In the midst of a raging row over over her government's spending money
for Dalit memorials, Uttar Pradesh Chief Minister Mayawati today said
it would not be possible for the state administration to fund
implementation of the Right to Education and asked the Centre to give
money for the scheme.

She accused the Centre of overlooking pratical aspects of implementing
the Right to Education Act by not arranging money for its
implementation.

Mayawati alleged the Centre was not serious in implementing the Act.
"This was the reason Centre did not look into practical aspects while
implementing the Act and a nominal provision was made in the budget,"
she said in a letter to Prime Minister Manmohan Singh.

"If the Centre is really willing to implement the Right to Education
Act to benefit the people, it should bear the financial burden to be
created on the state for implementation of the Act," Mayawati said.

She said that to implement the Act in Uttar Pradesh, Rs 18,000 crore
would be needed in one year, of which 45 per cent--Rs 8,000
crore--have to be arranged by the state.

It would be difficult for the state to arrange Rs 8,000 crore
considering its present financial condition, she said.

Mayawati said if the Centre seriously wanted to implement the Right to
Education Act, it should provide required funds to UP.

"The state had in a letter sent to the Centre in November last year
already requested for required funds," she said.

Taking Mayawati worship to another dimension, a farmer in Uttar
Pradesh's Mahoba district, who doubles up as a lawyer, is all set to
build a temple dedicated to his idol and the Uttar Pradesh chief
minister.

Kanhiya Lal (49), a resident of Nathupura village, around 300 km south
of state capital Lucknow, claimed the temple construction was a
personal endeavour.

Dalits constitute nearly one-third of the village's population. "I
don't think any permission from anyone is required — administration or
even the chief minister — because the temple would come up on one of
the two pieces of land that I own," Lal said. "And dedicating a temple
to any deity is no crime, is it?"

The 'deity' in question, of course, is none other than Bahujan Samaj
Party (BSP) chief Mayawati.

"To me she (Mayawati) is on a par with Lord Buddha. I worship her and
I don't think one needs the permission of a deity to build a temple
dedicated to one," said Lal, who is not a Dalit but of the backward
Lodh Rajput caste. "But I won't mind moving an application to her (in
case such permission is required) through the local Bahujan Samaj
Party unit."

The Mahoba administration has said that it has no role to play if the
temple comes up on private land.

Lal said he was willing to donate 1.2 hectare of agricultural land for
the temple's cause.

"My land's value is Rs 7 lakh," he said. "If just 20 people came
forward to contribute a similar amount, then it would total Rs 1.4
crore — enough to make a grand and glorious temple with an ornate
idol."

But if others refuse to show his level of enthusiasm, he would still
build the temple, though a smaller one, Lal said.

Changing face of social activism

Activist-writer Dr Anil Awachat has been associated with many social
movements striving for a positive 'change' in the outlook of people
and policy-makers. Known for his diverse interests and his
contributions to de-addiction campaign, Awachat talks to Sushant
Kulkarni analysing the phase social activism is passing through

Can you describe to us the emergence of the progressive socialist
movements in Maharashtra in 1970s?

We label them as movements when we look back at them today. Initially,
those began with a bunch of people taking up some social issues for
studies. For example, we went to Bihar for studying social issues in
the 70s. For instance, Yuvak Kranti Dal (Yukrand) was formed out of
some like-minded people coming together. I have also closely seen the
Dalit Panther Movement picking up momentum at the same time. These
streams started flowing even in areas like Vidarbha and Marathwada.

One of the important reasons was our anger towards mainstream politics
and politicians. Even the 'socialists' of that era had unfortunately
entered the dirty stream of politics.

Our activities were result of we getting fed up with romanticism,
detachment for real problems and nostalgia of these socialist leaders.
Even the Republicans, who by then had tied up with the Congress
politically, had failed in representing Dalits' aspirations.

Anti-establishment movement had even picked up in literature also in
the same era.

