[ZESTCaste] Jat boys dont want Group Photo with SC students

 

Dear Sir,
I want to tell one incident of today (20th April 2011) and also request you to please guide us in this matter. This is a true incident which happened at JK Trust Gram Vikas Yojna, Gopal Training Center, Sumeru Navkar Tirth, Miyagam, Karjan, Distt.- Vadodra (Gujrat). In this center 113 students from Haryana & near by states are taking part in a training related to animals. Out of these 113 students approx. 20 students are from Scheduled Cast. Today there was an Group Photo session for all the students. When an instructor told all the students to stand together for the photo session then two students came out and said openly that they don't want the Group Photo with these lower cast (Scheduled Cast) Students. Both the students are of Jat Community and belongs to Kaithal District of Haryana. After this incident the group photo session was postponed. This is really true incident. And now we want some suggestions from you.

New Delhi : The political class may be evil and corrupt but that's
whom Shanti Bhushan and his son Jayant Bhushan turn to when they want
a farmhouse each — for a song.

In his declaration of assets last week, Shanti Bhushan, also
co-chairman of the drafting committee of the Lokpal Bill, mentioned a
10,000 sq m farmland plot in Noida.

What he did not mention was the discretionary manner in which the
Mayawati government, early this year, allotted this land to him and
another 10,000 sq m farmhouse plot to his lawyer son Jayant Bhushan.
And in what raises questions of conflict of interest, Jayant Bhushan
has appeared against Mayawati in the Noida statue park case.

Incidentally, discretionary land allotment by the government is a key
issue on the agenda of the Group of Ministers on corruption.

In fact, this allotment of Noida farmland is now the subject matter of
a case in the Allahabad High Court filed by another allottee, former
Additional Solicitor General Vikas Singh.

Calling for the cancellation of the allotments, he has alleged that he
was allotted the "worst" piece of farmland as "punishment" since he
had shot off several complaints on the "arbitrary" manner in which the
farmland was being allotted.

The cost of each farmhouse plot is Rs 3.5 crore and allottees had to
pay just 10% — Rs 35 lakh — at the time of allotment, the rest in 16
instalments. This is less than a quarter of the market rate, according
to Vikas Singh's petition.

When contacted, Shanti Bhushan told The Indian Express: "My son and I
were among the applicants and we were surprised when we got the
allotment letters. I agree there is no transparency in the scheme and
allotments have been made without any clear criterion. But why should
we challenge this? The people who applied and were not given the
farmland should challenge it. I have heard that bribes have passed
hands for these allotments but, obviously, not from us. There may be a
case for a scheme like this to be cancelled."

Sources said that while 64 "successful" applicants were selected by
Noida authorities for farmland in Sectors 126, 127, 128, 131 and 133
in the first lot, the Bhushans were among 27 "successful" candidates
who appeared for an interview and got plots in a second batch in
Sectors 162, 164, 165 and 167.

Under the scheme, called "Open ended scheme for development of
farmhouse on agricultural land", announced by the Noida authorities in
January 2009, applicants had to submit a detailed project report on
how the farmland would be used, approved by a chartered accountant,
and provide a balance sheet of their income of last three years along
with cash- flow estimates. They were also asked to appear for an
"interview" before members of a screening committee.

When contacted, S C Pabreja, AGM (Institutional) of the Noida
Authority told The Indian Express that the "screening committee"
included members of the Authority's Finance, Planning, Legal,
Projects, Institutional and Construction Departments.

Once the applicants were cleared by this Committee, they were called
for interviews. While Noida authorities had announced they would put
up a list of "successful' allottees on their website, this has not
been done.

The manner in which the farmland was allotted has been challenged in
court. On April 16, the Allahabad High Court heard a bunch of writ
petitions, including that of Vikas Singh. In his petition, Singh has
alleged that the "the Noida Authority is not justified in selling its
property at rates way below the market price and that too collecting
only 10% of the premium thereof and such action of the Noida Authority
in the matter of allotment of plots is clearly arbitrary and
unjustified..."

Singh has also alleged that the Noida Authority made the filling of
the application forms and the submission of financial papers
complicated to "increase the subjectivity of the plot allotment
committee in selecting or rejecting the application."

Another joint petition has been filed by two Delhi-based doctors,
Harsh Mahajan and Vinay Sabarwal, who have not been allotted the
farmland. They have claimed they were "better placed" than other
applicants.

Lucknow : Taking suo moto cognizance of media reports on the
14-day-long Jat agitation in the state, which has led to disruption of
railway traffic and caused inconvenience to the public, the Lucknow
bench of the Allahabad High Court on Friday directed the agitators to
remove blockades and hold-ups on the railway track and roads at the
earliest.

