[ZESTCaste] 2010: Request for donations

 

No response from donors (execpt one or two) since I posted this request couple of weeks ago. Only 2 moths left in 2010. Please come forward with your pledges.

It has been over a month since I came from India. I am still busy with my personal matters (my brother's death is still bothering me a lot) and so I could not devote time to give information on my Indian trip or work on FFEI projects. I have yet to finalize the accounts for 2009. I will complete it ASAP.

So, I am appealing for donations for 2010. Please send them as early as possible so that we will make arrangements. You have been patronizing FFEI (Ambedkar Scholarships) since 2003 and I expect the same this year as well. Our responsibility has greatly increased as we have adopted kids for education at 5 different states and we need your help. Please come forward with whatever you can spare. We need your help.

 

In the past one month, the following activities have been taken place:

 

We sent advertisement to all schools in AP and expecting to get the applications by the end of October.

 

We disbursed Rs. 1,00,000 to Sakya Hostel for its maintenance.  As the funds are running out, its maintenance is worrying its managers. I was very impressed of its working when I visited the hostel. Thanks to Prof Shiva's initiative, the donation was made by Prof David Mumford of US. Thanks to both.

 

We disbursed Rs.50,000 to a microloan project (called "Centring" in building construction), thanks to Prof Anandswarup of Australia.  A group of 10 construction workers will become owners with this donation in a year or so. I met them, listened carefully the proposal, and requested help. Prof Anandswarup, as usual came forward. Thanks Professor.

 

We also planning to buy a computer for the library in Veluru, again with the donation of Rs.20,000 by Prof Anandswarup.

 

We are pleased to announce that Dr Siddoji Rao, Director, AP Study Circle (IAS coaching center run by AP Government) is willing to associate with FFEI. He is a young and dynamic. He studied in JNU, USA, Australia and gold medalist all through his academic career. He was a dean in an Australian university before coming to India to do social work.  I saw his dedication and sincerity from close quarters. We may officially induct him at a later date. Thanks, Dr Siddoji for coming on board.

 

I have been in dialogue with individuals and organizations I visited during my trip on how we can work together to help the most needy children.

 

So, friends, please come forward with you generous donations for 2010. We have 501(c)(3) in USA and your donation is tax deductible. We are hoping to get Income Tax exemption in India as well, most probably by the end of this year.

Abusing a Dalit by his caste in private interaction is not an offence, a Delhi court has said. The court's observation came while acquitting a principal of a government school of charges of passing some derogatory remarks against his junior, belonging to a Scheduled Caste.

To drive home the guilt of the accused, such incidents should happen in full public view, it said.

"The presence of principal (accused) and the teacher (complainant) alone during the dispute resulting in any abuse, insult or humiliation by virtue of caste does not constitute 'within public view' within the meaning of Section 3 (i) of the Scheduled Caste and Scheduled Tribes Act," Additional Sessions Judge Dharmesh Sharma said.

Deepak Singh, working as a teacher at Government Boys Senior Secondary School at Roop Nagar in New Delhi, had accused that Pal Dhama insulted and humiliated him by calling him with the name of his caste.

Later, the accused also abused him for lodging an FIR against him at Roop Nagar police station on May 14, 2007.

The court trashed the allegations that the accused also called him nikamma which also constituted an offence under the Act. "Mere fact that the accused once remarked that complainant was a nikamma is no offence which only mean that the complainant was not taking his teaching assignment seriously and the accused being principal had a duty to remind the complainant to improve his commitment to work," it said.

The complainant further alleged that the principal allotted him class VI for teaching mathematics despite the fact that he was a teacher of natural science.

"Much grievance is sought to be made by him... but this cannot be accepted in view of the guidelines of the Directorate of Education proved on record that empower the principal of a school to depute a graduate teacher for imparting class in mathematics and science to students up to class VIII," the court said.

NEWDELHI: Taking serious note over the reports of alleged diversion of
funds meant for the welfare of the Dalits to Commonwealth Games by the
Delhi Government, National Commission for Scheduled Castes Chairman P
L Punia on Friday demanded refund of funds in case it happened.


Punia, who has taken over as Chairman of the Commission, said that money

meant for the Dalits welfare should not be spent for any other
purposes. "The commission has taken this matter seriously. I don't
have full information, but, in my opinion the money that is meant for
the Dalit welfare schemes should not be spent for any other purpose.
If it has been diverted, I demand that it should be returned."

"As a Chairman of the Commission, I would not allow any government,
whether of the Congress ruled states or the Opposition ruled states,
to divert the funds meant for the Dalits to other purposes," he added.

