New Delhi : A person availing reservation in state jobs on grounds of
being a "backward" cannot claim the same privilege in the Centre
unless declared so by the Union government as well, the Central
Administrative Tribunal has ruled.

The tribunal passed the order on a petition by four members of the Jat
community, recognised as Other Backward Class (OBC) in state of Delhi
and seeking quota benefits for appointment as lower division clerks
(LDCs) in the Employees State Insurance Corporation Limited, a Central
government firm.

They reported for duty after clearing the selection process, but were
not allowed to join on the ground that they did not figure as OBC in
the Central government list and were not entitled to quota benefits.

Mangalore: It's said that all men are equal before God. However, the
treatment meted out to Dalits in the name of religion and tradition in
an ancient South Indian temple is baffling.

At the famous Kukke Shri Subramanya temple in southern Karnataka,
there is a 400-year-old ritual called Madhe Snana. As part of the
ritual, Dalits are asked to roll on used banana leaves, which are used
as food plates in religious ceremonies.

The ritual starts with a feast for Brahmins who are fed on banana
leaves. Once they finish eating, the Dalits are asked to roll over the
used banana leaves. The Brahmins claim that the practice cures them of
diseases.

This is the same temple that the God of cricket, Sachin Tendulkar,
often visits. Aishwarya Rai Bachchan has also sought blessings here.
Even Karnataka Chief Minister B S Yeddyurappa has offered prayers to
Lord Subramanya here.

Refusing to face humiliation in the name of tradition, the Dalits have
now decided to protest the practice. Shiv Ram, President, KRHVJV, says
the practice is an insult to Dalits in particular and the society in
general, and that government should stop the practice. Some other
organisations have also supported banning the practice.

The temple administration defends the practice, saying that Dalits are
not forced to roll over the plates.

India's Raghuvanshi receives German award for aid to untouchables

Weimar, Germany - Lenin Raghuvanshi, an Indian human-rights activist,
was in Germany on Friday to receive an award in the city of Weimar for
his long fight on behalf of the dalits, or untouchables.

Raghuvanshi, founder of the People's Vigilance Committee on Human
Rights (PVCHR) in Uttar Pradesh state, also campaigns on behalf of
women, children and indigenous peoples and counsels victims of
injustice.

Weimar's city council picked him in June as winner of the eastern
city's annual human rights prize, worth 2,500 euros (3,300 dollars)
and invited him to Germany to receive it in person on International
Human Rights Day.

The citation said Raghuvanshi, a 40-year-old doctor, documented
dalits, or members of India's lowest caste, who died of hunger or had
been victims of police torture.

Mangalore, December 10: A group of Dalits and people of Backward
Classes of Friday staged a protest at the popular Kukke Subramanya
Temple in Sullia taluk of Dakshina Kannada district demanding to ban
"Made Snana".

The protest was organised under the banner of "Karnataka Rajya
Hindulida Vargagala Jagruta Vedike (KRHVJV)" and "Dalita Hindulida
Alpasankhyatara Samanvaya Vedike (DHASV).

Speaking on the occasion KRHVJV President K Shivarama said that the
district administration and the state government should immediately
intervene to stop such reckless practices in the temples.

He warned that if the temple authorities failed to stop Made Snana the
Dalit and Backward Classes organisations along with other like-minded
groups would intensify their protest against this shameful ritual of
Hinduism.

He also criticised new Muzrai minister of the state Dr VS Acharya, who
had recently justified 'Made Snana' saying that it is an 'innocuous'
practice. "Such a foul ritual in a Muzrai temple is a shame," he
said.

Vidya Prasanna Tirtha of Subramanya Math had recently said that the
Math, which he heads, had nothing to do with the temple, which was
managed by the Endowment Department of the Government of Karnataka.
He had also said that this ritual is a matter of people's belief and
no force is used to make people offer Made Snana.

`Made Snana' is a practice of people, most of them Dalits, rolling on
plantain leaves used by Brahmins for meals, under the belief that it
will cure them of skin ailments. This will be performed on special
occasions, like the annual shashthi inside the temple premises
(horangana). This year, the three-day annual fair started on Thursday.

