VARANASI: The director of National Scheduled Castes and Scheduled

[ZESTCaste] Caste film causes uproar in India

Caste film causes uproar in India

Updated August 18, 2011 14:39:25

A Bollywood film that's been banned in India's most populous state has
stirred up emotions about the divisive issue of caste in the
subcontinent.

The film's title Aarakshan literally means 'reservation' in English
and refers to the system of quotas for lower caste people in India's
universities and public service.

Lower caste representatives have slammed the film as offensive and it
was last week been banned from screening in India's biggest state
Uttar Pradesh.

A Supreme Court challenge has been lodged to overturn the ban.

Presenter:Alma Mistry
Speakers: Bikas Mishra, Founder and Editor, dearcinema.com; Prakash
Jha, film director; Dr. Udit Raj, President, Indian Justice Party, New
Delhi; Dr Kamal Mitra Chenoy, Centre for Comparative Politics &
Political Theory, Jawaharlal Nehru University, New Delhi

Listen:
Windows Media

MISTRY: The movie Aarakshan features some of Indian cinema's biggest
names including Bollywood giant, Amitabh Bachchan. Bachchan plays an
upper caste college principal whose integrity costs him his job, to a
ruthless, profiteering rival. Bikas Mishra is the editor and founder
of the Indian film website dearcinema.com. He says Aarakshan tackles
caste issues from the point of view of upper caste Indians.

MISHRA: This is primarily about two different views about two views of
Aarakshan that's reservation amongst upper caste people one who
believed in a little bit of affirmative action based on economic
status of the people, and second one who is casteist and deadly
against reservation.

MISTRY: A system of reservation for India's oppressed lower castes
began during British colonial rule, but was formalised when India
gained Independence in 1947. While the benchmarks change from state to
state, people from lower castes must make up 50 percent of all
university entrants. The system was designed to end centuries of
discrimination against groups such as the Dalits, who were known as
'untouchables' and relegated to menial work.

But the quota system has caused tension amongst those who miss out on
jobs and university places.

Speaking at a festival in Mumbai last month, Aarakshan's director
Prakash Jha said the film didn't take a position on the system.

JHA: We have to see what is happening in the backdrop and landscape of
a reserved society and that is what film will try to show. It's not
always easy to simplify these huge social issues and put them into a
film or come out with some kind of solution.

MISTRY: But the film reviewer Bikas Mishra says even the hero of
Aarakshan has an ambivalent attitude towards the reservation system.

MISHRA: Even the good guy isn't in favour of it rather he is in favour
of reservation based on economic status of people not on the basis of
caste. And this is where I think the film lands itself in a little bit
of difficulty in states which are ruled by the political parties which
are involved in caste based politics.

MISTRY: While this year marks the first time that India's national
Census will collect information about lower castes, unofficial
estimates put India's Dalits at 160 million people. In Uttar Pradesh,
caste rights have been elevated by the election of a Dalit woman,
Mayawati, to the post of Chief Minister. Last week she banned the
film, saying it poses a risk to law and order because of inflammatory
dialogue about Dalits. Two other states Punjab and Andra Pradesh
initially moved to ban the film, but recanted after Prakash Jha filed
a petition in the Supreme Court to have the bans overturned.

Dr Udit Raj is the President of the Indian Justice Party, which
advocates for the rights of oppressed castes. He says the reservation
system has been essential to advance Dalits in India.

RAJ: They have only participated in Government jobs and in politics
through reservation. In other fields like industry, higher education,
media, arts and culture their presence is almost zero.

MISTRY: Dr Raj doesn't want the film banned, but is calling for some
scenes to be censored.

RAJ: The thrust of the film is to argue the case against reservation
that's why we are opposing. However we are not arguing for a ban of
the Aarakshan film, rather we are asking the director to remove
certain dialogues which hurt the sentiments of Dalits.

MISTRY: In the state of Maharashtra some scenes have been cut from the
film, at the behest of the local government. The controversy sparked
by Aarakshan is a sign of the growing political muscle of lower castes
in some states, according to Professor Kamal Mitra Chenoy from
Jawaharal Nehru University.

