Chandigarh: In a bid to mount pressure on the government, Haryana Jat
leaders announced on Wednesday that their community will boycott the
Holi festival in the state March 20 and observe a "black day".

Hundreds of Jat community members, including women, are since March 7
squatting on railway tracks and disrupting train services in Punjab
and Haryana to press for reservations in government jobs under the
Other Backward Classes (OBC) category.

A delegation of Jats met Home Minister P Chidambaram and Social
Justice and Empowerment Minister Mukul Wasnik in New Delhi on
Wednesday.

"A special delegation of Jats, including members from Punjab, Haryana
and Jammu and Kashmir, met Union Home Minister and Social Justice and
Empowerment Minister in a joint meeting in New Delhi today
(Wednesday). The meeting was neither successful nor unsuccessful,"
said Hawa Singh Sangwan, state president of All India Jat Aarakshan
Sangarsh Samiti.

"They have sought three-day time to announce their decision. In the
meantime, we would continue our protest and intensify it after three
days. Haryana Jats would also boycott Holi and celebrate it as black
day," he said.

In Haryana, Jat protesters have blocked almost all railway lines in
Bhiwani, Hisar and Jind districts. For the last few days, railway
authorities have either cancelled many trains or diverted these,
causing losses worth millions of rupees.

Sangwan said they would gradually block all railway lines in the state
and cut off Haryana from other parts of the country.

Due to shortage of coal caused by the agitation, power generation at
the recently-commissioned 1,200 MW Rajiv Gandhi Thermal Power Plant at
Khedar in Hisar district has been stopped for the last four days,
officials said.

Rejecting a request by the Centre to suspended their agitation, the
Jat community tonight decided to continue with its ongoing stir while
keeping open the option for the next round of talks.

The Jat leaders had meet Union Home Minister P Chidambaram and Social
Justice Minister Mukul Wasnik where they were asked to suspended their
agitation demanding reservation in Central jobs under the OBC quota.
The core committee of the protesting Jat leaders meet at Vasundhara
near Ghaziabad and rejected the government's request. Minutes after
the meeting ended, All-India Jat Arakshan Samiti president Yashpal
Malik told the Tribune over phone: "We have decided to continue with
our stir while keeping the option for talks open".

"The Central Government did seek suspension of the agitation till the
discussions were on. However, that was not acceptable," Malik said,
adding that the community would go ahead with its plans. The agitation
is also aims to stop supplies of essential commodities to Delhi on
March 17. The National Capital is "ringed" by Jat-dominated villages
falling in Jhajjar, Sonepat, Ghaziabad and Noida districts, from where
milk and vegetables are sourced. The agitators have also threatened to
block the supply of petrol and diesel to Delhi.

Earlier in the day, after emerging from the meeting with the Union
ministers, the Jat leaders had dropped ample hints that the agitation
could be suspended by tomorrow following an assurance by the Central
Government to look into the issue.

The Home Minister told the Jat leaders that the government needed 2-3
days time to discuss the matter.

Reservation's biggest failure is that it seems to reinforce rather
than dilute caste-based popular clamour. Social groups, some
not-so-needy, continue to seek its supposed protective cover, often
through violent means. Try telling that to India's politicians, who've
long turned quotas into a tool of competitive electoral mobilisation.
Rajasthan's leaders sometime ago granted Gujjar demands for
self-serving ends. Today, Haryana's Hooda and UP's Mayawati back a Jat
agitation for central jobs under the OBC category. What's blinked at
is that, six decades ago, it was thought that ostracised and
marginalised groups needed reservation only as a timebound instrument
of socio-economic levelling. India has come a long way since then.

Today, reservation has ended up creating "creamy layers" in targeted
sections. The Supreme Court's 50% ceiling on quota has been breached
as well, as in Tamil Nadu. Quotas were meant to facilitate upward
mobility in terms of jobs, livelihoods or status. Instead, they have
virtually come to resemble sarkari privilege, promoting a race to the
bottom with more and more social groups demanding inclusion under
SC/ST or OBC categories. Clearly, if we're to have reservation, it
must be based on the economic criterion. More important, quota-based
positive discrimination must make way for affirmative action in the
form of efficient services delivery to the poor across the social
board.

To the UPA government's credit, social schemes are being pushed with a
broad, secular approach to promoting socio-economic uplift, be it
through Bharat Nirman or the National Rural Health Mission. Whether
NREG, the proposed food security scheme or right to education, the
focus has been on need, not caste. This is as it should be. Whereas
quotas create social friction by building coddled niches,
welfare-for-all has unifying potential, and hence can help bridge
caste divides. The midday meal scheme in schools - encouraging
community eating at a young age - is a case in point.