Hinduism is not cast in caste

Millenial questions haunt various religious traditions, and their
adherents are too often forced into the roles of apologist or
antagonist. Islam is hounded by the questions of extremism and
violence--of the past and present; Christianity deals with a history
of the crusades and inquisition of yore, and church scandals today;
Jews are bedeviled now by the Palestinian question; and Hindus, well,
there is the caste conundrum.
A hierarchical system of caste based discrimination against those
belonging to the "lowest" castes, often referred to as Harijans or
Dalits, is still in play in parts of India, especially rural villages.
Hindus too often feared to tread on this "untouchable" issue--one that
is so contrary to the lofty ideals of a religion that speaks of an
immanent and transcendent divinity that inhabits every being
equally--or historical analogies and tortured explanations are
proffered to explain what should not be.
Marking Human Rights Day and the sixtieth anniversary of the
ratification of the Universal Declaration of Human Rights, the Hindu
American Foundation released today a report that confronts the caste
issue head-on. Hinduism: Not Caste in Caste--Seeking an end to Caste
Based Discrimination is a groundbreaking, 172-page report, that states
with brutal honesty that Hindus bear a special burden to denounce
caste-based discrimination since some Hindu texts sanction the caste
system. But in contending that caste is in no way "intrinsic" to
Hinduism, the report is redemptive: the solution to the caste blight
actually lies in a proper interpretation of authentic Hindu scripture.
It is an admission, a renunciation and a call to action.
Presented here, is the report's Executive Summary, as authored by the
report's editor-in-chief, Swaminathan Venkataraman, and co-editors,
Pawan Deshpande and Mihir Meghani.
Caste-based discrimination is a serious human rights issue in the
Indian sub-continent. Over 160 million people fall under the category
of Scheduled Castes (SCs), the erstwhile untouchables, and still
suffer from terrible discrimination. And, while untouchability has
been outlawed, abuse and discrimination of SCs persist, particularly
in rural areas of India. In 2008, the Government of India recorded
33,615 human rights violations of various types affecting SCs.
Hindus must acknowledge that caste arose in Hindu society, that some
Hindu texts and traditions justify a birth-based hierarchy and
caste-bias, and that it has survived despite considerable Hindu
attempts to curtail it. Caste-based discrimination represents a
failure of Hindu society to live up to its essential spiritual
teachings and is not an intrinsic part of Hinduism itself. It
represents a lamentable gap between the Hindu teaching of divinity
inherent in all beings, and the failure of society to put that precept
into practice in its dealings with fellow Hindus.
While many in Hindu society may have failed the SCs in the past , it
is critical for Hindu leaders and the larger community to own up to
the problem and address it. While we recognize, and salute, that much
work is already being done in this regard by many Hindu religious
leaders, organizations, and individuals, there is a need for a more
forceful, coordinated, and concerted approach than has been undertaken
thus far, given the sheer magnitude of the problem. In this
connection, HAF presents statements from 13 prominent Hindu religious
and spiritual leaders categorically denouncing caste-based
discrimination as having no part of their teachings and practice of
Hinduism. Several more leaders support our effort, but were unable to
provide us with written statements in time for this publication.
HAF supports the reanalysis and subsequent rejection of any and all
teachings that promote caste-based discrimination and birth-based
hierarchy. Most such teachings are found in texts called Smritis, or
books of ancient Hindu social law, which by their very nature and
intent, are recognized to change with space and time and do not
necessarily teach Hinduism's eternal spiritual truths. Hindu religious
and spiritual leaders must take the lead in ensuring that those parts
of the various scriptures that promote notions of caste-based
discrimination and a birth-based hierarchy are explicitly denied any
authority in the minds of their followers. We hope that they work more
actively to end discrimination, promote equality, and end birth-based
hierarchies by ensuring that their followers put Hindu spiritual
teachings into practice.
At the same time, traditional power structures in the caste hierarchy
have undergone a substantial change, and any solution to the problem
of caste-based discrimination must incorporate the new dynamic that
has emerged in India. The urbanization and economic development of the
country, the Government of India's (GoI) reservation policies, and the
sheer dynamics of representative democracy have wrought a sea change
in caste dynamics since India's independence in 1947. These factors
have also lead to dramatic improvements in the social status of
numerous erstwhile "lower" castes. Thus, while much remains to be
done, especially for the SCs and Scheduled Tribes (STs), the
significant progress in the six decades since India's independence
must also be acknowledged and built upon.
We must also recognize that caste violence in India today is
significantly driven by political and economic considerations and
occurs not between "upper" castes and SCs but rather largely between
the erstwhile "backward" castes and the SCs. For this reason,
eradicating caste-based discrimination not only places a religious
responsibility on Hindus, but also a secular responsibility on civic
and business institutions, and a political responsibility on the GoI
as well as state and local government and law enforcement. Effective
implementation of police reforms and stringent law enforcement are
critical in combating caste-based discrimination.
The movement for the emancipation of SCs is an important one. HAF is
fully committed to the end of discrimination against all SCs, Hindu or
otherwise. We are supportive of the vibrant Harijan and Dalit movement
that has taken root in India today, are working with such groups today
and seek to work with more in the future. Dr. B.R. Ambedkar's greatest
legacy consists not only in his authorship of the Indian Constitution
but also the self-empowerment that he has inspired among the Dalits,
as seen in the large number of secular, Dalit, non-governmental
organizations (NGOs) that are engaged in improving the lot of SCs in
various parts of the country today.
The modern Dalit movement has been joined in the last decade or two by
many Christian organizations, often supported financially from Europe
and the U.S. HAF lauds those organizations involved in mitigating or
eliminating human rights abuses, but is wary of the motives of those
that seek to exploit the situation through anti-Hindu propaganda and
that are driven primarily by conversion agendas. The presence of
caste-based discrimination in Hindu society is one of the reasons that
provides missionaries the ability to "fish in troubled waters." This
is why we argue that Hindu society has a great moral burden to act in
a more determined and concerted fashion to end caste-based
discrimination.
Missionaries are correct about the prevalence of caste-based
discrimination in India, but their claims about caste-based
discrimination being intrinsic to Hinduism, and that conversion to
other religions is the only way to eliminate this problem, must be
seen in the light of their vested interests of "harvesting souls."
Tellingly, conversions to Christianity have not led to an improvement
in the situation of SC converts, who continue to suffer discrimination
at the hands of "upper" caste Christians. We also present testimonials
from a Hindu SC community leader in Chattisgarh affirming his pride in
Hinduism and only demanding for an end to social discrimination, as
well as an article on the plight of Christian Dalits by a well-known
Christian interfaith activist.