A bench consisting of Justice Uma Nath Singh and Justice Virendra
Kumar Dixit also directed UP Principal Secretary (Home), DGP, Union
Home Secretary, chairman of the Railway Board and other concerned
authorities in the Government of India to hold a joint meeting and
take steps to ensure clearance of the railway tracks and highways at
the earliest.

They shall be held individually liable and proceeded against as per
law in case of failure or laxity to comply with the directions, the
court said, and fixed March 23 for next hearing and a status report.

Principal Secretary (Home) Fateh Bahadur Singh and DGP Karamvir Singh,
who were present in the court, assured that they shall take all
necessary steps towards compliance of the order.

Chief Justice Ferdino Inacio Rebello had constituted the special bench
after taking cognizance of media reports about cancellation and
disruption of train movement following the Jat agitation.

In the afternoon, the bench summoned UP Advocate General, DGP, and
Principal Secretary (Home). On behalf of the Central government,
Additional Solicitor General (Allahabad) Dr Ashok Nigam appeared in
the court.

On a call given by the Akhil Bharatiya Jat Arakshan Sangharsh Samiti,
the Jats have been sitting on the railway track at Kafoorpur in J P
Nagar district, between Delhi and Moradabad, since March 5, to press
their demand for OBC status in Central government jobs. Despite
several requests from the Railways, the state government has taken no
action to clear the tracks.

Asked about the HC directions to remove the blockades, Yashpal Malik,
president of the Akhil Bharatiya Jat Arakshan Sangharsh Samiti¿ said,
"The matter has been passed on to the legal cell of the samiti and we
will make a prayer before the HC on Monday to place our gri¿vances."

He said the samiti will apprise the court about the long-pending
demand of the community¿and the "indifferent¿attitude" of the Union
Government.

In another order, the Allahabad bench of the High Court on Friday
directed the Director General of Police to take immediate measures to
clear the railway tracks and provide full protection for smooth
movement of trains.

The DGP was also asked to update the court as to the action taken
against the miscreants, cases registered and the result of the
investigations. The court asked the DGP to file a compliance report on
March 29. It also directed the railways to announce restoration of
normal traffic on the lines between Lucknow and Delhi.

HYDERABAD: The architect of modern India - this is an epithet usually
given to Jawaharlal Nehru but it rightfully belongs to Dr BR Ambedkar,
said Prof BL Mungekar, Member of Parliament (Rajyasabha).

Speaking on 'Dr Babasaheb Ambedker's contribution to the making of
modern India' at the inaugural function of the Centre for Ambedkar
Studies (CAS) in the University of Hyderabad (UoH), the MP said that
Ambedkar had led millions of oppressed people to a life of
self-respect, dignity and responsibility.

He had always stressed on the importance of education for people's
upliftment and it was he who was primarily responsible for the
Constitution being adopted after India's independence, he said.

Ambedkar through his writings has moulded opinion and brought about a
revolution in the Indian society by expressing his views on caste
inequality, women's empowerment, social and political issues and
labour class movements and thus has contributed a lot to the making of
modern India.

Speaking about the new centre, Dr YK Ratnam, coordinator of CAS said,
"Writings are a modest attempt to mirror the prevailing issues of the
Indian society. Ambedkar's intellectual analysis and insights provide
a valuable resource to students and researchers as well as those
engaged in policy making." Prof Nancharaiah, dean of the school of
social sciences said more funds would be brought forth to develop CAS
in the 12th five year plan.

Acting university vice-chancellor, Prof V Kannan said that CAS will be
a good resource centre for scholars who want to do their research on
Ambedkar.

Prof I Ramabrahmam, head of the department of political scinece,
academicians from Osmania University, Ambedkar Open University etc,
research scholars and Dalit activists were also present.

HUBLI: People must introspect whether they were actually contributing
towards making Ambedkar's dream for the nation a reality, Praveen
Kumar Mishra, Divisional Railway Manager of Hubli Division of South
Western Railway, has said. He was addressing a gathering after paying
floral tributes to B.R. Ambedkar at the programme organised to mark
the 120th birth anniversary of B.R. Ambedkar at the Divisional Office
Quadrangle, here on Thursday.

Mr. Mishra said that Ambedkar had considered education crucial for the
empowerment of the Dalits.

According to Ambedkar, it was essential in carrying out a successful
movement for their socio-economic liberation, Mr. Mishra said.

The Supreme Court on Tuesday directed state governments to start
fixing accountability against administrative and police officials
failing to check caste (khap) panchayats from encouraging and carrying
on honour killings and other atrocities in an institutionalised way.

