Dalits gherao two ministers

Hubli (Karna), Aug 21 (PTI) Dalits of Nayakanooru village today
''gheraoed'' two ministers, including district-incharge minister
Jagadish Shettar against alleged atrocities committed by the upper
caste on them.
The crowd gheraoed Shettar, Social Welfare Minister A Narayanaswamy,
Dharwad MP Prahlad Joshi and Navalgund MLA Shankar Patil Munenakopp,
in the midst of tension brewing over a water tank dispute, police
said.
The Dalits were also furious over alleged lack of basic amenities in
their village, they said.
An FIR was lodged by the Dalits some days ago at Navalgund police
station in this regard, they said.
Shettar assured Dalits that he would look into the matter and said the
government had sanctioned Rs 50 lakh for the development of the
village.

Social welfare minister speaks to the members of dalit families

DHARWAD: Minister for social welfare A Narayan Swamy has assured that
an officer of DIG rank will inquire into the incident of social
boycott of a dalit family in Nayaknur village of Navalgund taluk in
Dharwad district.

Narayan Swamy who visited the village along with RDPR minister
Jagadish Shettar on Sunday met the dalits of the village and told them
that the guilty will be punished as per law.

He assured the members of Shivappa Basappa Madar's family that the
government would provide protection to the family membrs as well as to
other dalits in the village.

The minister's visit comes in the wake of a dalit family being
threatened of social boycott from Anandagouda Patil his sons of
Nayaknur village.

Narayan Swamy said the government would take the incidents of
harassment to the dalits seriously and would not allow such things to
happen.

RDPR minister Jagadish Shettar said the police had already taken
necessary action as per law against the accused. He said the
government would release Rs 50 lakh for the development of dalits
colony in Nayaknur and more help would be extended through Ambedkar
SC/ST Development Corporation.

Inspite of facing "tough battle" to release his film Aarakshan, the
movie has managed to amass Rs 58.5 crore within its first week of
release. "I'm very happy with the audience response to Aarakshan. I've
been flooded with congratulatory messages and calls. The film seems to
be touching
many people,"s Jha said in a statement.

Aarakshan, which deals with the sensitive issue of caste-based quota
system in India's educational system, was banned in Punjab, Uttar
Pradesh and Andhra Pradesh for fear of anti-Dalit comments in it.

However, the ban was lifted from Punjab and Andhra Pradesh a day after
its worldwide release of August 12. In Uttar Pradesh, the ban was
lifted August 19.

"It has been an unexpectedly tough battle to release the film... I
hope no filmmaker ever has to go through what I went through. I'm
grateful for the support of audiences worldwide who have been watching
and enjoying the film," Jha said.

LUCKNOW: The Congress on Saturday came down heavily on chief minister
Mayawati and held it responsible for the plight of dalits in Uttar
Pradesh. Addressing the party's dalit sammelan, the first one in the
series to be held across the state, UPCC chief Joshi accused Mayawati
of siphoning funds meant for dalit empowerment projects and running a
government, which has registered highest cases of atrocities against
the scheduled castes and tribes.

"Young SC girls are molested, raped and then jailed by Maya for
raising their voice in protest against these incidents," Joshi
declared, and added that the chief minister could somehow succeed in
misleading the dalits during the last assembly elections, but now they
have become wiser. "Rahul Gandhi stays at dalit homes, eats with them
at dhabas and travels in second class compartments to express his
solidarity with them," Joshi said.

"Young SC girls are molested, raped and then jailed by Maya for

declared, and added that the chief minister could somehow succeed in
misleading the dalits during the last assembly elections, but now they

Union coal minister Sriprakash Jaiswal said that Congress has always
been pro dalit. "The Centre has made a slew of schemes to bring them
in the mainstream by economically empowering them. However, due to
mismanagement and greed of the BSP regime, the financial help offered
has not been able to reach and benefit the target segment," he said.
The minister dared the CM to spell out steps she has taken during the
current regime to help out dalits and the deprived. He alleged that UP
CM only believes in using dalits as her committed votebank and beyond
this has no interest in their welfare.

First wrongful dismissal claim based on caste raises questions
An Indian couple who worked at a Coventry-based law firm have become
the first to cite caste discrimination in a wrongful dismissal case.

