Telangana Rashtra Samithi president K Chandrasekhara Rao is making a
promise that he would make Dalit as chief minister and a minority
leader as deputy chief minister, but he has not given a single MLA
seat to them in any election, says senior Congress leader Gone Prakash
Rao.

Prakash Rao who campaigned in Mancherial on Sunday, appealed to SC,ST
,BC, Minorities, students and TNGO to not to support KCR because he
and his family members had been enjoying political power with the
votes of these sections while denying them the same. He wondered why
KCR did not give a single MLA seat to the women and Muslims till today
who is promising deputy CM post to Muslims and 12 percent reservations
for tribals and Muslim minorities in the separate Telangana state. He
attributed the suicide of over 300 students to the provocation by KCR
and his family members.

He appealed to the Congress leaders not to use the Telangana issue to
attract the voters and not to promise to people that Congress was the
only party which can give separate Telangana state because congress
can't give separate state on its own without taking the consent of the
alliance parties in the United Progressive Alliance.

KATHMANDU: Dalit rights activists today demanded that equal rights be
ensured for Dalits in the new constitution.
Stating that Dalits have been chained by the manacles of social
discrimination for ages, Dalit rights activist Santoshi Biswokarma
demanded equal social, political, economic and cultural rights in the
new statute.
Speaking at a programme, Biswokarma said Dalit women suffer
untouchability, girl trafficking, domestic violence, sexual abuse and
rape and are deprived of education and basic health facilities.
Claiming that government-funded facilities were far from their reach,
she demanded inclusiveness in plans and policies for women.
Vice Chairperson of Constituent Assembly Purna Kumari Subedi pledged
to fight caste discrimination and assured that the constitution would
end the violence Dalit women were facing.

CHENNAI: Two of the three men of the 'katta panchayat' in
Chikkinaikanpalayam village of Namakkal district that gave a diktat
forcing three Dalit families out of the village for the past 10 months
were arrested by the police on Sunday.


The arrests followed the publication of a report on the plight of the
Dalit families in The New Indian Express on Sunday. Namakkal
Superintendent of Police, A Pari, said that C P S Subramanian and Mani
alias Palani Swamy were arrested and remanded to judicial custody
while Suresh, who was part of the team that headed the 'katta
panchayat', was absconding.

Tiruchengode DSP K Rajasekar said that the police have filed cases
under Prevention of atrocities against SC/ST Act. He said a special
team was being sent to bring back to the village the three Dalit
families, which have been forced to stay out since September, 2009.

Nallamaal and her neighbours, Palani and Manimekalai, all Dalits, were
asked to produce Rajendran, who had run away from the village
following a dispute with his wife, before the katta panchayat of caste
Hindus.

As Rajendran stayed in Nallamaal's house before he left the village,
Rajendran's sister Kala complaint with the village 'katta panchayat'
stating that Nallamaal was sheltering her brother.

Though Nallamaal explained to the 'katta panchayat' that she had no
idea about the whereabouts of Rajendran, she and her two neighbours
were ordered to produce Rajendran within a week or pay a fine of Rs
10,000 each. As she took up the issue with the Molhasi Police Station,
Subramanian, Palani Swamy and Suresh attacked the family members of
the three Dalits and forced them to leave the village.

In February, though Nallamaal with the help of police attempted to
gain entry into the village, the caste Hindus again attacked her
family.

Whenever a caste Hindu kills a Dalit, does that crime necessarily
qualify to be called a "caste atrocity"? Is there any so-called
"judicially manageable standard" to determine whether such an offence
was motivated by caste prejudice? These fundamental questions have
been thrown up by the Bombay High Court's judgment this month in the
much-touted Khairlanji case in which a mob of caste Hindus lynched
four members of a Dalit family four years ago.

