Lucknow Uttar Pradesh Chief Minister Mayawati today said the total
fund spent in constructions made in the name of Dalit icons were less
than one per cent of the state's budget.
She said while reacting to HRD Minister Kapil Sibal's statement that
UP government was more concerned about making parks and memorials than
spending for implementing Right to Education Act.

"Why Sibal forgot memorials, parks and museums named after
Nehru-Gandhi family members on which several crores of rupees is spent
for their maintenance every year", she said in a statement.

The total of UP budget was Rs 1.23 lakh crore last year and this
financial year it was Rs 1.53 lakh crore.

Chennai, Jul 26 (PTI) Alleging "harassment" by Tamil Nadu Government,
suspended IAS officer C Umashankar has approached the National
Commission for SC/ST seeking protection. The 1990 batch officer, in a
letter, has requested the commission to ensure that any inquiry
regarding his caste certificate was conducted by the Central Vigilance
Commission or CBI or any other Central agency. The state government
had on July 21 suspended Umashankar, who was Director of Small
Savings, on the charge of submitting a fake community certificate to
claim SC quota during his selection for civil services. Umashankar
said the community certificate submitted by him to the UPSC was duly
verified. "The government has not taken any action against corrupt
bureaucrats and is targeting me because I have been honest and
sincere," he claimed. Umashankar requested the Commission to take
action to allow him to work under the Central Government or any of its
agencies. He also sought proper security for him and his family
members by Central security forces. As the Chairman of the Arasu Cable
TV Corporation, set up by the state government in 2008 to run cable TV
business, Umashankar had recommended nationlisation of Maran brothers-
owned Sumangali Cable Vision, alleging that the company was sabotaging
ACTV. He is facing charges of accumulation of disproportionate wealth.
But on a petition by him, the Madras High Court has last month stayed
the probe by Directorate of Vigilance and Anti-Corruption.

Mumbai: A special court on Monday granted bail to ten persons
arrested under the Prevention of Atrocities Act for stripping and
parading naked a 22-year-old Dalit girl at Sewree in south Mumbai.

Additional sessions Judge C K Bhedi, hearing matters relating to
Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act,
today granted the ten arrested accused bail on a bond of Rs 3,000 each
after the police said they would soon be filing a chargesheet in the
case.

According to the police, on June 17 a group of 25 to 30 women forcibly
entered the victim's house in the bylanes of Mira Dargah street of
Sewree and dragged her out on to the streets after tearing her gown.

The incident took place after the girl's brother Vijay Kamble was
picked up in a rape case of a minor in the area.

The mob, according to the girl, attacked her under the pretext of
teaching a lesson to their family.

However, the girl, in her complaint to the police, has said her family
has been facing the wrath of the women who are from upper class.

"They have been abusing us by making casteist remarks. They would not
allow us to draw water from the community water pump installed in the
area. Even on the day they attacked me, the women kept screaming that
we 'Harijans' and should not stay here."

Apart from the Prevention of Atrocities Act, the ten accused, nine of
whom are women, have also been booked for unlawful assembly, rioting,
outraging the modesty of a woman.

The Bihar Assembly elections may be more than six months away, but the
major political parties in the State have begun gunning for the
crucial 'Maha Dalit' vote-bank.

The Lok Jan Shakti Party (LJP) held a "Dalit unity" rally here in
December last. At a "Maha Dalit Unity" rally, organised by the
National Democratic Alliance (NDA) here on Sunday, Janata Dal (United)
leader and Chief Minister Nitish Kumar urged the Maha Dalit community
to remain united and vigilant against divisive forces.

"Please do not think that our government is doing you a great favour
by launching so many development schemes for your benefit. It is your
right after having suffered centuries of oppression," he said.

Attacks Paswan

In a veiled reference to LJP supremo Ram Vilas Paswan, Mr. Kumar said:
"There is this leader who is bent on defaming me and who asks for my
resignation practically every day. I would appeal to these people to
stop indulging in baseless slander and instead engage in some
constructive work for the uplift of the Backward Classes."

As of now 21 Backward Castes, with the exception of the Paswan
community, have been included in the Maha Dalit caste list.

Mr. Kumar reiterated the government's desire to include the Paswan
community in the list to enable it to avail itself the benefits given
to Maha Dalits.

"We have no intention of leaving anybody out. In fact, it is my
fervent wish that a study of the Paswan community be carried out so as
to pinpoint the avenues for their development," he said.

Referring to the recent constitution of the Maha Dalit Development
Committee, Mr. Kumar said the State government had appointed 'Vikas
Mitras' to oversee the development of the community.

Deputy Chief Minister Sushil Kumar Modi also spoke.

Ahmedabad : A Dalit boy from Mansa town in Gandhinagar district,
Narendra Kumar Amin cleared his MBBS at B J Medical College as a
gold-medallist, on the top of his batch. However, the 40-year-old has
come a long way since. Suspended and behind bars since February 22,
2008, the deputy superintendent of police who has sought to turn
approver in the Sohrabuddin Sheikh case has had at best a chequered
career in the police force.
Amin is accused of involvement in disposal of the body of
Sohrabuddin's wife Kausar Bi.