CPI (M) State secretary asks why Chief Minister is objecting to a
probe by Joint Parliamentary Committee if he is convinced there are no
irregularities in allocation.

Communist Party of India (Marxist) State secretary G. Ramakrishnan on
Friday alleged that Chief Minister M. Karunanidhi, who was not able to
address the problems of ordinary Dalits, was using the "Dalit card" to
duck the 2G spectrum scam.

Addressing a public meeting here, Mr. Ramakrishnan, who had visited
the flood-affected districts such as Tiruvarur and Nagapattinam, said
the Dalits had been displaced and were living in schools after recent
rain ravaged their settlements.

"They are groping in the dark, not knowing from where the next meal
will come. There are Dalits facing discrimination in many parts of the
States. In places such as Uthapuram their entry is prevented. The
Chief Minister who is not able to address these issues, is using the
Dalit card to protect former Minister A. Raja," he said.

He asked why the Chief Minister was objecting to a probe by a Joint
Parliamentary Committee (JPC) if he was convinced that there were no
irregularities in the allocation of 2G spectrum.

On Karunanidhi's speeches

Recalling Mr. Karunanidhi's speeches made in the wake of spectrum
scam, Mr. Ramakrishnan said that though the Communists appreciated his
talents as writer and speaker, he would not succeed in protecting Mr.
Raja by utilising his skills.

'BJP too can't take pride'

He said the Bharatiya Janata Party too could not take any pride when
it came to clean image in politics, because its Chief Minister B.S.
Yeddyurappa was facing charges over allocation of lands in Karnataka.

CPI (M) North Chennai district secretary T.K. Shanmugam said the Chief
Minister's family was fully controlling the film world, that no
theatre in the city was ready to screen the Tamil version of the film
'Ambedkar' as it would not generate any revenue.

Probe sought

In a separate statement, Mr. Ramakrishnan sought a probe into the
alleged irregularities in the allocation of TNHB plots and flats under
government discretionary quota.

"Many allottees are wealthy people who already own houses in their
name. There are also irregularities in fixing the price," Mr.
Ramakrishnan alleged.

