Hyderabad, March 14: In the last 19 years, money to the tune of Ra
21,000 crore from the SC sub plan funds for Andhra Pradesh, which
should have been used for the development of the scheduled caste
community, has never reached them, revealed K R Venugopal, retired
bureaucrat and former secretary to Prime Minister of India.

Expressing concern at the diversion of funds earmarked for Scheduled
Castes (SC) and Scheduled Tribes (ST), he said, "A part of the funds
has been spent on outer ring roads, beautification of Hussainsagar,
flyovers and other projects." Venugopal was speaking at a media
workshop organised by the Centre for Dalit Studies (CDS) in the city
on Sunday on the implementation of Scheduled Castes Sub Plan. The
guests at the workshop spoke at length on issues related to budget
allocation for SCs and STs and its impact on their welfare.

Venugopal expressed concern over the growing disparity between the
underdeveloped sections and the developed sections as a result of the
inefficient usage of the funds allocated to them by the state and the
central governments.

"A specific law should be introduced for the transparent usage of
these funds as injustice is being done to the lower caste population
for the last 50 years," he said adding, "Some of the problems faced by
dalits include high infant mortality rate, low literacy rates, high
school-drop out rate, maternity deaths and poverty." Sharing the
details of his recent meeting with the chief minister, Venugopal put
forward a few demands which would help in the betterment of these
sections.

"I had submitted a representation to the chief minister on behalf of
the CDS in which we demanded that Rs 4,000 crores be spent every year
for the next five years to make up for the unspent Rs 21,000 crore of
the fund. We appealed to the CM to pass a resolution and implement it
immediately," he said.

According to him, there is a need for the government to allocate a
part of the fund to organisations working on dalit issues. "Funds
should be provided to organisations like CDS in order to do research
and conduct awareness programmes," he said.

K Srinivas Reddy, senior journalist and secretarygeneral, IJU felt
that the policies and benefits meant for the socially deprived
sections were only on paper.

"Most of the government schools in villages consist of only SC, ST and
BC students.

The teaching facilties is also poor. The conditions of welfare hostel
are even more pathetic," he said, adding that sometimes hostel
students have to go hungry as a result of contractors not supplying
food on time.

M Lakshmaiah, senior journalist, pointed out the discrimination
existing in the villages. "In most of the villages, good water supply
ends near Dalitwada. These areas do not have proper roads or
electricity.

About 30 Dalits on Tuesday presented a petition to the Revenue
Divisional Officer in Kumbakonam, Tamil Nadu stating that they would
boycott the April 13 assembly elections for alleged non-payment of
compensation under the SC & ST Atrocities

Prohibition Act for no action over 'attacks' against them.

They said about 300 backward class families of Umamaheswarapuram
village were attacked by some armed persons on Jan 15. The group
alleged that though a complaint was lodged, no action was taken
against the attackers, instead false cases were filed against Dalits
and some were even arrested.

Their property had been damaged and their day-to-day activity affected
as they were daily wage earners they said adding they were also not
given any compensation under the act.

The group demanded that the cases be withdrawn, the real accused
arrested and compensation be paid immediately, failing which they
would boycott the polls.

Lucknow : On the ninth day of a Jat agitation disrupting train
movement in several parts of north India, 52 trains were cancelled
today. Of these trains was the flagship Lucknow Mail, cancelled for
the first time in decades. However, even as the number of disruptions
on the Moradabad rail division now numbers 325 cancellations and 197
diversions, the Mayawati government seems to be in no hurry to clear
the tracks.

On the contrary, claims Chief Public Relations Officer (PRO) of
Northern Railways Manish Tewari, their several letters to Uttar
Pradesh Chief Secretary Atul Kumar Gupta to end the crisis, even
appeals on the phone to the Cabinet Secretary, had done nothing to
help restore railway traffic.

While officials are tightlipped, few doubt the reason behind their
hesitation to act against Jats agitating for 27 per cent reservation
in Central jobs under the OBC category. Chief Minister Mayawati has
extended the BSP's support to the Jat demands, though she had appealed
to them not to create a law and order problem.

Politically, the support to the agitation serves two purposes for the
BSP. It helps counter Rashtriya Lok Dal chief Ajit Singh's grip over
the Jat voters, while simultaneously creating problems for the
Congress.