However, it's not the first controversy that the doctor-turned-cop
finds himself in. Amin is believed to have fired a few rounds from his
service revolver in the 2004 encounter that killed alleged
Lashkar-e-Toiba operatives Ishrat Jahan and Javed Pillai. A
magisterial probe found that the encounter was fake, and the families
of the victims have been demanding that the incident be probed by the
CBI.

As part of the police team probing the murder of former minister of
state for Home Haren Pandya, Amin had gone to Hyderabad to arrest
Maulana Nasiruddin in October 2004. When Maulana's family members and
supporters protested, Amin had opened fire, killing a youth on the
spot.

Earlier, in April 2000, Amin had been booked for the custodial death
of Colonel (retd) Pratap Save of Umbergaon, who had been leading an
agitation against a private port being built by a multinational. A
magisterial court in Valsad had issued an arrest warrant against Amin
in the case.

Since his arrest in the Sohrabuddin case, Amin has claimed a threat to
him from fellow police officers and co-accused. On May 18, 2010, he
told the CBI court that there was a police-politician-criminal nexus
in the case.

During arguments before the court, he has demanded the arrest of
fellow police officer Geetha Johri, noting that she had been indicted
by the Supreme Court for not carrying out the probe properly. In fact,
it was during investigations by Johri that Amin was made an accused on
the basis of a statement by Anti Terrorist Squad (ATS) driver Nathuba
Jadeja. Jadeja had told Johri during questioning that Amin was present
on the spot where Kausar Bi's body was burnt and disposed of.

Earlier, in July 2009, Amin had written to the Ahmedabad Police
Commissioner urging him to register a criminal complaint against Raj
Kumar Pandian, a suspended IPS official imprisoned in Sabarmati jail
in the Sohrabuddin case. Amin had alleged that Pandian had made a bid
on his life. The charge could not be proved. He had also accused then
IG (Prisons) Keshav Kumar of torturing him in jail.

In December 2008, Amin had submitted an affidavit to Principal
Additional Sessions Judge P B Desai, alleging that a plot was being
hatched to kill him in jail because he was privy to vital information
in the case, and claimed to possess CDs containing "explosive
information".

Lucknow Chief Minister Mayawati has criticised Union Human Resources
Development Minister Kapil Sibal for his remarks on statues, parks and
memorials for Dalit icons being constructed by the BSP government.
Sibal, who was in the state capital on Sunday to attend a symposium,
had said that the chief minister should decide whether she wants to
spend money on parks and memorials, or on children's education by
implementing the Right to Education Act (RTE).

"The comments of Kapil Sibal were in bad taste, indecent and uncalled
for," said Mayawati in a statement on Monday.

"His statement betrays the anti-Dalit mindset of the Congress party.
It shows that the Congress is not interested in universalisation of
education through the RTE, but wants to make political capital out of
the legislation," she said.

She said that the Uttar Pradesh government had sought financial
assistance from the Centre for implementation of the RTE Act.

But it was unfortunate that instead of taking the measures needed for
implementation of the Act, the Union minister had stooped to the level
of making "indecent comments".

Before making a statement on memorials in the state, Sibal should have
thought of the hundreds of crores spent annually on the maintenance of
the hundreds of Nehru-Gandhi family memorials in the country, said
Mayawati.

"The people of the state are aware of the fact that less then one per
cent of the total budget has been spent on the memorials in the last
three years," she said further.

The chief minister said that Uttar Pradesh was not alone in demanding
money for the implementation of the RTE Act.

West Bengal, Madhya Pradesh, Karnataka and Punjab had also expressed
their inability to bear the expenses for implementation of the RTE.

Even Congress-ruled Andhra Pradesh had demanded additional grants for
this purpose, she said.

Mayawati said the state government had spent Rs 12,412 crore on basic
education in fiscal year 2009-10 and had made a provision of Rs 15,175
crore in 2010-11, which was 10 per cent of the state's budget.

The state government, as part of its efforts to implement the RTE, had
requested the Prime Minister to provide an additional grant of Rs
22,868 crore for the first three years,she said.

MANGALORE JUL 27: Another instance of alleged police atrocity against
a couple from the Koraga Scheduled Tribe community surfaced at the
monthly grievance meeting for the Scheduled Castes and the Scheduled
Tribes held at the Police Superintendent's office here.

Saraswati, a Dalit leader from Sullia taluk, complained to
Superintendent of Police A.S. Rao at the meeting on Sunday that on
July 12 four caste Hindus berated and grievously injured Chukru (50)
and her husband, Doja, Koraga (55), before tearing down their tent in
the Kochumuley forest in Sullia. But what enraged Dalit members
present at the meeting was the alleged police response to the episode.

