Justice for hapless tribal victims after more than 19 years

More than 19 years after forest and police officials descended on
Vachathi, a tribal hamlet in western Tamil Nadu, and committed
atrocities on hapless villagers in a raid said to be against
sandalwood smuggling, a district and sessions court here on Thursday
found 215 government officials and employees guilty and handed down
prison terms ranging from two years to 10 years of rigorous
imprisonment. Seventeen persons were convicted of the charge of rape.

Among the senior officials found guilty by Principal District and
Sessions Judge S. Kumaraguru were a retired Conservator of Forests,
two serving Conservators and an Additional Chief Conservator of
Forests.

The Central Bureau of Investigation, which was directed by the Madras
High Court to investigate the case, arraigned 269 officials of the
Forest, Police and Revenue Departments, but only 215 lived to receive
the verdict in a court thronged by victims, their family members and
activists who had supported them over the years. The remaining 54
officials are dead.

On June 20, 1992, a large contingent of officials entered Vachathi
following information that sandalwood was being illegally felled and
smuggled. The team claimed to have recovered a huge quantity of
sandalwood from a riverbed.

Later, the villagers complained that under the pretext of conducting a
search, the raiding party had ransacked their property, destroyed
houses and killed their cattle.

The most shocking charge was that the men in uniform had raped 18 women.

The State government denied the charges. The then Forests Minister,
K.A. Sengottaiayan, now Agriculture Minister, had accused the entire
village of being involved in sandalwood smuggling, and when a team of
officials went there for investigation, the villagers had attacked
them.

However, in 1995, on a writ petition filed by the then CPI (M) State
secretary, A. Nallasivan, the Madras High Court handed over the probe
to the CBI, which charge-sheeted the 269 officials. Later,
compensation was paid to the victims.

The senior-most official convicted was the first accused, M.
Harikrishnan, a retired Conservator of Forests, who was awarded a
three-year prison term under Section 201 of the Indian Penal Code for
causing disappearance of evidence or giving false information to
screen the offender, and another three years of rigorous imprisonment
and Rs.1,000 in fine under Section 3(2)(1) of the Scheduled Castes and
Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Accused number 2, Additional Chief Conservator of Forests P.
Muthaiyan, was sentenced to jail for a year under Section 342
(wrongful confinement) of the IPC. Conservator of Forests, Dindigul,
L.Nathan was given a one-year term. S. Balaji, Conservator of Forests,
Chennai, was awarded three-year rigorous imprisonment on three counts,
but the terms would run concurrently. He was also fined Rs.5,000.

Social justice has been denied to dalits with regard to reservation in
the local body elections to Madurai corporation, say dalit activists.

Though as per the reservation policy of Tamil Nadu, 18 per cent should
have been reserved for dalits, not even half of it has been earmarked
to them under the SC category, they say.

According to the notification of reserved and general wards for the
expanded Madurai city municipal corporation dated September 12, 2011,
four out of the 100 territorial wards have been reserved for SC
(general), two for SC (women), 32 for women (general) and the
remaining 62 have been earmarked as general wards. No ward has been
allotted either to ST (general) or ST (women).

This notification has come under fire from the activists who claim
that 18 wards should have been allotted for SC and one for ST.

Activist and advocate A. Rajini says, "While the corporation has
expanded from 72 to 100 in terms of the number of wards, the number of
seats allotted to SC remains static with six. The civic body has
failed in its duty to conform to the reservation policy adopted for
the dalits though it has stuck to the 33.33 per cent allocation of
seats for women."

Countering her claims, corporation commissioner S. Natarajan says the
reservation for SC\ST was finalised depending upon the population of
the particular ward.

"The dalit population, according to 2001 census, is only 6.4 per cent
in Madurai city and based on it 6 out of 100 wards have been allotted
to them in the descending order. As the ST population is a merely
0.001 per cent, no ward has been classified under the category."

He also added, "The reservation was applicable only to education and
employment and not for these types of elections."

However, Ms Rajini claims that the population does not have a bearing
on reservation, a constitutionally guaranteed right which is
applicable to political representation too as per the rule of the law
in the state.

Meanwhile, a petition has been filed in the Madurai bench of Madras HC
seeking a direction to suspend the elections to any of the 19 wards in
the corporation on the grounds that reservation policy with respect to
SC\ST has not been followed.

The seventeen employees of the Forest Department who were identified
by the affected women as accused in the identification parade and
later in the courts in Krishnagiri were convicted under section 376 of
IPC and 3(2) (v) of SC and ST (Prevention of Atrocities) Act 1989 for
seven years RI with Rs. 2000 fine and 10 years Rigorous Imprisonment
with Rs. 1000 fine.

They were handed over to the police immediately for lodging in the
Salem Central Prison. The accused sentenced under section 376 of IPC
were: P. Arunachalam, T. Arumugam, P. Rajagopal, A. Periyanayagam,
Rajamanickam, K. Govindan, P. Rathinavelu, K. Pachaipan, A. Vediappan,
P. Chidambaram, R.G. Perumal, L. Palani, M. Perumal, K. Alagiri, K.
Madhaiyan, C. Kaliappan, V. Janakiraman. Of this, twelve accused Non
SC, ST were convicted under section 3(2) (v) of SC and ST (Prevention
of Atrocities) Act 1989 and was sentenced to 10 years Rigorous
Imprisonment.

VELLORE: The busy commercial hub, wears a dull look while it hosts the
first ever civic polls after the city was upgraded into a corporation,
as electioneering is still on a low key, despite the fact that the
battle lines are drawn.

While the parties have selected their respective candidates and have
completed the process of filing of nominations on Thursday, the
functionaries and cadre of the AIADMK and DMK are still unable to
conceal their disappointment over the way Vellore has gone in the way
of electing a dalit woman as its first mayor.

This has also put the dalit population (around 20 per cent) under a
lot of pressure to do the tight rope walking. While they have to
appease the not-so-enthusiastic party cadre from other castes by
maintaining good relationships with them, to uphold amity on one hand,
they have to work on strategies for a balanced electioneering to keep
their own caste base intact, on the other.

Since its inception as a first grade municipality, Vellore has been
electing civic leaders from the Mudaliyar community over the past four
decades. This community also enjoyed the support of Muslims here on
many occasions during elections.

In the case of Assembly and Parliament elections, there have been
mutual agreement between these communities to choose candidates from
among them in a cyclic fashion, both the communities are stumped this
time over Vellore going ahead with a dalit woman.

Sources reveal that Muslim leaders are also equally disturbed by the
quota move. With a voter population of around 25 per cent, a sizable
section of Muslims might vent their anger on the ruling AIADMK and the
oppostion DMK, for not opposing the move.� Things took a further twist
when AIADMK announced that Karthiyayini, a Phd scholar was the mayoral
candidate, putting the opposition in a tight spot.

Verdict on adivasi women raped in Tamil Nadu

Chennai: More than a hundred Dalits were tortured and abused during a
raid for smuggled sandalwood; 18 adivasi or tribal women were raped in
a small village named Vachathi in Tamil Nadu. This was in 1992. And
the verdict for these atrocities has been delivered today.

A court in Tamil Nadu's Dharmapuri district has decided that all 269
accused are guilty. 17 Indian Forest Service (IFS) officials have been
convicted for rape. Four IFS officials have also been convicted under
the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act
for atrocity against tribals.

100 policemen and nearly 155 officials were accused of rape and
torture. Of the more than 200 people accused in the case, 54 have
died.

The quantum of punishment is yet to be announced.