During the farmer agitation in Tappal near Aligarh over land
acquisition for the Yamuna Expressway and a township, Rahul Gandhi had
visited the farmers, expressed solidarity with them and taken a
delegation to meet Prime Minister Manmohan Singh.

"Now it is the BSP's turn to settle scores by supporting this
agitation," said a party leader.

Meanwhile, the Railways counts its losses, which till today already
amount to more than Rs 1 crore. The important trains that have badly
suffered due to the agitation include Ala Hazrat, Kath Godam, Kashi
Vishwanath, Ferozpur-Bombay central, Awadh Assam, Nauchandi (all
express trains) and Lucknow Mail.

Apart from the cancellations and diversions, about 200 trains have
been short-terminated. Three trains are expected to remain cancelled
tomorrow and six trains will be diverted.

Goods trains have also been badly hit as the route that the Jats have
blocked is important for their movement. "The movement of containers
that originate from the NSPT (Nhava Sheva Port Trust) in Mumbai has
come to a complete halt," said an official.

The supply of coal to power houses situated in different parts of the
country has also been hit. "Barwala power house that is located in
Haryana's Hissar district is facing a serious problem. All the three
available rail routes which connect this power house are hit by the
agitation," another official said.

"Railway authorities are in constant touch with top officials of UP
government," said Chief PRO of Northern Railways Tewari. "Since law
and order is a state subject, I don't think UP government needs to be
prompted to end the crisis."

Asked about this, UP Principal Secretary (Home) Kunwar Fateh Bahadur
refused to comment. "Better you speak to our Information Department. I
don't interact with the press," he said.

Yashpal Mallik, president of the Akhil Bharatiya Jat Aarakshan
Sangharsha Samiti (ABJSS), said Jats had only occupied properties
under the control of the Centre. "I am happy that behan Mayawatiji has
supported our demand," he said.

"We have launched similar agitations in Haryana, Punjab and Jammu and
Kashmir. UP has included Jats in the list of OBCs, but the other
states have not."

Lucknow, March 14 (IANS) The Uttar Pradesh capital appeared to have
been painted blue on the eve of the 77th birth anniversary of Kanshi
Ram, the late founder of the state's ruling Bahujan Samaj Party (BSP)
and Chief Minister Mayawati's political mentor, Tuesday.

The city's main thoroughfares were flanked by blue hoardings
announcing the big event March 15.

Even hoardings carrying advertisements various brands and companies
were hijacked for the purpose.

Not only has the sprawling Kanshi Ram Memorial spread across a newly
developed 190-acre park been given a blue hue, but even other
monuments and statues erected by Mayawati in honour of BSP icons were
covered under canopies of blue lights.

Countless buntings, banners and posters can be seen hanging down from
every lamp-post along the major thoroughfares, each emboldened with
the names of party functionaries sponsoring the display.

However, unlike the big bash on Mayawati's 55th birthday Jan 15, no
public function has been planned on Kanshi Ram's birth anniversary.
Mayawati would offer flowers at the Kanshi Ram memorial at 10 a.m.
Tuesday, said an official spokesman.

New Delhi: Prime Minister Manmohan Singh has said the issue of
extending scheduled caste benefit to dalit Christians and dalit
Muslims is being "seriously looked", according to a Mumbai-based
Christian body whose members met him on Saturday.

"On extending SC benefit to dalit Christians and Muslims, the Prime
Minister said the same was being seriously looked at and a consensus
was sought to be achieved. Once this was done, the Supreme Court would
be intimated," a release by the Catholic Secular Forum (CSF) said.

The Mumbai-based organisation had on Saturday led a delegation to the
Prime Minister.

Members of the delegation included the Archbishop Vincent Concessao of
Delhi, Justice Michael Saidanha, CSF general secretary Joseph Dias and
President of the Truth Seekers International Sunil Sardar.

Archbishop Vincent Concessao told the Prime Minister that the
government needed to act soon on the issue of the SC status to dalit
Christians and Muslims as dithering on its part was being viewed
negatively by the minorities.

"The Supreme Court is expected to hear a key case, when it expects the
government to give its opinion on a challenge to Paragraph 3 of
Article 341 of the Constitution (Scheduled Caste Order) 150.