Amardeep Begraj and Vijay Begraj told an employment tribunal in
Birmingham that Heer Manak Solicitors treated them differently after
they were married because they are from different castes.

Mrs Begraj, a former solicitor at the firm, is from the higher caste
of Jat, while her husband, the former practice manager, is a member of
the Dalit caste, also called the 'untouchables'.

The couple met at the firm but Mrs Begraj said that a senior colleague
had later told her to reconsider marrying Mr Begraj because people of
his caste were 'different creatures'.

Following the marriage, Mrs Begraj claims she was given more work,
less secretarial support and less pay than other solicitors at the
company. Then Mr Begraj was dismissed after seven years at the firm
and his wife resigned in January this year.

In a statement, employer Heer Manak denied discriminating against the couple.

The caste system is an ancient Indian class divide based on race and
religion but it is not specifically recognised in British
discrimination law.

However, home secretary Theresa May is holding an ongoing consultation
about whether or not to include it in the Equality Act.

Alan Chalmers, partner at DLA Piper, said: "At the moment it's unclear
whether caste discrimination is unlawful at all in the UK, and this
case may go some way to establishing that it is.

"The government could remove uncertainty if it changed the Equality
Act to specifically say that caste discrimination is unlawful.

"The Equality and Human Rights Commission position is that it's
already covered, but I think it would be sensible to avoid dispute for
there to be some clarity on the situation, whether through this case
or through a change to the law."

Audrey Williams, partner, HR group and head of discrimination law at
Eversheds, said: "Caste discrimination creates a challenge in how you
define it. Look at where we are in this country with religion and
belief discrimination; we are still going through cases that are
testing the boundaries on that."

She said that the UK could look to existing legislation in India for
guidance. But caste distinctions are much more recognised in that
jurisdiction compared to the UK, she added.

"The other question is: 'Do we need legislation to fill a gap?'" asked
Williams. "Our race discrimination provisions talk about unlawful
treatment because of ethnicity, and I think it's quite difficult to
categorise all the forms of caste discrimination into the ethnic
origin definition. Not every potential caste issue will fit easily
into definitions of ethnic origin."

Dalit Rights Group Slams Modi Government's
Stand On Child Rights

Gujarat under Narendra Modi is touted about as Hindutva's most
successful laboratory. The corporate world and influential sections of
the 'mainstream' Indian media never tire of singing paeans to Modi's
'developmental model', which they uphold as eminently worthy of
emulation by the rest of the country. Scores of middle-class Hindus
passionately advocate Modi as India's next Prime Minister, who, they
fondly hope, will propel the country into the league of the economic
and military 'super-powers'.

As in the rest of India, but perhaps to an even greater degree, the
much-applauded Gujarat model of rapacious capitalist 'development' has
led to mounting inequalities and pauperization of vast numbers of
people, particularly belonging to the Dalit and Adivasi communities,
at the same time as it has greatly enriched Gujarat's already
well-entrenched social and economic elites. While Adivasis and Dalits
together comprise more than a fifth of Gujarat's population, they
remain at the bottom of the state's steeply hierarchical social
pyramid. This clearly illustrates the caste-class interests that the
politics and ideology of Hindutva and Modi's 'developmental model' are
geared to promoting.

Much of Gujarat's reported economic 'success' owes to the exploitation
of cheap Dalit and Adivasi labour. Gujarat enjoys the dubious
distinction of having one of the largest numbers of child labourers in
the country, most of who are Dalits and Adivasis or belong to other
such marginalized caste groups. They work in miserable, often
bonded-labour like, conditions, being paid a pittance, and the state
government, apparently, is completely apathetic to their plight.