CHENOY: Virtually every political party is wooing them for sheer
electoral considerations given their numerical strength. So the
reaction to our action is also because of that.

MISTRY: Dr Chenoy says there's no doubt the reservation system causes
some tensions. But he says it is necessary to heal the injustices of
the past.

CHENOY: This is a very major experiment in social engineering and it
should be looked at with sympathy no matter what faults have occurred
and we Indians have to learn to live as one equal people.

[ZESTCaste] Dalits ostracised in Navalgund

Dalits ostracised in Navalgund

August 18, 2011
DC
Hubli

Aug. 17: More than twenty dalit families in a tiny hamlet of Nayakanur
in Navalgund taluk, are facing social boycott by a landlord, for
refusing to work in his house. The landlord instructed shop owners in
the village, not to provide any foodgrains and tea to the dalits. They
were prevented from fetching water from the tank, and threatened with
hefty fine and other punishment for disobeying him. This prompted all
dalits to desert the village, and evoked strong criticism from
religious heads and the public.

"We don't have any agricultural land, and earn our livelihood by
working under the landlords, as bonded labourers. All dalit men are
working as farm labourers, in the lands of landlords, and women are
employed as maids in their houses. Our children are also employed in
the houses of landlords. They get food grains instead of wages in
return. We have been living under fear, and the harassment has been
going on for many years," said forty-two year old Dalit Basappa Madar.

The district administration has beefed up security in the village,
after dalits staged a protest against the atrocity of the landlords.
They lodged a complaint against the culprits at Navalgund police
station. All dalit families returned to their village, after assurance
given by the officials to protect them. The police have arrested six
persons from the upper class in this connection, including main
culprit Andanigouda Patil. Deputy Commissioner Darpan Jain, and SP R.
Dilip, held a meeting with the villagers and appealed to them to
maintain harmonious relations. Dr Siddalinga Swamiji of Gadag
Tontadarya Mutt visited the village, and sought punitive action
against the landlords. Consoling the dalit families, the pontiff
assured them free education and accommodation for their children.

"Dalit families can live without fear in the village, as measures have
been initiated to safeguard them. Legal action will be taken against
the guilty. All facilities of the government will also be provided to
them. Employment will be given to them under National Employment
Guarantee Scheme," DC Darpan Jain said.

[ZESTCaste] Tension in Kalghatagi village over land issue

Tension in Kalghatagi village over land issue
TNN | Aug 17, 2011, 11.37PM IST

HUBLI: Tension gripped Kadankoppa village of Kalghatagi taluk in
Dharwad district on Wednesday as a group of villagers let their cattle
feed on soya bean and tur crops raised by dalits allegedly by
encroaching gomala (grazing land).

While dalits maintained that they have been cultivating the lands
since the past 25 years and have also requested the authorities to
regularize it, the upper caste members said that it is the only patch
of land available for the cattle of two villages to graze.

Deputy commissioner Darpan Jain said that he has instructed the
tahshildar to clear the encroachments on gomala as it is meant for
pasture. He denied the dalits claim that they have been cultivating it
since many years and said it was only since the past 15 months they
have been cultivating it. He said the application which the dalits
claim to have submitted for regularization of the land in question is
for a different survey number and has nothing to do with the said
land.

Law pair 'lost jobs in clash on caste'

AN Indian couple have become the first in Britain to take legal action
for caste discrimination.

Law firm manager Vijay Begraj and his wife Amardeep, a solicitor
there, claim they lost their jobs because senior staff objected to
their marriage.

Vijay, 32, belonged to the Dalits - the lowest people in India's
ancient caste system and once called The Untouchables.

Amardeep, 33, from the high-society Jats, told a Birmingham employment
tribunal a boss asked her to call their wedding off.

She later quit after conditions at Coventry solicitors Heer Manak
allegedly got worse, while her husband was fired.

They claim unfair dismissal - Amardeep's constructively - and discrimination.

The hearing continues.