"More than dozen individuals and advocates including dalit Christians
and Muslims have joined the case, which has has had numerous hearings
and delays since early 2004," the release said.

The CSF said that the government already has enough political support
on the issue with Chief Ministers of Bihar, Uttar Pradesh and Tamil
Nadu publicly urging the Centre to restore dalit Christians' rights.

Rangnath Mishra Commission, which suggested, steps to improve the
socio-economic conditions of minorities, has also favoured giving SC
status to dalit Christians and dalit Muslims.

"Prime Minister Manmohan Singh listened patiently to the delegation
and assured Christians that the country was indebted to the community
for its social services, which greatly surpassed its minuscule numbers
as a micro reality...he also said he would all in his capacity to
allay the fears and insecurities, the Christians were experiencing,"
the release said.

The delegation had discussed three issues with the Prime Minister
including the long standing demand for extending SC status to dalit
Christians and Muslims, the rise of anti-Christian violence in
Karnataka and Orissa and the demolition of the Mumbai Crosses and
religious structures as per the Supreme Court directives.

The CSF said that the Prime Minister was concerned about the
deteriorating law and order situation coupled with the rising
communalism in Karnataka and Orissa.

The Prime Minister said he would ask Home Minister P Chidamabram to
look into the reports of violence against Christian communities coming
from states, it said.

AMBALA: A dalit woman sarpanch and her husband were thrashed by a
group of villagers at her residence in Sardherhi village of Barara
block on Sunday night after she refused to listen to an influential
person regarding execution of MNREGA works.

The incident came to light on Tuesday when a group of women headed by
Leela Devi, the victim, protested before the office of DSP and sought
registration of a criminal case against the accused. A case was
registered at Barara police station on Tuesday evening. It is learned
that some influential person had sought certain favors from the
Sarpanch in execution of work.

"They not only thrashed, but also tore her clothes. Since then we have
been running after cops to seek action against the culprits. This
shows how dalits, especially women, are being suppressed and harassed
by influential people," Leela Devi's husband said. Baraa DSP Kushal
Pal Singh said, "Besides charges of assault, we have also added
sections related to passing castiest remarks. We have zero tolerance
for such issues. Raids are being conducted to round up the accused."

KATHMANDU, MAR 15 -

The first national general convention of Nepal-India Dalit Friendly
Association held on Tuesday elected a new working committee comprising
15 members under the leadership of Om Prakash BK.

The other elected executive members are: Bishnu Maya Pariyar (Vice
Chairperson), Chandra Kumar Gadal (General Secretary), Meena Swornakar
(Secretary), Lok Darshan Lamichhane (Joint-Secretary), and Ramsugav
Harijal (Treasurer).

Its members are Shambhu Hajara Paswan, Kailash Man BK, Ram Chandra
Bayalkoti, Jayakumar Pariyar, Surya Bahadur Budhaprithi, Swaraswoti
BK, Harka Maya Bardewa, Goma Sunwar and Swaraswoti Pariyar.

After his election as the new chairman Om Prakash BK expressed
commitment to launch an effective program for the welfare of Dalit
people in Nepal and India.

"Our organisation will fight for caste based discrimination that
around 300 million Dalit people of South Asia are facing," he said.

HYDERABAD: The number of SC and ST candidates applying for Eamcet has
hit an all time low this year. With authorities insisting on caste
certificates with Eamcet applications, several candidates have been
unable to apply for Eamcet-2011 even as the last date for application
without fine is on March 16.

According to Eamcet authorities, there is a 30 per cent dip in the
number of SC/ST candidates this year compared to previous years. The
drop in the number of candidates for reservation seats has caused a
drop in the total number of applications that reached the Eamcet-2011
office, Jawaharlal Nehru Technological University (JNTU) officials
said.

While the total number of applications for Eamcet 2010 was around 2.5
lakh two days before the last date for submission, this year the
number is as low as 1.5 lakh. In engineering, the number of
applications received is 1.35 lakh and for medicine the number is
15,000.

According to students from the city who were not able to apply for
Eamcet so far, the tehsildars at various mandals were delaying the
process. "I applied for my caste certificate almost two months ago.
While I made several trips to the mandal office till date I have not
got my caste certificate," said a student from Khairatabad mandal.
Students said that if the applications are not accepted without the
certificate they will have to shell out money as fine for late
submission.