Early last month, a friend of mine, the indefatigable social activist
Rajesh Solanki, Secretary of the Ahmedabad-based Dalit Hak Rakshak
Manch ('Dalit Rights' Protection Forum'), shot off a memorandum to
Kamala Beniwal, Governor of Gujarat, drawing her attention to the
absence of a State Commission for the Protection of Child Rights'
(SCPCR) in Gujarat, which, it indicated, meant that children's
rights', particularly of marginalized communities, continued to be
violated on a large scale across the state. It argued that despite the
fact that the Commission for the Protection of Child Rights Act 2005
had made it a duty of state governments to set up such commissions,
the state Government of Gujarat continued to ignore this. It pointed
out that the claim of the Gujarat government that in place of a
separate SCPCR it had arranged for child-rights-related issues to be
handled by the Gujarat State Women's Commission was specious and, in
fact, in violation of the Commission for the Protection of Child
Rights Act. Given that the Women's Commission had its own specific
mandate and that it did not possess adequate human resources to deal
additionally with the violation of children's rights, the memorandum
insisted that the Gujarat Government must set up a separate Child
Rights' Protection Commission as was required by law. Delegating the
work of such a commission to the Women's Commission, it pointed out,
was leading to the subversion of children's rights on a large scale.

The memorandum submitted by the Manch, which is one of the most active
Dalit groups in Gujarat, elaborated on the extent of gross denial of
rights to children (particularly belonging to marginalized caste and
tribal communities in the state), all of which necessitated, it said,
a full-fledged Child Rights' Protection Commission. It pointed out the
existence of at least 400,000 child labourers in Gujarat (who must be
mostly Dalits and Adivasis) making the state ninth among India's 28
states in terms of child labour. Despite child labour being declared
illegal, it noted that the state had exhibited little enthusiasm to
tackle the problem. Less than 4500 child labourers were 'freed' from
child labour during the period 2001-2010, it pointed out. As on 31st
January this year, it noted, more than ten thousand cases related to
children in the state remained pending before the Juvenile Justice
Board, and only around a fifth of them have been disposed. Every year,
the memorandum added, thousands of workers (who are mainly
impoverished Dalits and Adivasis), along with their children, are
lured to Gujarat from neighbouring states—to work in farms and
factories under extremely harsh and exploitative conditions. Yet, it
noted, the Gujarat state had failed to arrange for an inter-state
coordination committee to address the serious problems of such migrant
workers and their children.

More than 100,000 children, the memorandum indicated, including minor
girls, 'are being exploited and sex-ploited' in hybrid cotton seed
farms across seven districts in Gujarat. In this case, too, most of
these child labourers would be from the marginalized and historically
oppressed Dalit and Adivasi communities. The memorandum noted with
dismay the refusal of the Collector of the Banaskantha district to
acknowledge the presence of such child labour in his district when
confronted with evidence to the contrary by activist groups. The
memorandum noted that the Dalit Hak Rakshak Manch has requested the
National Commission for the Protection of Child Rights to use its
quasi-judicial powers and summon government officers in Gujarat to
inquire as to why they continue to allow such an obnoxious form of
exploitation.

The memorandum stressed that the separate Child Rights' Commission
which it urged the Gujarat Government to establish was also needed for
the proper implementation of the Right to Education Act 2005. It noted
that vast numbers of children across the state (probably mainly Dalits
and Adivasis) are denied access to primary education facilities, in
part due to what it called the 'callousness of the government'.
Gujarat, the memorandum pointed out, lagged behind 21 other states in
the immunization coverage of infants, and this clearly exposed what it
called 'the tall claims' of the Gujarat Government about its
achievements in the health sector. It criticised the Gujarat
Government for giving the task of the implementation of the Right to
Education Act to the State Women's Commission, which, it stressed was
'nothing but a mockery of the Right to Education Act. All this, the
memorandum stressed, were additional reasons why it was imperative for
Gujarat to establish a separate state Child Rights' Commission.

The memorandum concluded with an appeal to the Governor to issue
appropriate orders to the Gujarat Government, which it termed as a
'penny-pinching miser' that 'does not want to use resources for this
vital issue related with future citizens of this state'.

So much, then, for the story of the Modi 'Model of Development'.

BHOPAL: A dalit was killed and two others were seriously injured as
upper caste Thakurs attacked them in a village in Bhind district in
northern Madhya Pradesh. No arrests have been made so far and the
incident has created panic among dalits in the village.

The incident took place in Kirat village in the wee hours of Wednesday
when a group of upper caste Thakurs comprising Pinku Tomar and Rama
Shanker Bhadoria among others barged into the house of dalits. The
police said that Bhogiram Vidharam and Manu Jatav were beaten black
and blue by the accused for the reasons 'still under investigations.'

