The Republican Party of India (RPI) has decided to showcase the new
political alignment with the Shiv Sena-BJP combine at Shivaji Park on
the occasion of Dr Babasaheb Ambedkar's death anniversary on Tuesday.

Despite alliance with the Sena-BJP, the RPI has retained its original
colour symbolically depicting there is no shift from its ideology. The
RPI's annual rally at the historic ground will explore and explain to
Dalits the concept of Shiv Shakti-Bhim Shakti.

"Ever since I took the decision to shun the Congress and the NCP,
there is an intense campaign launched against me and my organization
to tarnish our image. We have to set things right," RPI chief Ramdas
Athavale said.

Dalits across Maharashtra who converge on December 6 to pay their
reverence to Ambedkar are raising questions whether the RPI has
decided to follow Hindutva by joining hands with the saffron combine.

Dalits are wondering how the RPI can pursue its ideology hobnobbing
with the Sena -BJP combine. These are some of the questions, which
Athavale wants to remove from the minds of Dalits ahead of the civic
elections.

"I want to send a strong message that there was no ideological shift
in the RPI. Moreover, the decision to join the Sena-BJP alliance was a
tactical move towards empowerment of Dalits who have often been
exploited by the ruling Congress-NCP combine," Athavale said.The RPI
has extended invitation for the grand rally to second rung leaders of
Sena and BJP.

"We want Athavale to be the star of the rally. And we don't want it to
turn into a personality based event. What is more significant is the
message he would convey to the Dalits," RPI activists said.

Dalit writer Arjun Dangle said, "The Gennext Dalits are well aware
about Congress-NCP's betrayal to Athavale. They are ready to accept
the Sena-BJP as an alternative. As far as ideological differences are
concerned, we will always maintain our stand."

Subramanya temple, near Mangalore attracts severe criticism and equal
amount of support in India. The practice involves devotees allowed to
roll over plantain leaves; reportedly after dominant caste Brahmins
have eaten from the leaves. It is believed that the ritual will cure
skin diseases, in the past leprosy, mostly of the inferior castes, in
particular the Dalits. The temple is under the Muzrai Department of
the Government of Karnataka. Dr. Vedavyas Srinivas Acharya, a senior
minister of the state cabinet, who is also responsible for higher
education, planning, statistics and information technology departments
in the state government heads the Muzrai department. Dr. Acharya is a

That a qualified medical doctor heads a government department, which
manages religious institutions and the revenue generated from such
institutions is also responsible for other important cabinet
portfolios, not only allows such inhuman practices in the country but
justifies it in the name of religious belief and centuries-old
tradition is not just a shame for the country, but illuminates the
deep-rooted nature of orthodox prejudices that benefits the dominant
castes in the caste system of India. It underscores the fact that the
liberation of the country from the cobweb of caste is impossible
should the current situations continue. It paints an appalling picture
of what modernisation means in India, that Acharya is a senior
minister in the state, which hosts the country's IT capital,
Bangalore. It reiterates the argument that neo-Dalit political leaders
like Ms Mayawati are nothing more than shrewd politicians who use
pro-Dalit sentiments to maintain power and intends no good to the
community that she allegedly represents and her newfound affinity for
Brahminical practices could justify, manual scavenging, a practice
vicious and demeaning that rolling over banana leafs.

The government had prohibited the practice of Made Snana in 1979. But
it was soon reintroduced on the justification that it is a
centuries-old religious ritual. So is untouchability, a much older
practice, which today is prohibited not only in the constitution, but
also in at least half a dozen statutes. Yet it continues openly in the
country.

The practice of manual scavenging is also prohibited, including the
construction of dry latrines. But institutions like the Indian
Railway, the municipalities, corporations and panchayats employ manual
scavengers. The Indian Railway is the largest employer of manual
scavengers, and manages some of the longest rows of open latrines in
the world. The open-hole lavatories in every railway compartment that
is in service in the country turns the largest rail network of the
world into one big lavatory that drops raw human excreta and other
waste onto the rails, and over people and vehicles - where the rail
line runs above roads. It is a common scene in every railway station
in the country, railway employees cleaning with a broom, railway
sleepers covered with human excreta. In a country that tolerates this
and accepts the practice as 'god given' to a community, a few thousand
'devotees' rolling over leftover food and plantain leaves upon which
the food was served and eaten by some of the most exploiting
communities in the world - those Brahmins who believe in the caste
hierarchy - have eaten must be a negligible incident.