The underprivileged have a sense of powerlessness and low self-esteem
precisely because they've been treated as a faceless collective to be
swayed by political populism, rather than as individual citizens with
distinct identities and entitlements. Here's where UID and financial
inclusion come in. By giving the poor identity, financial agency and
provable claim to social benefits, such projects can do more good than
quotas ever could. Similarly, reservations in perpetuity can't
substitute for genuine empowerment flowing from access to education,
healthcare and infrastructure. Development, fast-tracked, will work
the magic reservation hasn't in over 60 years. In a new, aspirational
India where votebank politicking increasingly seems an anomaly, the
needy realise this. The outcome of key elections in Bihar - a state
long associated with casteist politics - has demonstrated this not
once but twice.

The court, meanwhile, decided the applications filed by witnesses
regarding the payment of expenses and arrangements to be made for them
at the time of examination."The expenses for the victim or witnesses
protection arrangement in Haryana shall be borne by Haryana
government."However, if the situation arises where the victims or
witnesses are required to stay in Delhi pursuant to the directions of
the court, then under these circumstances the additional protection
and expenditure for the same shall be borne by Delhi government," it
said.The court also directed that the responsibility of boarding,
lodging, food, medical facilities in Delhi would be that of Delhi
government. The court had earlier framed charges against 98 upper
caste men for their alleged roles in burning alive a 70-year-old Dalit
man and his teenaged daughter at Mirchpur village in Hissar district
on April 21 last year. The court had framed charges terming dominant
Jat community as "aggressor" and Dalits as "sufferers" in the April
2010 killings. The Supreme Court had earlier directed that the case
relating to the killing of the father-daughter duo by a mob of over
100 upper caste people be transferred to the special court here to
ensure a free and fair trial.

New Categories for Census 2011
A number of changes have been incorporated in Cenus 2011 for the
better capturing and analysis of data. The details of the changes
incorporated are given hereunder:

1. Gender: New category "Other" introduced in addition to Male and Female.

2. Date of Birth question introduced along with Age.

3. Current Marital Status: Separate codes Assigned for Separated and Divorced.

4. New filter Question on SC/ST Introduced – "Is this person SC/ST?"

5. Disability: The question on disability canvassed at the Census 2001
has been modified. Household Schedule attempts to collect information
on eight types of disabilities as against five included in the
Household Schedule of Census of India 2001. The information is being
collected on disabilities namely, disability 'In Seeing', 'In
Hearing', 'In Speech', 'In Movement', 'Mental retardation', 'Mental
Illness', 'Any Other' and 'Multiple Disability'.

6. Literacy Status for "Other" sex added in addition to existing Male
and Female.

7. New Codes under Status of Attendance in Educational Institutions
introduced for Not Attending viz., (i) Attended before and (ii) Never
attended.

8. Work: In the previous censuses, workers were categorized as 'Main
workers' and 'Marginal workers'. Those who worked for more than 6
months during last year were categorized as 'Main workers' whereas
those who worked less than 6 months were categorized as 'Marginal
Workers'. At the Census 2011, for better capturing and analysis of
Census data, 'Marginal workers have been classified into two
categories viz., (i) worked for 3 months or more but less than 6
months (ii) worked for less than 3 months. The definition of 'Main
worker' remains the same.

9. A separate code-5 has been included under Non-economic activity for rentiers.

10. Migration – Provision to specify the present name of the
Village/Town of the Birth Place as well as the Place of Last Residence
introduced.

11. Name of the Institutional Household is also being recorded.

This was stated by the Minister of State in the Ministry of Home
Affairs, Shri Gurudas Kamat in written reply to a question in Rajya
Sabha today.

Lucknow, March 14 (IANS) Uttar Pradesh Chief Minister and Bahujan
Samaj Party (BSP) supremo Mayawati Monday announced her support for
the ongoing Jat agitation for declaring the community a backward class
and urged the protesters to shift their demonstrations to the national
capital.

'We are in full support of the Jat community's demand for inclusion in
the list of backward castes, but that is something beyond the purview
or powers of any state government and it could be done only by the
central government,' Mayawati said in a statement issued here.

She urged the agitators to shift their demonstrations to New Delhi so
that their voice was heard by the ruling dispensation there.

Meanwhile, the nine-day-old agitation by the members of the Jat
community, who dominate large parts of western Uttar Pradesh, has hit
over 550 train services so far.