A bench presided over by Justice Markandey Katju asked state
government to immediately suspend the district magistrate/collector
and SSP/ SPs of the district as well as other officials concerned if
they fail to prevent such incidents despite prior knowledge of the
happening.

Apart from initiating criminal proceedings against those directly
responsible for such incidents, there was a need to fix accountability
against officials failing to prevent such incidents and not
apprehending the culprits promptly, the court stressed.

The court said state governments should suspend such officials,
chargesheet them and proceed against them departmentally.

The direction was passed while upholding the conviction in a case
concerning an assault on a Scheduled Caste person by a group of
backward caste persons in Tamil Nadu. The accused beat the victim
after abusing and humiliating him.

After dealing with the case at hand, the court went on to discuss the
ills plaguing our society.

"This is the age of democracy and equality. No people or community
should be today insulted or looked down upon, and nobody's feelings
should be hurt. This is also the spirit of our Constitution and is
part of its basic features," the bench said.

The bench expressed displeasure over prevalence of, what it called,
the two tumbler system in Tamil Nadu. "This system is that in many tea
shops and restaurants there are separate tumblers for serving tea or
other drinks to Scheduled Caste persons and non- Scheduled Caste
persons… In our opinion, this is highly objectionable and is an
offence under the SC/ ST Act," it said.

The court recalled that in an earlier case it had directed protection
of those marrying outside their caste. There was a need for harsh
punishment for those behind honour killings, the court had said.

After issuing directions for fixing liability against officers failing
to check atrocities by khap panchayats, the court directed that a copy
of the order be sent to all state chief secretaries, home secretaries
and director- generals of police. The state should in turn circulate
it to all officers up to the level of district magistrates and SSP/ SP
for strict compliance.

The bench said the order should also be brought to the notice of all
high court judges.

Cop suspended for beating a dalit man

Karnal, April 20, 2011

Karnal police have suspended a munshi (duty officer) at Gharaunda
police station for torturing a Dalit youth on Monday. Sanjiv Kumar
from Gharaunda was summoned at the police station along with his
father Chand Singh following some dispute with some neighbours. The
other party was also called to arr
ive at a compromise.

However, five policemen, including munshi Vinod Kumar, allegedly beat
Sanjiv Kumar when he said he saw a 'bomb-like' object in the toilet of
the police station.

Sources said Sanjiv fainted after the beating and was taken to a
private hospital, from where he was referred to the trauma centre in
Karnal. His condition was reported to be stable.

Deptuy superintendent of police Surinder Singh Bhoria visited the
victim in the hospital to inquire into the matter.

Meanwhile, Rohtak inspector general of police V Kamaraja has directed
the Karnal SP to investigate the matter and take prompt action against
the erring cops.

The Supreme Court on Tuesday said anyone calling a Dalit by his caste
with an intention to insult him or her would commit an offence under
the Scheduled Castes and Scheduled Tribes (Prevention of atrocities)
Act.

A Bench of Justices Markandeya Katju and Gyan Sudha Mishra also
decried the practice of "two tumblers" prevailing in Tamil Nadu, while
upholding the conviction of two persons under the Act.

The court warned that the administrative and police officers would be
held liable for prosecution if they failed to curb the practice of
serving foods in two separate tumblers to Dalits and members of other
castes. "This is an offence under the SC/ST Act, and hence those
practising it must be criminally proceeded against and given harsh
punishment if found guilty," the Bench said.

Two persons Arumugam Servai and Ajit Kumar, belonging to the "servai"
backward caste community, were held guilty by a Madurai sessions court
for calling Panneerselvam and Mahamani by their caste "pallan".

"The word 'pallan' no doubt denotes a specific caste, but it is also a
word used in a derogatory sense to insult someone. Even calling a
person a 'pallan', if used with an intent to insult a member of the
SC, is, in our opinion, an offence under Section 3(1)(x) of the SC and
ST (Prevention of Atrocities Act), 1989," Justice Katju said.

Casteism is one of the main causes holding up the country's progress

While deprecating the caste system in the country, the Supreme Court
has declared illegal 'khap panchayats' which often decree or encourage
honour killings or other institutionalised atrocities against boys and
girls of different castes and religions who wish to get married or
have married.

"This is wholly illegal and has to be ruthlessly stamped out. There is
nothing honourable in honour killing or other atrocities and, in fact,
it is nothing but barbaric and shameful murder. Other atrocities in
respect of the personal lives of people committed by brutal,
feudal-minded persons deserve harsh punishment. Only this way can we
stamp out such acts of barbarism and feudal mentality. Moreover, these
acts take the law into their own hands, and amount to kangaroo courts,
which are wholly illegal," a Bench of Justices Markandey Katju and
Gyan Sudha Misra said on Tuesday.