That caste-based discrimination continues in India is nothing new.
There is neither news value in it, nor is there any shocking discovery
about the incident. That this year's Made Snana was widely reported in
the media can be discounted due to the news value the event attracted
since a person who protested against this was publically assaulted.
The inhuman ritual never attracted such media frenzy before, and
probably will never again until some untoward incident that has an
alleged media value than the ritual itself happens. Such is the media
vigilance in India on some important issues, and the Indian media is
not immune to caste prejudice. It is clear from the fact that many
other similar inhuman practices based on dominant caste prejudices are
of no news value for the Indian media. This includes widespread bonded
labour of Dalits, Devadasi practices, the denial of food and medicine
to the Dalit and tribal children in rural villages by the dominant
caste government servants and land grabbing by dominant castes.

The only entities that openly express discomfort regarding caste
prejudices are the government agencies that represent India in
international fora. For these institutions and the persons who work
for them representing the government, caste is an internal matter of
the country. So was apartheid an internal matter of South Africa,
holocaust a domestic affair for Nazi Germany, and slavery an in-house
labour management for the racists.

Mistakes get corrected starting from the moment defects are admitted.
Caste based prejudices in India will continue until the government
publically admits that discrimination based on caste, in all its
manifest forms, is a crime against humanity. What it requires is
honesty in polity, and it is precisely what the governments in India
lack.

MANGALORE: Leaders of various dalit organizations demanded a ban on
Made Made Snana practiced at Kukke Sri Subrahmanya Temple during the
'shasti' festivities at the monthly meeting organised by DK district
police with members of and representatives of SC/ST organizations here
on Sunday.

Terming the practice "inhuman", they demanded that the feelings of
dalits be conveyed to the state government for necessary action.L
Shekar of Dalit Hakkugalla Horata Samiti pointed that such customs
were increasingly being used to subjugate dalits and they were foisted
on them in the name of tradition. He was also critical of the district
administration which backed down from its earlier decision of banning
the ritual.

Narayana Punchame, another dalit leader observed it was time for all
concerned to create awareness and bring this practice to a halt. P
Keshava, Dalit Sangharsh Samiti leader, sought action against
policemen on duty for failing to prevent the assault on K S Shivaramu,
president of Karnataka State Backward Classes Awareness Forum.

Noting that the section of the temple's administrators had treated
Nagesh and others accused of assaulting Shivaramu like heroes, Shekar
demanded that police take action against Keshava Jogithaya, the chief
priest of the temple for honouring the accused and offering them
prasad. SP Labhu Ram who chaired the meeting said since the probe was
on into the incident, points raised by the leaders would be looked
into during the course of investigation. he said t hat only one
complaint had been registered in connection with the assault and
police had already.

A report of the National People's Tribunal on the 2008 riots in
Kandhamal, Orissa, is out. The report that runs into 197 pages points
out that the brutality of the violence falls within the definition of
'torture' under international law, particularly the Rome Statute of
the International Criminal Court.

According to the tribunal, headed by Justice A P Shah, communal forces
used religious conversions as an issue for political mobilisation and
incited horrific forms of violence and discrimination against tribals
and Dalit Christians.

The 12-member jury relied on the testimonies of 45 victims, survivors
and their representatives.

The report, a copy of which is in rediff.com's possession, states that
the targeted violence against tribals and Dalit Christian community in
Orissa violates the fundamental right to life, liberty and equality
guaranteed by the Constitution, and affirmed by the ICCPR, ICESCR,
CERD and other international covenants.

