Inter-caste marriage doesn't confer SC/ST status: HC

Nov 24, 2010 - SUCHITRA KALYAN MOHANTY | New Delhi

Saying that women of forward castes cannot claim Scheduled Caste or
Scheduled Tribe status after getting married to men belonging to
either of the two communities, the Delhi high court has upheld an
order of the Central Administrative Tribunal (CAT) rejecting the
Kendriya Vidyalaya Sangathan's decision to dismiss from service a
woman recruited under the reserved quota for the STs.

A division bench comprising Justices Pradeep Nandrajog and Siddharth
Mridul upheld the decision of the CAT saying that the Sangathan was
very lax in recruiting the woman and then woke up from deep slumber 15
years later to take action against her.
Another factor which went in favour of the woman was a ruling of the
Supreme Court, which said that the court has to make a distinction
between those who get jobs under the quota meant for persons belonging
to the two communities by committing fraud upon the authorities and
those who have availed of the benefit believing that they have been
admitted to either of the two communities by getting married to men
belonging to one of them.
The Sangathan had appointed one, Shanti Acharya Sisigi, as a primary
teacher way back in 1988 under the reserved quota meant for ST
candidates.
She had also produced relevant certificates issued by the deputy
commissioner of Singhbhum in Jharkhand. She had got married to a
person belonging to the Munda community. Fifteen years later, the
sangathan issued a notice to the woman challenging her claim that she
belonged to ST.

[ZESTCaste] SC hints at transfer of Dalit case from Haryana to Punjab

SC hints at transfer of Dalit case from Haryana to Punjab

New Delhi, Nov 23 (PTI) The Supreme Court today indicated it would
transfer the trial relating to largescale violence against Dalits in
Haryana''s Hissar district to Punjab in view of the alleged harassment
faced by the victims and witnesses.
A Bench of Justices G S Singhvi and A K Ganguly expressed displeasure
at the prevailing situation asked the Additional District Sessions
Judge, Hissar, to send a report in the context of affidavits filed by
two advocates on behalf of the victims.
It asked Haryana to file its response within a week and pulled up the
state government for not setting up a State Human Rights Commission
till date.
The additional affidavits filed in the case by advocates Veena Sharma
and Rajat Khalsan detailed the alleged threats and the hostile
atmosphere towards the victims/witnesses by the perpetrators of the
violence.
"We are indicating to you (Government) that it would be appropriate if
the case is transferred to Chandirgarh.
"Let it go to Chandigarh, at least they will feel secure.
Not that we are casting any aspersion on the trial court at Hissar.
But the atmosphere is not conducive to fair trial. We have seen the
judicial system crumbling during terrorism", the Bench said in its
oral observation.
On April 21, a 70-year-old Dalit man and his 18-year-old physically
challenged daughter were burnt alive in the violence against the
community by members of the upper caste, forcing about 150 families to
flee Mirchpur village in Hissar district and take shelter at the
Valmiki Temple in Delhi. PTI RB

[ZESTCaste] Dalits barred entry into temple, tension in Tirupur village

Dalits barred entry into temple, tension in Tirupur village
Nandhu Sundaram, TNN, Nov 24, 2010, 06.26am IST

COIMBATORE: Tension gripped the Uthamapalayam village in Tirupur
district in western Tamil Nadu after dalits were allegedly barred from
entering a Hindu temple built by non-dalits.

Behind the serene facade of Uthamapalayam, a village about 12km from
Kangeyam town, a row has been simmering for the last one week between
250 dalits and 1,500 non-dalits. The trouble erupted on November 21
when the dominant community of Gounders, besides Mudaliars and
Chettiars, decided to perform the kumbabhishekam of the new Mariamman
temple they had built. As dalits were refused entry into the new
temple, they blocked the roads and staged protests. The revenue
divisional officer (RDO) called a meeting of the leaders of the
different communities, but the talks failed. Prohibitory orders have
been clamped in the village and police are standing guard at the
temple site.

Dalits claimed that the upper castes' had refused to even sit along
with them during the talks with the RDO. The non-dalits allegedly
constructed the new temple as dalits were allowed entry into the old
temple which was being administered by the HR&CE department in January
2005. The dalits alleges that the upper caste people took away the
jewels of the deities and funds of the old temple to form a new
Mariamman Trust and build the new temple.