The high court verdict proved controversial because, even as it
awarded an exceptionally stiff sentence of 25 years to eight accused
persons, it upheld their acquittal by the trial court on charges
pressed by the CBI under the Scheduled Castes and Scheduled Tribes
(Prevention of Atrocities) Act 1989. Thus, the denial of the atrocity
label did not quite conform to the stereotype that the upper
caste-dominated judiciary is indifferent to crimes against outcastes.
Short of the death sentence, there was little scope for the high court
to impose a higher penalty.

Yet human rights defenders and Dalit activists are crying foul. This,
because of the court's refusal to acknowledge the caste angle in the
Khairlanji case. Many see this as a setback to the larger challenge of
enforcing the atrocity law or preventing such incidents. Even 20 years
after the enactment of this special law, there is no clarity on when
its harsh provisions should apply to offences committed against
Dalits. For, the law, which gives teeth to the constitutional ban on
untouchability, divides caste atrocities into two broad categories:

* The first covers typical forms of untouchability: forcing a Dalit to
drink or eat any "inedible or obnoxious substance", dumping excreta or
carcasses on his premises, parading him naked or with painted face,
obstructing a Dalit from accessing a "place of public resort" or
forcing him to leave his house or village. In such cases, the caste
motivation is a given.

* The second category covers grievous offences that are anyway
punishable under the Indian Penal Code (rape or murder, for instance).
It is not enough for the victim to be a Dalit and the culprit to be
non-Dalit to invoke the atrocity law. The prosecution would also have
to prove that the crime was motivated by caste prejudice.

The problem is that this is subjective. Hence, cases relating to the
second category of caste atrocities often result in acquittals under
the special law. There is no objective standard for determining the
hand of caste prejudice in such cases. Unsurprisingly, this offers
ample scope for judges to interpret the law in a manner that may
diverge from common sense.

In fact, the problem with the Khairlanji verdict is that the high
court remained unconvinced that caste hatred had, in any way,
contributed to a terrible crime — the four Dalits were chased and
beaten to death by a mob made up of locally dominant Kunbi Marathas.
As far as the court is concerned, the only motive for the mass murder
was the mob's quest for "revenge". It is true that two of the targeted
Dalits — mother and daughter — had dared to lodge a police complaint
against some of those caste Hindus following an assault on a Dalit
family friend.

But the assumption that the mob was driven by revenge alone and
displayed no caste prejudice is contradicted by the court's own
narrative of facts. Take its failure to notice that the vengeance
wreaked by the mob was far too disproportionate to the supposed cause
of their outrage: the registration of an allegedly false assault case
by the Dalit mother and daughter. The offence of assault carries a
maximum penalty of two years. Could mob frenzy be whipped up to the
extent of committing crimes punishable with death just to get even
with somebody who lodged such a petty case? Had the Bhotmange family
been upper caste, let alone the locally dominant Kunbi Maratha, would
the mob have dared behave this way, that too in broad daylight?

The revenge theory also seems thin given the manner in which the
daughter's body was found naked in a canal and the fact that the mob
killed the sons as well, one of whom was disabled, although they had
nothing to do with the allegedly trumped-up assault complaint.

The Khairlanji verdict is more questionable than other atrocity cases
in which judges have ruled that the crime had little to do with the
victim's low caste status. In 2006, in Bandu Tamboli vs State of
Maharashtra, the high court rightly ruled against the application of
the atrocity law as there was no reason to believe that the accused
would not have raped the victim had she not been a Dalit. "There was
no racial tinge to the offence," the high court said.
It is ironic that while the courts use caste and race interchangeably,
the government spares no effort at various international meets to
delink the two. In any event, Khairlanji is a watershed event. It is a
fit case for the Supreme Court to clarify that judges cannot defeat
the very purpose of having an atrocity law by overlooking clear
evidence of caste prejudice. Else, judges themselves might be seen as
unwittingly betraying a "racial tinge".

GHAZIABAD: Tension prevailed in the Musuri area after five dalits
allegedly set a 50-year-old man, belonging to an upper caste, on fire
in the wee hours of Saturday. The victim, Viresh, was sleeping outside
his house in a cattle-shed that was allegedly set afire by five of his
neighbours. The cops have arrested three persons, identified as Sukha,
Bobby and Ashok, while two other accused are absconding.