Phagwara (Pb), Dec 5 (PTI) A case of murder has been registered
against a girl and her father here for allegedly killing a Dalit
youth, police said. The girl Jaspreet Kaur, her father, a former
sarpanch and four of their relatives were booked yesterday on the
complaint of the victim's brother Kulwinder Singh, SHO Shiv Kanwal
Singh said. The victim Harvinder, a Dalit youth, was in love with
Kaur, an upper caste girl and both studied in the same college Domeli
village, police said. Kulwinder alleged that Harvinder was called to
Kaur's residence in Sahni village on November 30 and murdered, they
said. The case has been filed under Sections 302 (murder), 34 (acts
done by several persons in furtherance of common intention) of the IPC
and Sections 25 and 27 of the Arms Act. However, no arrests have been
made in the case so far, the SHO said, adding that a country-made
weapon has been recovered. Police had earlier said that the youth shot
himself dead after attacking Kaur at her residence.

Ghaziabad, Dec 5 (PTI) Two Dalit women have alleged they they were
beaten up by policemen and forced to vacate their hutments in
Indirapuram area here in the presence of SSP Ghaziabad. Sushma (36)
and Meera (33) have written letters to Uttar Pradesh Chief Minister
Mayawati in this regard, their advocate Ravi Dutt Sharma said. In
their complaints, the women alleged they were beaten up, molested,
their hutments were destroyed and household articles looted on
November 5 by policemen in the presence of SSP (Ghaziabad) Raghubir
Lal and SHO (Indrapuram) Sunil Kumar. The complaint, filed by Sharma,
said according to a Government Order, dwellers living on government
land before 2005 could not be evicted and the two women were living on
the land for the past 40 years. The two women went to the District
Magistrate Sashi Bhushan's office and handed over the letters to him
on December three, the advocate said. The copy of the complaint had
been sent to the President, the Prime Minister and the National
Commission for Scheduled Castes and Scheduled Tribes, Sharma said. SSP
Raghubir Lal and SHO Kumar were not available for comments.

MANGALORE: The 'Made-Made Snana' ritual should be banned as it defames
Dalits and people from lower classes. The police department should
initiate suo moto action to safeguard the interests of Dalits, said
Dalit leaders during the SC/ST meeting held at the SP office on
Sunday.

Pointing out the incident reported at Kukke Subrahmanya temple
recently, Dalit leader Shekhar said, "The 'Made Snana' ritual is a
barbaric and superstitious practice and it should be stopped. If the
administration or police fail to do this, Dalits will have to
interfere to prevent the practice next year. As Kukke Subrahmanya
temple comes under the Muzrai Department, how can the mass meal be
served to Brahmins separately?" he questioned.

Puttur sub-division DySp Nagaraj should be suspended for his rude
behaviour with a Dalit leader, when he had gone to the police station
to lodge a complaint against the miscreants, he said.

SP Labhu Ram said that when the miscreants were assaulting Shivaramu,
the police interfered and separated him from the miscreants
immediately. The allegation on police that they did nothing to curb
the chaos was far from the truth, as the police had already arrested
the accused, he claimed. "But they are now out on bail and the court
will decide on the case," he added.

Dalit Rights Committee city secretary Lingappa Nanthoor said, "there
would be some people who indirectly support this practice and who
played a vital role in the incident. The police department should
identify such miscreants." He urged them to file an atrocity case
against assistant commissioner of Puttur sub division, Sundar Bhat,
who is also the administrator of the temple.

DSS district convener S P Anand alleged that a Dalit girl Soumya from
Kadaba had been denied a caste certificate, though she had produced
all the documents in concern.

Most Dalits face similar problems through out the district, he pointed
out. Another Dalit leader Gopal Kadumata said that Dalit employees who
are working at hostels under the Social Welfare Department receive a
pittance of a salary, which is given only once every four months.�
"This should be stopped immediately," he said.� Civil Rights
Enforcement Cell S P Sarvothama Pai said no one had complained about
the irregularities in payment of salaries.

Out of the Rs 1,600 crore worth grants released by the Central
government for the welfare of Dalits in the country, 90 per cent is
misappropriated, alleged Melur Manjunath, district unit convener of
Karnataka Dalit Sangharsha Samiti.

