A fraud by Mayawati government, say angry investors

Noida: First it was the farmer. Now it is the investor. With courts
taking up the cudgels for the poor, the investor now finds himself on
a sticky wicket. On Tuesday, in another major setback for the Uttar
Pradesh government, the Allahabad High Court scrapped the UP
government's decision to acquire 589 hectares of land in the Patwari
village in Noida Extension. (Read: 25,000 flats won't be built in
Noida Extension)

This has got the investors raging as it puts a big question mark on
their dream homes. Investors are now tense and worried if they will
get a complete refund from builders.

Dhananjay Kumar Singh, an advocate, purchased a Rs. 21 lakh flat on a
loan of Rs. 16 lakh.

"I'm stunned by this judgement. The entire responsibility for the
fiasco is with the state of UP along with the Greater Noida Industrial
Development Authority. I am asking for the refund and I will be
interested in getting the refund along with the interest," said
Dhananjay Kumar Singh, flat investor.

For software engineers Amit Mishra and Amit Singh this was their first
investment to purchase a dream house.

With Greater Noida's proximity to Delhi and the low prices, this they
believed was the perfect decision.

"We are losing out on money; we are losing out on hope. We are tense
as we don't know we will get a flat or not now. We have a humble
request to Supreme Court and High Court: they should think about
buyers too. We are not rich. We have put in our hard-earned money,"
said Amit Mishra, flat investor.

It remains to be seen what really happens. The matter will surely go
to Supreme Court, and in a matter of weeks the investors will know if
they can heave a sigh a relief or will their life long earnings simply
disappear before their eyes.

THENI: Mariyammal (24), a Dalit woman of Kovilpatti village was
assaulted by a caste Hindu, recently.

According to sources, her husband Bethan is working as a sanitary
worker at Theni government hospital.

Mariyammal was returning home after visiting her sick husband and on
the Kovilpatti-Karuttupatti Road at around 2.30 pm, caste Hindu
Chinnathambi (50) and two others intercepted her and said that they
would drop her home.

She refused and while passing through a cashewnut orchard, caste Hindu
Karikalan who had come along with Chinnathambi, attacked her and
gagged her with a cloth. As he tried to sexually assault her, she
started screaming for help. Immediately, Kariakalan and Chinnathambi
escaped.

Based on this incident Kandamanur Vilaku Police have registered an
FIR.� Karikalan was arrested and Mariyammal has been admitted to the
Theni Government Hospital.

According to a fact finding team from Evidence, an NGO, local bigwigs
have approached the police and were holding talks in favour of the
accused. Evidence sought that a case be registered under (3)(1)(10),
3(2)(5) of SC/ST Act against Karikalan.

They also wanted Theni District Superintendent of Police to be
appointed as an investigation officer and victim Mariyammal be paid a
compensation of `5 lakh.

NAGPUR: Not long ago, Ramdas Athavale of the Republican Party of India
was an ally of the Congress-NCP dispensation and whatever these
parties did was fine with him. Now that he has crossed over to the
saffron side by deciding to have political pact with Shiv-Sena and
BJP, he finds everything wrong with his former allies. On Tuesday, he
blamed chief minister Prithviraj Chavan for the latest terror attack
on Mumbai. "The Congress-led governments at the Centre as well in the
state are too busy preserving self-interests and corruption to bother
about people's security," he said.

He questioned Chavan's timing of raising the issue of power sharing
formula between the Congress and the NCP. "The latest Mumbai blasts
once again exposed the chinks in Mumbai police and failure of our
intelligence set-up. But instead of presenting a picture of unity and
concern, Chavan raked up the issue of power sharing and went on to
claim that the home ministry was too important a portfolio to be given
to the ruling partner NCP, thus implying that the Congress could have
handled it better," said the RPI leader.

The former MP parted ways with long-term ally NCP earlier this year
and has plans to fight next elections - from local-self government
level to state assembly and Lok Sabha - with Shiv Sena and the BJP as
electoral partners. "BJP president Nitin Gadkari has invited the RPI
to join the NDA and I intend to accept it. I will be travelling to New
Delhi early next month and talk to NDA convener Sharad Yadav about
it," said Athavale. He said there were chances of the much-hyped Shiv
Shakti-Bhim Shakti pact being sealed in October. The RPI is preparing
its own draft of the common minimum programme. "Namdeo Dhasal is
heading a draft committee and would complete his report in the next
few days after which we will start talks with the Sena-BJP," said
Athavale.

The RPI wants the new political combine to be in place firmly for
elections to 10 municipal corporations and local self-government
bodies in the state likely in February next. "Later, we would extend
it to state and general elections. Some people are questioning how my
party, which has always fought the saffron parties, is now joining
hands with them. To them I reply, in politics nothing is static.
Sometimes out of the box solutions are necessary. History is replete
with such revolutionary moves in politics. Moreover, I am convinced
that the Congress-NCP are not keen on serving the interests of the
Dalits. So what is wrong if I look for other options?" he asked.

"Dalit icon Babasaheb Ambedkar was very keen on a non-Congress
political alliance and had at one stage allied with Hindu Mahasabha
which was a major force at that time. Barrister Khobrgaade had, in
1980, been a close ally of the Jana Sangh," said Athavale, justifying
his decision to go along with the Sena-BJP. "My joining the saffron
alliance does not mean that I am walking away from Ambedkar ideology.
In fact, I want to leverage the new political equation for betterment
of Dalits," he stressed. He also said that the RPI would be made more
broad-based by giving 50% ticket share to non-Dalit candidates in all
elections.