Lately, there have been arguments between those who rear animals and
locals on many occasions, according to police. SP Beg added:
"Arguments and disputes are common, but it had never spiralled so much
out of control. The `thakurs' would constantly reprimand the
`valmikis' when their pigs would enter their houses as they consider
it a filthy animal. This is the first time it has resulted in such an
extreme act.''

According to police, some of the animals of Viresh's neighbours mostly
buffaloes and pigs used to stray into his cattle yard. This is what
had happened on Friday night also, and was followed by an altercation
and a minor scuffle. Viresh's family alleged that the animals damaged
the fodder and other articles kept in the cattle yard. Early morning
on Saturday, when Rajbala brought tea for Viresh, she heard him
screaming for help inside the single-room yard that was up in flames.
The windows of the room were also burning. After she raised an alarm,
family members rushed to pull Viresh out. The attackers had allegedly
bolted the room from outside to prevent Viresh from escaping, alleged
the family.

Said SP (rural) M M Beg: "Viresh's wife, Rajbala, has alleged that she
saw their neighbours Ashok, Sukha, Bobby, Sanjay and Joginder running
away while the shed was burning. We have filed an FIR and three
persons have been arrested. Viresh was rushed to hospital where
doctors declared him brought dead.''

Meanwhile, police and units of the Provincial Armed Constabulary have
been deployed in the area. Confirming this, SP Beg said, "There was
tension in the area which is now under control. We have deployed
police personnel as a precautionary measure.'' Confidence-building
measures are being taken to restore normalcy in the area, said cops. A
case has been registered at the Musuri police station and a postmortem
of the body was conducted.

Dalit Sangarsha Samiti demands justice for night soil workers

Chikkaballapur/Kolar, July 22, DHNS:

The Dalit Sangarsha Samiti members protested the practice of carrying
night soil or human excreta on the head which is still prevalent in
Savanur in Haveri taluk here on Thursday. The protesters staged a
dharna at Shidlaghatta circle and demanded justice for night soil
workers.


Addressing the protesters' the Samiti State Unit Coordinator K C
Rajakanth said, "The practice of carrying night soil or human excreta
was wrong and the workers need to be given more socially respectful
jobs. The government should provide justice and should ban the
practice of carrying human excreta."

The protesters also demanded suspension of Town Municipal Council
Officers for harassing community members and also demanded
rehabilitation facility. He warned State government of violent
protests if it fails to take immediate action in this issue.

Memorandum submitted
The members of Dalit Sangarsha Samiti submitted a memorandum to
Governor through Assistant Commissioner demanding ban on manual
disposal of night soil by Bhangis in Savanur in Haveri.

The government should provide basic amenities including free education
to Bhangi children, they added.The government should provide
protection to dalits and safeguard their interests, they added.

The government should stop the move to evict Bhangis who are residing
in the Savanur for more than 70 years and create an environment where
they can live with dignity, they added.

The protesters submitted the memorandum to Assistant Commissioner R S
Peddaiah. Samiti's Venkatapura Sathyam, Harohalli Ravi and others were
present on the occasion.

COIMBATORE: A trickster played the trick on 150 dalit women at
Ammankulam area in the heart of the city promising them to get micro
finance. However, he left them in lurch after he fled away with the
collection.


The incident came to light through R Murugan, a dalit panchayat
president and taluk organiser of Vizhuthugal, an NGO working for the
cause of Arunthathiyars when the women members poured out their woes
to him during his visit to the colony.

It was T Gomathy, a resident of the locality who enrolled women
members by issuing application forms of 'Pothigai Thendral', a
selfstyled service organisation located at RS Puram.

Since Gomathy had helped them get micro finance from other sources
earlier, the dalit women believed her and joined the scheme after
remitting anywhere between Rs 150 and Rs 300.

The 'Pothigai Thendral' service organisation was run by Sreenivasan
alias Raja and the office was located at RS Puram.

To their disappointment, the person never kept his promise of getting
them micro finance.

