The Supreme Court has held that reserved candidates like SC/STs, OBCs
can be provided age relaxation and fee concession for selection in
government jobs under general category even after the reserved quota
has been filled.

However, such relaxation can be extended provided the reserved
candidates secured competing or more marks with the general candidates
in preliminary or qualifying exams for final selection.

The apex court said such relaxation cannot be termed as violative of
the Constitutional provisions of equality or the norm that
reservations in general category should not exceed the 50 per cent
quota fixed by it in the Indra Sawhney case.

"Reservations are a mode to achieve the equality of opportunity
guaranteed under Article 16 (1) of the Constitution of India.
Concessions and relaxations in fee or age provided to the reserved
category candidates to enable them to compete and seek benefit of
reservation is merely an aid to reservation.

"The concessions and relaxations place the candidates at par with
general category candidates. It is only thereafter that the merit of
the candidates is to be determined without any further concessions in
favour of the reserved category candidates," a bench of Justices Tarun
Chatterjee and Surinder Singh Nijjar said in a judgement.

The apex court passed the judgement while upholding the validity of
the selection process conducted by Uttar Pradesh government in 2000
for recruitment of police sub inspectors. In the selection process,
the government had permitted reserved candidates to appear for
selection in general category by permitting them to avail age
relaxation.

However, the move was opposed by general category candidates on the
ground that they cannot enjoy double benefit as they have already been
granted fee and age relaxation in reserved candidates category.

The Allahabad High Court had upheld the government's action, after
which the aggrieved general candidates had appealed in the apex court.
Dismissing the appeal, the apex court said reserved category
candidates have not been given any advantage in the selection process
as all the candidates had to appear in the same written test and face
the same interview which is decided on the basis of merit.

HYDERABAD: A case was registered against CPM Rajya Sabha MP Madhu
under Scheduled Caste and Scheduled Tribe Act (SC & ST Act) by LB
Nagar police based on a complaint given by an electrician on Tuesday.

Sudhakar, a resident of Sai Nagar in LB Nagar, alleged that the MP
abused him by referring to his caste. LB Nagar police said the case
was registered based on the complaint given by Sudhakar.

New Delhi : Congress President Sonia Gandhi on Tuesday dissociated
herself from the controversial list of Pradesh Congress Committee
(PCC)'s office-bearers that specified their caste names, which is
banned under the SC/ST Act. "I do not know," Gandhi told reporters
about the PCC list at the Rashtrapati Bhawan.
As reported by The Indian Express on Tuesday, the 562-member PCC list,
signed by the AICC in charge of Bihar, Jagdish Tytler, included Lok
Sabha Speaker Meira Kumar as Permanent Invitee. The list specified the
caste names of office-bearers, including that of Kumar. Asked about
it, Kumar said, "I belong to a political party. As a Speaker, I
believe in strict neutrality of the chair."

The Congress, in the mean time, swung into damage control exercise on
Tuesday, even as the Bihar Dalit Morcha burnt Tytler's effigies.
Senior Congress leaders in Delhi maintained that the list with caste
names was an "internal document" and the SC/ST Act applied only if
they were used publicly.

New Delhi: Barely a few months after the Congress working committee
(CWC) decided at a meeting to advise leaders not to use prefixes to
names that would suggest caste, the Bihar unit of the party has
flouted the norm.


A list released by the Bihar Pradesh Congress Committee (BPCC) not
only mentions the religions and communities its 64 members belong to,
but also contains details such as their castes, including SC/ST,
background and the names of districts they come from.

Apart from flouting the party norm, the list is in contravention of
the SC/ST Prevention of Atrocities Act. Lok Sabha speaker Meira Kumar
has been mentioned as belonging to the Dalit community.
It's another matter that since she is in a constitutional position,
she cannot hold a party post.

Senior party leaders sought to explain thelist on Tuesday. They said
names of communities had been mentioned to ensure all castes in the
state are adequately represented on BPCC.

"The idea was to ensure proper representation to all sections, since
in the past, a majority of the posts have been cornered by a few
castes," Jagdish Tytler, the AICC in-charge of Bihar, said.

In some cases, even sub-castes of members have been mentioned.
Scheduled caste members have been classified as Chamar, Dushad, Pasi,
Dhobi, etc, while details such as Koeri, Kurmi, Yadav and Vaish/Baniya
have been provided about members from the OBC community.

Members belonging to the upper caste have been classified as Kanyakubj
Brahman, Bengali Brahman, Maithili Brahman, Bhumihar and Rajput. Only
caste affiliations of Muslims have not been mentioned.

Lucknow : Plans to launch new scheme for those without BPL cards
The latest entrants to Chief Minister Mayawati's birthday party are
those who do not have the below poverty level (BPL) cards.

On January 15, her birthday, Mayawati is likely to announce a new
scheme for this section — one that will entail financial help through
cash doles. The scheme is to be named "Uttar Pradesh Mukhya Mantri
Mahamaya Garib Arthik Sahayata Yojana".