Officials of private Intermediate colleges who submit the applications
of their students in bulk said that the Eamcet authorities should not
insist on the certificates along with applications. "If students fail
to get these certificates on time they would miss an opportunity to
write the exam. The authorities should relax the rules," said faculty
member of a private junior college.

JNTU authorities, however, said that they made caste certificates
mandatory as several OC (open category) candidates had applied under
the SC/ST quota in the previous years. "The general category students
apply under the reservation tag and write Eamcet. After getting a rank
they take admission under management quota in private colleges. We
wanted to stop this practice," said D N Reddy, chairman, Eamcet
Committee and vice chancellor, JNTU.

The authorities are, however, thinking of relaxing the rule. "We are
planning to ask the SC/ST students to submit their applications but
turn in their caste certificates later on before the closing date of
applications with fine," said Ramana Rao, Eamcet convener.

15 member team to lead Dalit body

KATHMANDU, March 15: The first national general convention of
Nepal-India Dalit Friendly Association held on Tuesday elected a new
working committee comprising 15 members under the leadership of Om
Prakash BK.

The other elected executive members are: Bishnu Maya Pariyar
(Vice-Chairperson), Chandra Kumar Gadal (General Secretary), Meena
Swornakar (Secretary), Lok Darshan Lamichhane (Joint-Secretary), and
Ramsugav Harijal (Treasurer).

Its members are Shambhu Hajara Paswan, Kailash Man BK, Ram Chandra
Bayalkoti, Jayakumar Pariyar, Surya Bahadur Budhaprithi, Swaraswoti
BK, Harka Maya Bardewa, Goma Sunwar and Swaraswoti Pariyar.

After his election as the new chairman Om Prakash BK expressed
commitment to launch an effective program for the welfare of Dalit
people in Nepal and India.

"Our organisation will fight for caste based discrimination that
around 300 million Dalit people of South Asia are facing," he said.

In a bid to find an amicable solution to Jats' demand for reservation
in Central government jobs under the Other Backward Classes (OBC)
category, the United Progressive Alliance government has invited their
leaders from Uttar Pradesh and Haryana for talks.

The decision to hold talks with the Jats, whose week-long agitation
has disrupted rail traffic, with protesters squatting on the track in
various parts of north India, was taken on Tuesday at a meeting of the
Cabinet Committee on Political Affairs, chaired by Prime Minister
Manmohan Singh. Attorney-General G.E. Vahanvati was present.

Home Minister P. Chidambaram and Social Justice and Empowerment
Minister Mukul Wasnik will be the government's representatives at the
negotiations, likely to be convened on Wednesday, official sources
said.

The agitation also figured in the Rajya Sabha, with the government
assuring MPs that it would make a statement on Wednesday.

The decision to call the agitators for talks was taken after the Jats
threatened to cut all essential supplies to Delhi if their demands
were not met by Thursday. The agitators have also threatened to block
oil supply from the Mathura Refinery to Delhi.

Meanwhile, at a Congress briefing, party spokesman Abhishek Singhvi
parried questions on the party's stand on the Jats issue, saying it
was "delicate and sensitive" and could be resolved only through
dialogue. Stressing that his party was opposed to violence, he said
all stakeholders, including the Haryana and Uttar Pradesh governments,
should resolve it through discussions.

In Haryana, the Assembly witnessed uproarious scenes for over 80
minutes over the Jat stir.

SIRSA: Tipping off the police and the child marriage prohibition cell
in-charge about plans of a Jat family of marrying off their
13-year-old daughter proved costly for a Dalit, who along with his
family, was ostracized by a caste panchayat, convened by Jat families
of village Kumarian of the district here on Sunday.

Chaired by Daya Ram, an ex-chairman of the village committee and Vinod
Beniwal, an ex-sarpanch of the village, the panchayat attended by
members of the Jat families gave Rameshwar Balmiki, a peon a 24 hour
deadline to leave the village for his "wrongful" act. The Jat
Panchayat has accused Balmiki of misguiding the police about the
girl's age. The decision was taken after an hour long panchayat held
in the premises of the government school here.

Though Rameshwar, was also summoned but fearing humiliation, he did
not turn up for the panchayat. This only added to the panchayat's
anger, who announced the diktat. Acting on a verbal complaint lodged
by Rameshwar, SP Satender K Gupta assured police protection for him.
Gupta told TOI, "Investigations are in progress and appropriate action
shall follow.'' On Friday Rameshwar, who is a peon in a branch of the
Gramin bank in his village tipped off the district police and the
child marriage prohibition cell incharge about Mangtu Ram's plans of
marrying off his minor daughter in Kumarian village. Rameshwar was
among those present on the spot when the raiding parties comprising of
police officials and officials from the social welfare department
swooped down on Mangtu Ram's house where the marriage was to be held.
As Mangtu failed to provide documents to prove his daughter's age, he
was asked to cancel the marriage.

New Delhi, March 11 (IANS) A Delhi court Friday framed charges of
murder, rioting and criminal conspiracy, among others, against 98
people accused of attacking Dalits in Haryana's Hisar district in
April 2010, which led to the death of two community members.

Special Judge (Scheduled Caste/Scheduled Tribes Act) Kamini Lau said:
'In addition to the aforesaid material placed before this court in the
charge-sheet, the MLC (medico-legal case) of the victims are also
present on record which I have duly perused. Most of which show the
presence of injuries caused to them by blunt objects.'

'The post-mortem report of the deceased Tara Chand and his daughter
Suman also show that they had expired on account of burn injuries
connected with the incident. Further, the report regarding the damage
of immovable properties and theft of movables has also been perused by
me,' she said.

Seventy-year-old Tarachand and his 18-year-old physically-challenged
daughter Suman were killed in the April 21 arson attack in Mirchpur
village, about 300 km from Chandigarh.

The judge said that prima facie there was sufficient material on
record to frame charges under Sections 120-B (criminal conspiracy),
302 (murder), 147 (rioting), 148 (rioting armed with deadly weapon),
149 (member of unlawful assembly guilty of offence), 323 (voluntarily
causing hurt), 325 (voluntarily causing grievous hurt), 395 (dacoity),
397 (robbery with attempt to cause death), 427 (mischief), 435
(mischief by fire), 449 (house-trespass), 450 (house trespass in order
to cause offence), 452 (house-trespass after preparation for hurt,
assault) of the Indian Penal Code and additional charges under Section
3(1)(x), (xv), 3(2)(iii), (iv) and (v) of the Scheduled
Castes/Scheduled Tribes (Prevention of Atrocities) Act, 1989 against
all the accused.

'In this regard I may observe that the incident dated April 21, 2010
was not an independent incident but was arising out of and stretching
from the earlier dispute dated April 19, 2010,' the judge said.

'The incidents have to be taken and read together and not in
isolation. Once the constitution of the unlawful assembly, the common
object of which is prima facie evident, then each and every member of
such unlawful assembly would be jointly and collectively liable for
any act done by any other member of such an assembly,' Lau added.

The judge also said that the context of the caste cannot be lost sight
of in the present case. 'It is writ large that the accused belonging
to dominant caste (Jat community) were the aggressors and the victims
belonging to the Dalit community were the sufferers.'

The entire incident took place within the full public view of the
residents of the village and hence the provisions of the Scheduled
Castes/Scheduled Tribes (Prevention of Atrocities) Act, 1989 would
apply, she added.

At this stage of framing of charges, the court is not required to
meticulously go into the material placed on record and to assess,
evaluate and weigh the prosecution evidence in a criminal case as it
is done at the final stage.

The Supreme Court had earlier directed that the case be transferred to
the special court here to ensure a free and fair trial.

MANGALORE: Prime Minister Manmohan Singh assured the Christian
delegation that he will try to evolve a consensus on granting
Scheduled Caste status to dalit Christians and Muslims.

This assurance was given to the Catholic Secular Forum (CSF), the
Mumbai-based NGO, who took a delegation to meet the PM on various
issues plaguing Christians. Once this was done (consensus on SC
status), the Supreme Court would be intimated of the government stand,
the PM told the delegation stated CSF general secretary Joseph Dias.
The Supreme Court delayed a verdict on this issue as the Centre was
unable to make up its mind on the matter, Dias added.

The Supreme Court is expected to hear a key case, when government
gives its opinion on a challenge to Paragraph 3 of Article 341 of
India Constitution (Scheduled Caste Order) 1950. This Paragraph 3 of
Article 341 has been described by Christians and Muslims as
anti-Constitutional and `communalizing' the uplift of the former
untouchable groups who still remain the most economically and
politically marginalized in India.

Dias stated that Delhi Archbishop Vincent Concessao said the
government needed to act soon, on this issue as its dithering was
being viewed negatively by the minorities as communalizing the SC
benefits to support only the dalits of Hindu, Sikh and Buddhist
origin.

Dias said that the PM was concerned about the deteriorating law and
order situation, coupled with rising communalism, particularly in
Karnataka and Orissa.

JAIPUR: The Centre for Dalit Rights will form a team of experts to
probe into allegations of murder of a boy– Rajendra Bairwa – during
the inauguration of a guest house at the Mehndipur Balaji in Dausa on
June 3 last year.

This was decided at a public hearing organised at the Samagra Sewa
Sangh, Durgapura, on violence and discrimination against Dalits in
Rajasthan.

According to Thandi Ram, the boy's uncle, Bairwa was sacrificed to
appease the gods so that nothing untoward happens at the community
hall. The programme was attended, among others, by Vijay Goyal, a
former Union minister and the national general secretary of the BJP.
Thandi Ram alleged that a contractor, Durga Lal Baira of the Mehndipur
Balaji, had come to Rajendra Bairwa's house three days before the
programme and taken the boy from his widowed mother saying he would
get a job.

"The boy was put on an alter and shot by Goyal's bodyguard Maheswari.
We came to know of the incident later. When we rushed there the
post-mortem had already been done. It was much later when villagers
alerted us that we realised what had happened," he claimed.

However, police officials have so far denied this. Police say shots
fired in the air by the bodyguard by mistake killed the boy. The boy's
mother was later paid Rs 6.5 lakh as compensation by Goyal.

Thandi Ram rejects the explanation and insists the boy was murdered.
"His mother has been taken into confidence by the accused with the
money paid to her," Thandi Ram said.

Nearly 19 other cases were scheduled to be heard during the meeting by
a panel that included retired jurists, bureaucrats, police officers
and specialists.

The panelist have decided to seek compensation and take another case
where three students from the Valmiki caste were thrown out of by a
school in Alwar as they were from a lower caste. Though enquiries have
already been made by the district education officer and the district
commissioner, both of whom have "reprimanded" the school for the act,
but the court felt that action should be initiated against school
officials and compensation paid to children.

Lucknow : The BSP is all set to show its strength by organising
district-level public meetings on Tuesday across the state on the
occasion of 77th birth anniversary of its founder Kanshiram.

The party leadership has asked functionaries to ensure a good
gathering of supporters at the venues.

Chief Minister Mayawati, however, may not attend any function. "She
will visit the Manyawar Kanshiram Smarak Sthal on Lucknow's VIP road
to garland Kanshiram's statue," said an official in the state's
Information Department.

Party insiders said the CM has given special instructions to leaders,
including MPs/MLAs, to attend the functions.

"At least 5,000 supporters will come from each Assembly area. The
coordinators will speak about the struggles of Kanshiram's life," a
leader said. According to him, since Kanshiram had travelled even in
remote areas across the state, he is a most respectable figure among
the party's old cadres.

The party aims to woo young Dalit voters through the functions.
"Younger Dalit voters in rural areas have got diverted from the path
showed by Kanshiram," a leader said. "This is not a good sign for the
BSP, which has been the sole contender of the votes of the community
across the state. So, the leaders want to make the young generation
aware of Kanshiram's ideology."

Next year, he said, the BSP will not be in a position to hold such
meetings due to Assembly elections, he added.

As per strategy, the party will project Kanshiram as the leader who
ensured respect for the Dalit community. "Despite enjoying the
reservation facilities given to Dalits by Baba Saheb Ambedkar, the
Dalits are in no position to get proper respect," said another leader.
"It was Kanshiram who turned the Dalit samaj from the society of
takers to the society of givers with the help of ballot."

According to sources, leaflets containing Kanshiram's achievement will
be given to participants at the function. In her message to people,
Mayawati said Kanshiram was a great thinker who not only created
consciousness among Dalits, but also gave new directions for the all
round development of "Sarva Samaj".
