Govt submits its SC/ST employees figure in court

JAIPUR: In the controversial issue of quota in promotions, the
Rajasthan High Court on Thursday remarked that allowing consequential
seniority benefits to the reserved category employees once their
representation in the government jobs has exceeded the quota limits
was tantamount to contempt of the court judgment.

The division bench comprising Chief Justice Arun Kumar Mishra and
Justice NK Jain-I made the verbal remark, as the Bhatnagar committee
that collected data of reserved category employees in state government
jobs reported that the Scheduled Caste (SC) representation has
exceeded its 16% limit.

"Facts cannot belie," the chief justice remarked pointing to the
Bhatnagar committee's findings.

The division bench wanted to know how the government could issue a
notification on September 9, 2011 to protect the promotions of
reserved category employees when they already had adequate
representation in state services. "Protecting excess promotion was
also contempt of court," chief justice Mishra observed.

The state government has been arguing before the court that the
overall representation of the SC and ST employees-who separately enjoy
16% and 12% quotas, respectively-in its services was still less than
28%.

As directed by the court a day earlier, the state government submitted
on Thursday the figures related to the numbers of SC and ST employees
in its job at present. The figures were not disclosed but hearing in
the case would continue for the fourth consecutive day on Friday.

The high court asked the state government if having exceeded the
adequate representation mark, 16.1% in the case of SC employees, was
not reason enough for discontinuing the quota benefit.