"An FIR has been filed against both parties (dalits and non-dalits)
and a curfew has been imposed under section 145 of the CrPC to prevent
further tension," said revenue divisional officer (RDO) Akbar Ali.

"The Mariamman Trust is illegal because the old temple is under the
HR&CE department. There should be only one Mariamman temple for this
village and both the dalits and the upper castes should be allowed to
worship there," says S Karuppiah, the convenor of the temple entry
movement. But the non-dalits are unrelenting. "Who are they to say
there cannot be two temples in Uthamapalayam," asks 57-year-old V
Sivasubramani, a land-owning Gounder, whose father is a temple
trustee.

The old temple, which has stood in Uthamapalayam for 600 years,
meanwhile, has been abandoned by everyone in the village. "No one
wants to worship there anymore. The priest never comes. He is in the
control of the upper castes," says P Muthu, a dalit labourer, who was
part of the temple entry movement.

After series of meetings to bring about peace between the two groups
failed, the RDO ordered an inquiry on December 2. Non-dalits claim
that the temple is on nearly two acres of patta land owned by them
and, therefore, they have the right to keep dalits out. But dalits
counter that the trust which owns the land is a public body and they
have the right to enter the temple.

Dalits are unable to offer worship in many temples across Tamil Nadu
even 86 years after rationalist leader EV Ramasamy led a revolutionary
movement to take Dalits into Hindu shrines. Dalit leaders and Left
party functionaries have launched a state-wide movement to throw open
the temples which are shut for the Dalits.

Subject: Donations for 2010

Please circulate it widely to your colleagues, friends, relatives, organizations, and social and email groups.

-----------------------------------------

Dear donors, friends, and well-wishers,

It has been over a month since I came from India. I am still busy with my personal matters (my brother's death is still bothering me a lot) and so I could not devote time to give information on my Indian trip or work on FFEI projects. I have yet to finalize the accounts for 2009. I will complete it ASAP.

I am thinking of sending donation appeal after finalizing accounts; but time and tide wait for none.

So, I am appealing for donations for 2010. Please send them as early as possible so that we will make arrangements. You have been patronizing FFEI (Ambedkar Scholarships) since 2003 and I expect the same this year as well. Our responsibility has greatly increased as we have adopted kids for education at 5 different states and we need your help. Please come forward with whatever you can spare. We need your help.

In the past one month, the following activities have been taken place:

We sent advertisement to all schools in AP and expecting to get the applications by the end of October.

We disbursed Rs. 1,00,000 to Sakya Hostel for its maintenance.  As the funds are running out, its maintenance is worrying its managers. I was very impressed of its working when I visited the hostel. Thanks to Prof Shiva's initiative, the donation was made by Prof David Mumford of US. Thanks to both.

We disbursed Rs.50,000 to a microloan project (called "Centring" in building construction), thanks to Prof Anandswarup of Australia.  A group of 10 construction workers will become owners with this donation in a year or so. I met them, listened carefully the proposal, and requested help. Prof Anandswarup, as usual came forward. Thanks Professor.

We also planning to buy a computer for the library in Veluru, again with the donation of Rs.20,000 by Prof Anandswarup.

We are pleased to announce that Dr Siddoji Rao, Director, AP Study Circle (IAS coaching center run by AP Government) is willing to associate with FFEI. He is a young and dynamic. He studied in JNU, USA, Australia and gold medalist all through his academic career. He was a dean in an Australian university before coming to India to do social work.  I saw his dedication and sincerity from close quarters. We may officially induct him at a later date. Thanks, Dr Siddoji for coming on board.

I have been in dialogue with individuals and organizations I visited during my trip on how we can work together to help the most needy children.

So, friends, please come forward with you generous donations for 2010. We have 501(c)(3) in USA and your donation is tax deductible. We are hoping to get Income Tax exemption in India as well, most probably by the end of this year.

We are planning to wind this drive by Dec 31, 2010. Please rush your donations.