Sentence upheld

The Bench upheld the sentence of two-year imprisonment, including six
months' imprisonment under the SC/ST (Prevention of Atrocities) Act,
1989, awarded by a trial court to Arumugam Servai, who called a member
of a Scheduled Caste community by his caste name, 'Pallan'. It
dismissed his appeal against a Madras High Court judgment.

Writing the judgment, Justice Katju said: "The word 'Pallan' no doubt
denotes a specific caste, but it is also a word used in a derogatory
sense to insult someone. Even calling a person 'Pallan,' if used with
intent to insult a member of the Scheduled Caste, is, in our opinion
an offence under the SC/ST PoA Act."

Jefferson's ringing words

The court quoted Thomas Jefferson in the American Declaration of
Independence, 1776 saying "We hold these truths to be self-evident,
that all men are created equal, that they are endowed by their creator
by certain inalienable rights that among these are life, liberty, and
the pursuit of happiness."

The Bench said: "Over two centuries have passed since Thomas Jefferson
wrote those memorable words, which are still ringing in history, but a
large section of Indian society still regards a section of its own
countrymen as inferior. This mental attitude is simply unacceptable in
the modern age, and it is one of the main causes holding up the
country's progress."

Two-tumbler system

The Bench also expressed its anguish over the two-tumbler system
prevalent in many parts of Tamil Nadu. "This system is that in many
tea shops and restaurants there are separate tumblers for serving tea
or other drinks to Scheduled Caste persons and non-Scheduled Caste
persons. In our opinion, this is highly objectionable, and is an
offence under the SC/ST Act, and hence those practising it must be
criminally proceeded against and given harsh punishment if found
guilty. All administrative and police officers will be accountable and
departmentally proceeded against if, despite having knowledge of any
such practice in the area under their jurisdiction, they do not launch
criminal proceedings against the culprits."

Condemning honour killings and khap panchayats, the Bench directed the
administrative and police officials to take strong measures to prevent
such atrocious acts. "If any such incidents happen, apart from
instituting criminal proceedings against those responsible for such
atrocities, the State government concerned is directed to immediately
suspend the District Magistrate/Collector and the SSP/SPs of the
district as well as other officials concerned and chargesheet them and
proceed against them departmentally if they do not prevent the
incident if it has not already occurred but they have knowledge of it
in advance, or if it has occurred, they do not promptly apprehend the
culprits and others involved and institute criminal proceedings
against them, as, in our opinion, they will be deemed directly or
indirectly accountable in this connection."

The Bench directed that a copy of this judgment be sent to all Chief
Secretaries, Home Secretaries and Directors-General of Police in all
States and Union Territories, and circulated to all officers up to the
level of District Magistrates and SSP/SP for strict compliance. A copy
would also be sent to the Registrars-General/Registrars of all High
Courts who would circulate it to all judges.

Chandigarh, Apr 19 (PTI) Chief Minister Bhupinder Singh Hooda today
directed Deputy Commissioners and SPs to ensure effective
implementation of the Scheduled Castes and Scheduled Tribes
(Prevention of Atrocities) Act in Haryana. Hooda gave the direction
while presiding over a meeting of state-level Vigilance and Monitoring
Committee constituted for implementation of the Act, an official
release said. An officer of DSP-level would be deputed to probe cases
relating to violation of the Act, the Chief Minister said. The meeting
was informed that the legal assistance given for defending such cases
would be increased from Rs 2,500 to Rs 5,500.

Jalandhar : The state Scheduled Caste Commission directed the local
police and the civil administration on Tuesday re-open all cases where
alleged atrocities have been committed on Dalits and forcible
compromises executed by the police, instead of providing justice to
the victims. It has also directed that even those cases, which have
been cancelled by the police, be re-opened within a month.

Commission Chairman Niranjan Singh, along with members Dalip Singh
Pandhi and Parkash Singh Gardiwal, said this while hearing complaints
of the people belonging to the SC community in Jalandhar. This was
part of the Commission's drive to visit all 20 districts across the
state to listen to the complaints of the SC community. Before
Jalandhar, it has paid a visit to Nawan Shahr district.

In Jalandhar, the Commission received over 50 complaints pertaining to
killing, rape, pension, civic amenities, etc.

According to Niranjan Singh, in nearly 86 cases of atrocities on
Dalits, the police have put pressure on the community to accept
compromises. "It is ridiculous that even in court cases, the victims
turned hostile under pressure from Punjab Police," he added.