With the Mayawati administration and police looking the other way,
demonstrators have been blocking the important Delhi-Lucknow train
route. While a large number of trains have been diverted, a bigger
number of trains were cancelled on account of the sit-in demonstration
by Jat farmers squatting on the tracks.

At many places, the farmers had parked their tractors on the rail
tracks, from where railway authorities were unable to remove them in
absence of support from the state police.

'The state government is just looking the other way and all our
requests to the Uttar Pradesh chief secretary and director general of
police have fallen on deaf ears,' a senior official of Moradabad
railway division told IANS over telephone from Moradabad.

'Apart from affecting passenger train services in a big way, the
agitation had also disturbed freight movement, so much so that crucial
supply of coal to certain power installations was also disrupted,' he
added.

'The agitation has cost the railways dear and the estimated losses
already run into several crores of rupees,' the official said.

NEW DELHI: The Centre seems tilted against the inclusion of "dalit"
Christians and Muslims in the Scheduled Castes list, arguing the need
for evidence to show that converts continued to face discrimination of
the same degree as before their exit from the Hindu fold.

The Union law ministry has cited a Supreme Court judgment dismissing
the claim that the constitutional provision limiting the SC tag to
Hindus/Sikhs was discriminatory. The UPA is learnt to favour status
quo on the back of law ministry's view coupled with the opinion of the
National Commission for SCs — that the touchstone of being a dalit was
if converts followed traditions and customs as before conversion and
suffered the same social disabilities.

The contentious issue is before the apex court and the Centre has
marshalled opinion from its key arms to finalize its stand. A senior
minister who was part of recent discussion in the Cabinet Committee on
Political Affairs, suggested caution, telling TOI: "The Constitution
cannot be tinkered with in a casual manner."

The issue is politically sensitive. Dalits, as articulated by NCSC,
have opposed stretching the frontiers of SC list to outside Hindu,
Sikh and Buddhist fold, arguing that the fresh addition would encroach
on their share of 15% job quota.

The law ministry has added a strong caveat for continuing with the
existing regime by quoting a 1985 SC ruling that quashed a claim that
the 'constitutional order 1950, para 3' discriminated against
Christians.

The Soosai vs UOI, 1985, ruling said the President of India had based
his judgment on the definition of SCs on the material showing that
Hindus/Sikhs "suffered from economic and social disabilities and
cultural and educational backwardness so gross in character..."

The apex court said, "to prove the said clause as discriminatory in
nature, it must be shown that they (converts) suffer from comparable
depth of social and economic disabilities and cultural backwardness
and similar level of degradation within the Christian community..."

The court noted that merely showing continuance of caste after
conversion was not sufficient. "It is necessary to establish further
that the disabilities and handicaps suffered from such caste
membership in Hinduism continue in their oppressive severity in the
new environment of a different religious community," it said.

The law ministry told the Centre that the spirit of the apex court
order had to be taken into account while deciding the issue. The NCSC
said it had not conducted any study to establish the truth either way.

New Delhi : Nearly 39,000 police cases under the (Scheduled
Castes/Scheduled Tribes) SC/ST (Prevention of atrocities) Act were
registered all over the country in 2008, with the maximum of 7,969
offences registered in Uttar Pradesh, Parliament was informed today.

Tabling the 2008 annual report on Schedule Caste/Schedule Tribe (PoA)
Act in the Lok Sabha and the Rajya Sabha, Minister of State for Social
Justice and Empowerment D Napoleon said 38,943 cases were registered
in 2008 as compared to 35,352 the previous year.

He said that of the 79.4 per cent cases of atrocities pending in
various courts, the conviction rate was 31.4 per cent.

Fifty three per cent of the cases relating to SCs figured in charge
sheets in courts during 2008 and 21.5 per cent cases were closed after
investigations. Likewise, 57 per cent of the cases related to STs were
named in the charge sheets in this period and 17 per cent cases were
closed after probe, the report said.

The report said that while Uttar Pradesh accounted for the maximum
cases against SC, with 7,960 cases, Madhya Pradesh had registered the
maximum cases against ST with 1,071 offences.

While tabling the report, Napoleon cited reasons for the delay in
laying the annual report for 2008 and said certain state governments
were slow in giving their reports to the ministry.

Napoleon also said the National Crime Records Bureau had furnished the
data for 2008 only in February 2010, adding to the delay.

Dalit jeweller shot dead

Ambedkarnagar (UP), Mar 17 (PTI) A Dalit jeweller was allegedly shot
dead by unidentified persons in Jamnipur bazar in Akbarpur police
circle here, police said today.

