The state, within three weeks, will have to file an affidavit
informing the high court whether it had forwarded reports to the
Centre on implementation of Scheduled Caste and Scheduled Tribes
(Prevention of Atrocities) Act in the state. A division bench of
Justice Ranjana Desai and Justice V.K. Tahilramani was hearing a
public interest litigation filed by NGO National Dalit Movement for
Justice, which alleged that the Act was not being implemented in the
state.

Public prosecutor Pandurang Pol informed the court on Thursday that a
high-powered committee had been formed recently under the chairmanship
of Chief Minister Ashok Chavan to oversee the implementation of the
Act.

Pol also informed the court that the file concerning appointment of a
nodal officer to oversee implementation of the Act had been referred
to the chief minister who said within a fortnight a decision would be
taken in this regard.

Counsel for the petitioner, Sanghraj Rupawate, alleged that the state
government had not constituted a high-powered committee under the
chairmanship of the chief minister.

He also said no nodal officer had been appointed in accordance with
the rules framed under the Act in 1995.

Mumbai: The Bombay High Court today asked the Maharashtra Government
to file an affidavit within three weeks informing whether it had
forwarded reports to the Centre in the last five years on
implementation of Scheduled Caste and Scheduled Tribes (Prevention of
Atrocities) Act in the state.

The direction was given by Justices Ranjana Desai and Vijaya
Kapse-Tahilramani on a PIL filed by NGO National Dalit Movement for
Justice, which alleged that the Act was not being implemented in
Maharashtra.

Public Prosecutor Pandurang Pol informed the bench that a high-powered
committee had been formed recently under the Chairmanship of Chief
Minister Ashok Chavan to oversee the implementation of the Act.

Pol further told the court that the file concerning appointment of a
Nodal officer to oversee implementation of the Act had been referred
to the Chief Minister and said within a fortnight a decision would be
taken in this regard.

Counsel for the petitioner, Sanghraj Rupawate, alleged since many
years the Government had not constituted a high- powered committee
under the chairmanship of the Chief Minister to oversee the
implementation of the Act. Besides, he said, nodal officer had not
been appointed in accordance with the rules framed under the Act in
1995.

He said all the states had to submit reports every year on
implementation of the Act to the Centre which tables the reports
before the Parliament. However, the Maharashtra government had not
followed this practice.

Rupawate said the PIL was based on 43 cases of atrocities committed on
Scheduled Caste and Scheduled Tribe members from various districts of
Maharashtra.

The PIL brought to the notice of the High Court various gaps and
negligence by the implementing authorities at different levels in
effective implementation of Act.

According to the PIL, vigilance and monitoring committees set up under
Rule 16 and 17 of the rules framed under the Act were not properly
constituted and were not functioning at all in the state. The
government was also not sending report to the Centre on March 31 every
year as stipulated under the rules.

The PIL alleged that the state was not performing its specific
responsibility in accordance with Rule 14 of the Act to review twice
in a year the performance of prosecutors, consider reports received
and investigations made in atrocity cases apart from ascertaining
preventive steps taken by police and district magistrates and
rehabilitation measures taken to help the victims.

The PIL further alleged that in many cases FIRs were not registered at
all and, if registered, proper sections of the Act were not applied.
Besides, the accused were also not arrested immediately.

The PIL contended that in special courts set up under the Act special
public prosecutors were not appointed to conduct the trial.

Ghaziabad : The Ghaziabad administration has pulled up educational
institutions that are reportedly charging fees from economically
underprivileged students belonging to backward classes or SC/ST
categories, warning that a formal police complaint will be lodged
against all such institutes.
District magistrate Hridyesh Kumar instructed social welfare
department officials to issue warnings to educational institutes that
charge fees from students whose parents' income are less than or equal
to Rs 1 lakh per annum. The administration has received complaints
from students regarding being charged fees that are equivalent to that
levied on the general category students by their institutes, the DM
said.