Sensing trouble, the dalit women along with other members from
Ammankulam, Balasubramania Nagar, Puliyakulam, Pappanaickenpalayam
went to the office of the service organisation only to infer that the
office was vacated.

Sheela, who runs a roadside eatery at Ammankulam told Express that she
was repeatedly scolded by her husband for her foolish act.

Frequent squabbles between the couple became a regular feature during
night hours.

Gomathy told Express that she made frantic efforts to locate the
person who was running the service organisation besides the collection
agent. After much pain, she was able to zero in at the house of the
promoter at Karamadai. And she was shocked to see the house locked.

Later, she came to know that he had fled away from the place without
vacating the house. Aggrieved women members knocked the doors of B2 RS
Puram Police Station seeking help. But they failed to entertain their
complaint.

A police constable is understood to have told them that the trickster
Sreenivasan alias Raja had obtained anticipatory bail. Vizhuthugal
organiser Murugan said that they have planned to stage a demonstration
in front of Red Cross building on July 28 demanding police action
against the culprit who cheated the dalit women of Rs 76,000.

Although Dalit writers have been at work in India for many centuries,
the term 'Dalit literature' has a specific, currently meaning and can
perhaps be seen in those writings. 'Dalit literature' describes Dalit
narratives depicting the struggle against oppression and has been
inspired by African-American literature and movements in the 20th
century.


Protests against the caste system and oppression are expressed in a
new literature called 'Dalit literature.' Poems, short stories,
novels, and autobiographies by Dalit writers provide useful insights
into the question of Dalit identity. In India, the movement started in
Mumbai with the publications of the Maharashtra Dalit Sahitya Sangha
in1958, and soon found its place in the mainstream of Marathi
literature. Later, the trend shifted to Hindi and Kannada. Currently,
it has entered Tamil. But in Oriya, Dalit writing has had a late start
compared to its counterparts and its voice has not yet been part of
the mainstream.

The poets of Charya Yuga or the Natha sect of saints like Hadi Pa,
Kanhu Pa, Tanti Pa, Chourangi Nath, Gorakh Nath, Mahendra Nath or Lui
Pa etc, all came from downtrodden social groups and constitute a
distinct social tradition in Orissa. But their poems are more
philosophical and tantric — religious rather than portraying social
oppression. But that does not mean Oriya society is a stranger to
caste oppression and other forms of inequality.

There were also many poets from the 'shudra' community who raised
their voices against the Brahmen hegemony but their writings were not
similar in theme and concept to today's so-called Dalit writings. From
Saral Das, the Adikabi of Oriya literature whose Oriya Mahabharat was
read for the first time in the fifteenth century to the famous saint
poet Bhima Bhoi to the powerful Marxist poet Rabi Singh of the 20th
century, a long list of Dalit writers have flourished in Oriya
literature. But these writings are not only confined to Dalit
oppression in relation to a Dalit caste system. There is evidence of
writings on Dalit oppression in Oriya literature from Bhagbati
Panigrahi and Sach Routray to Gopinath Mohanty, and many have a theme
of such oppression. But these writers do not belong to the lower or
untouchable caste. In poe­try the Vaishnavite upper-class poets like
Dinakrushna Das raised their voices against the Brahmanical
bureaucracy, but we can't place them alongside contemporary Dalit
writing. Bhima Bhoi, the tribal (Kandha) religious poet of the 19th
century fought against caste and ritualised piety and initiated women
in the society.

The only English book I have ever read on Oriya Dalit literature was
Paralysed Tongue, an Anthology of Dalit Studies (Pagemaker, 2005).
Ironically, this book is edited by two Brahmin scholars: Aswini Kumar
Mishra and Jugal K Mishra. While searching for other articles on the
net, I found two; one is a long essay by Raj Kumar
(http://findarticles.com/p/articles/) and another is a blog by Basudev
Sunani (http://basudevsunani.blogspot.com/). Raj Kumar identified only
one Dalit short story writer, Ramchandra Sethi, and one of his short
stories: Dwitiya Buddha. He counted six contemporary poets:
Bichitranand Nayak, Basudev Sunani, Kumaramani Tanti, Sanjay Bag,
Anjubala Jena, Mohan Jena, adding an appendage of 'many more.' Basudev
Sunani's irregular blogging (ten between April 2009 and December 2009)
contains two of his essays, a short story, and a few poems.

