Affair assault on dalit teen triggers protest

Hazaribag: A dalit teenager was confined to a room, his head was
partially shaved and thrashed for allegedly having an affair with a
Muslim girl at Guruwa village under Hazaribag Mufassil police station
area on Tuesday, creating resentment among the dalit families of the
area for the past four days.

Family members of the teenager, a Class X student of Amritnagar High
School, alleged that the boy was accosted by some 20 to 25 people led
by Md Rafique, the girl's father, when he was going to school and was
thrashed.

The mother of the boy alleged that her son was locked in a room for
more than four hours and was severely beaten up on Tuesday following
which he had to be admitted to the Hazaribag Sadar Hospital.

He has been shifted to the RIMS in Ranchi on Thursday when his
condition deteriorated. She also alleged that prior to his
confinement, the boy's head was partially shaved and he was paraded in
the village with a garland made of shoes for his alleged affair with
the girl.

The action by the relatives of the girl was protested by the Dalit
villagers, who said that if the boy was punished for his alleged
affair, the girl, too, should be punished for the same "offence" as
she was equally responsible. The girl, they alleged, was exchanging
letters regularly with the boy for the last few months. The villagers
demanded that action against the girl's parents and kin be taken under
the SC/ST act.

When the situation turned serious, a meeting was called with the
members of both the communities in the village. The relatives of both
the boy and girl attended the meeting. The village elders issued an
order asking the boy's family to leave the village and settle
elsewhere and imposed a fine of Rs 10,000 on them for the "offence".

Later, when the boy's father expressed his inability to pay such a
heavy amount, the "fine" was reduced and he was directed to pay Rs
3,000 .

Hazaribag SP Pankaj Kamboj said cases had been lodged by the parents
of the victim and girl's father. In addition, a separate case under
the SC/ST act was also registered with the Hazaribag Mufassil police
station following a complaint lodged by the boy's parents .

Meerut: A 12-year-old Dalit girl was sexually assaulted at gun-point
by three men who also made an MMS clip of the act in Daurala area of
the district, police said today.

The victim, a Class VI student, along with her younger sister had gone
to attend nature's call to the fields where she was gang-raped by
Joni, Sushil and Guddu of Daurala village yesterday, police said.

Joni also made an MMS clip while committing the crime.

The accused fled the spot after the victim's sister raised an alarm,
they said, adding that efforts are on to arrest the culprits.

Those who dare to violate the 'ban' face abuse, threats from caste Hindus

After several years of struggle and agitation, the Dalits of Perali
village in Perambalur district say they continue to face
discrimination at the hands of caste Hindus.

They still cannot ride a bicycle on streets where upper caste members
reside. Those who dare to violate the 'ban' face abuse and threats.

In 2002, the All India Democratic Women's Association organised an
agitation in the village, forcing the district administration to
intervene. A group of Dalit boys and girls cycled along the upper
caste streets under the supervision of Revenue officials. The freedom
was short-lived.

Dalits students of the Government Higher Secondary School in the
village still cannot take the upper caste streets though it is a
shorter, safe route.

They have get down from the bicycle and push it or go via the busy
Perambalur-Ariyalur High Road , says 49-year-old N. Ayyakannu, a real
estate broker. Even the postmaster, a Dalit, cannot ride his bicycle
on the upper caste streets.

"After all the representations and agitations many of us are fed up
and have come to the conclusion that things will not change," he says.

Dalits constitute a minority in the village.

Many among them have to work as agricultural labourers for the
affluent and dominant caste Hindus and can hardly afford to go against
the wishes of their employers.

Dalits are not allowed to enter the temple on the upper caste street,
says Mr. Ayyakannu.

'The two-tumbler system' is prevalent in some of the tea shops, says
Arumugam, a 70-year-old agricultural labourer. "The system is followed
except in two shops. We cannot even sit as equals with caste Hindus on
the benches at the tea shops."

Though the village has a library, Dalit youth can only sit on the
floor, says Suresh, a Dalit boy.

Charge denied

K. Padaikathu, president of the village panchayat, who belongs to the
upper caste community, denied there was any ban on Dalits cycling
through the upper caste streets.

When probed further, he conceded that there could be a few minor
issues, but maintained there were no major problems in the village.

"Such problems were there some years back when I was young. But now,
we co-exist peacefully."

Asked about Dalits being denied admission to the temple, Mr.Padaikathu
said there were separate temples in upper caste and Dalit streets and
there was agreement that the two communities would worship separately.

ALLAHABAD: Lok Janshakti Party president Ram Vilas Paswan today
demanded adequate representation for dalits, minorities and backward
classes in the selection committee that would appoint the Lokpal.

"I will raise the matter at the meeting of Parliamentary Standing
Committee going into the Lokpal issue which is likely to be held on
September 7," he said here.

The Rajya Sabha MP from Bihar is also a member of the Committee.

"My party's stand reflects the concerns of all members of such social
groups," Paswan said.

The former Union Minister is in favour of keeping lower- rung
government officials under the purview of Lokayuktas of respective
states who, he said, should be allowed to function independently of
the Lokpal.

Opposing the idea of bringing lower judiciary under the ambit of the
Lokpal, Paswan said "courts have been accorded the highest status by
our Constitution and nothing should be done which goes against its
spirit".

"Former RSS ideologue Govindacharya and leaders of the Vishwa Hindu
Parishad have themselves been claiming that the crowd that had
gathered at the Ram Lila Maidan comprised Sangh Parivar volunteers,"
he said when asked about the character of Hazare's anti-graft
campaign.

However, Paswan added he was not trying to say that the entire
movement was sponsored by the Sangh Parivar.

The Madras high court has observed that despite a number of
anti-discrimination statutes and positive-benefit provisions exist in
Indian law for the protection and benefits of dalits, tribals and
other backward classes of society, the implementation of these laws is
poor.

Directing the Tiruvannamalai district collector to expedite the
implementation of the Adi Dravidar housing scheme in right earnest,
Justice K. Chandru said, "Dalits face social, linguistic and
systematic barriers that become virtually impossible to overcome in
the face of an often hostile system and an insensitive civil
administration. The entire system is designed to exclude and ostracise
dalits".

Dismissing a petition from R. Harikrishnan, challenging the
proceedings relating to acquisition of his dry land measuring 1.00
cents (hectare 0.40.5) at Sevoor village in Tiruvannamalai district
for granting free house sites to the Adi Dravidar people of the
village, the judge said it must be noted that the constitutional
validity of Tamil Nadu Acquisition of Lands for Harijan Welfare
Schemes Act 1978 (Act 31 of 1978) was upheld by the Supreme Court in
1995 and a Full bench of this court has settled the controversy on the
modalities of the procedure involved in the land acquisition for
Harijan welfare schemes in 2006.

"It is a pity that these cases which were filed a decade ago have
virtually frustrated the welfare scheme conceived for the welfare of
dalits. Thirty years have gone by and the law conceived for the dalits
remains on paper," the judge added.

Petitioner contended that his objections with regard to acquisition of
his land were not considered and instead of the district collector
satisfying himself, the gazette notification shows the satisfaction
was that of the government and therefore, on that short ground, the
acquisition must fail.

The judge said this court was fully satisfied that the collector had
taken appropriate steps.