Mahendra Kumar was shot dead by some unidentified men yesterday when
he was returning home, they said, adding the assailants later took a
bag containing cash and jewellery.

Kumar was rushed to a hospital, where he was declared brought dead.

Police is probing the matter.

LUCKNOW: The 77th birth anniversary of BSP founder Kanshi Ram on
Tuesday turned out to be a sober affair. The usual grandeur seen in
the programmes organised by the Bahujan Samaj Party was missing.

There was no rally, no crowds, no cultural programmes and no organised
tour of dalit memorials for BSP supporters.

A BSP worker tried to explain the reason behind the low-key
celebrations. "There has never been pomp and show on birth anniversary
of Kanshi Ram. Last year, since it coincided with the maharally, there
was a bigger celebration. The party had completed its 25 years. There
was all reason to rejoice,'' he said. However, no official statement
from the party was available.

The key highlights of last year celebrations included special pandals
erected at Kanshiram Smriti Upvan where Mayawati addressed a
maharally. Party workers from across the country including Karnataka,
West Bengal, Maharashtra, Haryana, Madhya Pradesh, Punjab, Gujarat,
Rajasthan and Uttarakhand had attended the maharally. A special tour
of dalit memorials here was also arranged for the rallyists.

Balangir, March 15: Acting upon a Public Interest Litigation (PIL)
filed by the general secretary of Paschim Odisha Adivasi Mahasangh,
Orissa High Court recently ordered the state government to pay
enhanced stipend to students belonging to scheduled caste and
scheduled tribe communities. The order took into account price
escalation and stipend paid to students of other categories.

A division bench comprising chief justice V Gopala Gowda and justice
B.N. Mahapatra asked the commissioner-cum-secretary of the SC and ST
welfare department to implement the court order from the current
academic year.

The Paschim Odisha Adivasi Mahasangh had expressed concerns over the
fact that students belonging to other backward classes (OBC) and
socially and educationally backward classes (SEBC) of BPL families
were getting a much higher stipend than those of the SC/ST students.

General secretary of the Paschim Odisha Adivasi Mahasangh, Niranjan
Bishi, who had filed the PIL, informed that students belonging to
OBC/SEBC category were entitled to a stipend of Rs 750 per annum while
there was no such provision for tribal and dalit students of BPL
families.

"Similarly OBC/SEBC students from Class VI to VIII receive a stipend
of Rs 900 and those of Classes IX and X get Rs 1,000 per annum. On the
contrary, SC/ST students get a paltry Rs 150 for Classes VI to VIII
and Rs 200 for Classes IX and X. This is sheer injustice," Bishi said.
The tribal leader further said the Mahasangh had urged the government
to increase the stipend of SC/ST students studying in residential
schools of the welfare department to Rs 530. "We had also urged the
government to fix stipend of SC/ST students at Rs 1,500 for Class I to
Class V, Rs 1,800 for Class VI to Class VIII and Rs 2,000 for Class IX
and Class X.

"Our demand is genuine as poor students in Navodaya Vidyalaya get Rs
2,500, while those in central schools are paid Rs 3,500. I filed the
PIL to draw the attention of the high court to all these
discrepancies," Bishi said. After hearing the counsels, the judges
asked the state government to dispose the representation of the
petitioner keeping in view the provision under Articles 15(3) and 41
of the Constitution.

"Taking into account price escalation and the stipend amount which is
being paid to students of other category, the opposite parties should
dispose the case as soon as possible," the bench said.

MIRCHPUR: Beneath the calm lies an air of uneasy restlessness. It has
been nearly 11 months since caste violence rocked Mirchpur but the
atmosphere is far from being calm. One can feel it the moment one
enters this small village, located roughly 60 kilometres from Hisar.

At every corner there are pickets with CRPF jawans manning them. While
on one hand, the Jats insist that everything is peaceful and blame the
media and NGOs for portraying the Dabangg versus Dalit picture, the
Valmikis, on the other, say they are constantly living under fear.
According to them, the terror is escalating with each passing day and
two months ago, around 130 villagers had fled the village after Jats
publicly announced that they would not spare anybody in case the 103
youths who are currently lodged in Tihar jail and accused in last
years violence are punished by the Supreme Court (SC).

Recently, the SC pointed out that Jat khap panchayats may now have to
pay up Rs 33.95 crore to compensate the loss and damage they caused by
blocking rail and road traffic in Haryanas Jind district for 11 days
in January to protest the arrest of their youth in the Mirchpur caste
violence that rocked the district on April 21 last year.