Taking a dig at Uttar Pradesh Chief Minister Mayawati, Punia pointed
out that the state government had set up a medical college from the
funds meant for the Dalits welfare. Indicating a pro-active role of
the commission, Punia said that the commission would monitor and
evaluate the spending of the funds earmarked for the development and
welfare of the Dalits and make sure that the money.

The Delhi government may have invited sharp criticism over the
diversion of R744 crore funds meant for Scheduled Castes' — or
Dalits' — welfare to the Commonwealth Games over five years, but many
states have routinely been guilty of flouting norms when it comes to
earmarking funds for Dalits.
Planning Commission guidelines mandate that each state allocate funds
for the development of Scheduled Castes in proportion to their
populations in their annual plan, and place the allocations under a
separate budget head. This is technically called the Scheduled Caste
Sub Plan (SCSP).

However, the Parliamentary Standing Committee on Social Justice and
Empowerment expressed concern in 2008-end that Kerala, Bihar and
Rajasthan had not earmarked any funds specifically for Scheduled
Castes' development. The scale of funds Dalits may have missed out on
can be gauged from the fact that the Dalit population of the three
states is 9.8 per cent, 15.7 per cent and 17.2 per cent, respectively.

This violation of Planning Commission guidelines was happening at a
time when Delhi was indulging in the said diversion, which has made
the new Scheduled Caste Commission chairman P.L. Punia condemn the
diversion "if" it has actually taken place.

The same parliamentary panel said that Andhra Pradesh with an SC
population of 16 per cent had allocated just 7 per cent of funds for
SC development, Himachal Pradesh with an SC population of 24 per cent
just 11 per cent and Punjab with an SC population of about 29 per cent
just 26 per cent.

"We regularly take up such matters with states and ask them to ensure
compliance," said a Social Justice Ministry official.

In 2006-07, the amount actually allocated for SCSP for 14 states and
Union territories across India was R3,223 crore less than what it
should been as per their SC populations, meaning it was R21,461 crore
instead of the required R 24,684 crore.

For the previous two years, the corresponding deficit in allocation
was R5,688 crore and R5,591-crore, respectively.

The government has told the Rajya Sabha that the percentage of funds
allocated for SCs by all states and Union territories was just 11.2
per cent in 2005-06 and 12.9 per cent in 2006-07. It came up to a more
respectable 15.8 per cent in 2007-08. Ideally, it should be equal to
the SC population of the nation, which is 16.2 per cent.

Bikaner: In a shocking incident in Rajasthan, three Dalits were fined
Rs 45 thousand by a Panchayat for daring to drink water from a public
tap. A case has now been registered against the accused.


These Dalits have been discriminated against not just by the upper
castes, but also by Muslims. The three of them from Randhisar village
near Bikaner were fined Rs 15,000 each by their Muslim sarpanch Gope
Khan. Their crime was drinking water from a public tap.


One among the three victims, Birbal Meghwal said, "We have been fined
Rs. 45000 for drinking water from a public tap."

When the Dalits protested against the decision, they were allegedly
roughed up by Gope Khan's henchmen. Police were then deployed in the
village to defuse any tension and an FIR filed against the attackers.


SP, Bikaner said, "The injured man has registered a case."


But shockingly the sarpanch who perpetrated this discriminatory act
continues to be off the hook.

After its near-total estrangement from the minority communities, the
CPI(M)-led ruling LDF is now facing the ire of the Dalits and Adivasis
of Kerala in the civic polls. Most Dalit and Adivasi outfits in the
State have either fielded candidates opposing those of the Left or
have announced their decision to vote against LDF candidates.

The Dalits of Kerala, who have traditionally been supporters of the
Left, turned against it following the treacherous attitude the
CPI(M)-led LDF Government under Chief Minister VS Achuthanandan showed
towards their demand for land to live and cultivate since it took
charge in May, 2006.

The Adivasi Gothra Mahasabha, Adivasi Forum, Kerala Pulayar Maha
Sabha, Kerala Dalit Federation, Dalit Panthers, Dalit Human Rights
Movement and Sadhujana Vimochana Samyuktha Vedi are some of the
organizations that have adopted anti-Left position in the civic
election for which polling is to be held on October 23 and 25.

The Gothra Mahasabha, which spearheaded the Muthanga agitation in
Wayanad which ended with a brutal police action in February, 2003, had
stood with the Left in the 2006 Assembly elections. But they later
turned against the CPI(M) after the Government refused to solve their
land issues and to withdraw the cases against several of them.

The Gothra Mahasabha has considerable influence on the Adivasis of
Wayanad, Kannur and Ernakulam districts and, according to observers,
the forum is capable of ensuring the defeat of LDF candidates in
several grama and block panchayats in these areas.