Please send your donations to one of the following methods:

[ZESTCaste] A true inheritor of Ambedkar's mission

http://www.khabrein.info/news/A_true_inheritor_of_Ambedkars_mission_1290445690/

A true inheritor of Ambedkar's mission

22 November, 2010Share
By Vidya Bhushan Rawat

The passing away of veteran Ambedkarite Bhagwan Das is closure of a
great chapter in the contemporary Dalit movement. A close associate of
Baba Saheb Ambedkar, Bhagwan Das in every sense of life lived a life
of true follower of Baba Saheb. I had opportunities to meet on several
occasions and would vouch that I remained highly impressed and in awe
with his simplicity and the library of knowledge that he had on
Ambedkar's work and writing. He was not a rebel rouser but proved
through his meticulous writings that he was much more concerned and
his views were immensely important to the growth of Ambedkarite
movement. Those narratives and documented work on the life and mission
of Ambedkar are inalienable part of the Dalit movement.

It was a great opportunity for me to have heard his counseling on
various occasions. For me, just an association with Dr Ambedkar made
him a legend in my eyes. But that was not enough; his association with
people's movement particularly with those who believed in Ambedkarite
perspective gave him credibility. He has tremendous knowledge about
different caste and their issues. I can say that after Dr Ambedkar, he
was the most read person in the community who spoke on the
contemporary issues with great passion and with a command and
conviction of ideas. Though, he was the most respected Ambedkarite of
his time, one does not know why the politicians claiming Ambedkar's
legacy kept away from him.

It is ironical that the tallest ambedkarite became victim of his caste
identity. Though, he was most concerned about the schedule castes yet
he often spoke about the marginalization of 'Bhangis'. Yet, just usage
of the term Bhangi made him unpopular among many of his own folks who
started using Balmiki which according to Bhagwan Dasji was a term
cleverly used to Hinduise the community. His book ' Main Bhangi Hoon',
became popular among people yet the community leaders never ever
thought of involving him in their issues. I had put this question to
him many times as why there is a perception that Balmikis did not join
hand with Baba Saheb Ambedkar. But, Bhagwan Das ji was very clear
about this and said that the myth that the Balmikis not being part of
Ambedkarite movement was absolutely an attempt to divide Ambedkar's
struggle. . He referred to Baba Saheb and his support to the cause of
scavengers in Punjab. According to him, it was the Bhangis who invited
Baba Saheb to Punjab. But because of politicization of castes, many
among his caste felt otherwise. Similarly, the other communities who
felt that he was not from them alienated him. It was most tragic thing
that I felt and that Bhagwan Dasji knew but Ambedkarism and Buddhism
were his two commitments and he never dithered from that.

The 1990s were turbulent years in contemporary Indian political
history. The forces of Hindutva were gaining ground with growing
assertion of Dalits and backward communities. The Mandal commission
report and its aftermath show how the Indian middle classes and caste
Hindus did every dirty trick to thwart the implementation of the
report. It also showed how the struggle for implementation of Mandal
Commission Report was more carried forward by the Dalits and not by
the so-called other backward communities for whom the entire exercise
was meant. They bore the brunt of the contempt and violence of these
reactionary forces. It was also a period of ascendancy of the Bahujan
Samaj Party and its politics. They were becoming a force to reckon
with yet Bhagwan Das and many other veteran Ambedkarites kept away
from it. One does not know whether they kept away from it or were
unwanted in the BSP kind of politics. He always focused to develop an
enlightened Dalit community which can respond to the upper caste lies
and manipulations through knowledge and arguments. He would go to
different parts of the country particularly in organizations like
Samta Sainik Dal to strengthen the movement.

It was tragic that the person who was an embodiment of a true
Ambedkarite did not get the respect that he deserved. It is an
undeniable fact that Bhagwan Das was perhaps the tallest Ambedkarite
in the post Ambedkar era. The amount of work that he contributed to
explore Ambedkar and his writings is unparallel. He was a living
encyclopedia of Ambedkarite perspective on various contemporary
issues. I can say without any doubt in my mind that whenever I had any
doubt about anything about Baba Saheb's writing and work, I would
first speak to him and try to find the factual position. He had
numerous anecdotes about Baba Saheb Ambedkar and how he got influenced
with his life and action. Each time, I visited him; I would just
listen to his arguments and narratives. With his personal warmth, each
narrative was important and that is why I felt that I should record
his views and one day I went with my camera to record his views on
contemporary issues. It was a seer pleasure to listen his enlightened
views.

