
so that people in the most backward areas can also access progressive
education.

I don't think these are backward-looking objectives. In fact, Mayawati
emphasises on the inferiority complex of Harijans. The Congress and
the Bharatiya Janata Party offer you fear and hatred. Ours is the only
party that has a positive campaign. The Congress tried to cheat the
Muslims in the name of 4.5 per cent reservation for them. This quota
will not help the community in any way. The Samajwadi Party will
provide more reservation for the Muslims on the basis of the Sachar
Committee and Rangnath Mishra Commission's reports.

Your party is associated with a return of rowdyism and politics of
thuggery on campuses…
Law and order will be the highest priority of our government. There is
a committee in our party, under the leadership of Ramgopalji (Mulayam
Singh Yadav's brother), to scan the people who should be allowed to
enter the party. As far as law and order is concerned, we want to set
up CCTVs everywhere — in police stations, tourist and religious
centres. This will serve as a deterrence to anti-social activities.

You are believed to have said on the record that if you come to power,
you would auction statues of elephants and dismantle Ambedkar parks.
How do you think the Dalits would react to such a statement?
I was misquoted. I never said statues would be auctioned. There is
enough political space for everyone. Most of these parks occupy
several acres of land — some span 600 acres. We would like to use the
land in a better way — create aesthetically modelled medical colleges,
research centres and information technology centres. We will seek
advice from their (Mayawati-government appointed) architects! In fact,
these complexes will be meant for the Dalits. Except they would be for
their progress, and not for statues of individuals.

Your party is undergoing a transition, as the leadership is shifting
from the hands of one generation to another. How are you going to
manage it?
True, there have been some issues. Some things have come up. But there
is no change in principles. The Samajwadi Party believes in equality
and prosperity for all. The whole party is engaged in campaigning.

Who do you consider as your closest political ally in Uttar Pradesh,
helping to form a government if you don't get the numbers?
We will get a majority on our own. We won't need any help from anyone.
The people of Uttar Pradesh will ensure that.

Do you see yourself as the chief minister?
Netaji will be our chief minister.