These movements seem to have lost the force around early 1990s. What
exactly went wrong at that time?

India heartily embraced globalisation and liberalisation in the
beginning of 90s. This badly hampered the labour movements. Even the
outside force that was inspiring these movements, the Soviet Russia,
collapsed. We forgot that conditions in Western world and those here
were different. We needed different strategies and technologies for
our problems, not the copies of western world.

Today, I do not see the discontent that was driving these movements.
The discontent is about individual progress, 'how will I earn more
money?' or 'how will I go to US?' Who will think beyond this? Thus the
force behind these movements, youth, got detached from them.

Where are these movements today?

People then realised that blanket solutions given by mass movements
were not working. Even the morchas, dharanas had started turning
violent. The present day form is that of activists handling specific
issues and providing logical, scientific and 'Indian' solutions to
problems.

Examples like Abhay and Rani Bang working for community health, the
Amate family working on leprosy and for tribal issues, Muktangan on
de-addiction and other social issues regarding addictions.

Point is when movements cannot relate to problems of common human
beings, they fail. Sometimes it happens with environmental movements
if they address the symptom and not the cause, they fail.

Taking a clue from this, have the present day movements failed to
relate to the people who are immersed in the systems these movements
are opposing?

It is not the movements that have failed. It is us who have. Moreover,
you cannot put all the people in the same category. There is a huge
gap between the rich and the poor of the day, and it is growing. These
movements need to address problems of all them. Both rich and poor.

Even the media, which need to communicate and discuss these issues,
are part of the capitalist system. We get the newspaper almost for
free but reality is that it's run on advertisements. This situation is
not at all conducive for proper communication of the messages that
these movements want to send across.

How can we evaluate contribution of these movements?

In some of the cases, the movements may not have been successful in
achieving their goals but their effects are definitely penetrating.
The Narmada Bachao Andolan led by Medha Patkar may not have been
successful in a conventional sense but their repercussions are
definitely here. It has inspired people from Konkan to stand against
illegal mining. This is also one of the successes of these movements.

The transformations that Anna Hazare could bring to Ralegaon Siddhi,
may not have been replicated as it is everywhere but the Right to
Information Act did get important inputs from this movement. Isn't
that success?

You might not have many examples like SEARCH (Society for Education
Action and Research in Community Health) all over but that model did
change the way we look at community health. That I feel is success.

You talked about new generation not getting attracted towards these
movements? Is the present education system responsible for this?

The content of the education that is imparted may not have changed
that much. The way things are looked at and taught have painfully
turned marks oriented. Question is, are we working on correcting this?

We rarely look at these movements as processes and start evaluating
them. The processes take time to give tangible results. Education is
one such process.

When I started working for Muktangan, the satisfaction that I got was
missing when I was working with mass movements earlier. The young
generation needs to understand that the satisfaction and joy one gets
by working for people is an asset for lifetime.

There is one more thing. Such specific issue-based movements lead to
bigger issues in the later stages. Today's generation needs to
understand this. From movement against addiction of alcohol, a
movement against alcohol making from grains arises. This is real
learning.

What does history of these movements teach us?

One of the most important lessons is that we have to learn from what
we do. Another thing is inclusion of affected people in the process of
their own growth. This will provide these movement a real sense.

NEW DELHI: Already off judicial duty, Karnataka High Court chief
justice P D Dinakaran faced another setback with the Supreme Court
collegium asking him to go on leave.

Justice Madan B Lokur, acting chief justice of Delhi High Court, has
been made the acting chief justice of the Karnataka HC.

The SC collegium took the decision on Thursday after representations
from various quarters that judicial work at the Karnataka HC was
suffering in the absence of a functioning chief justice.

Interestingly, since the Constitution does not provide for a judge to
be sent on leave, cooperation of Justice Dinakaran is crucial for the
implementation of the collegium's decision.