Recently, a few magazines and Facebook users have tried to raise the
Dalit discourse aiming to make it more active and streamlined. But the
main question is: are there a sufficient number of lower caste or
tribal writers from Dalit socio-economic classes available in Oriya
literature or it will be a movement of middle-class upper-caste
writers who are plenty and who constitute the mainstream?

CHENNAI: A 'katta panchayat' in Namakkal has forced three Dalit
families out of their village for 10 months, despite police
intervention.

The unofficial elders' council is made up of three men from the
dominant Naicker community of Chikkinaickanpalayam village. In
September 2009, it ordered Nallamaal and her neighbours Palani and
Manimekalai, all Dalits, to produce Nallamaal's relative Rajendran.
Rajendran had run away from home after a dispute with his wife and
Nallamal was alleged to be sheltering him.

The trio was ordered to produce Rajendran within a week or pay a fine
of Rs 10,000 each. Rajendran's sister Kala had filed the complaint
with the panchayat. The trio approached the Molhasi police station,
and the police managed to work out a compromise between Kala and
Nallamaal. However, when the latter returned to the village, she along
with Palani and Manimekalai were attacked by men from the Naicker
community and forced to flee the village with their families.

In February, Nallamaal sought police protection to return to the
village. The police took a written assurance from the village elders
against harassing the families. But in days, the families were
attacked and finally chased out of the village on March 25. S Kathir,
executive director of Evidence, a Maduraibased NGO said that Nallamaal
then filed a complaint with the Tiruchengode revenue divisional
officer, who forwarded it to the Deputy Superintendent of Police on
May 21.

Nallammal, her husband Selvaraj and their two children, now live in
Kollapatti, 30 km from Chikkinaickanpalayam. Palani works as watchman
in a private company in Erode district. Manimekalai and her family
moved to a village in Erode where the couple works as loaders.
Namakkal Superintendent of Police, A Pari said he was examining the
case and would take action.

VIRUDHUNAGAR: A 45-year-old man was hacked to death, while several
others were injured in a group clash between people belonging to two
scheduled castes in T Puthupatti village of Virudhunagar on Sunday.

According to the police, P Karuppaiah belonging to one of the groups
was hacked to death in the village on Sunday afternoon, triggering
tension there. A posse of policemen was deployed in Puthupatti, where
the situation was brought under control only after the police fired 12
rounds in the air to disperse the warring villagers. The police were
not aware of the exact number of injured. A few houses belonging to
one group were ransacked. No one has been arrested so far, as all the
men were on the run, police said.

Trouble started between the people of Parayar and Pallar castes in the
village four days ago in a bus. What started as a wordy duel
culminated in the murder of Karuppiah on Sunday afternoon. After
Karuppiah was fatally attacked, the rival group started attacking
members of the other caste and ransacking their houses . Soon both
groups entered into a street fight armed with knives and logs. Police
rushed to the spot and lobbed tear gas shells and fired warning shots
in the air, after which situation came under control. Senior police
officials are camping in the village.

The Prime Minister's Adarsh Gram Yojana , the Centre's version of the
Uttar Pradesh government's Ambedkar Gram Vikas Yojana, seems to be
caught in the political battle for Dalit votes. Both are almost
identical and target Dalit-majority villages for an integrated
approach to implementation of existing schemes.

While the UP scheme just needs tying up all available scheme funds at
the village level to achieve certain targets set by the state, the
central scheme provides Rs 10 lakh per village, with the state
government expected to make a matching contribution.