Dalit Christians demand quota in education, jobs

The Dalit Christians Munnetra Kazhagam staged a demonstration
demanding reservations in education and employment, near the
Collectorate, here on Friday. The protestors pitched strongly for
quota on lines of the two per cent reservations for Dalit Muslims and
fisher folk announced by the Puducherry government. The Vidudalai
Chiruthaigal Katchi lent its support to the protest.

"The demand came in the backdrop of the recommendations of the
Ranganath Mishra Commission. The Puducherry government announced
reservations for Dalit Muslims and fisher folk, but none for Dalit
Christians," said Bismarck, president, Dalit Christians Munnetra
Kazhagam.

The National Commission for Religious and Linguistic Minorities headed
by Justice Ranganath Mishra had recommended inclusion of Dalit
Christians and Dalit Muslims in the scheduled caste category thus
entitling them to reservations. Dalit organisations had observed a
nation-wide black day demanding inclusion of Dalit Christians in the
SC category in August.

CHENNAI: Fear of the local panchayat and the threat of a
counter-complaint' from the accused lead to many cases of atrocities
on dalit women going unreported in the southern districts, which are
prone to caste-related crimes. Only 84 cases of atrocities on dalit
women had been reported between December 2004 and November 2009 in
Madurai, which, according to the 2001 census, has 12.54% dalit
population.

While Sivaganga, which has a 19.36% dalit population, reported just 33
cases of atrocities on dalit women, Theni (16.35% dalits) reported
only 25 cases during this period. While Madurai tops the list when it
comes to cases of rape, sexual abuse and other physical injuries,
Theni tops the list for murders, says a survey conducted by Evidence,
a Madurai-based NGO.

"The fewer number of cases, unfortunately, shows the rise of crimes
against women in these areas. Almost all the cases against dalit women
are settled' by the local panchayat head in many remote villages.
Women are not allowed to approach the police in many places. If
someone files a complaint, the police will not book the accused under
serious sections of the IPC. They file most of the cases under a minor
section of the Scheduled Castes and Scheduled Tribes (Prevention of
Atrocities) Act, 1989. In many cases the accused will file a false
counter-complaint against the victim and finally the case will be
settled with police support," says R Thilakam, an activist, who works
on projects on dalit women.

There are 6,051 cases of atrocities on women reported all over Tamil
Nadu in 2009. Madurai alone recorded more than 350 cases. Lack of
awareness is also an important reason for most cases going unreported.
"In many cases, women don't know how to approach a police station. If
at all the case is filed, they don't bother to check the status
because they are unaware of procedure.The conviction rate is also very
low," says K Arumugham, an advocate.

The police, however, don't agree. "I don't think most cases are going
unreported. We get a lot of complaints and action is taken on almost
all. We always give preference to dalit women. Since proper inquiry is
needed, some cases may take a little while. But there is no
unreasonable delay,' says Madurai SP M Manohar.

Is 'Vijaya Karnataka' ready for a Dalit editor?

Vishweshwar Bhat's exit from Vijaya Karnataka yesterday has been
treated by the paper's owners and managers with the same contemptible
gracelessness that has been the hallmark of their conduct vis-a-vis
journalists in the last two decades. There is not an announcement in
today's paper nor an explanation.

It is as if the reader, who is told why Yana Gupta didn't wear her
underwear, somehow doesn't deserve to be told why there is a change at
the top of the State's biggest newspaper, in today's imprintline.

The boiler-plate internal Times VPL memo, designed to reassure the
rest of the flock and cool their anxieties, announces the name of E.
Raghavan as the new consulting editor of the paper, on top of his
current responsibilities as consulting editor of the presciently named
Vijaya Next.

But just what kind of new editor should a mass-circulation paper like
Vijaya Karnataka get? The Udaya TV anchor Deepak Thimaya, who did a
short stint as editor of Vijaya Next before being replaced by
Raghavan, has posted a provocative suggestion on his Facebook page.

"I think a qualified journalist with a Dalit background should be made
editor of a major newspaper in Karnataka. We may get new perspectives
and the issues addressed may be different too. The time is ripe."

Thimaya doesn't take the name of Vijaya Karnataka, of course, but the
hint is clear.

