CHENNAI: The minimum mark of 35 per cent is enough for granting
educational loan by nationalised banks, the Madras High Court has
ruled.
Justice D Hariparanthaman gave the ruling on Thursday while allowing a
writ petition from S Maran, belonging to SC community, who was refused
the educational loan by the branch manager of the State Bank of
Travancore in Mogappair on the ground that the candidate had not
obtained the minimum mark of 45 per cent.
The judge observed that if the argument of the bank was accepted, then
in Tamil Nadu, except the general category students, no other students
belonging to SC/ST and MBC categories admitted in BE courses with less
than 45 per cent marks could get educational loans, since the
government had prescribed only 35 per cent for admission to SC/ST
students. Such a prescription of lower marks for SC/ST was to achieve
the objective of the constitutional goal set out in Article 46 of the
Constitution. The very purpose of the educational loan would get thus
defeated.
If such an (rejection) attitude was there, even Dr BR Ambedkar could
not have gone for higher education. He had obtained only 287 marks out
of 750 in the matric exam. But the King of Baroda was kind enough to
extend financial assistance to him, the judge pointed out.
Now the Centre had framed a scheme to provide financial assistance to
the weaker sections of society for their education. It was unfortunate
that the respondent bank was denying the same citing one reason or the
other, the judge said, and directed the bank to grant the loan within
four weeks. The judge directed the bank to sanction the loan for the
subsequent years also.