It was always a sense of deep enlightenment to have met Bhagwan Dasji.
A man who saw and worked with Ambedkar was so simple in his personal
life. I was fortunate enough to have met him so many times and in our
small association he too developed respect of the work that I was
doing and hence was always available for the seminars and conferences
that we organized on contemporary issues related to Dalits and
marginalized. In those days, I was regular in these meetings and
listening to him always gave a great pleasure. Anyone, who heard him
for one or two hours, could never say that his grasp over the subject
was not increased. His understanding of Indian caste system was
tremendous. A widely traveled person, Bhagwan Dasji would inform you
about the caste and sub caste issues with impeccable knowledge on the
issue. That also showed that he was not just a book worm but a widely
accessible person to people who understood their feelings and issues.

There was no difference in his personal life and beliefs. I knew many
veteran Ambedkarites for whom Ambedkarism was just a political thought
but Bhagwan Dasji proved through his life and mission how one can live
a life of true Ambedkarite. It is difficult to see that kind of warmth
that he possessed when we become machines without emotions and
solidarity. As a young activist, I learnt from him so many things that
it is difficult to narrate but every time when I would visit him, the
first thing he would ask me to relax or take a cup of tea of coffee
prepared by him. He would bring himself the tea and ask me to first
have it and then discuss any other thing. He would inquire how am
coming from a far away place to meet him and he always encouraged my
deep sense of commitment to Ambedkarite thought.

Bhagwan Das was the first person who brought the issue untouchables (
I am using his term only as he refused to use the word Dalit) or
Scheduled Castes at the international forums, at the United Nations
and at various international human rights forums. Today, the Dalit
issues have got international recognition and many may claim to have
done it but the ground work for it was done by Bhagwan Das when there
were not many civil society organizations working for human rights of
the Dalits.

It is equally important to know that these Dalit rights organizations
never felt to honor him or take his guidance on the issues of the
Dalits in contemporary India. Of course, last year a Hindi literary
journal devoted to Ambedkarite philosophy carried a special issue on
him. It is tragic that a man of his stature remained a person non
grata in his own community because he embraced Buddhism and was a true
Ambedkarite. He was concerned about the manual scavenging practices in
our society and was worried about their conditions and isolation with
in the Dalit movement yet he never really supported the sub-caste
identities. For him, being Ambedkarite was the most important part of
a person life and that is where I felt that he was far above than many
of his contemporaries. I understood the politics going in the name of
Dalit Bahujan and had his own reservation about them. There were very
few like him who could speak of conviction despite the emotional
feelings of many. His commitment was to Baba Saheb Ambedkar's thought
and he traveled to nook and corner of the country to spread the
message of Dr Ambedkar in true sense.

Today, when the media has been highlighting the 'Dalit issues' and
some of them have given some 'space' to new 'Dalit' 'movement', yet
the harsh reality is that none ever thought to approach him to speak
on the contemporary issues. Was it because he did not have JNU tag
which our media wants? Was it because he equally condemned the
globalization and knew the international instruments of human rights
much better and hence would not speak the language of the corporate
media for the sake of appearing in their programme? It is shocking
that none in the mainstream media thought of writing about the man who
was undoubtedly the tallest Ambedkarite amongst us. Like Baba Saheb he
reminded us the power of knowledge and self change.

That cultural change in self made Bhagwan Das is much bigger than
others but alas our political class, self proclaimed messiahs and
so-called international activists would have taken a few things from
him for the benefit of masses. He never resorted to rhetoric which are
the hall mark of today's literature and politics. He shined through
his knowledge, his humility and his convictions. Whether corporatised
brahmanical media remember him or not, Bhagwan Das remain am icon for
all those who have not compromised on their basic principals and
adhered to original philosophy of Baba Saheb Ambedkar of enlightenment
through passion and participation. Like Baba Saheb Ambedkar, he left
with a rich legacy of enormous material on Ambedkarism, Caste
particularly related to Scheduled castes and on Buddhism. Generations
will benefit from his work on caste and religion in India particularly
those who are the most marginalized and how Dr Ambedkar fought his
battle against the status quoits forces. As we grow and face so many
challenges of caste, class, imperialism and communalism, Bhagwan
Dasji's writings will be the guide for us to understand Baba Saheb
Ambedkar and how Ambedkar could have responded to current crisis. We
remain indebted to him for his path breaking work on Baba Saheb
Ambedkar and his unquestionable integrity to strengthen an Ambedkarite
India where each one of us can live with equality, dignity and self
esteem.

