Morena: Four booked for calling dog 'untouchable'

Morena (Madhya Pradesh): In a bizarre incident, three brothers have
been booked along with their neighbour for calling their dog
"untouchable" after it ate food given by a Dalit woman in Morena's
Malikpura area last week.

"Three brothers Amrit Singh Yadav, Naresh, and Ramveer and their
neighbour Lallu Singh - all members of the OBC - have been booked
under relevant sections of Scheduled Caste and Scheduled Tribe
(Prevention of Atrocities) Act last night," SC/ST Police Station
deputy Superintendent of Police, Baldev Singh said.

The accused had allegedly declared their pet "untouchable" and
demanded Rs. 15,000 as compensation from Sunita Jatav after it ate
bread given by the Dalit woman, police said.

The accused also dumped the dog at Sunita's place.

The matter came to light on September 21 when Sunita took the dog to a
public hearing and narrated her ordeal to top police officers.

The accused, while denying the allegations, claimed that they had
given the dog to the woman as it fell ill after eating food given by
her.

Minor raped, strangulated to death

Muzaffarnagar, Uttar Pradesh: A 10-year-old Dalit girl was allegedly
raped and murdered at a village in Bijnore district, police said on
Sunday.

The girl had gone missing on September 24 from Jahanabad's Khera village.

Her body was yesterday found in the nearby fields, they said.

The condition of the body suggested that the girl was raped and then
strangulated to death, police said.

Dalit panchayat president alleges sidelining by colleagues

MADURAI: S. Karuppan, panchayat president of Kottakachiyenthal village
in Virudhunagar district, is an elected Dalit representative. But, he
alleges that the meaning of grassroots democracy and local governance
is still not within his grasp.

He is the president of a village, which is one among the four reserved
panchayats, the others being Pappapatti, Keeripatti and Nattamangalam
(all in Madurai district), where elections could not be held owing to
non-cooperation to the rotational reservation policy by caste Hindus.
The Dravida Munnetra Kazhagam government earned appreciation for
restoring the democratic set-up by conducting elections in 2006.

Mr. Karuppan, who belongs to the Arunthathiyar sub-caste, alleged that
panchayat president's office had been usurped by the vice-president,
who had taken advantage of his ill health following an accident. Even
after recovery, he was prevented from executing his duties.

The Panchayat president told The Hindu here on Friday that there was
no freedom for him to function independently. The vice-president, by
appointing his relative as the panchayat clerk, had become the de
facto president.

Mr. Karuppan also alleged that he was forced to sign blank cheques
without being briefed about their utilisation. There was no
cooperation from the dominant caste members at panchayat council
meetings. There was no access to panchayat records, account books and
registers.

He also said that work under the Mahatma Gandhi National Rural
Employment Guarantee Scheme was not being allotted regularly and the
details of the work were not made available to him.

His wife K. Irulayi, a member of Ward 3, alleged there were
irregularities in distributing wages and often the beneficiaries were
given Rs.60 or 70 and not the allotted wage of Rs.100.

MNREGS has helped the Dalits here to escape dependency and move beyond
the confines of the dominant castes and provided them a sort of
independence. The weak economic platform provided by agricultural
labour compounded by the seasonal nature of farm work has now resulted
in these families moving for jobs in brick kiln units.

Mr. Karuppan said that the village was facing acute shortage of
drinking water and residents had to go to distant Irunjirai Vilakku to
fetch water. They used to transport the water pots in buses but now
the crew of State Transport Corporation buses do not allow them to
carry water pots.

Equal Rights, a non-governmental organisation working among Dalits in
Madurai, visited the village on September 7 to conduct a study.

The demands put forth by the president include appointment of a clerk
from another village who is adept in local administration,
investigation into the working of the panchayat by officials of the
Department of Adi Dravidar Welfare, enhancement of salary of the
president to Rs.7,000 per month and extension of the panchayat's
reserved status.

Ambedkar Manch: Why compendium on quota?

The Dr. B.R. Ambedkar Vichar Manch has opposed the Centre's move to
bring out a compendium on 'Reservation for Scheduled Castes, Scheduled
Tribes and Other Backward Classes in Service' pending enactment of a
new law.

In a letter to Prime Minister Manmohan Singh, general secretary said
"no convincing grounds for issue of a new compendium on reservation in
services have been mentioned in the proposed official memorandum." Nor
had any reason for denying reservation in every service and post been
explained, or any constitutional provision under which job reservation
had been prescribed for the SC/ST.

The Manch pointed out that no mandatory consultation had been held
with the National Commission for Scheduled Castes and Scheduled Tribes
and no opportunity was given to the SC/ST Employees Welfare
Associations, which were on the panel of the Union Home Ministry.

The proposed consolidated instructions on the reservation policy
lacked constitutional authority. These constructions "do not contain
the origin of determination of population-based percentage, its
detailed criteria and showing the table of population from time to
time since independence."

Mr. Kain said the reservation policy for the OBCs should not be
clubbed with that for the SC/ST as their ground realities were
different.

"They suffer no social stigma or untouchability and they got
reservation only at the expense of SC/ST people."

The Manch opposed the new methodology of recruitment through
'walk-in-interview' for higher posts in the administration and the
engineering department, and for scientific and technical posts and in
hospitals for a limited period.

The reservation policy was not being followed in these appointments,
and this practice should be discontinued forthwith.

While voicing its protest against bringing out a compendium without
Cabinet approval, the Manch sought the Prime Minister's intervention.

A petition in Supreme Court challenging the election of sitting MP
from Akola has much in store to determine the political fate of Baba
Bhim Rao Ambedkar's grandson, a two-time MP from Akola.

Having lost the 2009 Parliamentary elections by a whisker, Prakash
Ambedkar, who was unseated by his nearest rival Sanjay Shyamrao
Dhotre, had decided to serve constituency and party — Bhartiya
Republican Party-Bahujan Mahasabha, a breakaway of Bahujan Samaj Party
(BSP).

However, fortune seems to have smiled at him again after an election
petition filed by one Gajanan Samadhan Lande, an agriculturist of
Akola, has challenged Dhotre's election on the charge that he held an
office of profit on the date of election.

An apex Bench of Justices JM Panchal and Gyan Sudha Mishra has issued
notice after being convinced by the records of the petitioner which
clearly suggest Dhotre held the post of director, Maharashtra Seeds
Corporation Ltd, a Government body from which he received emoluments
and other benefits.

Article 102(1)(a) of the Constitution specifies that such post would
be an office of profit. Moreover, the petitioner has submitted
documents of the company showing how the State and Central Governments
hold substantial stake, giving it the nature of an office of profit
under the Government.

The petitioner had first approached Bombay High Court which refused to
entertain the petition. But now, with the apex court having issued
notice, the matter would be argued at length
