Allahabad HC to decide Maya's spending on smaraks and statues: SC

NEW DELHI: Allahabad High Court will now decide in four months the
legality of huge spending from public exchequer, alleged to be over Rs
2,000 crore, by the Mayawati government on building memorials for
dalit leaders and installing their statues in numerous projects at
Lucknow.

On Tuesday, a Supreme Court Bench comprising Justices H S Bedi and A K
Patnaik transferred PILs to the HC and requested the chief justice
there to constitute a separate Bench to hear them along with all
pending matters and decide the issue within four months.

Several petitions had been filed before the HC following which the
state government had approached the apex court seeking transfer of all
of them to one place, preferably the Supreme Court.

Transferring the petitions to HC instead, the Bench said, "We are not
inclined either to interfere with the interlocutory order passed by
the Allahabad HC or to direct transfer of the writ petitions pending
in the Allahabad HC to this court."

The Bench clarified that during pendency of the petitions in HC, the
apex court's earlier interim orders completely stopping construction
activity at the 24 projects in Lucknow would remain in force. However,
it permitted the state government to carry out minor maintenance work.

The permitted works range from removal of stone waste, unused
construction material, scaffolding, temporary constructions and labour
hutments to planting of new saplings, grass, fixing of leak in water
supply line. The state had sought permission for carrying out these
works at Kanshiram Smarak Sthal (Lucknow), Ramabai Ambedkar Maidan and
Dr Bhimrao Ambedkar Sthal.

Satisfied with UP chief secretary's affidavit that no work was carried
out after the ban, the Bench discharged the contempt notices against
him, which was issued after the court formed an impression from media
reports that construction at project sites continued despite interim
orders.

Suggesting that the concession to carry out minor maintenance work did
not apply to all sites, the Bench said, "We have perused the list, but
we are not inclined to permit the state government of Uttar Pradesh to
carry out all the items of work mentioned in the list. In the name of
repairs, the state government had submitted an exhaustive list of
works to be carried out at the sites."