"Sub-Inspector Umesh Uppalige, who is from the same caste as the
attackers, tried to bribe the injured couple with Rs. 5,000 to drop
the charges," Ms. Saraswati alleged. Ms. Chukru, who was also present
at the meeting, told Mr. Rao that she was still unable to use her arm
that was injured in the attack. She said that since the attack, she
was not able to weave baskets, which was her only occupation. She said
that since they had to collect yew from the forest to weave baskets,
they had built a small tent for themselves in the forest.

On July 12, Giriappa Gowda (32) and his brothers Lava Gowda (28) and
Madhava Gowda (40), and their mother, Krishnaveni (62), asked the
couple to vacate the tent, claiming that the land belonged to them.
However, the records showed that it was government land, said Ms.
Saraswati.

"It was raining heavily and we were cooking a meal. Hence, we asked
for a day's time to vacate. But they did not listen, and destroyed the
pot in which we were cooking," Ms. Chukru said. When they protested,
the four persons assaulted them with staves and chased them away, she
added.

Several Dalit leaders at the meeting alleged that the police were
reluctant to file cases under the SC/ST (Prevention of Atrocities)
Act.

Some leaders complained that the police tend to treat land disputes
involving SC/STs as a civil matter and ask them to go to court. They
said that most often the victims could not afford to move the court as
they were poor and uneducated.

Mr. Rao told his officers that encroachment of land belonging to
SC/STs by caste Hindus was a serious crime under the atrocities Act.

Several leaders asked whose responsibility was it to restore the land
to SC/STs. They complained that both the Police and the Revenue
departments pointed fingers at each other whenever they were
approached to restore the possession of land to SC/STs. Mr. Rao
assured that the police would henceforth extend all the support in
such cases.

Muzaffarnagar, July 27 (PTI) A fast track court has convicted two
persons and sentenced them to life imprisonment for kidnapping and
gangraping a minor Dalit girl here. Judge Agad Prasahad also imposed a
fine of Rs 23,000 on each of the accused Dalbir and Amjad after
holding them guilty under section 363 (Punishment for kidnapping), 366
(Procreation of minor girl), 376 (Punishment for rape) of Indian Penal
Code and Dalit Prevention of Atrocities Act. According to prosecution,
the 15-year-old Dalit girl was kidnapped and gangraped by Dalbir and
Amjad at Khajurwala village in Saharanpur district on August 23, 2005.

Three of Dalit family killed in Uttar Pradesh

Three members of a Dalit family were killed in Uttar Pradesh's Jyotiba
Phule Nagar Tuesday, police said.

Mukhram, 55, his wife Gyanwati, 50, and their son Rahul, 22, were
found murdered inside their house in Dhanaura area, about 300 km from
here.

'Prima facie it appears the three died of injuries inflicted by a
sharp-edged weapon,' police inspector Sanjay Tiwari told reporters in
Jyotiba Phule Nagar.

'We are yet to ascertain the exact reason behind the killings.
Investigations are on to nab those involved in the incident,' he said.

Mukhram, who was a fruit vendor, had a tiff with his elder son
Rishipal a few months ago over some property dispute. Later, Rishipal
started living separately in another house in the same village. He has
been untraceable since Tuesday morning.

'Though we are yet to identify the assailants, we cannot rule out the
alleged involvement of Rishipal in the incident. We are investigating
the case on the lines of family dispute also,' said Tiwari.

Court questions government on Dalit Muslims' plea

The Supreme Court Monday gave six weeks' time to the central
government to file its reply on a suit filed by the Akhil Maharashtra
Muslim Khatik Samaj seeking inclusion in the list of other scheduled
castes.

The petition said that socially Muslim Dalits like khatiks, mehtars,
bhangi, lal-begi, halakkhor, mochi, mukri and garudi were similarly
placed as their Hindu counterparts therefore they should be included
in the category of other scheduled castes.

An apex court bench of Justice P. Sathasivam and Justice B.S. Chauhan
gave six weeks' time to the government after Solicitor General Gopal
Subramanium told the court that a petition by similarly placed Dalit
Christians was pending before the court.

He said that the National Commission for Religious and Linguistic
Minorities under the chairmanship of Justice Ranganath Mishra has
recommended the delinking of religion from the issue of scheduled
caste status.

The solicitor general said that they need time for getting response
from the states.

The petitioner said that denial of scheduled caste status to Dalit
Muslims on the grounds of religion was discriminatory and against the
spirit of the constitution.

The Hindu Khatiks in Maharashtra have been declared as scheduled
castes but the Muslim Khatiks doing the same job of slaughtering have
been denied the same status, which was arbitrary and without any legal
and constitutional foundation, the petitioner said.

The classification of Dalits into Hindu Dalits, Muslim Dalits,
Christian Dalits, Sikh Dalits and Buddhist Dalits was a recent
phenomenon. Previously under the Act of 1935 they were referred to as
'depressed classes', the petitioner said.
