Muzaffarnagar : In a suspected honour killing, a man involved in a
relationship with a Dalit woman was stoned to death allegedly by her
community members, police said on Thursday.
Forty eight-year-old widower Prem Singh of Thakur caste was in a
relationship with the woman for the past few years, which was opposed
by her community members, they said.

Singh was cornered near the woman's house in Umarpur village here last
evening and beaten to death after being attacked with bricks and
stones by a group of Dalit men, Deputy SP Rajesh Kumar said.

Police have registered a case against four accused - Rishipal, Ishwar,
Kala and Guddu - who are absconding and a search is going on to nab
them, he said, adding, security has been tightened in the village.

Mumbai: The Maharashtra government has proposed to set up special
courts for speedy trial of atrocity cases in view of the low
conviction rate in crimes against dalits.

"We have proposed to set up special courts to deal with atrocity cases
against dalits and the proposal has been sent to the law and judiciary
department for approval," home minister RR Patil informed the
legislative council today.

Shiv Sena MLC Neelam Gorhe raised the issue in the house and asked the
government to explain the low conviction rate in the atrocity cases.

She cited figures by the National Scheduled Castes and Scheduled
Tribes Commission which indicates that the conviction rate in these
cases in the state is only three per cent.

Citing reasons for the low conviction rate in atrocity cases, Patil
said the delay in registering complaints and investigations,
non-cooperation of witnesses and failure to verify caste certificates
are the main issues.

"The state government has appointed a committee to overcome such
hurdles and improve the conviction rate," Patil said.

Another Shiv Sena MLC Diwakar Raote alleged that the Atrocity Act is
being misused and false complaints are being lodged.

He asked if the government would make any changes in the Act
considering the false complaints. Patil said the government has no
plans to amend the Act.

A deputy level official verifies these cases before lodging the
complaints under the Act, he said.

KATHMANDU: Dalit rights activists today demanded that equal rights be
ensured for Dalits in the new constitution.

Stating that Dalits have been chained by the manacles of social
discrimination for ages, Dalit rights activist Santoshi Biswokarma
demanded equal social, political, economic and cultural rights in the
new statute.

Speaking at a programme, Biswokarma said Dalit women suffer
untouchability, girl trafficking, domestic violence, sexual abuse and
rape and are deprived of education and basic health facilities.
Claiming that government-funded facilities were far from their reach,
she demanded inclusiveness in plans and policies for women.

Vice Chairperson of Constituent Assembly Purna Kumari Subedi pledged
to fight caste discrimination and assured that the constitution would
end the violence Dalit women were facing.

NAGPUR: Prominent Republican leaders Prakash Ambedkar and Jogendra
Kawade have welcomed the Central Bureau of Investigation (CBI)
decision to appeal the July 14 high court verdict in Khairlanji case
in Supreme Court. The Nagpur bench of Bombay high court's decision to
commute the death sentence of six convicts has come as a shock for
Republican leaders.

The Dalit leaders will lead a march to Vidhan Sabha in Mumbai on
Friday to protest what they say is state's mishandling of the
investigation and prosecution of the case.

"It was the moral responsibility of the CBI and I am happy they are
fulfilling it. I am sorry to say that the state has not done its bit.
Even at this stage, the state can absolve itself of its anti-Dalit
attitude by appointing a judicial commission in Khairlanji killings
and reinvestigate the case," said Kawade, who had resigned as
legislator to protest the alleged mishandling of the case by the
government.

"I stand by my allegations that the Congress-NCP government in the
state and home minister R R Patil have conspired to weaken the case
from the start so that charges of Atrocities Act (1989) and that of
rape do no stick. The gory way in which the Bhotmange family members
Surekha, her daughter Priyanka, sons Sudhir and Roshan were killed and
later their bodies were defiled were enough to press the Atrocity
charge. But R R Patil, his party's local legislator Nana Panchbudhe
were more worried about the NCP image and influenced investigations so
that two crucial charges were diluted," said Kawade.

He said his People's Republican Party will constitute a fact-finding
committee and submit a report within three months. "In Mumbai riots
case Srikrishna Commission was appointed while Gundewar commission was
set up to probe Ramabai Ambedkar Nagar case. On the same lines, the
government should set up a judicial commission to look into
Kharirlanji case in its entirety, including the role of politicians in
influencing its investigations," said Kawade who is in Mumbai to
organise the march. "The high court delivered judgement but not
justice," he remarked referring to commuting of death sentence to
imprisonment of 25 years.

Bharatiya Republican Party Bahujan Mahasangh chief Prakash Ambedkar,
was, however, hopeful that the CBI appeal in Supreme Court could serve
the purpose of securing justice to Bhotmange. "In my opinion the high
court did not consider the portion relating to cruelty and brutality
of the crime based on which the lower court felt it was the rarest of
rare cases. The high court apparently viewed the case as revenge
killing," said Ambedkar. He was hopeful that the crucial aspect of the
case would not be overlooked in the apex court. The caste angle was
not given credence in the high court, said Ambedkar.