Indian couple who lost their law firm jobs due to 'forbidden love' at
centre of first caste discrimination tribunal

Home Secretary Theresa May considering whether to add the ancient
Indian class system to British equality law

By Andy Dolan

Last updated at 9:20 PM on 17th August 2011

An Indian couple who met at a legal firm have become the first in
Britain to claim 'caste' discrimination, saying they were forced from
their jobs following their marriage.

An employment tribunal was told that solicitor Amardeep Begraj, 33,
was from a higher caste than her husband Vijay, 32, the practice
manager.

He belonged to the Dalits, formerly known as the Untouchables because
of the nature of their work in roles such as cleaning, pest control or
scavenging, and the lowest class of people according to the ancient
Indian caste system.
Hand in hand: Amardeep Begraj and her husband Vijay are pictured
outside the tribunal in Birmingham

Mrs Begraj has told the tribunal that a senior colleague warned her
against marrying Mr Begraj because people of his caste were 'different
creatures', while he was told his position at the firm was
'compromised'.

The case throws a spotlight on how the hereditary caste system, for
centuries used to categorise people according to occupation or social
standing in India, has gained a foothold in a contemporary Britain
where five per cent of the population originates from the
sub-continent.
ANCIENT CASTE SYSTEM HAS STRONG ROOTS IN BRITAIN TODAY

Dating back to at least 1500BC there are dozens of different castes
based on race and religion, with most of these represented across
Britain.

Despite being outlawed in the Indian constitution during the last
decade, experts say it is increasingly becoming a source of identity
for young people today.
Children at a rural Dalit school in the north Indian state of Uttar Pradesh

Children at a rural Dalit school in the north Indian state of Uttar Pradesh

For example Britain's hugely popular banghra music scene was created
by Jats, who were originally rural people who composed this type of
music to celebrate the harvest in India.

While the Brahmins, generally considered the highest caste because
they were the most educated, hold meetings and group events so people
can meet and marry.

Home Secretary Theresa May is considering whether to add protection to
those discriminated because of their caste to existing safeguards
governing race, sex, religion and sexuality in British equality law.

Five Law Lords last year inserted a clause into the Single Equalities
Act, passed just before the election, giving the Government power to
forbid caste discrimination.

But the issue was then referred for public consultation and the
Coalition is now considering responses.

Mrs Begraj, a Sikh, belongs to the Jat caste, an agrarian people from
the Punjab. She and her husband met when both worked at Coventry-based
solicitors Heer Manak and began dating four years later.

Mrs Begraj told the Birmingham tribunal she was warned by a senior
colleague. 'He said I should reconsider the step I was taking of
marrying Vijay because people of his caste were different creatures.
Marriage would be very different from dating. Vijay was told a number
of times that his position had been compromised for entering into a
relationship with me.'

She also claimed that her workload increased and secretarial support
was reduced 'as a punishment', and she was paid less than colleagues.

The couple married at a Gurdwara, or Sikh temple, in Leamington Spa,
Warwickshire, three years ago, when a colleague raised a toast to 'Jat
girls going down the drain'.

When the couple had their first child, the firm did not send flowers,
although this was standard practice.

Mr Begraj, who worked as a practice manager for the firm for seven
years, was sacked last year. His wife resigned in January.

Last year the couple briefed a committee of the House of Lords, which
swayed them to insert the clause in the legislation recognising caste
discrimination. A subsequent newspaper story led to the couple's car
windscreen being smashed.

The tribunal will also rule on whether they were discriminated against
on grounds of religion or race. Mr Begraj is claiming wrongful
dismissal and his wife is claiming unfair constructive dismissal.

The firm's management are said to consider the couple's claims outrageous.

The tribunal continues.

[ZESTCaste] Dalits reject DCs appeal

Karnataka
Dalits reject DCs appeal
indianexpress Express News Service , The New Indian Express
Posted on Aug 18, 2011 at 11:07am IST

HUBLI: Deputy Commissioner Darpan Jain has said that district
administration would ensure safety and livelihood to the Dalits of
Nayakanur village of Navalgund taluk. "We will also take serious
action against those responsible for social boycott of dalits in the
village," he added.