The Sadhujana Vimochana Samyuktha Vedi, the Dalit outfit which
spearheaded the 26-month epic struggle of sufferance for land on the
hills of Chengara in Pathanamthitta district, has already moved to the
UDF camp. The Achuthanandan Government had from the very beginning
adopted a negative approach towards the Vedi's struggle.

After the 26 months of struggle, during which the CPI(M) tried to
break the Dalits' will through muscle power, the Government agreed to
allot land to more than 1.700 families in October, 2009. However, when
they reached these lands, they found them to be either uncultivable or
already owned by others.

The Dalit Human Rights Movement (DHRM), which was termed as an
extremist organization after the murder of a 63-year-old morning
jogger in Varkala last year, has fielded about 4,000 candidates in the
civic polls in eight districts where Dalits have considerable
presence.

Though the truth of the role of DHRM in the murder is yet to be proved
legally, there are complaints that the police, under orders from the
LDF regime, have been hunting innocent Dalits living in the inhuman
conditions of slums. This has led to the creation of a strong
anti-Left sentiment among the Dalits of the southern districts.

Sajitha Prakkanam, former secretary of the Samyuktha Vedi and
second-in-command of the agitation at Chengara, is a DHRM candidate in
the civic polls. Dalit activists campaigning for Sajitha and her
associates say that their goal is not electoral victory but claim that
they can spoil the chances of the Left candidates.

"There are more than five million Dalit and Adivasi voters in Kerala
and that way we are a big power," says Gopalan, a Dalit rights
activist in Iritti, Kannur. "Majority of them will vote against the
Left in this election as well as the Assembly polls in next
April-May," he said.

A former CPI(M) State committee member from Kochi admitted that the
LDF Government had been rude to the Dalits and Adivasis. "The top
leadership had adopted some ill-advised ideas with regard to their
problems. The result is that we are now left with almost no support
among these two sections," he said.

BSP condemns discrimination done to dalits in Rajasthan

Lucknow, Oct 16 : The Mayawati-led Bahujan Samaj Party in Uttar
Pradesh today termed as 'saddening' and 'discriminating' the
imposition of Rs 45,000 as penalty on three dalits for drinking water
from a public tap in Bikaner district of Rajasthan.

UP BSP president and state cabinet secretary Swami Prasad Maurya today
raised question on the functioning of the National Scheduled Caste
Commission and said the Congress-ruled states was least bothered about
it.

''It is 'sorrowful' to know that the panchayat of village Randhesar in
Bikaner district of Rajasthan imposed the fine of Rs 45,000 on three
dalits only for drinking water from a tap,'' he asserted.

First, the locals used objectionable language for them and imposed a
fine on them. Later, the mob beat them with sticks.

''This sort of discriminate behaviour after over 60 years of
independence is hurting,'' Mr Maurya alleged.

He charged National SC Commission's new chairman P L Punia with
ignoring the wrong done to the dalits.

Narayanpatna(Orissa): Narayanpatna, a tribal dominated area in
Orissa's Koratpur district, is once again on the boil.
It was just in 2009, that Chasi Mulia Adivasi Sangh, an organisation
believed to be a frontal body of Maoists, was involved in a land-grab
movement that shocked the rest of the state.

In July 2009, the organisation had forcibly taken over 2000 acres of
land, owned by non-tribals, forcing 400 Dalit families to flee.

Now, after a year's lull, Nachika Linga, the leader of the Sangh and
its members have resurfaced in the tribal landscape of Narayanpatna.

''Our agitation is to liberate our lost land and ensure our people do
not starve,'' said Nachika Linga.

The Sangh justifies the land grab claiming tribals are the actual
owners of the tracts others had been cultivating for decades. Though
the police killed two Sangh activists last year and arrested all top
leaders except Nachika declaring the agitation crushed, the fear of
the Sangh still prevails and has kept the ousted land owners in exile.

And now Linga has regrouped, and if sources are to be believed, not
just backed by Maoist ideology but Maoists who want to hijack the land
agitation.

''The police chase us all the time. And when we go into hiding, they
label us as Maoists. It's the police who are creating Maoists,''
Nachika Linga.

Orissa has for long been the battleground of the tribal versus
non-tribal agenda. And the advantage has always gone to the Maoists.
However, this fact has seldom been given prudence.

Many believe the police brutality has made the Sangh more pro-Naxal
and Nachika Linga's return in an era of recharged Maoist offensive is
a growing concern, not only in Orissa but also for the neighbouring
Andhra Pradesh.

'Caste fence' pulled down in Tamil Nadu

COIMBATORE: An ' untouchability fence' that prevented Dalits from
using roads in a hamlet near Krishnagiri in western Tamil Nadu was
pulled down after it was brought to the notice of the police and
revenue authorities.