The state Home department decided to set up special courts that will
expedite trial in cases of atrocities on Dalits. Home Minister R.R.
Patil said conviction rates in these cases are as low as 3 per cent
according to the National Scheduled Castes and Scheduled Tribes
Commission. "We have written to the Law and Judiciary department to
help us set up special courts for these cases," Patil said in the
legislative Council.

Shiv Sena legislator Neelam Gorhe raised the question quoting the
recent Bombay High Court judgement commuting the death sentence
awarded to the six convicts in the Khairlanji massacre to life
imprisonment.

Gorhe said the victims had approached the police before the murders
but the police refused to file a case under the Atrocities Act. The
state had identified 22 problem areas including delay in registering
complaints and non-cooperation of witnesses.

Sena legislator and Leader of the House, Diwakar Raote alleged that
some people misuse the Act by lodging false complaints.

"The Act is meant to protect Dalit rights and if there is an
individual case (of misuse) we will look into it," Patil said. "But
there is no question of making changes in the Act."

High-caste Indians find low-caste cooks hard to swallow

plan in northern India to bridge social divisions by employing members
of the lowest caste as cooks in government schools has led to hundreds
of upper-caste pupils being pulled out of schools and outbreaks of
violence by angry parents.

The scheme was part of an ambitious drive by the Uttar Pradesh chief
minister, Mayawati, to empower the dalit caste. Dalits, often referred
to as "untouchables", are considered the lowest in the Hindu caste
hierarchy. But human rights groups have said resistance to the plan
shows how deeply embedded and discriminatory the caste system remains
in modern India.

The resistance against the dalit cooks by the upper-caste Hindus
turned so fierce in recent weeks that villagers attacked teachers and
the dalit cooks in some schools and fought pitched battles with
police.

Ms Mayawati, who was born into a dalit family, ordered the appointment
of hundreds of dalits to prepare meals for children in the state's
government schools in April.

In Hindu society, only upper-caste Hindu cooks are allowed to cook
community meals.

Trouble started on July 1 when dozens of female dalit cooks were sent
by the education department to start working in village schools where
the majority of pupils were upper-caste Hindus.


At one primary school in Mairakhpur village in Ramabai Nagar district,
the pupils refused to eat the meal prepared by the new dalit cook.
Last week more than 300 villagers, both men and women, armed with
wooden and iron bars and stones attacked the school. The angry
villagers locked the kitchen, ransacked the school and held the
teachers and the dalit cook captive in a room for hours until police
arrived and rescued them.

In an another school in Kannauj district, after pupils were forced to
eat the meals by general administration and education officials,
furious upper-caste villagers beat up the officials and set their
vehicles on fire, according to ETV.

Sanjay Shukla, an Uttar Pradesh education official, said last week
that legal action would be initiated against the villagers for
disrupting the functioning of government schools and that the dalit
cooks would not be removed. Sources inside the education department,
however, told local media that further district appointments of dalit
cooks had been put on hold.

Regional television channels reported this week that more than 1,500
upper-caste Hindu pupils had been pulled out of government schools by
their parents in villages in Ramabai Nagar, Kannauj, Kanpur Dehat,
Allahabad, Auraiya, Etawah and other districts.

"They are trying to force our children to eat food cooked by
untouchable dalit. It's like forcing a Muslim to eat pork. It's
totally against our culture," said Veeru Dubey, an angry villager in
Ramabai Nagar district, where the recent appointment of three dalit
cooks in two schools sparked protests. "They did not accept our demand
to replace dalit cooks with upper-caste ones and so we decided to
withdraw our children from the school."

Rights groups said this type of reaction demonstrated the difficulty
they face in eradicating the caste system.

"This is nothing but a rabid form of untouchability being imposed
against employments of dalit cooks," said Paul Divakar, a convenor of
the National Campaign for Dalit Human Rights. "Though this practice
has been abolished in the constitution, the hidden apartheid is
continuing in several contemporary forms."

In 2007, Ms Mayawati vowed to lift the social position of Uttar
Pradesh's dalits, who make up about one-fifth of the state's
population.

According to the latest Uttar Pradesh education department rule,
instituted this month, a school with 25 pupils should have one dalit
woman appointed as the cook. For a school with up to 100 students one
dalit and one non-dalit cook should be appointed. A school with more
than 100 pupils would have a third lower-caste cook.

For Shanthi, one of the dalit cooks from Ramabai Nagar, the scheme
that had once seemed like an opportunity has left her embarrassed and
disappointed.

"I asked a 10-year-old child in our school why he would not eat kheer
[milk pudding] cooked by me when I had cooked it with utmost care. He
replied that his parents had asked him not to eat anything cooked by
me because I was dalit," Shanthi, 38, said.