Jain, who visited the village on Wednesday, held a meeting with
victims. He tried to convince them not to move away from the village
fearing attacks by the upper communities.

However, dalits made it clear to the DC that they don't have any faith
in the administration. They pointed out that they experienced the
social boycott in the village earlier a few years ago. "The people
from the upper castes, who have been arrested recently, will threaten
again even while in police custody. We decided that better to leave
the village as early as possible," they said.

Jain told them that it was not a big issue for the administration to
rehabilitate them in some other village of the same other taluk in
district. But their families were living in the same village for
generations and the village belonged to them. "Why can't you drop the
idea of leaving the village? The administration is ready to give all
kinds of help," he told the dalits.

SP R Dileep also assured that the police have arrested the accused who
imposed social boycott on dalits. He told them they will ensure that
the accused would be proved guilty and punished accordingly. "The
Police Department is ready to provide security to every dalit in the
village. There is no reason for you to leave the village," he said.

However, all the efforts of the district officials proved futile as
dalits refused to their appeal not to leave the village. During the
meeting, some dalits even fell on the feet of officials' several times
begging them to allow them to lead their lives. They told the DC and
SP that they would migrate to another place within a week. As a last
effort, the officials asked the dalits to think again if there is any
possibility of changing their decision.

DySP AB Basari and Navalgund tahasildar Vinan Palankar were present.

[ZESTCaste] Mayawati finally lends her support to Anna Hazare

Mayawati finally lends her support to Anna Hazare
Ashish Tripathi, TNN | Aug 17, 2011, 04.31PM IST

LUCKNOW: Uttar Pradesh chief minister and BSP supremo Mayawati finally
broke her silence on Wednesday and announced her party's support to
Anna Hazare's fight against corruption.

The statement came immediately after the minister of state for animal
husbandry and dairy development Awadh Pal Singh Yadav tendered his
resignation. Yadav resigned after being indicted by the UP Lokayukta
for corruption. The Lokayukta submitted his report on Tuesday
following which the BSP top brass found itself in a dilemma over
staying distant from Anna's countrywide agitation against corruption
when one of its ministers had been indicted for the same.

As a face saving exercise, the BSP decided to ask the minister to
resign on his own on the `moral ground' and then chose to issue a
statement on Anna. The minister, who is also an accused in a recent
triple murder case, had earlier rejected the demand of resignation.
The ruling party had even defended the minister in the UP assembly on
the grounds that the allegations did not mean that a person was
guilty. But the opposition accused Mayawati of protecting a corrupt
minister.

On Wednesday, minutes after Yadav submitted his resignation saying
that he was resigning on the moral grounds and in the interest of free
and fair inquiry of charges against him, the BSP leader Mayawati in an
official statement said that her party had always been against
corruption and criminalisation of politics.

She also said that the BSP had also been supporting Anna's agitation
against corruption since the beginning. She said that the central
government should invite the civil society for talks and reach a
consensus on the issue of the Lokpal.

Maya also described Anna's arrest by the Delhi police as
unconstitutional and undemocratic. She went on to say that the BSP was
not only with Anna but with every organisation fighting against
corruption. She claimed the BSP was founded to fight against
corruption. The BSP, she said, was formed only because all other
political parties which ruled the country after independence failed to
serve the people, particularly the poor masses and downtrodden, with
honesty and dedication.

Social activist Anna Hazare got support from unexpected quarters on
Wednesday as UP chief minister Mayawati declared her endorsement for
Anna's crusade against corruption.

"Our party and state government is completely against corruption and
criminalisation of politics from the very beginning," the BSP chief
said in statement released here on Wednesday.

Mayawati secured the resignation of the minister of state for animal
husbandry Awadh Pal Singh Yadav whom the UP Lokayukta has found guilty
on severe charges of corruption.

Lok Ayukta NK Mehrotra had submitted his report on as many as 18 cases
of corruption against the minister and recommended his removal from
the ministry only on Monday.

With Yadav's resignation some other ministers have also become wary of
their future.