"FIR will be lodged under SC/ST Act against the owners and the
administration of any college, professional institution or school if
it is found that they have charged fees from economically backward or
SC/ST category students who cannot afford the fees. The government
gives money to these educational institutes on behalf such students
who have been given admission for free or at a lesser fee. These
institutions have no right to charge money," the DM maintained.

DM Kumar has also asked senior officials to keep a tab on the
development work in the district. Officials found stretching the
deadline set for completion of the work would be penalised, he said.
"The decision has been communicated to senior administration officials
on not awarding appraisals to those who have not achieved their
targets of the development work," said the Kumar.

To ensure the strict implementation of the decision, the DM asked the
administration to demote three officials with immediate effect for not
meeting the targets in the development work assigned to them.

"We have stopped the salary hike and demoted one official from
horticulture, one from irrigation and one executive engineer. They
have not met their deadlines nor does it appear that it can be
finished soon," the DM added.

CHENNAI: CPM leade\rs G Ramakrishnan and T K Rangarajan termed the
ruling DMK anti-Dalit and alleged that the DMK was unleashing violence
against its workers for criticising the government policies.


On Thursday, Rajya Sabha MP Rangarajan said that the TN government was
yet to take any action to settle Dalits issues in Uthapuram near
Madurai.

CPM state secretary Ramakrishnan said the suspension of Dalit IAS
officer C Umashankar by the government for allegedly producing fake
community certificate was a violation of natural justice. He pointed
out that the State government had no jurisdiction as the IAS officer
was appointed by UPSC, who must have thoroughly verified the
documents.

"Normally we do not take up issues like the suspension of an IAS
officer, but Umashankar's records show that he is an honest officer.
He had found out the corruption in the ELCOT but the government was
yet to take any action," he said.

Both the leaders pointed out that the government is reluctant to
distribute acres of land to the Dalits and others despite its (land)
availability.

Ramakrishnan said the DMK was intolerant to criticism and alleged that
his party workers and leaders were attacked or threatened mainly in
Madurai if the anti-people policies of the government were critised.
The CPM had submitted a petition to the Director General of Police on
the issue.

When asked about AIADMK getting closer to Congress, he refused to
comment and said, "the party would discus alliance after the election
is announced." On DMK's protest against AIADMK general secretary J
Jayalalithaa seeking frequent adjournments in the wealth case,
Rangarajan said while the nation was protesting price-rise issues, the
DMK was focusing its resources on such an issue.

Republican Party of India (Democratic) has asked Maharashtra Animal
Husbandry Minister Nitin Raut to disclose names of his colleagues who
are against discussing the Khairlanji Dalit killings in state Cabinet
meetings. After Dalit ministers had insisted, Chief Minister Ashok
Chavan had discussed the issue after the Cabinet meeting on Wednesday.
Some prominent non-Dalit ministers did not attend the meeting called
by the CM, who has assured that the Centre will be requested to
reinvestigate the murder case.

Hindustan Times had reported this on August 5. "Raut should reveal the
names of his ministerial colleagues who do not want the Khairlanji
issue to be discussed," party president T.M. Kamble said.

"If the state cabinet can discus the James Laine's bookon Shivaji
issue, then why not the Khairlanji issue," Kamble added.

Dalit ministers alleged that the Khairlanji accused were not tried
under the Scheduled Castes and the Scheduled Tribes (Prevention of
Atrocities) Act.

THE WEAPON OF THE OTHER – Dalitbahujan writings and the Remaking of
Indian Nationalist Thought: Kancha Ilaiah; Pearson Education, 7th

The meek and the weak deserve to be written about because they
constitute the 'other' side of our society. The maturity of our
democratic consciousness can be measured by how we treat, not our
descendants and dependents, but members of the classes/castes other
than our own.

The term 'Dalitbahujan' refers to and encompasses the Scheduled Castes
and the Other Backward Classes, the "people and castes who form the
exploited and suppressed majority." This is what Kancha Ilaiah told us
in his classic Why I Am Not a Hindu (1996). Now, 14 years later,
Ilaiah says there were three kinds of nationalist thought during the
anti-colonial struggle. There was the Hindu nationalism of Tilak and
Gandhiji, the Brahmanical communist nationalism of P.C. Joshi and S.A.
Dange, and Dalitbahujan nationalism of Jotirao Phule, Ambedkar and
Periyar E.V. Ramasami.