Bhopal, July 19:
The State Government has extended time-limit for special recruitment
drive being carried out with a view to filling up of backlog and carry
forward posts for candidates belonging to Scheduled Castes, Scheduled
Tribes, Other Backward Classes and disabled persons. The time-limit
has been extended upto June 30, 2012. Earlier, the time-limit for
these reserved posts was extended till June 30, 2011.
The Principal Secretary, General Administration, Smt. Vijaya
Shrivastava has issued a circular in this regard to all the
Secretaries, Divisional Commissioners, Collectors and Chief Executive
Officers of district panchayats. The officers have been asked to
complete the recruitment process against reserved posts within
time-limit and send report to the General Administration Department in
every three months.

New Delhi : The National Commission for Minorities (NCM) on Tuesday
cleared Indian Institute of Technology-Delhi, of charges of

discrimination against scheduled caste and scheduled tribe students
and termed the allegations as "baseless".

The charges of discrimination was concerning allotment of

hostels and harassment of Scheduled Caste/Scheduled Tribe (SC/ST)
students, according to NCM officials.

A team from the NCM, led by Chairperson , P L Punia visited the IIT
campus and spoke to students and staff about the complaints. However,
of the 800 students in this category, only about 15 were present as
vacations are on. "We received some complaints from IIT Delhi about
harassment of SC/ST students on campus and also discrimination in
allotment of hostels and we have come to investigate into the matter."
said Punia.

The team, after speaking to the reserved category students, concluded
that the complaints were completely "baseless".

The average SC cut- off at IIT Delhi is 54.33 per cent of the general
category cut-off. The number of SC/ST students at IIT has gone up from
93 to 123 between 2006 and 2011.

The director of IIT-Delhi Surendra Prasad said that the institute was
going out of its way to help out students from reserved categories and
providing them the same facilities and opportunities as the general
category students.

A relaxation in performance is also provided to all SC/ST students to
help them in continuing their education smoothly. While general
category students require 27 credits to pass first year of their
degrees, reserved category students need only 23.

"We also run a preparatory course of one year's duration for those
reserved category students who have not made it to the cut off but
fall above a second cut-off. These students are taught Physics,
Chemistry, Math and English for a year and after passing a test, they
are admitted to the first year." said the director.

IIT admits about 30 students in the reserved category through this
programme every year.

In accordance with government policy, these students are exempted from
paying tuition fee and mess charges, additionally IIT Delhi provides a
scholarship of Rs 300 per month to each student from the reserved
category whose parent's annual income is below Rs 4.5 lakh.

NEW DELHI: Weeks after a major admission racket in Delhi University
was busted, Delhi Police is now investigating the role played by the
parents of the students who sought admission to DU colleges by
presenting fake SC/ST certificates.

Three agents and two DU employees have been already arrested in the case.

The crime branch has questioned the parents of the 13 students
involved in the racket and recovered several documents, relating to
payments made to scam kingpin Himanshu Gupta, from their possession.
Crime branch sources now say "the parents would be named in the
chargesheet".

The parents paid amounts ranging between Rs 2.5 to Rs 5 lakh to Gupta
and two other touts – Vikas Khanna and Ketan Gupta – for SC/ST
certificates that would allow their children to seek admission in
prestigious colleges under the reserved category.

Senior Delhi Police officials say they "have not arrested the parents
because they are still collecting evidence in the case" and are yet to
arrest Satish, an employee at the Ghaziabad Tehsil.

"The parents against whom we will find evidence of making payments to
agents would be chargesheeted under section 120B (criminal
conspiracy). We have spoken to all of them. Some of them have admitted
to paying the money while a few others will have to be questioned
again," said an officer. In an effort to jog their memory, the police
have questioned some parents in the presence of accused Gupta and
Khanna as well.

The department is also scanning call records of the parents because
they reportedly kept in touch with the racketeers over the phone. "The
parents were aware that what they were doing was illegal. They paid
for their kids' admissions knowingly," said an officer.

During the interrogation of Gupta, the police learnt that he had
facilitated admissions by provided fake certificates under SC/ST
category in 2008, 2009 and 2010. Most of the students who availed of
his services during these years also belonged to affluent families.

The racket came to light in the middle of June when crime branch
officials arrested Himanshu Gupta and two others for facilitating
students admission, through the reserved category in prominent DU
colleges, by providing them fake SC/ST certificates.

During the probe, the police learnt 12 students had gained admission
this year through this dubious route in colleges such as SRCC, Kirori
Mal, Sri Venkateshwara, Kamla Nehru and Shaheed Bhagat Singh, Moti Lal
Nehru and College of Vocational Studies.

The Supreme Court last week upheld the decision passed by the Bombay
high court in April directing the state government to reimburse
students belonging to the Schedule Class and Schedule Tribe category
studying in private un-aided schools.

The court also directed the state to form a committee of ministers to
look into the issue of reimbursing the entire education fees of these
students.

A division bench of chief justice Mohit Shah and Justice GS Godbole,
were informed by the petitioners that the appeal filed by the state
government against the April 28, order of this court, directing the
state to make interim payments of Rs100 to Rs200 to backward class
students has been dismissed.

Justice Shah, noted that "There is no question as to whether the fees
will be reimbursed or not it is at what rate will the state do it is
the question now." The schools which have been seeking fees from the
parents until the state reimburses, said that "Our fees are much
higher than what has been allowed as an interim relief to the
students. The parents should pay the difference, to us by then."

The bench also agreed with the school and suggested that the students
should pay up some amount until the final hearing of the petition. The
bench was hearing a petition filed by Naresh Gosaviclaiming that since
the government failed to disburse grant to private aided and unaided
schools under the free education scheme, their children were not
permitted to attend classes.