Addressing a press conference, he said all parties are busy making
money, than working for welfare of Dalits. Dalit associations
mushrooming all over the State have become a major problem.

On 'made snana'

"Made snana ritual, which involves devotees rolling over the food left
over by Brahmins promoted in Kukke Subramanya temple in Dakshina
Kannada and Chikkaballapur districts is a pathetic ritual. It
deteriorates human values. Karnataka Dalit Sangharsha Samiti not only
opposes this ritual strongly but will stage protest if such incidents
are repeated," he warned.

Total sanitation in Dalit colonies is still a distant dream. In
records, all the facilities have been provided to the Dalit colonies.
But in reality, none of these projects and facilities in record exist
in reality. All the grants have been misused by the officers
concerned.

Some of the associations forcibly collecting money at government
offices, in the name of Dalit welfare, is a major reason behind poor
condition of Dalits as the grants or money does not reach the
eligible.

Irregularities in the Department foSocial Welfare is on rise.
Substandard materials are used for hostel construction near
Hanumanthapur gate. So the building may fall even before inauguration.

Hostel contracts are also taken up by the Dalit leaders. There are
complaints that in these hostels children are deprived of quality
food.

MYSORE: Tension gripped Kanagana Maradi village in Pandavapura taluk
when upper caste youths attacked Dalits, injuring a Village Panchayat
member and a few others, over a trivial issue on Sunday night.

Injured Village Panchayat member Savithramma, youths Manoj and
Prashanth have been admitted to the government hospital in
Pandavapura.

Some upper caste youths picked up a quarrel when they noticed Dalits
seated close to upper caste to watch a circus performed at the
junction of the village.

When a few Dalits raised objections for directing them to keep a
distance from upper caste in public places, the upper caste men
thrashed Dalits and chased them away.

The Kanagana Maradi village has 40 Dalit families, who worked as
agriculture labourers. It is also said that upper caste people were
unhappy as a few Dalit youths demanded entry into Akantheshwara temple
funded by Muzari department. Meanwhile, additional police force has
been deployed in the village to defuse tension and ensure protection
to Dalit families.

Tahsildar Shivanand Murthy, DSP Kala Krishna, Circle Inspector Lakshme
Gowda and others visited the village and held talks with both the
factions.

They have held one more round of talks and appealed to the villagers
to bury their differences and lead a peaceful life.

Ahmedabad: Any person, accused of committing atrocity against people
belonging to scheduled castes/tribes, shall not get anticipatory bail,
the Gujarat high court has ruled.

The court was deciding on crucial question whether stringent
provisions contained in special law - the Scheduled Castes & Scheduled
Tribes (Prevention of Atrocities ) Act, 1989 - have specific bar on a
person's right to anticipatory bail as per CrPC.

Pravinchandra Solanki and four others were booked for beating and
abusing a dalit in Shahpur area of the city. Fearing arrest as they
were also booked by cops under the Atrocities Act, all five moved HC
for anticipatory bail. Their counsel cited different judgments by HC
in the past, in which persons booked under the Atrocities Act were
granted protection against arrest.

Justice Anant Dave found this quite opposite to the provisions
contained in section 18 of the Act. The judge cited a judgment by full
bench of Rajasthan high court on the same issue , in which the
conclusions were contrary.

Justice Dave felt that benches of Gujarat high court that granted
anticipatory bail in cases of dalit atrocities might not have noticed
the Rajashtan HC's order, or a similar order delivered by a Madhya
Pradesh high court.

Finding earlier orders in contradiction with orders of other high
courts, Justice Dave referred the issue to a division bench for
interpretation of law - whether accused in the atrocity cases can be
given anticipatory bail by HC while exercising its powers under 438 of
CrPC, particularly when there is an embargo in section 18 of
Atrocities Act that provisions of 438 would not apply in cases of this
special act.

Abench of Justice A L Dave and Justice Bankim Mehta heard the issue at
length, where in the applicants counsel argued that flat denial of
anticipatory bail is violative of provisions of freedom granted in
Article 21 of the Constitution . In a rebuttal, advocate general Kamal
Trivedi cited a Supreme Court order in this regard and contended that
the provisions of special act are meant for denial of relief in dalit
atrocity related cases.