Officials are busy working out the details, but sources said a few
things have already been settled. Each family will get Rs 300 per
month, 50 per cent of the beneficiaries will be Scheduled Castes and
Scheduled Tribes, and families headed by women will get preference.
Only families which do not get the benefit of any existing scheme for
the poor will be entitled to avail this scheme.

Sources said the idea was to launch the state's own pro-poor
initiatives which reaches out to those who do not get any benefit from
existing schemes like old-age or widow pension and antyodaya. Almost
all existing schemes are funded by the Centre and in each a BPL card
is the ticket to the benefits.

The state government has made several requests to the Centre to
increase allocations for various pro-poor schemes, arguing that
surveys of BPL families were faulty and did not reflect the correct
picture.

"The Union government has not paid any attention to these requests. As
a result, a large number of poor people do not get any benefit because
their names do not figure on the BPL list," said an official.

The new scheme is expected to serve two purposes. It will help the
chief minister counter the Congress which has been trying to get
political mileage out of all pro-poor schemes by telling the people
they were being financed by the Centre and that the state was just
implementing them.

Besides, it is expected to build pressure on the Centre to accept the
state's figure of poor families and increase allocation to various
schemes.

An official said the survey to identify beneficiary families under the
new scheme will be completed in four to five months. However, the
government is yet to identify the department that will conduct the
survey.

One option in consideration is to identify the beneficiaries in open
meetings of the gram sabha.

BALASORE: The National Commission for Women (NCW) has sought a report
from Balasore police on the abuse of a
Dalit woman in the district.

"The commission wants to know about the action taken by police in this
particular case in which a Dalit woman was assaulted and abused in
public. It also wants to know whether the woman has been rehabilitated
and what steps have been taken for her security," the NCW letter to
the SP stated.

On October 14, a 25-year-old woman and a mother of three, was dragged
to a market place at Bagudi near Soro, tied to a tree and assaulted by
a group of people who pulled her hair.

They abused her calling her a prostitute and the entire act was shot
and handed over to an electronic media.

The barbaric incident sent shocked the state. Claiming sluggish action
of police against the culprits, the woman had appealed to the chief
minister seeking his intervention. Several women and Dalit
organization also supported the victim.

The NCW, however, sought the report from police after lawyer Prabir
Das moved it and the National Human Rights Commission (NHRC) citing
police inaction.

"Police should act immediately before the accused can take any
preventive steps to evade arrest," Das said.

Police said six persons have been arrested in this case. "Three were
arrested a day after the incident and the rest three, including the
prime accused were nabbed within a month. Earlier, the NHRC had sought
a report and we have compiled it," sub-divisional police officer
(Balasore Sadar) K C Parida said.

NEW DELHI: An embarrassed Congress was on Tuesday forced to distance
itself from a massive list of Bihar Pradesh Congress Committee (BPCC)
office
bearers parts of which surfaced in the media with caste names written
against the names of new members. The list of new BPCC office bearers
which runs into the hundreds also contains another big blooper. It
designates Lok Sabha speaker Meira Kumar as a permanent invitee and
mentions the caste of the Dalit leader along side her name.

The use of the Dalit caste name invited a sharp rebuke from the
Opposition BJP and raised the prospect of a legal tangle for the BPCC
as the matter could be pursued in court.

Top Congress sources said party chief Sonia Gandhi indicated that she
had no knowledge of the existence of such a list, even as the party
itself remained tightlipped about the issue officially. Of the record,
Congress leaders admitted to a "major goof up" at the state level with
the blame resting at the doorstep of the AICC in-charge of the state,
Jagdish Tytler, and PCC chief Anil Sharma.

"The list (with the caste names) was an internal document. It should
have been sent to the AICC for a final clearance from where it would
have been forwarded to the Congress president. This last step was
ignored by those in charge of the state," a senior Congress leader
said explaining the surfacing of the document. Mr Tytler, however,
blamed the media for having "stolen" an "internal Congress document".

Incidentally, the party did the same thing ahead of the 2005 Assembly
elections. The BPCC released a candidates list of 41 names along with
their castes. Then BPCC chief Sadanand Singh had called it a "lapse"
just as it is being described by the central congress leadership now.

The matter could become tricky for Congress as rival parties have
pounced on the opportunity to question the Congress' brand of
politics. "The Congress in-charge of Bihar wants to push the state
back further by attempting to divide it on caste lines," BJP
spokesperson Rajiv Pratap Rudy said calling it an "unconstitutional"
list.

Meanwhile, Ms Kumar said, "I belong to a political party. As a
Speaker, I believe in strict neutrality of the chair." Congress,
however, justified her inclusion in the list holding that there was no
strict rule against the Speaker taking up a party post though such a
convention did exist.

Meanwhile, a section of the Bihar leaders have launched a signature
campaign against the jumbo size PCC and the use of caste names. They
are also expected to apprise the party high command of the
developments.
