ALLAHABAD: The Dalit Resource Centre (DRC) of G B Pant Social Science
Institute organised a two-day brain storming workshop on `Cultural
resources and forging a democratic order: Marginalised groups in
northern India' on November 3-4.

In his inaugural speech on the first day of the workshop, Allahabad
University vice-chancellor Prof Rajen Harshe said, "Languages link
people. When we think about culture, we do not pay attention to
language. The way language is spoken is the way you understand
society.''

Mentioning a Marathi magazine, he stated that young boys were asked to
define water. "While for the lad in Mumbai, water came from the
fridge, it was something different for the Dalit boy in Marathwada.
For him it was something for which they had to travel a long distance
and traverse through a different path. The meaning and language
differed for both,'' V-C said.

He called upon the need to relook into the traditions of sage poets.
He mentioned Tukaram and two other poets. Dwelling on the dialectics
of appearances versus reality, he quoted a sage poet of Maharashtra,
who pointed out that "though the sugarcane might be crooked, there is
no such crookedness in its sweet juice. We do not think about the
history of ideas. We need to think on the realms of culture.''

Prof Bishnu Mohapatra, a political scientist and poet, in his address
said that in the 1990s secularists and liberalists felt that a society
cannot be interpreted merely on the basis of law or the constitution.
There are many elements in the marginalised traditions, which can
provide resources and be used to reshape our society.

He called upon the need for reinterpreting Bhakti to create a new
sense of power. He stated that the 15th century was creating grounds
for vernacular modernity. "I am uncomfortable with the generic term
Bhakti,'' said Prof Mohapatra. Recounting the tradition of the Bhakti
sage-poets, he said that there are marked differences in the Bhakti
traditions of Maharashtra, Bengal, Orissa, Tamil Nadu, etc. In every
region there is something unique. The language is very contemporary.

Badri Narayan, project director, DRC, said this project would trace
the socio-cultural roots of Dalit politics. The resources to be drawn
from are heterogeneous popular sects, French Revolution, the Indian
Constitution and the American protective policies along with French
policies. What is the language of people or Dalit discourse vis-a-vis
the language of governance? The modern and traditional often
interchange their meanings.

Director of the institute, Pradeep Bhargava dwelt on rights of Dalit
politics in UP. He said the advent of Mayawati is an interesting
phenomenon.

Administrative officer of the institute Bhaskar Mazumder proposed the
vote of thanks.

New Delhi, Nov 4 (ANI): The Supreme Court (SC) on Wednesday lifted
curbs imposed by the Allahabad High Court, giving relief to Uttar
Pradesh Chief Minister Mayawati to go ahead with the construction of
the Ambedkar Park in Lucknow.

The Mayawati Government had moved a petition to vacate the stay on
construction activities, saying that it had resulted in serious
problems of maintenance of the memorials.

The apex court observed that "the orders passed by the judiciary on
the subject falling under the domain of legislature and the executive
should be ignored and should be treated in nullity" and the courts
should not exceed their "limits".

"How can the High Court pass interim order on the issue relating to
the Master Plan which is not in the domain of the judiciary," said a
bench comprising Justices H K Sema and Markandey Katju, while staying
the April 4 interim order of the High Court.

The Mayawati government had triggered a controversy by changing the
land use of 35 acres area of Bhim Rao Ambedkar Park and starting the
construction activities for setting up the Kanshi Ram Research
Institute.

A group of residents had moved the High Court, which directed the
state government to maintain status quo on the construction
activities.

The apex court refused to pass any order for contempt action against
the state government for allegedly installing a permanent structure in
the park to organize the birth centenary celebrations of Bhim Rao
Ambedkar on April 14.

The Bench also issued notice to Gomati Nagar Jan Kalyan Samiti and
other petitioners on the plea of the state government seeking transfer
of all cases relating to the Ambedkar Park to the apex court and
stayed all the proceedings in the High Court. (ANI)

HYDERABAD: Piqued by the administration's decision to fix cut-off
marks to evaluate the performance of students at the entrance level,
University of Hyderabad students have staged a massive rally in
protest here today.


The university administration has decided 45 per cent as the cut-off
marks for OBC candidates and 40 per cent for SC/STs for admission to
various programmes and courses. But many reserved category students
are not happy with the decision as a large chunk of seats were left
unfilled for the current academic year 2009-10. ``The administration's
decision is against the spirit of the principle of reservation. On the
one hand they recognise that some students come from deprived
background and at the same time the administration is being
exclusivist by fixing cutoff marks. It is not at all practical,'' G
Prabhakar, a Ph.D candidate in the history department, told Express.
The decision came at a time when the apex court thwarted a similar
move made by the Medical Council of India in the case of STs, terming
it as against the principle of reservation.

According to a reliable source in the university administration, about
70 to 80 seats have remained unfilled in the current academic year in
various courses and departments. When contacted, an academic section
official, on the condition of anonymity, said that the decision on the
cut-off marks was taken after going through the recommendations
suggested by the SC/ST standing committee.

PG students and research scholars have cried foul over the way the
decision was taken. The rules framed by the standing committee were
ten years old and none of the top brass approached the present
standing committee before taking this decision. ``We would fight till
the administration repeals its decision. This is not fair on the part
of an institution of higher learning to take arbitrary decisions,''
says Imli Nichet, a Naga student pursuing Ph.D at the School of Social
Exclusion and Inclusive Policy Studies.

Earlier, in the afternoon, hundreds of students thronged the
administrative block and tried to barge into the vice-chancellor's
chamber and shouted slogans against the administration.

They dispersed with the administration agreeing to consult the SC/ST
standing committee to take a final decision on the matter soon.

NEW DELHI: A day before hearing on contempt charges against the UP
chief secretary for alleged violation of orders stopping construction
of
memorials and installation of statues, the Mayawati government on
Tuesday moved the Supreme Court with a plea to resume work at the
project sites in Lucknow.

The application followed a detailed affidavit filed by chief secretary
Atul Kumar Gupta accusing the media of failing to understand the width
of the apex court's September 8 and 11 orders. "The construction,
maintenance and repair work at different sites carried out were out of
the ambit of any of the interim orders passed by the Supreme Court,"
Gupta said.

Given the "do not play with fire" warning and stinging orders of the
top court while issuing the contempt notice, the chief secretary did
not forget to tender his unqualified apology yet again for any
"inadvertent" disobedience or deviation from the two orders.

The chief secretary said he had already filed an affidavit detailing
incorrect reporting by the print and electronic media, which went on
with the issue without ascertaining the actual subject matter of the
writ petitions pending before the Allahabad High Court. He said the SC
had imposed "no work" restriction on the smaraks coming under the
purview of the writ petitions before the HC.

But as an abundant precaution, the chief secretary said, "I had acted
in compliance with the orders passed by the apex court. However, I
hereby tender my sincere and unqualified apology for any kind of
disobedience or deviation, aberration or misconstruction, if any,
which might have happened in implementing the orders passed by the
Supreme Court."

Stressing on the point that none of the orders of the apex court were
ever violated, the UP government in its fresh application pleaded for
vacation of stay on work at the project sites indicating its keenness
to complete the smaraks and installation of statues, which have
remained in limbo for nearly a month.

NEW DELHI - Asserting that the involvement of tribal communities in
developmental processes was highly important, Prime Minister Manmohan
Singh Wednesday urged state governments to give a healing touch to
victims of systemic exploitation.

The states should endeavour to give a healing touch to the tribal
communities. Their integration in the development processes is highly
important. But this should not become a means of exploitation or be at
the cost of their unique identity and their culture, Manmohan Singh
said.

He admitted that tribal communities in central India have become
victims of systemic exploitation.

The prime minister was speaking after inaugurating the two-day
conference of chief ministers and state ministers for forests and
tribal development. The meeting has been convened to review the
implementation of the Forest Rights Act, 2006, and tribal development
and welfare programmes.

strongly denying any defiance of SC directions, said he has the
highest respect for the apex court and was "duty bound to comply" with
its orders in "letter and spirit."

On October 6, the apex court had served the Chief Secretary with a
contempt notice following complaints that the state government was
going ahead with the construction work despite giving two undertakings
before it on September 8 and 11 that it would be stopped.

CHANDRAPUR: Yet another prominent personality from Chandrapur is going
to be honoured through a commemorative postage stamp on his name. The
department of posts has decided to issue commemorative postage stamp
on late Barrister Rajabhau Khobragade, a close aide of Dr Babasaheb
Ambedkar and former deputy speaker of Rajya Sabha. The stamp will be
released on November 11 in a programme to be held with the help of
Chandrapur chapter of Indian National Trust for Art Culture and
Heritage (Intach).

Born on September 25, 1925, Khobragade was known for his close
association with Bharat Ratna Dr Babasaheb Ambedkar. He completed his
Bar-at-Law degree in 1950 from England only to join his father in
social work. In 1952 he was elected as vice-president of Chandrapur
Municipal Council. Dr Ambedkar fought Lok Sabha election from Bhandara
in 1954 and Rajabhau shouldered the charge of chief election
campaigner for him.

In light of his dedication and dexterity in work, Dr Ambedkar
entrusted him with the post of general secretary of Schedule Caste
Federation. After Dr Ambedkar's demise he took over the charge of
general secretary of Republican Party. He was thrice elected as Rajya
Sabha member in 1958, 1966 and 1978. He even held the post of deputy
chairperson of Rajya Sabha between December, 1969, and April, 1972. He
was the pioneer of Dhamma Diksha programme held by Dr Ambedkar for
lakhs of dalits at Chandrapur on October 16, 1956. He passed away on
April 9, 1984.

Earlier in March the department had issued postal stamp of tribal
martyr Baburao Shedmake of Chandrapur. Now, through the efforts taken
by former union minister of state Shantaram Potdukhe and the family
members of Khobragade, the postal directorate, New Delhi, has approved
the release of the stamp on Rajabhau Khobragade on November 11.

The Uttar Pradesh Chief Secretary has tendered a "sincere and
unqualified apology" to the Supreme Court for allegedly going ahead
with the construction of the Rs 2,600-crore memorials and statues of
Dalit icons including Chief Minister Mayawati in Lucknow even as he
denied non-compliance of its directives on the issue.

In a 51-page affidavit Chief Secretary Atul Kumar Gupta, while
strongly denying any defiance of SC directions, said he has the
highest respect for the apex court and was "duty bound to comply" with
its orders in "letter and spirit."

On October 6, the apex court had served the Chief Secretary with a
contempt notice following complaints that the state government was
going ahead with the construction work despite giving two undertakings
before it on September 8 and 11 that it would be stopped.

"I humbly and most respectfully submit that I have the highest regard
for the orders passed by this Hon'ble Court. I had acted in compliance
of the orders passed by this Hon'ble Court. However, I hereby tender
my sincere and unqualified apology for any kind of disobedience or
deviation, aberration of misconstruction, if any, which might have
happened in implementing the orders passed by this Hon'ble Court.

"Any such disobedience of deviation, if any, was inadvertent and I
hereby undertake that I shall do everything in due compliance of the
orders of this Hon'ble Court as may be directed by this Hon'ble
Court", the affidavit said.

The affidavit said "I am duty bound to comply with the orders of this
Hon'ble Court and had never intended to disobey or to disrespect the
orders of this Hon'ble court to do anything which may amount to
contempt of the orders of this Hon'ble court".

The Chief Secretary reiterated the state government's earlier stance
that the constructions alleged to have been carried out was on those
structures which were not the subject matter of writ petitions in the
Allahabad High Court.

"I very humbly submit that the state government fully complied with
the orders passed by this Hon'ble Court on 8-9-2009 and 11-09-2009. In
any case, there is no attempt being made by the state government to
justify any action or wrong which was legally impermissible," the
affidavit said.

It further said "there is no disobedience of the orders passed by this
Hon'ble Court in respect of any of the properties covered by any of
the writ petitions/transfer petitions."

According to the Chief Secretary, the constructions were undertaken at
three properties "Samajik Parvartan Sangrahalay," "Pratimbimb Sthal,"
and "Pyramid" (Drishya sthal) which were not the subject matter of the
writ petition in the high court.

Certain constructions were also undertaken at "Smriti Upvan" which was
in fact permitted by the apex court by its December 12, 2008 order,
the Chief Secretary said.

He said the undertaking given by the state before the apex court on
September 8 and 11 were with regard to 13 properties which are the
subject matter of the writ petitions pending in the high court in
which no construction activities are being carried out.

These properties are "Satkar Bhawan," "Ambedkar Sthal," "Ambedkar
Maidan,", "Bunglow No 4, 5, 12, 12A and 13, Mall Avenue, "Kanshiram
Yadgaar Sthal,""Office of the Cane Commissioner," "Kanshiram Smiriti
Bhawan," "Elephant Court," "Mini Stadium," "Ramabai Park," "Khasra No
87 and 88 spread over 0,809 hectars of land at Jugauli village,
Lucknow," "75 acres land of Ambedkar park/Ambedkar Smarak" and "270
acres land of M/S Sahara India Ltd."

The affidavit said construction on these 13 structures were completed
by June 26 and only certain rectifications were needed to be carried
out but no further construction was done at these sites in pursuant of
the undertaking given by the state government on September 8 and 11.

The apex court, which had directed the personal appearance of the
Chief Secretary, is expected to take up the matter tomorrow.

Mithilesh Kumar Singh, an advocate and an NGO had challenged the
validity of Mayawati government's decision to spend Rs 2,600 crore of
public money for construction of the memorials by demolishing several
existing heritage structures in the heart of Lucknow city.

The court had rebuked the state government asking it not to play
politics with the court and said instructions from the "highest level"
seems to have come to defy its orders.

The apex court, while dealing with the issue, said it was expanding
the scope of the petitions and would examine the constitutional
validity of the government spending huge amount of public money for
construction of memorials and statues for political leaders.