Contributions

Dalitbahujan writings made five contributions to Indian nationalist
thought, says Ilaiah. The first is the Buddha-Ambedkar school that
advocates non-violence and restricted use of weapons, for self-defence
only. In contrast, the Hindu gods carry weapons —Krishna has his
'chakra' (wheel), Parsuram his axe, and Rama his bow and arrow.

The second contribution is the concept of equality based on communal
property. The life of Dalitbahujans mostly depends on the labour power
of their hands and the larger prakriti (or nature). The leisure-loving
higher castes, who constitute the upper class, base their life on
private property and on the labour of the other sections of society.

The third contribution is universal humanism or 'Dalitism.' The
"egalitarian democratic-socialist baby" is growing in the womb of
Dalitbahujan wadas or neighbourhoods.

The fourth relates to the democratic gender relations. Ilaiah believes
that man-woman relations in the Dalitbahujan wadas are less
patriarchal. In these wadas, atrocities are inflicted by husbands
under the influence of brahmanical feudalism and capitalism.

Socio-economic values

And the fifth contribution concerns positive socio-economic values.
The class of people who produce goods and are wrongly considered
'polluted' deserve to be respected, while those who produce nothing
and remain mere 'consumers' but claim themselves to be 'pure' must be
'devalued.' "Making shoes should receive greater respect and better
payment than teaching in the university."

It is noteworthy that Ilaiah is himself a university don. Hence he
merits our respect for the courage of his conviction to talk against
his own interest.

Kancha Ilaiah, who has risen from a humble background, has six books
to his credit, and his articles have appeared in all leading Indian
journals. He has participated in the U.N. Conference on 'Racism,
Racial Discrimination and Xenophobia' held at Durban in 2001 and has
also been a postdoctoral Fellow with the Dalit Freedom Network,
Denver, in 2004-05.

This book, which is rhetorical in character, is the outcome of another
Fellowship, the one from Nehru Memorial Museum and Library (1994-97).
Ideally, such a prestigious Fellowship should have been used to offer
some fresh theoretical insights.

But Ilaiah has chosen to uncritically endorse Jotirao Phule's theory
that the Aryans were invaders. Phule (1827-90) could take that
position because such was the historical thinking during his time. In
fact, he was only echoing what Max Mueller (1823-1900) had said. If
Ambedkar (1891-1956) endorsed that line it was because his work
related to public administration, not history. As for Periyar
(1879-1973), the Aryan invasion theory eminently fitted into his
campaign for the Dravidian cause.

One expected Ilaiah, as an academic of stature with a record of
pioneering work, to have examined the issue in the light of the latest
thinking in the academia. For instance, we have Romila Thapar telling
us that Aryans were not a race but were people speaking Indo-Aryan
group of languages. And languages get disseminated through
story-tellers, pen-pushers, litterateurs, and so on.

Faizabad The VHP claimed that Bangladeshi Muslims have been allotted
houses in Ayodhya and threatened to launch an agitation to evict them,
a charge refuted by the district administration.
About 300 Muslim families were allotted houses in Kanshi Ram housing
scheme, one of the dream projects of the Mayawati government launched
for urban poor two years ago.

Under the scheme, the Faizabad district administration has developed a
colony adjacent to Karsewakpuram, the local headquarters of VHP in
Ayodhya, where about 300 houses have been allotted to Muslim families
living below the poverty line.

Alleging that most of those families were Bangladeshi Muslims, a
delegation of senior VHP leaders led by Ram Vilas Vedanti met Faizabad
District Magistrate MP Agrawal and demanded immediate eviction of the
families.

They threatened to launch an agitation had these families were not
evicted within a week.

Agrawal, however, said the allottees have been scrutinised many times
rubbished the charge.