The social justice ministry today launched the scheme in a village in
Sriganganagar district of Rajasthan. The government has planned to run
a pilot programme in Uttar Pradesh, Tamil Nadu, Bihar, Rajasthan and
Assam. It has released a sum of Rs 22.72 crore for Bihar and Rajasthan
and Rs 10 crore for Assam. The proposals from Tamil Nadi are still
being processed, while the UP government never responded to requests
for proposals, ministry sources said.

The scheme allows identified villages with a majority Dalit population
to get gap-funding of Rs 10 lakh to fulfill any need not met by
existing funds and schemes. Ministry officials explained that if, for
example, an anganwadi was functioning without a building, the money
could be used for that. It would ensure a bottom-up approach, allowing
villages to decide how to use the money, the ministry says.

A total of 1,000 villages are to be covered under the scheme. About
225 villages in each of the four states named (excluding UP) are being
given funds in the first phase, after which more villages in other
states would be identified for funding. Unlike the central scheme,
UP's Ambedkar Gram Vikas Yojana does not allocate any special funds
but ensures convergence of existing schemes at the level of the
village to achieve key targets in water sanitation, connectivity,
electricity and land distribution.

The scheme was started in 1991 and was revised by Chief Minister
Mayawati in 2008 and is to end next year, on the eve of the state
elections.

While the Centre has been accusing states of taking credit for central
schemes, in this case the state could be wary of the Centre confusing
voters with a new scheme for Dalit villages when one already exists.

Lucknow : Three months after introducing reservation for SC/STs
through a roster system in appointment of cooks for the mid-day meal
scheme, the state government has withdrawn the order, following
several incidents of boycott of these cooks by students, withdrawal of
wards by parents, and even violent protests against their appointment.
The official reason given by the Education Department is that the
roster system was only applicable to regular government jobs, while
cooks under the mid-day meal scheme were on contract. "Applying
reservation system on a roster basis for appointment of cooks for the
mid-day meal scheme was a mistake. These cooks are contractual
employees who get just Rs 1,000 as honorarium," D C Kanaujia, Director
of Basic Education, said.

While the roster system is out, Kanaujia added, SC/ST candidates would
get priority in appointment of cooks.

On April 24, 2010, the state government had announced fresh guidelines
for appointment of cooks under the mid-day meal scheme, and also the
system of reservation. While there was no reservation for schools with
just one cook, in schools with more than one cook, reservation was to
be done on the basis of a roster.

So if there were four posts, say, the first post was reserved for
SC/STs, the second was unreserved, the third was for OBCs, and the
fourth unreserved. It was to go so on for additional cooks.

BARNALA: In yet another case of honour killing in Punjab, the nephew
of a Scheduled Caste woman allegedly killed her lover after he spotted
them together last night at Shaihna village in Tappa Sub-division of
Barnala. The police has arrested the 28-year-old and booked him under
Section 302 of IPC.

Police sources said that Lakhvir Singh Lakkhi, a jat from Uppli Patti
was allegedly killed by Harjinder Singh Bobby, the nephew of Sukwinder
Kaur (name changed), who belonged to a Scheduled Caste. He spotted the
duo and allegedly after killing Lakkhi last night threw him into a
septic tank near his house.

Police sources added that the 35-year-old girl was having an affair
with the boy for the last 7-8 years and the duo used to meet
clandestinely. When the girl's parents came to know, they warned the
boy to sever ties with their daughter.

Sources further said that despite the warnings the duo used to meet
and their meetings became quite frequent after the death of the girl's
brother since she was in a state of shock and needed support to
recover. After the death of the girl's brother, her nephew Harjinder
Singh Bobby came to live with them. He too warned Lakkhi not to meet
his aunt.

Sources added that on Saturday night when the boy went to meet his
girlfriend at her home, Bobby spotted them and badly thrashed Lakkhi,
resulting in his death. Allegedly, after killing Lakkhi, Bobby threw
him into a septic tank near their house.

Lakhwinder Singh, the deceased's brother got the complaint registered
at the police station at Shaihna told the police that few days ago the
parents of the girl had come to their home and threatened Lakkhi.