Journalist Samanth Subramanian's debut novel wins prize

New Delhi, Dec 10 (IANS) Journalist-turned-novelist Samanth
Subramanian's debut book 'Following Fish', which explores food and
cultures associated with fish along the country's coastline, has won
the 2010 Shakti Bhatt First Book Prize.

Subramanian, currently a deputy editor at The Mint, a New Delhi-based
business newspaper, has an undergraduate degree from the Penn State
University and a masters degree from Columbia University in
international relations.

'Following Fish' is a fascinating exploration of one of the world's
oldest aqua species and the lores, gastronomy and cultures associated
with the humble fish along the country's extensive coastline - from
Bengal to Kerala to Goa.

The prize has been instituted in the memory of Shakti Bhatt, daughter
of Sheela Bhatt, editorial director of rediff.com. Shakti Bhatt, a
publisher and writer, was the wife of well-known poet Jeet Thayil. She
died in 2007 in her mid-twenties after a sudden illness.

The prize carries a purse of Rs.100,000 and a citation. It is awarded
to a debut work of fiction, poetry, creative non-fiction (travel
writing, autobiography, biography and narrative journalism) and drama.
Writers from the sub-continent are eligible for the prize, but their
books have to be published in India. The medium of language has to be
English or translated in English from a regional language.

The three-member panel of judges comprising playwright Mahesh Dattani,
writer and surgeon Kalpana Swaminathan and novelist Ruchir Joshi
selected Subramaniam's book from a short-list of five books.

The short-list included 'Homeboy' by H.M. Naqvi, 'House on Mall Road'
by Mohyna Srinivasan; 'Songs of Blood and Sword', 'A Daughter's
Memoir' by Fatima Bhutto; 'The Wish Maker' by Ali Sethi, and 'Delhi
Calm' by Vishwajyoti Ghosh.

The judges described the book as a 'delightful read, adventurous and
unabashedly fun'. They said the writer's 'instinct for the apt word,
telling phrases, colourful personalities and the comic element' kept
the narrative taut.

The book has been described by writer Ramachandra Guha as a 'stunning
debut by a hugely gifted writer'.

The writer begins his fishing odyssey in Kolkata where he pursued the
prized hilsa with 'single-minded intensity'.

'The fish has such a unique place in Bengali society. It is reflective
of the Bengali obsession that they like to do certain things in a
certain way,' Subramanian told IANS.

The young writer subsequently trawled the waters down south to Andhra
Pradesh, Tamil Nadu and Kerala, where he even drove an autorickshaw
'rather poorly, on an empty Kerala highway to chase his muse'.

Subramanian said he was 'very very happy' to win the prize. The award
was presented to him at the British Council auditorium Friday.

Bijapur: More than 25 students of the Scheduled Castes and Scheduled
Tribes Boys' Hostel in Bijapur city staged a dharna in front of the
Dr. B.R. Ambedkar Circle on Thursday evening for the alleged failure
of the hostel authorities to provide food and breakfast to them
regularly.

The students, who staged the dharna under the leadership of Akhila
Bharatiya Vidyarthi Parishat (ABVP), alleged that the authorities
concerned had not taken any steps to improve quality of food even
after repeated pleas and memorandums submitted to them.

On Thursday morning, cooks at the hostels asked students to have their
breakfast and food outside as the hostel authorities had not received
funds for groceries and foodgrains.

As most of the students residing in these hostels are poor and are
dependant on food provided in the hostel, such students would be
forced to discontinue their education and go back to their villages to
earn their livelihood.

Keeping this in view, the authorities concerned should take action
against the hostel authorities who had failed to serve food to
students regularly.

The students also alleged that the hostel authorities have not taken
any steps to provide safe drinking water, proper toilets, library
facility and other amenities, though funds had been released for the
purpose.

The government today said more than 450 posts under the reserved
category were lying vacant in three top state-run hospitals in the
national capital owing to various reasons.

"498 reserved posts are lying vacant in three Central government
hospitals -- Safdarjung hospital, Dr Ram Manohar Lohia hospital and
Lady Hardinge Medical College and associated hospitals on account of
death, retirement, resignation, non-availability of suitable
candidates," Union Health Minister Ghulam Nabi Azad told the Lok Sabha
in a written reply today.

"Recruitment and filling up of these posts is a continuous process and
vacancies are filled up through the recruiting agencies based on
requirement and also taking into account the government's reservation
policy," Azad said.