The collegium also considered the fact that the inquiry against
Justice Dinakaran by a three-member committee headed by Justice V S
Sirpurkar will take more than a year to complete its work. Till then
judicial work at the Karnataka HC could not have been allowed to
suffer. The committee was set up by the Rajya Sabha chairperson Hamid
Ansari after admitting a motion seeking Justice Dinakaran's removal.

The allegations against Justice Dinakaran range included possessing
wealth disproportionate to his known sources of income, unlawfully
securing five housing board plots in the name of his wife and two
daughters, entering into benami transactions, and acquiring and
possessing agricultural holdings beyond the ceiling limit.

There are also allegations that Justice Dinakaran was involved in
illegally encroaching on government and public property to deprive
dalits and poor of their livelihood, violation of human rights of
dalits and poor and destruction of evidence during the official
inquiry.

In its meeting, the collegium also recommended the name of MY Eqbal,
the senior-most judge of the Jharkhand High Court, as the new chief
justice of the Madras High Court. He will succeed Justice H L Gokhale,
who has been recommended for elevation to the Supreme Court.

Agra, Apr 4 (PTI) Three women, including two dalits, were brutally
assaulted and their house ransacked by mob for allegedly running a
prostitution racket in Malpura village of the district, police said
today.

"Three women were beaten up last evening and their house was ransacked
and partially damaged by mob, who alleged that the trio were running a
prostitution racket in the village," station house officer, Malpura,
Veer Singh said here.

Villagers mobbed house of Baby alias Guddi and dragged her along with
Reshma and Meena, they said, adding the house was ransacked and
partially damaged.

Police rescued them after receiving information that they were being
held captive, Singh said.

"Cross FIRs have been lodged from both the sides.

LUCKNOW: The Opposition might have slammed chief minister Mayawati for
not waiting for governor's nod to raise a security force for memorials
and monuments, particularly those of the Dalit icons, but for BSP it
has come as another opportunity for Congress-bashing and projecting
Maya as the champion of Dalits.

Maya got the Special Zone Security Force Bill passed in the state
assembly to protect monuments of historical and cultural importance,
which include the parks and memorials built by the BSP government in
the name of Dalit icons. But the bill could be executed because
governor BL Joshi did not give his approval. Maya then issued an
ordinance to raise the force with special powers, but that too has not
been approved by the Raj Bhawan yet. Sources said governor is
conducting a detailed scrutiny of the ordinance before taking any
decision. UP is the first state in India to form such a force
dedicated to monuments.

As per Article 200 of the Constitution, any bill can become law only
after consent of the governor. The governor can send back the bill for
reconsideration of the legislative body or can withhold his consent.
If the legislative body passes the bill again and sends it to governor
for approval, the latter cannot withhold it but can refer it to the
President for consideration. Article 207 (3) states that any bill
involving financial expenditure can be introduced in the legislative
house after taking governor's consent. After being passed by the
legislature, the bill is again sent to the governor for approval.

These provisions have been made to ensure balance of power and that no
bill is promulgated which is against the spirit of the Constitution or
adverse to public interest or has provisions which might lead to
adverse impact in the lost run. In the case of Special Zone Security
Bill, the governor has not given his consent as yet. He has also not
approved the ordinance which later replaced the bill. But Maya
government decided to go ahead with her plan through an executive
order, though the force formed through administrative order will have
no special powers to make arrests or seizures for security purpose.

All the Opposition parties have slammed Maya for not respecting the
Constitutional norms. UP Congress chief Rita Bahuguna Joshi said that
by overlooking Raj Bhawan, Maya has shown disrespect to the
Constitution. SP leader Shivpal Singh Yadav went a step ahead and
demanded governor to order probe into financial bungling in the
construction of the monuments which also include Mayawati's statues.
BJP spokesman Hriday Narain Dixit said the state government has
crossed its constitutional authority by deciding to set up a new force
through an executive order and bypassing the authority of the
governor.