"I felt devastated when I found that the little boy even felt
uncomfortable when I touched him. I am sure that the child was taught
by his parents that he should not even get in physical touch with a
dalit. I was reminded again in a painful way that I am an
'untouchable'."

After trying to popularise the public private partnership (PPP)
concept in the infrastructure sector, the Mayawati government in Uttar
Pradesh has decided to take a step further and introduce PPP in the
social sector such as education.

In order to address the acute shortage of medical professionals in
Uttar Pradesh, especially in rural areas, the Mayawati government has
decided to establish five new medical colleges and two paramedical
colleges under the public private partnership (PPP).

According to sources in the medical education department, each of the
five medical colleges would have MBBS degree course for 100 students
every year while the two paramedical institutions would train students
as lab technicians, nursing and other in para medical streams as well.

The five medical colleges and associated hospitals that are to come up
under the PPP formula are Baba Saheb Bhim Rao Ambedkar Allopathic
Government Medical College in Kannauj, Manyawar Kanshi Ramji
Government Medical College, Orai in Jalaun district, Super Facility
Medical College and Hospital, Chakrapanpur in Azamgarh district, an
Allopathic Medical College in Saharanpur and Banda Medical College in
Banda.

The two paramedical institutes are Safai Institute of Paramedical
Science, Safai in Etawah district and Manyawar Kanshiram Paramedical
Sciences in Jhansi. While the Safai unit would have courses of nine
paramedical disciplines of 480 students every year, the Jhansi
institute will have ten paramedical disciplines of 600 students every
year.

"Private companies have been invited to participate in the bidding
process in which the developers will be given the responsibility of
developing, managing and running these medical colleges along with
associated hospitals and paramedical colleges on a profitable basis.
The last date for submitting the request for qualification (RFQ) is
July 31," said a source.

Stating the reason behind the project, the official said the health
sector is in dire need for professionals and there is a huge gap
between what is being churned out by the government and few private
medical colleges and the requirement of doctors and trained staff. "At
present, there is one doctor per 2,000 people in the state and most of
them do not want to be posted in rural areas. Hence, there are no
doctors, pathologists, nurses or even anesthetists in the villages.
Even if we start churning out 500 doctors and 1,000 odd paramedics
every year, it will take us at least 20-odd years to bring the ratio
to one doctor per 1,000 people."

The government's effort to allow private sector into medical education
is a step in this direction. All these five medical colleges and two
paramedic colleges were originally planned to be built by the state
government itself, but they were left midway for various reasons.

"While some of the colleges have around 80% of the physical
infrastructure ready, others have only 20-30% ready. These properties,
along with 100 acre, will be handed over to the selected bidders to
start functioning as professional medical colleges," said the
official, adding that since the need for training medical professions
is severe, the government has decided to give the 100 acre as a
sweetener to woo private companies.

"This project has been designed against heavy odds. This is the reason
that the government has decided to allow the winning bidder to develop
the medical college in 25 acre, as per the Medical Council of India
(MCI) norms and allow them to set up any other educational facility or
even upgrade the college to a PG college or even a university later
on."

According to sources, the bidders would have to invest between 300-500
crore for each of the institutes, depending upon the kind of
government investment that has already gone into infrastructure.

Raichur: Activists of the district unit of the Madiga Dandora
Meesalathi Horata Samiti took out a procession and staged a dharna
here on Thursday. They urged the Government to provide inner
reservation for Madigas.

Cause of anger

The protesters alleged that the A.J. Sadashiva Commission on Internal
Reservation among the Scheduled Castes in Karnataka had not submitted
its report on time and that the chairman of the commission should be
replaced by another so that the Madigas can get justice speedily by

The members of the samiti also wanted the Government to complete work
on relocating flood-hit villages and rehabilitating the displaced
families in Raichur district.

General secretary of the district unit of the samiti P. Narasappa led
the protest march which began from Ambedkar Circle and passed through
the main streets of the city before it culminated at the Deputy
Commissioner's office. where they staged staged a dharna and submitted
a memorandum there.

Mr. Narsappa sought the removal of Vaddar, Lambani and Koravar
communities from the list of Scheduled Castes. According to him,
because the Vaddar, Lambani and Koravar communities were included in
the Scheduled Castes list, Madiga community was affected.

Houses for flood-hit

On the occasion, Mr. Narsappa stressed on the need to construct houses
and toilets for all BPL families in Merchethal village in Manvi taluk.
He urged the Government to take steps to construct a separate samudaya
bhavan for Madigas at Masarkal village in Deodurg taluk. He added that
the Government should also initiate action to hasten the construction
of the houses at all the identified relocated centres for
rehabilitating the displaced families from the flood-affected villages
in Raichur district.