Dear reader,
It has been some time ago since you received news from the India
Committee of the Netherlands (ICN) via this IndiaNews mailing list.
This is not because nothing happened, but because there were too many
other issues to attend to. We plan to send you this news from now on
more frequently, around every two weeks or so. The newsletter mainly
focuses on issues of child labour & education, corporate
accountability and caste discrimination in South Asia. But we will
also inform you about related global, thematic or regional issues.
Path-breaking reports: No Child labour – Better Wages
Together with the federation of Dutch Trade Unions the India Committee
of the Netherlands has published the path-breaking report: 'No Child
Labour – Better Wages'. It shows that eradicating child labour, while
already being very positive itself, can also make a big contribution
to much better wages for agricultural labourers. Although the sample
of the study is small it reinforces the experience of e.g. the MV
Foundation in Andhra Pradesh that ending child labour leads to better
wages. It has also decreased the dependency of agricultural labourers
on the landowners. See:
http://www.indianet.nl/pdf/NoChildLabourBetterWages.pdf
This study is also published as part of a larger study on child labour
and decent work which has four other cases from India on this issue
showing, among other things, how unions can increase their membership
and strength if they engage in fighting child labour. This report is
called: Let Parents Earn and Children Learn:

Former manual scavengers demand total eradication and rehabilitation
`Government should apologise to us´
Around 1,000 Safai Karamcharis from 20 states, who were until recently
engaged in the outlawed practice of manual scavenging, assembled in
Delhi on the 1st of November 2010 and resolved to return to Delhi on 1
January 2011 if their demands were not met. "We are giving the
government time to announce a special package for the rehabilitation
of manual scavengers," said Bezwada Wilson, national convenor of the
Safai Karamchari Andolan Read more about this extraordinary movement

Guiding Principles Human Rights and Transnational Companies
UN Special Representative for Business and Human Rights John Ruggie
has published his draft Guiding Principles for the implementation of
the United Nations 'Protect, Respect and Remedy' Framework. The draft
Guiding Principles are open for public review and comment until 31
January 2011.  The draft Guiding Principles and press release are
available here:
http://www.business-humanrights.org/Links/Repository/1003306. Comments
can be sent via Professor Ruggie's online consultation forum:
http://www.srsgconsultation.org
The Guiding Principles elaborate and clarify for companies, states,
and other stakeholders how they can operationalize the UN 'Protect,
Respect and Remedy' Framework, by taking practical steps to address
business impacts on the human rights of individuals. The UN Human
Rights Council had...asked Ruggie to provide this additional concrete
guidance, [to be presented formally to the Human Rights Council at its
June session.
Rights for People, Rules for Business
Under this slogan the European Coalition for Corporate Justice (ECCJ)
is conducting a petition campaign. We call on you to hold companies
operating in the EU legally accountable for any harm they cause to
people and the environment around the world. They must disclose
accurate information about their activities. Victims should face no
barriers in accessing justice in the EU. The campaign is directed to
the heads of state of the European Union and to the president of the
European Commission, José Manuel Barroso. Please sign at:

ISO 26000: Guidance on Social Responsibily
The ISO Guidance Standard for Social Responsibility of organizations
has been officially launched on the 1st of November. The national ISO
members have approved of the Standard with 93% of the votes in favour.
India was one of the few countries voting against it, while China
voted yes. The standard is unique for 'translating' international
human rights, labour and environmental standards for organizations,
but also for firmly establishing principles like accountability,
transparency, ethical behaviour and stakeholder engagement. This has
been done in a process of almost six years involving stakeholders
groups from governments, NGOs, unions, employers, consumer
organizations and a group of academics, consultants etc. Developing
countries were strongly represented. It is expected that, though this
standard is not certifiable, it will have a profound influence on the
discourse and practice of organizational accountability and social
responsibility. Unfortunately the standard is not freely available but
a lot of information can be found here:
