Mumbai : It caused consternation among officials at what appeared to
be a state government and Congress capitualation to arm-twisting by
squatters inside a Union government-owned mill in Central Mumbai. And
it set off a series of congratulatory messages for the Congress and a
parallel clamour among parties for credit.

When Prime Minister Manmohan Singh last week agreed to allocate the
entire 12.5-acre expanse of India United Mills for a mega memorial to
Dr Babasaheb Ambedkar, it brought to an end a decade-long struggle by
the Dalit community that has been demanding space for an
"international-level" memorial. It has also initiated a good amount of
political drama, with the Dalit constituency a looming factor in
municipal corporation polls across Maharashtra as well as in the Uttar
Pradesh elections.

At the centre of the dispute is a prime plot of sea-kissing land, just
off Shivaji Park and adjoining the existing Chaityabhoomi where a
memorial and stupa attract a few million visitors each year. The
demand for the India United Mills and Dye Works land (loosely called
"Indu Mill") for the Chaityabhoomi expansion project has been hanging
in balance since at least 2003, though the state government and the
NTC arrived at a decision in 2011 regarding sharing the land. The NTC
would get a high FSI of up to 7 for an 8-acre parcel in exchange for
the remaining 4 acres that could be used to expand the memorial. The
development potential for the land was then pegged as around Rs 1,000
crore.

On Dr Ambedkar's death anniversary last year on December 6, more than
500 followers under the Republican Sena stormed the mill land, claimed
that they had "taken possession" and installed a bust of Dr Ambedkar
and Buddha inside. Most of the hundreds left later, but some 15 monks
stayed back, watching over the statues as a steady stream of visitors
from remote corners of Maharashtra came over subsequent days to pay
their respects.

Encroachment of public spaces is common enough in Mumbai, but even the
Bombay High Court was astonished that the state administration had
chosen not to act against the squatters. It compared the occupation to
the demolition of the Babri Masjid, stating that the police should be
unapologetic about using force if necessary to evict the squatters.

"It was merely a symbolic occupation of the land," argues Kashinath
Nikalje, Maharashtra president of the Republican Sena, formed by
Ambedkar's youngest grandson Anandraj. "We did not construct a single
structure inside. We weren't seeking the land for ourselves. And, as
promised, we left as soon as the state government assured us that a
positive outcome could emerge in New Delhi."

Whether prompted by the symbolic protest or the rap on the knuckles
from the high court, the state government took its next steps swiftly,
initiating backroom negotiations with the occupiers and with New
Delhi.

"It is indeed a big step for the community that looks up to Ambedkar
even more than God," said Dalit writer-poet and political activist
Namdeo Dhasal. "But when such a populist decision is taken with
elections around the corner, it is natural to think about what led to
the decision at this time. The issue had been pending for years; had
they taken a decision earlier, it may have been much more meaningful."
Dhasal called the action of forcibly occupying the mill land
"childish" and said the various groups claiming credit for the outcome
should instead focus on completing Dr Ambedkar's mission.

While the move is expected to enthuse Dalit voters, including those in
Uttar Pradesh, the Congress in Maharashtra says it is mere coincidence
that elections in UP and key municipal corporations in Maharashtra are
round the corner.

"I am pained at the negative connotations around the decision. The
Congress has always been totally oriented towards the oppressed or
neglected sections of society," said MPCC general secretary Sanjay
Dutt. "This decision is a reaffirmation of our faith in the ideology
of Bharat Ratna Dr Babasaheb Ambedkar."

According to Dutt, Sonia Gandhi and the Prime Minister responded
positively to the initiative by the state Congress and Chief Minister
Prithviraj Chavan, taking the decision as swiftly as the chief
minister had presented his case on the very next morning after the
Rajya Sabha's adjournment following the Lokpal debate.

Anandraj Ambedkar has himself insisted that his was no political
stunt. Nikalje, who said various Dalit groups had supported their
"social movement", added that the Republican Sena is not interested in
contesting elections itself.

Yet, since the decision on Saturday, several hoardings have been put
up thanking Congress leaders for the decision, NCP members have
pointed out that their activist Vijay Kamble had been on a fast at
Chaityabhoomi even before the December 6 occupation of the mill, and
Republican Party of India leader Ramdas Athavale has organised his own
victory rally although the Republican Sena clearly out-thought him on
the issue.

Much anger is reserved for the Athavale group of the Republican Party
of India, which tied up with the Shiv Sena and the BJP for the local
body polls in mid-2011. Shiv Sena chief Bal Thackeray has called the
decision an election gimmick by the Congress. Congress and NCP leaders
have immediately pointed out that while Athavale is attempting to
claim some credit for the decision, his ally Thackeray had some years
ago stoutly opposed the renaming of the Marathwada University after Dr
Ambedkar. "The recent municipal council polls have shown that there is
no shakti in the Shivshakti-Bhimshakti combine," said Dutt, referring
to the Sena-BJP-RPI's poor showing. "The shakti of the people is
behind the Congress-NCP."

But NCP leaders have been candid about drawing up their own plans to
woo the Dalit vote after former ally Athavale supported the Sena-BJP,
including the suggestion last year to rename Dadar railway station as
Chaityabhoomi station, a step immediately opposed by Raj Thackeray.

Athavale has now demanded that the land be handed over by January 26,
failing which he would launch his own agitation, a threat termed as
tokenism by the Congress since a committee will now report on the
modalities of the handover by January 31.

Meanwhile, what precise shape the memorial will take is another debate
that has begun. While original plans were for a "Bhikshu-vihar", a
library and a "social justice university", new ideas include land for
Dalit groups to protest, a political education center for Dalit groups
and Anandraj's own idea — a statue of Dr Ambedkar, to be called the
Statue of Equality, on the lines of the Statue of Liberty.

Perambalur, Jan 4 : Tension prevailed following rumour that one of the
hands of a staue of Dr Babasaheb Ambedkar was damaged by unidentified
miscrents here.

Police said the right hand of the statue, installed by Pattali Makkal
Katchi(PMK) at the old bus stand area was found broken. Acting on
einformation, PMK volunteers led by town secretary Devendran, rushed
to the spot and repaired the broken hand.

Police said the same hand was found damaged repeatedly and every time
PMK partymen used to set it right. Police bandobust was made near the
statue.

Uttar Pradesh Chief Minister Mayawati's sinister trick

Uttar Pradesh Chief Minister Mayawati seems to have taken the misuse
of government machinery to buttress the poll prospects of the ruling
party to a new level in India's most populous state. According to
reports she is using state intelligence units to choose her party's
candidates for the assembly elections.

In what appears to be a sinister move, the Bahujan Samaj Party
government is allegedly even employing its machinery to pressure
candidates most likely to win to join their party.

Considering that the model code of conduct is already in force in the
state, this is a matter that must be looked into seriously by the
Election Commission of India. District officials who are willing to
act as pollsters for the ruling party can hardly be expected to
conduct the poll process fairly, and the EC must seek their removal.

But the larger issue here is of our governments habitually misusing
intelligence agencies for petty political purposes. This ensures that
the task of genuine intelligence gathering, critical for checking
crime and terror activities, gets the short shrift.

Here, Ms Mayawati seems to have picked a leaf out of the book of the
central government which, recent reports have revealed, makes the
Intelligence Bureau devote a large chunk of its resources on political
tasks rather than security duties.

MPs renew demand with PM for SC/ST reservation in private institutions

NEW DELHI: The recently created quota for minorities has given a
fillip to the demand for reservation for Scheduled Castes and
Scheduled Tribes in private educational institutions and government
establishments. The 165-member Forum of SC and ST parliamentarians has
taken up this demand with Prime Minister Manmohan Singh.

The forum has urged the government to move ahead with the central
legislation, which would provide reservations for SC, ST and OBCs in
private or unaided institutions. Both the prime minister and human
resource development minister Kapil Sibal are understood to have
responded positively to the demand.

However, no clear time frame has been given. "At present, private
educational institutions are not required to give reservations to
students from disadvantaged sections. We have appealed to the prime
minister to implement the 93 {+r}{+d} Constitution Amendment in
totality," J Seelam, the forum's secretary general, said.

The 93 rd Constitution amendment, which resulted in the insertion of
Clause (5) in Article 15, gives the government the right to make
special provisions for the advancement of socially and educationally
backward classes of citizens or for SCs/STs. It is argued that the
amendment was introduced to counter the Supreme Court judgement
striking down all reservations, including for SCs/STs in unaided
educational institutions in the PA Inamdar case.

The HRD ministry, then headed by the late Arjun Singh, had prepared a
draft legislation in 2006 to extend reservation to private
institutions under the provisions of the newly-inserted Article 15 (5)
of the Constitution. However, a group of ministers, which comprised
Pranab Mukherjee and P Chidambaram, had called for wider consultations
before taking the legislation forward.

New Delhi : A petition challenging the zero representation of
Scheduled Tribes in the UP Legislative Assembly on Tuesday left the
Supreme Court in a "delicate position" as regards the fate of the
fast-approaching state polls.

The writ petition filed by Virendra Pratap, a Gond Mahasabha member,
said the total lack of representation for STs in the UP Assembly was
in violation of a 2003 parliamentary enactment for "proportional
representation" in all legislative assemblies.

With the elections scheduled from February 4 to 28, the Bench of
Justices Altamas Kabir and S S Nijjar said any order passed by the
court at this point would disturb the poll schedules. "We are in a
delicate position here," the Bench observed.

