Allahabad The Allahabad High Court has quashed the Uttar Pradesh
government's order cancelling negative marking in the post-graduate
medical entrance exam for SC, ST students.
On Thursday, the court issued directions to hold fresh counselling,
which, it said, should not take into account the government circular
dated April 6, 2010, by which negative marking for SC/ST candidates
was cancelled after declaration of results, because there were not
enough candidates for reserved seats.

The circular had ordered the Director General of Medical Education to
add the marks deducted through negative marking only for SC/ST
students.

The result of the entrance exam was declared on March 4 and the
counselling was to begin from April 11. But the government circular
came five days before the counselling was to begin.

Justice Dilip Gupta passed the order on a petition of Hemant Kumar
Maurya and others, who had challenged the government circular.

The petitioners had appealed that candidates belonging to reserved
categories who secured less than 40 per cent marks not be allowed — as
prescribed by the Medical Council of India.

The court observed that the number of questions a candidate may
attempt in a multiple choice format depends largely on whether
negative marking applies. In case of negative marking, a candidate
attempts only those questions where he is sure of the answer.
Otherwise, a candidate attempts all questions.

"The negative marking, therefore, has a direct effect on the number of
questions a candidate may attempt and so it is necessary for the
authority to make it known to the candidates before the examination
whether there will be negative marking or not and if a decision for
negative marking has been taken prior to the holding of the
examination, such a decision cannot be altered after the examination
is held," said the court.

It added: "If the system of negative marking is dispensed with after
the exam is held, the examination will stand vitiated and cannot be
considered valid for determination of the academic merit of
candidates. For this reason alone, the circular dated 6th April, 2010
deserves to be set aside."

LUCKNOW: The Bharatiya Janata Party (BJP) Thursday distanced itself
from comments made by its leader Varun Gandhi in which he said statues
of Uttar
Pradesh Chief Minister Mayawati would be replaced with those of Lord
Rama if the party came to power in the 2012 assembly elections.

"Those were his personal comments. The party will act within
constitutional rights," party's state chief Surya Pratap Shahi told
reporters here.

"The party has yet to take a decision on the issue (related to
replacement of Mayawati statues with that of Lord Rama). It was his
(Varun Gandhi's) personal opinion," added Shahi.

At a function organised Wednesday at the BJP office in Lucknow to
welcome the party's new state unit chief, Gandhi said: "We are
determined to replace the statues of Mayawati and install statues of
Lord Rama in those places."

"After several years, there appears a ray of hope. We are confident we
would be voted to power under the leadership of our newly-elected
state chief," he added.

Gandhi accused Mayawati of targeting BJP activists for being vocal
against her "anti-people policies".

"Once we come to power, those harassing us will definitely have to
face action for their ill-deeds," Gandhi said.

Workers of Lok Janshakti Party, Dalit Sena and Dalit Dasta Virodhi
Andolan staged a demonstration at Jantar Mantar here on Thursday
protesting against the rising cases of atrocities on Dalits in the
country.

Addressing the rally, LJP president Ram Vilas Paswan said the policy
of discrimination and disregard adopted by various State governments
leads to such attacks on Dalits. "It is high time the Centre
intervened to protect the rights of Dalits. A special court and a
committee must be set up to look into such matters. The affected
Dalits must be rehabilitated far away from the place where they were
subjected to ill-treatment," he added.

Mr. Paswan also demanded that the Khap Panchayat in Haryana be banned.

In a memorandum to the Prime Minister, Mr. Paswan drew his attention
to the attack on Dalit houses at Mirchpur in Haryana on April 21 in
which two people were burnt alive.

"Even after that dreadful incident justice has been denied to the
affected Dalit villagers. The Haryana Government has provided economic
relief to the affected people and also offered jobs to three persons
but such incidents are not new to the State." Meanwhile, in another
protest organised here on Thursday by Haryana Dalit Bachao Sangharsh
Samiti, Dr. Udit Raj demanded that the Haryana Chief Minister be
dismissed and a judicial probe ordered into the Mirchpur incident.

Lucknow, May 20 (PTI) An Assistant Sub-Inspector of Police was
arrested for allegedly assaulting a dalit and opening fire from his
revolver in Etah district of Uttar Pradesh, police said today.

Posted at Kanshiram Nagar, ASI Anil Kumar Yadav was arrested last
evening on charges of assaulting a dalit and misbehaving with a police
team.

Yadav also allegedly opened fire from his revolver and created a
ruckus at a garage where he had gone to get his motor-cycle serviced,
police said.

The ASI allegedly hit the dalit with his revolver,they said.

Bhopal, May 20 (PTI) Madhya Pradesh BJP today slammed National
Commission for Scheduled Castes Chairman Buta Singh for his adverse
comments on status of dalits in the state.

The state BJP passed a motion condemning Singh at a meeting here for
his comment that status of dalits was not good in Madhya Pradesh.

"Singh was playing into the hands of Congress which was against the
dignity of his post," BJP state general secretary Nandkumar Singh
Chouhan told reporters.

He said Singh, who along with a team of NCSC visited Jait, the native
village of Chief Minister Shivraj Singh Chouhan on Saturday, was wrong
to say that dalits were being discriminated there.

Congress cooked up a story that dalits were not being allowed to enter
temples in Jait and Singh went there to give it a political hue, the
general secretary alleged.