Lucknow, Aug 20 (PTI) Framing of laws is a prerogative of Parliament
and should be done by MPs, Union Minister for Coal Sriprakash Jaiswal
today said and appealed anti-graft crusader Anna Hazare to respect the
Constitution. "Anna Hazare is a social activist and we respect him,
but he should not also forget to respect the Constitution framed by Dr
Ambedkar," Jaiswal said while addressing a SC/ST convention organised
by the party here. He said that framing law was the work of the
Parliament and it should be done by the MPs. The minister said that he
appealed Anna Hazare not to be adamant and contribute in strengthening
the Constitution by honouring the law. Jaiswal alleged that the Centre
has launched a number of schemes for upliftment of Dalits, but in UP
it was not reaching the real beneficiaries. The reality is that
Mayawati is using Dalits only as the vote bank and had nothing for
them, he alleged. UPPCC president Rita Bahuguna Joshi alleged that due
to corruption and scams development had come to standstill in the
state. Alleging that central fund was not reaching Dalits, she said
that law and order situation had hit bottom low and there was spurt in
crime against SC girls.

NEW DELHI: The Supreme Court on Friday ruled that state governments
cannot ban a film, which has been cleared by the censor board for
public screening, on the apprehension that it could cause a law and
order problem.

Clearing decks for release of Prakash Jha's film 'Aarakshan' in UP, a
bench of Justices M K Sharma and A R Dave said it was the state's duty
to maintain law and order and quashed an order banning the film's
screening for two months.

It rejected the Mayawati government's plea that reservation continued
to be a sensitive issue despite apex court's rulings and any
derogatory reference to it could spark violent reaction leading to a
law and order problem.

The court said: "It is for the state to maintain law and order
effectively and meaningfully." It said reservation as a social issue
needs to be debated in every forum. "We feel reservation is a social
issue and in a vibrant democracy like ours, public discussion is
necessary. Such discussion on social issues bring about awareness for
effective working of the democracy," the bench said.

It also said divergence of opinion was important to a healthy
democracy. "In a democracy, it is not necessary that every one sings
the same song," the court said.

The state through senior advocate U U Lalit said a high-powered
committee comprising eight principal secretaries previewed the film
and found certain dialogues inflammatory enough to trigger a law and
order situation on the sensitive issue of reservation. On the
recommendations of the committee, a temporary ban was put on the
screening of 'Aarakshan'.

The bench agreed with Jha's counsel Harish Salve that the ban amounted
to pre-censorship and said: "Once the Central Board for Film
Certification has cleared the film for public viewing, the screening
cannot be prohibited in a manner as has been done by the UP
government."

The court found that the CBFC had included members from the SC, ST and
OBC communities as well as experts in law and dalit movement for the
scrutiny of the movie before certifying it for public screening on
July 20. The UP government had banned the film on August 9.

"Once an expert body has cleared a film, the state cannot go behind
law and order situation to stall its screening in theatres," the court
said erasing lines of worry drawn on the face of Jha, who watched the
court proceedings in rapt attention.

BHUBANESWAR: A woman employee of Bhubaneswar Development Authority
(BDA), who had lodged a police complaint against two BDA officials
alleging caste slur, seems to have landed in trouble.

A government inquiry has raised question marks over her caste, terming
her a 'Brahmin' by birth and not eligible for the caste certificate
she holds. Notably, Das had filed a complaint with police that two
senior officials of BDA had called her by caste. A case under the
SC/ST (Prevention of Atrocities) Act was registered against the
officials in July.

After the episode, Orissa State SC/ST Youth and Students Council on
August 2, issued a press statement, questioning the caste of Das.

birth caste of Madhumita Das is Brahmin and said steps are being taken

Sub-collector Saroj Kumar Samal wrote to BDA that caste is determined
by birth as per the established norm and that Madhumita Das doesn't
have the eligibility to be issued such a certificate. The community
and caste one is born into is the only premise the tehsildar
ordinarily relies upon for issuing caste certificate, the
sub-collector said in his August 4 report.