Even turning to the Centre, represented by Attorney General GE
Vahanvati, for advice did not help, as he said the government cannot
be expected to go against the legislative intent of the 2003 law,
which calls for "proportional representation" of STs in assemblies.

The 2003 law saw 10 communities, earlier in the Scheduled Caste
category, shifted to the STs' list. With this, the law took the tally
of ST communities from five to 15 in UP. The development saw the ST
population in UP rise to 6.65 lakh from about 1 lakh.

"This means that a 0.4 per cent of the population (16.67 crore) is ST,
and this would translate to two of a total 403 seats in the UP
Assembly," advocate PS Narasimha, appearing for Pratap, submitted. He
argued how the Delimitation Commission, in a December 2005 order,
disregarded the increased presence of STs in the state.

The Commission, Narasimha submitted, had explained its action saying
their findings were based on the 2001 Census figures — when the 10
communities were still identified as Scheduled Castes.

The court asked what was Pratap doing for the past six years since the
Delimitation Commission's order in 2005. "If my mathematics is
correct, you have been asleep for six whole years. So why is it that
you have come now... You want to stall the elections?" Justice Kabir
asked.

The next hearing in the case is on January 9. The UP government has
also been made a party.

Lucknow: In journalism school, the first thing a student learns is
often Marshal McLuhans famous line - the medium is the message. In
political schools too, especially Uttar Pradesh (UP) style, McLuhan's
advice is being taken very seriously. At a time when it is its make or
break for political parties in the upcoming UP elections, political
parties in the state are looking for an image makeover and this task
has been handed to ad gurus and deft spin doctors.

Chief Minister and Bahujan Samaj Party (BSP) chief Mayawati has hired
a public relations (PR) firm to sell her party to the voters. The
coverage of her rallies is now outsourced to private event management
companies. She is also learning how to strike the right pose, to
ensure her enigma flows through the giant screens at her rallies.
Screens giant enough, perhaps, to match her ambitions.

However, the UP Chief Minister, known for her iron fist, has gone
beyond a cosmetic exercise. She has denied tickets to more than 50
sitting MLAs of her party, including 16 top ministers who have been
shown the door.

Avdhesh Kumar Verma, a former BSP Minister who is a victim of
Mayawati's operation cleanup, broke into tears while addressing a
rally in Shahjahanpur. "Someone who I treated like a parent is
punishing me without even letting me know what I have done wrong," Mr
Verma was heard saying amidst his sobs.

Many of these rejected MLAs are heading to other parties in search for
that suddenly elusive election ticket.

Former Labour minister Badshah Singh and till recently close Mayawati
aide Babu Singh Kushwaha joined the BJP on Tuesday after being given
the pink slip by the BSP supremo for being non-performers.

However, there are no takers for other candidates like D P Yadav who
enjoyed immense political clout despite facing serious criminal
charges.
Akhilesh yadav, Samajwadi Party (SP) President and son of Mulayam
Singh Yadav told NDTV that his party "will not take in tainted people
from Bahujan Samaj Party and there are no talks right now."

In fact, the image makeover for SP goes beyond giving tickets to
'clean' candidates.

The party has asked its candidates have been asked not to attend
flashy weddings, which can catch the Election Commission's attention.
They have also been warned against convoys of more than eight cars and
raising the party flag without permission.

While the Congress is projecting brand Rahul, the BJP is treading
cautiously. The failed 'India Shining' campaign of 2004 continues to
haunt the party, especially because Rahul Gandhi referred to it many a
times during his recent rallies in the state.

Much has changed since the last elections in the state. And while
Mayawati comes on the back of an absolute mandate, her party's image
seems to be more important than the achievements of the past five
years.

Uttar Pradesh goes to polls in seven phases from February 4 to February 28.

Andhra minister complains to President against colleague

Hyderabad: A minister in Andhra Pradesh Tuesday complained to
President Pratibha Patil against his cabinet colleague, whom he held
responsible for a recent attack on him.

Textiles Minister P. Shankar Rao met Pratibha Patil, who is on a
southern sojourn here, and demanded action against those involved in
the Dec 20 attack on him.

Accompanied by Dalit leader Manda Krishna Madiga, Shankar Rao told the
president that Home Minister P. Sabita Indra Reddy is responsible for
the attack.

Shankar Rao alleged that the conspirators behind the attack were yet
to be arrested by police.

The minister had come under attack at NTR Nagar allegedly by the
followers of the home minister and her son on Dec 20. His car was
damaged in the incident.

The incident took place when Shankar Rao was visiting a piece of land,
which is said to be the bone of contention between the home minister's
son and another person.

Shankar Rao has already urged Chief Minister Kiran Kumar Reddy to
dismiss the home minister.