On January 19, the Jats went around our village and said they will go
to any extent to settle scores if the SC verdict is unfavourable. The
same night, 130 villagers fled and took shelter in Hisar where they
have been living since then. However, five days ago, Raj Kumar Obra, a
Jat leader, in a public meeting instigated the crowd to kill the man
who is providing shelter to these villagers. We are all living under
fear and dont know what will happen next, said 29-year-old Dalsher
Singh, whose house was completely burnt down in the violence.

While the government has extended a helping hand and has rebuilt their
houses, the dalits want a livelihood and wish to see their children go
back to school. Ever since the violence broke out, we have been
jobless. The Jats used to give us work but since they dont trust us
anymore they refuse to employ us. We find if difficult to make both
ends meet. Our children are being denied admission in schools because
the Jats are threatening the authorities and say they will burn the
schools if they give admission to our children, said 26-year-old
Satyawan Singh.

More blood was splattered in a Bhandara village on Saturday evening
when a minor dalit girl was raped and later burnt alive at Dushala
village near Khairlanji, some 100 kms from Nagpur in Maharashtra.
According to delayed reports, one Ankush Ramdayal Gajbhiye (26), a
resident of Dr Ambedkar Nagar of
Dushala village, lured the victim (his cousin), a student of 6th
standard, when she was alone at her home.

Ankush reportedly took her away to his farm on a cycle by giving her a
candy and then reportedly raped her. The girl screamed, but her shouts
went unheard and finally she fell unconscious. This scared Ankush and
he poured kerosene on her and set her on fire.

The crime came to light following an enquiry by the victim's parents
at night as one of the villagers informed of seeing Ankush with the
girl.

The villagers then caught Ankush and thrashed him before he confessed
the crime. The villagers were left aghast after seeing the crime
scene. The stack of hay was reduced to ashes and the villagers could
only see the charred bones of the girl.

The villagers later handed over Anklush to the local police where he
again confessed his crime.

Dushala, just 10 kms away from Khairlanji, is the village where four
dalits of Bhotmanage family were mercilessly killed by a village crowd
in 2006.

Siddhartha Gajbhiye, a resident of Dushala village where the minor was
raped, was one of the prime witnesses of Khairlanji massacare.

inequalities and economic disparities with the focus on the student
community. How it suffers is told grippingly through the story woven
around the four protagonists — Vijay, Madhu, Naffe Singh, and Rekha.

life, student unions, and concomitant hardships. The different kinds
of humiliation and abuse, as also the miseries, the Dalits are
subjected to come across sharply, and the images they produce leave
great impact.

That one needs enormous encourage to stand by one's conviction is
conveyed tellingly through the characterisation of Vijay.Madhu,
initially swayed by western fashions and addictions, evolves into a
woman of noble ideals and strong character, thanks to her association
with Vijay, with whom she falls in love. Eventually, the story is
taken to the logical conclusion of 'good defeating the evil', with the
narrow-minded dogmatic persons turning over a new leaf and becoming
broadminded. The message is: "Mukti maarg" or the way to liberation is
'positive change.' The translated version makes for easy reading, a
testimony to Santha Sundari's
proficiency in the art.

The debate on Dalit capitalists is welcome. My observation is that as long as
caste system, untouchability are alive in India Dalits cacnot become
capitalists. Even OBC capitalists are Shudras and they cannot succeed unless
they serve the upper castes or brahmins. Mr. Teltumde is  a marxist in the
company of upper caste marxists. Marxism is the refuge of Brahmins in India. My
obsevation is, as you climb the caste model you find increasing no. of marxists.
In Maharashtra for example, you will find Dalits as takers for Jotirao Fule.
Acceptance decreases as you go upward in the caste heirarchy. Dalits , OBC follw
Fule but Marathas do it with reservations. For Ex. Sharad Patil, a maratha, does
not accept Fule completely. Joins Fule with Marx. Baba Adhao, a socialist
Maratha accepts Fule attaching Prgressive word. He runs 'Purogami Satyashohak;
magazine. Sharad Patil edited for some years the marathi monthly Styashodhak
Marxwadi. (Satyashodhjak movement was launched by Fule in 1873 which was against
Brahmanic machination.)When you come to Brahmins they do not consider Fule at
all. Brahmins consider joining Fule or Ambedkar with Marx as inferior ideology
or contaminaztion of Marx. They considred them as stooges of British imperialism
and that was and is the view of RSS Brahmins, too.

As Marxism is an idealogy for classless society and does'nt touch upon caste
system. It is helpful to maintain the caste heirarchy and also talk of classless
society. Brahmanism is safe in marxism.
