Centre admits Sheila diverted SC/ST fund for Games

NEW DELHI: The Centre has admitted that the Sheila Dikshit government
violated guidelines to divert funds meant for Schedules Castes and
Tribes to finance its pets projects for the Commonwealth Games.

"In view of the guidelines of 2006, these appear to be wrong," home
minister P Chidambaram said in the Rajya Sabha during a discussion on
the diversion of nearly Rs 678 crore from the funds for Scheduled
Castes and Tribes for the Commonwealth Games. The admission comes at a
time when the Delhi government is under attack from the rivals for its
reluctance to conduct governance in an ethical manner.

The Rajya Sabha witnessed disruptions by BSP MPs over the issue, which
came to light through a Right to Information application.

According to the information given by Delhi government to an RTI
petitioner, nearly Rs 678 crore from Delhi's special component plan,
which was meant for improving the standard of living of the poor
sections of the community through various government schemes and
programmes, was diverted for Games projects.

In his reply, Mr Chidambaram said that Delhi government had got around
Rs 8,000 crore for five years from 2006-7 to 2009-10, under the
special component plan. "As is common practice with various other
state governments, Delhi had divided this fund into two categories —
divisible and indivisible." The divisible category was for schemes
which affected the Scheduled Castes and Tribes directly. "While Rs 983
crore was in the divisible category, the rest — Rs 7,100 crore — was
in the indivisible category. Out of that (indivisible category), Rs
678 crore was contributed to CWG projects," the home minister said.

"This seems to be prima-facie wrong," Mr Chidambaram admitted, but
added: "This happens not just in NCT, but in all states." He said that
Delhi government had told him that the amount diverted will be added
to the Plan funds for the next financial year. The minister said that
the Planning Commission was seized of the matter and had set up a
committee to look into the diversion of funds in all states.

NEW DELHI. Aug 31, DHNS:

The Centre on Tuesday admitted that the Delhi government had indeed
diverted the funds meant for scheduled castes and tribes welfare to
Commonwealth Games projects. Making a statement in the Rajya Sabha,
Home Minister P Chidambaram said efforts would be made to bring the
money back to the SC/ST Fund.

The Rajya Sabha had recently witnessed disruptions by members of the
Bahujan Samaj Party over the issue, which came to light through a
Right to Information application.

As per the information given by Delhi government through RTI, nearly
Rs 744.35 crore from Delhi's special component plan (SCP), meant for
improving the standard of living of the backward sections of the
community through various government schemes and programmes, was
diverted to the Games projects.

Chidambaram said that the Delhi government had received around Rs
8,000 crore for five years from 2006-7 to 2009-10, under the special
component plan.

Greater Noida, Aug 31 (IANS) A 20-year-old Dalit woman was allegedly
gangraped at gunpoint in the Jewar area of Greater Noida, police said
Tuesday.
The incident came to light Tuesday when the woman complained to the police.

"Shalini (name changed) was sleeping on the terrace of her parents's
house in Karoli locality of Jewar area Monday night when two
neighbourers, identified as Bunty and Bhura, raped her at gunpoint.
She was sleeping alone as her parents were away and her siblings were
sleeping inside the house," said Superintendent of Police Atul Saxena.

She narrated the ordeal to her parents when they returned home.

The woman, married about two years ago in Haryana's Palwal district,
had come to her parents' home for the Rakshabandhan festival.

"The victim approached us this (Tuesday) evening. We have registered a
case of rape and have sent her for medical examination," said Station
House Officer Har Pal Singh.

Assuring the Lok Sabha that the government would make law more
stringent to prevent atrocities against SC and ST, Home Minister P
Chidambaram today said the principal responsibility was with the
states to implement these laws.

"We will make the law more stringent and if needed, bring amendments
in the Act (SC&ST Prevention of Atrocities Act)," he said replying to
a discussion on situation arising out of increasing atrocities against
SC and ST.

He said, "In my view, the principal responsibility is with the state
governments to implement these laws. The state government must post SC
and ST officials where the people are vulnerable."

About reservation in jobs for SC and ST, the minister said, "Since
1950...government is totally committed to reservation of SC, ST and
OBC in jobs. In UPA—I, we have cleared a backlog of 54,000 vacancies.
We would come up with another drive to fill the vacancies reserved for
SC and ST."

He said, "This is the most vulnerable country (as far civil rights of
SC and ST are concerned)...we can't call ourselves civilised...how we
treat our SC, ST and women."

About fund allocations for the welfare of SC and ST, he said, "The
ministries give details of funds allocated for SC and ST and the
schemes under which they partially benefited."

"Some ministries are not doing so. The Planning Commission has
constituted a committee for the purpose. Once the committee submits
its reports, all ministries would follow the same pattern of giving
details of funds allocated for SC and ST."

The minister pointed out that one of the reasons for atrocities
against SC and ST is that they are getting prosperous day by day.
"This has also created problems," he said.

He also said the delay in justice results in disappearance of evidence
and forces witnesses to turn hostile. Thus speedy justice is required
to ensure civil rights of vulnerable classes of society, he said.

A delegation of Scheduled Caste and Scheduled Tribe MPs, including
some union ministers, on Tuesday met Prime Minister Manmohan Singh to
demand that an order providing reservation in government jobs be
replaced by an act to bring greater benefits to them.

"Members of the SC/ST Parliamentary Forum met the Prime Minister today
to demand that an Act is necessary to provide reservations to SC/ST
which is done through a government order," LJP Chief Ram Vilas Paswan
said.

The MPs also demanded that the Bill in this regard, which was passed
in Rajya Sabha in the last session of Parliament, be amended as it
excluded some government establishments in providing reservation to
the two categories.

"We demanded that there should be no exception. Section 4 of the Bill,
passed by Rajya Sabha, should be deleted. The Bill should be prepared
immediately and passed in the next session of Parliament," Paswan
said.

The delegation included union ministers Sushil Kumar Shinde, Kumari
Selja, Namo Narayan Meena and Vincent Pala, and MPs from other
political parties.

"The Prime Minister gave us a patient hearing and said he will hold
consultations on this issue," Paswan said.

Meena, who is minister of state for Finance, also brought up the issue
of job reservation for Scheduled Tribes by the Delhi government.

"7.5 per cent reservation in jobs to STs in the Delhi government is
being provided under a Home Ministry notification of 1955. But a
recent Supreme Court order said a Presidential notification is
required for this reservation in jobs and education. The Prime
Minister assured us that he would take up the matter," Meena said.