But instead of going on backfoot, Maya has grabbed the opportunity to
whip up Dalit emotions as she did in the case of currency-garland
controversy. In the latter case, BSP leaders had raised question when
Opposition leaders can be felicitated with costly items and garlanded
with currency notes, why can't it be done with a dalit leader. Now in
the special force case, BSP leaders said that SP is issuing open
threat to damage the dalit monuments. "Damage to any of dalit
monuments can create a nationwide turmoil. Opposition of special force
by rival parties only exposes their anti-dalit mentality," said a BSP
leader.

NEW DELHI: Just days after a Karnal court in Haryana sentenced five
men to death for their role in an honour killing, the central district
police claimed to have apprehended a 17-year-old minor and his two
friends, allegedly for plotting and murdering a 20-year-old Dalit
youth who reportedly ''proposed'' to the former's 15-year-old sister.

''The boy came all the way from Haryana, where his family had sent him
after he fell in bad company, after news reached him that Bunty
proposed to his younger sister, a Class 10 student of open school, in
full public view,'' said Jaspal Singh, DCP (central).

According to the police, Bunty was lured to a spot near Jakhira Bridge
on March 25 where, helped by Arun alias Behari (22) and a 14-year-old
boy, the brother of the girl killed him.

DCP Singh said on March 28, Bunty's father, Kalu Ram, a resident of
Nehru Nagar in central Delhi, lodged a missing report at the Anand
Parbat police station. Kalu, a plumber, said his son was missing for
the past three days and he feared that he had been murdered.

''Even as the police was conducting its investigation, residents near
Zakhira Bridge complained of a foul smell coming from the water body.
When the police reached the spot, they found a decomposed body inside
a 25-feet deep water tank near the bridge,'' said ACP (Patel Nagar)
Anita Roy. ''The victim was identified as Bunty. He had been brutally
murdered and his face was crushed with heavy stones in a bid to hide
his identity.''

The police said the probe revealed Bunty was in love with his
upper-caste neighbour in Anand Parbat. Though he had approached her on
several occasions, she rejected his advances, saying she was yet to
pass her class 10 exams. A senior police officer said recently Bunty
proposed to her at a busy marketplace after which he was threatened by
the girl's family.

''When we questioned the girl's family, we found several
contradictions in their statements,'' said chief investigating officer
Padam Singh. The police claimed they also received a tip-off that the
brother of the girl could be involved in Bunty's murder.

Working on leads, the police apprehended three of the accused from
central Delhi on Saturday. The police said on March 25, the accused
met Bunty near Daya Basti railway tracks around 10.30pm and assaulted
him with a razor and punched his face. ''They then threw him in the
empty water tank near Zakhira Bridge. But when the victim managed to
hang by the sides of the tank, they thrashed him and hit his knuckles
to make him loosen his grip,'' said DCP Singh.
Once Bunty had fallen into the pit, the accused allegedly went down
and strangled him with a shirt. ''We have recovered bloodstained
sticks and handkerchief from the accused,'' said Roy.

The police said the girl's brother is a school dropout. His parents
sent him to his maternal uncle's house in Haryana about a year ago.
The police said they were investigating the role of other family
members in the incident. ''We have conclusive evidence that the
brother of the girl spoke to his mother on cell when he was with the
boy who was killed on March 25. The boy's father, a small-time TSR
transporter, will be questioned too,'' said DCP Singh.

AICC secy's Ambedkar remarks draw RPI ire

Mumbai : RPI has sought the sacking of AICC secretary in charge of
Congress affairs in Maharashtra, Mohan Prakash, for allegedly
disparaging Babasaheb Ambedkar.
On Friday, he reportedly said Ambedkar was included in the Drafting
Committee of the Constituent Assembly because of Gandhiji and
Jawaharlal Nehru. "It is an insult to Ambedkar, who possessed
extraordinary abilities...," former MP and RPI leader Ramdas Athawale
said. "We are planning a Maharashtra bandh in protest. Babasaheb was
not at the mercy of any Congress leader..."

