165 SC/ST students vacate hostel alleging neglect

Rayagada (Odisha), Dec 6 (PTI) Alleging neglect by authorities, 165
inmates of government-run 'Sevasram' school in Maoist-hit and
tribal-dominated Rayagada district of Odisha have left their hostel.
"All the 165 boy students of the Sevasram at Dangasurada have left
their hostel on Sunday evening. We are inquiring into the matter",
district welfare officer Damodar Meher said today. Out of total 326
students, from Class I to Class X, in the school there were 205 boys
and 121 girls. Of them, 165 boys and 100 girls were putting up in the
school hostel. The students alleged they had been writing to the
authorities to solve their problems but it had fallen on deaf ears.
Apparently peeved over the alleged neglect, the students put up
posters on the school walls and nearby places before leaving the
hostel en masse. Their problems included alleged lack of sanitation
and drinking water facility in the hostel leading to health hazards,
inadequate teaching staff, non-payment of pocket money, incomplete
hostel building for girl students and non-cooperation and misbehaviour
of the staff. The students had drawn the attention of the district
collector, sub-collector and block development officer besides the DWO
to their problems, Meher said. The additional district welfare officer
(ADWO) and local welfare extension officer (WEO) had gone to the spot
to inquire into the matter, Meher said, adding students have
apparently gone back to their respective villages. PTI COR SKN PS NN

Mangalore: Police Intensify Search for Missing Dalit Woman

Mangalore, Dec 7: The city police on Monday December 5, intensified
investigations into the case of missing Dalit woman Sunita, who was
residing at Tokrabattu in Harekala village, near here. Sunita
reportedly went missing on November 24, 2011. Konaje police
registered a case in this regard on November 27, 2011.

She lived in a hut located on Tokrabettu hillock along with her three
daughters. Her husband Vishwanath had died seven years ago after
falling from a palm tree. The daughters are in the care of their
grandmother.

Konaje police led by sub-inspector Shivaprakash arrived at the spot
with the canine squad that traced Sunita's tracks to Harekala ferry
point at Netravati River. They suspect there are chances of her
boarding a ferry for her onward journey.

Grant graduation degree to failed SC/ST students - CSMMU

Lucknow: The Chhatrapati Shahuji Maharaj Medical University (CSMMU)
has recommended the Medical Council of India (MCI) to grant Graduation
Degree to SC/ST medical students, who have failed to pass out the
final exams even after repeated attempt. Few among them are trying to
clear the exam since 1996.

Earlier, about 50 reserved category students blamed the varsity's
teachers for deliberately giving SC/ST students less marks.

This move took place few months before assembly polls in Uttar Pradesh
as, here, scheduled castes and scheduled tribes constitute 18% of the
electorates.

On Monday, Prof. DK Gupta, the Vice-Chancellor of the University sent
a letter to MCI, which stated that as students failed consecutively on
several attempts, they should be allowed to have a degree.

He also suggested that a separate passing percentage should be fixed
for reserved category students, as for them medical entrance test's
qualifying marks are lower.

Uttar Pradesh's Medical Education Minister, Lalji Verma said that he
would like to comment on this issue only after going through the
documents. On the other hand, Ram Kumar Bhargava, Congress Spokeperson
said that this repeated failure of students should be probed.

Samajwadi Party leader, Ambika Chaudhary is of the view that once
underprivileged sections get an opportunity, they must also be at par
regarding marks, with other students aspiring to become a doctor.

Ahmedabad, Dec 6 (PTI) A division bench of Gujarat High Court has
ruled that any person accused of committing atrocity against people
belonging to scheduled castes/tribes, cannot legally seek anticipatory
bail. The division bench of Justice A L Dave and Justice Bankim N
Mehta has further ruled that a court cannot grant such persons
anticipatory bail in view of specific bar under Section 18 of the
Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act,
1989. The court passed the ruling last week while deciding on a
crucial question referred to it by a single judge, whether provisions
contained in Prevention of Atrocities Act, 1989 imposes a bar on a
person's right to anticipatory bail. "Once a provision of law enacted
by Legislature is held to be not unconstitutional or not violative of
Article 21 of the Constitution, the same stands on statute book and
has to be read as it is and court while interpreting the same, cannot
read what is not provided for in the provision nor can it ignore what
is provided for in the provision," the division bench ruled. "A person
who is facing accusation of having committed an offence under the
Atrocities Act, cannot legally invoke provisions of Section-438 of the
CrPC in view of specific bar contained under Section-18 of the
Atrocities Act and a court cannot grant anticipatory bail to a person
accused of having committed an offence," it added.