The barbed wire fence put up by non-Dalits around an elementary school
at Ittikkal Agaram in Krishnagiri district prevented eight Dalit
families of the locality from using an approach road leading out of
the village for over one week. The incident comes barely a month after
some non-Dalits erected barbed wire fences to prevent Dalits from
using two roads at Dharapuram near the hosiery town of Tirupur.

These are some of the glaring instances of untouchability being
practised in remote villages of Tamil Nadu. The fence at Ittikkal
Agaram was brought to the notice of district administration and police
officials after local CPM cadres warned of "direct action" to remove
"the symbol of shame" with the support of eight Dalit families in the
area.

Acting swiftly on the issue, district collector V Arun Roy and police
superintendent A G Babu reached the village accompanied by a massive
police force and ordered immediate removal of the fence. They also
warned the non-Dalits of severe action if they engaged in similar acts
of hatred. On their part, non-Dalits, dominant in the area, gave an
assurance to the collector that they wouldn't resort to such acts
again.

Non-Dalits, led by their village head, A Nagaraj, justified their
action telling the collector that they were protecting the land of the
local panchayat union primary school by putting up the fence and that
too on the request of the school headmistress.

Dalit requests Gujarat HC for non-Brahmin judge

AHMEDABAD: A Dalit man has requested the Gujarat High Court that his
petition be heard by another court as the present judge's surname
suggested that he was a Brahmin and hence would not be able to do
justice to his case.

Petitioner Atul Ramjibhai Makwana, had approached the High Court
against the Junagadh district judge who, according to him, was
favouring only Brahmins for posts of class III and class IV staff in
his office.

Justice R R Tripathi stunned at the submission made by Makwana's
lawyer A M Chauhan, dismissed the petition and observed, "this court
has come across such argument for the first time from a learned
advocate after it assumed office as Judge of this court." Chauhan had
submitted, "the surname suggests that Your Lordship also belongs to
the same community (Brahmin) and, therefore, I want that this Court
may not take and hear this matter."

Expressing its displeasure over the submission made by Makwana's
lawyer the court was of the opinion that "this is fit case for issuing
'notice for contempt' against the learned advocate and if he is making
this submission on instruction of his client then against him also."

"But the Court restrains itself from doing so. The learned advocate
seems to have made the aforesaid submission only with a view to either
bring pressure on the Court and obtain a favourable order or to get
his matter out of this Court," the order further said.

"The Court deems it proper to dismiss this matter so as to discourage
such a practice," it said.

Chauhan wanted to make further arguments but was not allowed to do so
by the court.

Makwana's lawyer, during his earlier arguments had told the court that
nearly 60 per cent of candidates selected by the Junagadh district
judge were Brahmins.

The petitioner also accused the judicial officer of 'promoting'
Brahmins and in doing so, he conducted interviews twice and deprived
him of the opportunity.

Chauhan said he had just expressed apprehension before the judge that
he would not get justice from him.

He further said the was planning to challenge Justice Tripathi's order
before a division bench because according to him the petition was
dismissed without being heard on merits.

GURGAON: The city-based lawyers started a two-day strike on Saturday
after one of the sitting first class judicial magistrates lodged a
case against three advocates, including the bar president and
secretary. The cases have been lodged under the SC/ST Act and Section
506 of the IPC (threat to kill).

Lawyers went on strike about 12 pm after learning that the magistrate
had lodged the FIR at City Police station on Friday night. According
to police, magistrate Anklur Lal alleged in his complaint that the
three accused had made casteist remarks and threatened to kill him.

Till late evening, the protesting lawyers did not allow the courts to
function. They said that the protest would continue till the case was
withdrawn and the judge was shifted from the city.

The case is now being investigated and ACP (City) Sumer Singh Yadav
has been deputed for this case. On the basis of the findings we will
take necessary steps, said Maheshwar Dayal, DCP (West).

According to a senior police officer, on Friday when there was hearing
of a case in Lals court, one of the advocates in this case Vikas Yadav
was asked to leave the court room. We did not know what exactly
prompted the judge to ask the lawyer to get out of the room. But it
happened during the course of argument, the officer said.

Sources said that an upset Yadav rushed to the bar association
president Meer Singh Yadav. Then Yadav and association secretary Ajay
Chaudhry went to the court room. Police said that when Lal did not
listen to them, they made casteist remarks against the judge.

Only by Saturday afternoon, the accused came to know of the case bring
registered against them based on the statement of the magistrate.

However, Chaudhry refuted all charges. The case is baseless and we
want it to be withdrawn immediately. We also want him to be shifted
out from here, advocate Kulbhushan Bhardwaj said.