Dalit community seeks better life

Bangladesh's 1.5mn Dalits are seeking recognition for the menial work
they do and also a better deal for their children.
The Dalits were brought to present-day Bangladesh by the British
rulers in 1835 from India's Kanpur and Nagpur cities.
Community leaders say that although they educate their children, they
are not given jobs because of their identity as Dalits.
Krishnalal, chairperson of the Bangladesh Harijan Oikya Parishad, said
at a conference on Tuesday: "We keep the city clean and for that
occupation we are considered untouchables."
"Our children receive formal education, but they do not get jobs
because of their identity as Harijans," The Daily Star quoted him as
saying.
He received support from social organisations, human rights bodies and
NGO speakers who called for creating alternative job opportunities for
them.

Says Dalit authors are activists too


On literature:Marathi author Sharankumar Limbale inaugurating a
national seminar on 'literature, art and culture,' organised in
connection with the State conference of the Purogamana Kalasahithya
Sanghom in Kollam on Friday.

KOLLAM: Marathi author Sharankumar Limbale here on Friday said that
Dalit literature was a new and distinctive stream of Indian
literature.

He was inaugurating a national seminar on 'literature, art and
culture', organised in connection with the State conference of the
Purogamana Kalasahithya Sanghom.

Mr. Limbale, at the same time, wondered how long Dalit literature
would remain new and distinctive. In order to understand Dalit
literature, one would have to understand the caste structure.

Mr. Limbale said Dalit authors were also activists.

Progressive literature

"Progressive writers are those who open the doors of a caste-ridden
society and provide entry to the Dalits as human beings." He said
progressive literature required a socio-political document.

Mr. Limbale said "the commitment of the author is his way of life." He
felt that the State conference was a gathering which inspired him a
lot because he could meet several well known Malayalam writers under a
single roof.

Historian K.N. Panikkar presided over the seminar. Vice-Chancellor of
Mahatma Gandhi University P.M. Rajan Gurukkal delivered the keynote
address.

Vice-Chancellor of the Kerala Kalamandalam K.G. Paulose, literary
critic Sunil P. Elayidam, Suja Susan George and P.K Pokkar spoke.

A resolution was passed at the conference calling upon the people to
isolate those who tried to stymie the development of the State.

The resolution noted that there was a conspiracy to demolish the
development agenda of the Left Democratic Front government by
unleashing unnecessary controversies and violent agitations.

Another resolution called for ensuring progress of Malayalam language.

Caste-based census controversy reaches apex court

NEW DELHI - The controversy over the caste-based census Thursday
reached the Supreme Court after a Chennai-based advocate filed a
pre-emptive caveat, praying that if the Madras High Court verdict
asking the census commissioner to carry out a caste-based census is
challenged, he should be afforded an opportunity of being heard.

Advocate R.Krishnamurthy filed the caveat - an application praying the
court not to grant relief to an anticipated petitioner without hearing
the person filing the caveat - apprehending that the census
commissioner might challenge the high court verdict.

In his earlier petition before the Madras High Court, the advocate
pleaded that several political parties, MPs and state legislators had
made representations to the census Commissioner that the 2011 census
should also include caste identities of segments of the population.

The last caste-based census was conducted in the country in 1931
during British rule.

CHENNAI: 'Other' chairs in barber shops, bar on wearing polyester
dhoties, opposition to rear pedigree pets and postmen not knocking on
their doors are some of the new forms of untouchability that SCs in
rural Tamil Nadu face, even today.


A survey conducted by the CPM-backed Tamil Nadu Untouchability
Eradication Front over the past seven to eight years has revealed that
Dalits living in various parts of the State are subjected to different
forms of inhuman discrimination.

"We have identified 80 forms of untouchability, apart from 23 forms of
atrocities prevailing in Tamil Nadu," P Sampath, State Convener of the
Front, told newspersons in Chennai on Thursday.

"Dalits in Aandarkottaram and Thaniamangalam villages falling under
Melur Panchayat Union in Madurai district have to go to the post
office to collect letters or money orders as postmen won't step into
Dalit colonies.

Similarly, Schedule Caste people in Velayudhapuram village in
Thoothukudi district don't have the right to rear pedigree dogs." Some
other unusual practices that figure in the report include disallowing
Dalits to ride bicycles and bullock carts, keeping separate almirahs
for stacking Dalit clothes at laundries, ban on bursting crackers
during temple festivals, refusing permission to watch shows on public
panchayat television sets and forcing Arunthathiyar students to clean
toilets in schools.

Refusal to call Dalits with 'respectable' terms in their names is
another common practise – in names like Madasamy and Munniyasamy, the
'samy' is omitted and they are called Madan or Munni.

Some of the cruelties identified are feeding Dalits with human faeces,
sexual abuse and foisting of false cases. When the survey was
presented to district collectors, they categorically denied existence
of any such discrimination.

Sampath said. "Perhaps, police are hand in glove with dominant communities."

Official records are revealing that in a span of two years (2008 and 2009)   three dalit students have committed suicide in Andhra Pradesh. They have also recorded one attempt suicide. . But there could be several more such cases which were either not reported or the reasons were distracted. In the recent past number of Dalit student's suicides cases as a whole in the country in educational institutions is increasing alarmingly. The situation needs urgent attention from not only the administration of those institutions but also all government departments, educationists and intellectuals.