Mohan Prakash, when contacted, said, "There is no question of
insulting... I had said the belief that Congress and Ambedkar were at
loggerheads, was unfounded. I said Ambedkar was elected to the
Constituent Assembly from East Bengal in 1946, but after Partition, it
became part of Pakistan and ceased to be a member. The Congress asked
one of its members to vacate his seat to accommodate him."

NEW DELHI: After battling a row over OBC reservation for students, JNU
may now witness an agitation over SC/ST quota for faculty recruitment.
Disgruntled by the administration's long deliberation on whether posts
for SC/ST should be reserved at the level of associate professor and
professor, student groups in JNU are now gearing up to stage a mass
protest and call for a strike on Tuesday.

The academic council (AC) and the Executive Council of the university
are undecided on whether the Ministry of Human Resources Development's
directive of 2005 and University Grants Commission order for
implementation of SC/ST and physically handicapped reservation at all
three levels of professorship and the OBC reservation for assistant
professors are legally binding or not. The varsity has sought the
opinion of solicitor general. Many view this as a move to stall social
justice on the campus.

Former JNUSU president Sandeep Singh said: "The authorities think that
this could dilute academic standards, which is discriminatory. Many
professors from this category have contributed to academics.''

The Brahmin, Bania party doesn't seem to be interested in romancing
the OBCs anymore.

The BJP's choice of presidents in electorally crucial states as well
as its central list of office-bearers symbolically highlights the
trend quite clearly.

The central unit led by Nitin Gadkari is dominated by the Brahmins.

Besides the two leaders of Opposition, Sushma Swaraj and Arun Jaitley,
the senior-most general secretary, Ananth Kumar, is also a Brahmin.

Gadkari has dropped the sole OBC general secretary Vinay Katiyar.

He now holds an ornamental position as a party vice-president.

But in Maharashtra, Gadkari has tried to check the domination of
Brahmins by appointing Sudhir Mungantivar as the state chief.
Mungantivar, from Vidarbha, is a powerful OBC leader belonging to the
Komti caste.

However, the party is led by Brahmins in most other states. Pandit
Ashwini Sharma heads it in Punjab, while Arun Chaturvedi is the
president of the Rajasthan unit. In Himachal Pradesh, the BJP has
found a Brahmin, Pandit Khimi Ram, to head it.

There are indications that in states such as Uttar Pradesh, Madhya
Pradesh and Bihar, the BJP will end up appointing a Brahmin.
RSS-appointee Prabhat Jha seems to be the chosen one to head Madhya
Pradesh. This signal was clear when Jha, accorded a Rajya Sabha berth
last year owing to his proximity with the RSS strongman Suresh Soni,
did not get any significant position in the central list of
officebearers.

"It is a clear sign that Jha is going to MP," a party insider said.

Similarly in Bihar, three prominent names doing the rounds for the
president's post are state general secretary Mangal Pandey, minister
in the Nitish Kumar government Ashwini Choubey and senior leader
Sukhda Pandey.

This is because the consensus in the state is that a Brahmin should be
appointed to counter- balance Nitish's overt stress on wooing the
"extreme backwards". Both Nitish and deputy chief minister Sushil Modi
are OBCs.

Even in Uttar Pradesh, the BJP is desperate to fill the lacuna created
by Atal Bihari Vajpayee's withdrawal from public life. Chief Minister
Mayawati's social engineering is widely believed to be crumbling with
the Brahmins drifting away because of Mayawati's ostentatious display
of power and the creation of various parks and monuments in her name.

The BJP's biggest worry is that the Congress may turn out to be the
beneficiary of the Brahmins' disenchantment with the BSP. While the
BJP is considering many candidates, Lucknow mayor Dinesh Sharma is
believed to be a strong contender because of his Brahmin lineage.