The division bench observed , "Once a provision of law enacted by
Legislature, is held to be not unconstitutional or violative of
Article 21 of the Constitution, it stands on statute book and has to
be read as it is... The Section has to be read and given its ordinary
meaning ." In such circumstances, an accused under the Atrocities Act
cannot even seek anticipatory bail, neither a court can grant it, the
bench concluded .

"dalits and the downtrodden", for all tokenism of a Dalit as speaker
of Lok Sabha, and for all the buzz about a possible Dalit replacement
for Manmohan Singh as prime minister, the Congress-led UPA government
has issued a measly six pages of ads in 12 newspapers to mark the
death anniversary of the father of the Indian Constitution—and the
icon of Dalits—Dr B.R. Ambedkar.

In contrast, the State government of Uttar Pradesh, headed by Mayawati
of the Bahujan Samaj Party, has issued seven pages in the same 12
newspapers surveyed by sans serif.

The Centre's six pages of ads for Ambedkar is in stark contrast to the
393 pages of ads issued by various ministries and departments of the
Union government and Congress-run State governments to mark the three
birth and three death anniversaries of Jawaharlal Nehru, Indira Gandhi
and Rajiv Gandhi in 2011.

While various ministries were falling over each other to sing hosannas
for the three ex-PMs, only the ministry of social justice and
empowerment is in evidence for Dr Ambedkar. The only State government
advertiser is the Delhi commission for safai karmacharis.

'Dalit' kids getting normal names

BIRGUNJ, Dec 6: In recent times, the Dalit community has started
giving children normal names as opposed to past practice of giving
kids odd names so that the names did not match with those of people
belonging to higher castes.

The recent political changes and the ensuing social changes have
emboldened the community to give kids normal names.

"In the past, priests themselves did not give good names to our
children," said Chokat Majhi, son of Aghan Majhi of Chorni-7, Parsa.
"But I named my daughter Pooja," he added. Pooja, who is a nursery
student, is very happy with her name, he further said.

Many children who were given odd names are too ashamed to tell their
names to people, said Matar Majhi. "My father´s name was Tula. But I
names my son Raju," he added.

Dasai Chaudhary of Bakuliya, Bara, said the Dalit children, in the
past, were named according to their color, build, month of birth, day
of birth, or behavior.

While non-Dalit people gave their children names such as Rajendra,
Nagendra, Rajkumar, and Manish, among others, the Dalit children were,
in the past, named Kariya, Bhado, Bhikhari, Potan, Gena, Akkalu,
Jhagaru, and Paltu, among others, said Chaudhary.

"But things have changed," said Fariyad Ansari of Jitpur. "We now see
Dalit children with good names," he added.

Ansari believes the change has been brought about by the community´s
increasing access to schools, markets and electronic appliances.

The Chhatrapati Shahuji Maharaj Medical University in Lucknow has
urged the Medical Council of India that graduation degrees be granted
to SC and ST medical students, who have repeatedly failed to clear the
final exams. A few of them have been trying since 1996.
Earlier, about 50
reserved category students blamed the university's teachers, alleging
that they were deliberately giving SC-ST students poor marks.


The move comes only a few months before the assembly polls in Uttar
Pradesh where scheduled castes and scheduled tribes constitute 18% of
the electorate.

On Monday, a letter from the vice-chancellor of the university —
India's first residential medical university, established in 1905 —
Prof DK Gupta, to the MCI read: "As students have failed consecutively
on several attempts, they be allowed to have a degree."

He said a separate passing percentage should be fixed for students
belonging to the reserved category, as they get selected with lower
qualifying marks through medical entrance.

Although state medical education minister Lalji Verma said, "I will
comment only after going through the documents", Congress spokesperson
Ram Kumar Bhargava said repeated failure of a section of students
should be probed.

But Samajwadi Party leader Ambika Chaudhary said, "Once they (students
from underprivileged sections) get an opportunity, they must be up to
the mark to become doctors."
