Moga : The case of rape of a Dalit girl, from Ramuwala Kalan village,
took a new turn, when the principal of government primary school,
Ramuwala Kalan, submitted a letter to the
Scheduled Caste/Scheduled Tribe (SC/ST) commission recently, stating
her date of birth in school records as October 7, 1993, making her a
minor.

This development took place after the state education department held
an inquiry at the local village school and submitted the report with
the SC/ST commission, which is conducting an inquiry into this matter.

Dalip Singh Pandhi, member Punjab State SC/ST commission confirmed the
development and said, "This letter has made it clear that the police
had built up a false case to try and save the culprits."

The civil and police authorities had been claiming that the girl was a
major and did not wish legal action against the alleged accused
persons.

The police then stopped the investigation process and filed an
application before the district and sessions' court requesting it to
close the case.

The case of rape had come to light when the girl gave birth to a baby
in April last year.

An FIR was lodged against six persons under Sections 376 and 506 of
the IPC. SP (D) Gurmeet Singh who was investigating the case claimed
that father of the girl had filed an affidavit that his daughter was
above the age of 18 and she willingly developed relations with the
'accused'.

He demanded cancellation of the case stating that nobody was at fault.

In order to hush up the case, the girl was married-off to a man in
Jalandhar district in February this year, violating the provisions of
the Prohibition of Child Marriages Act, 2006. The SC/ST commission
will now carry on further investigations into the case.

Dalits make offerings at Panthapuli temple

Amid tight security cover provided by police, Dalits of Panthapuli
village near Sankarankovil sacrificed goats and offered 'pongal' at
the Kannanallur Mariamman temple on Tuesday.

Villagers belonging to other communities, who left their hamlet on
Sunday in a huff against the members of "oppressed community" entering
the 100-year old temple, continued their agitation on the Yettisery
hillock for the third day.

With the law-enforcers led by Deputy Inspector-General of Police,
Tirunelveli Range, K.P. Shanmugarajeswaran, Superintendent of Police
Asra Garg and other police personnel providing the Dalits protection
for the past few days, they came prepared for offering 'pongal' in
front of the temple.

Following 'abhishekam' to the presiding deity, three goats were
sacrificed and 'pongal' was offered after 9 a.m.

After the celebration, the Dalits returned home with police protection.

The members of the other communities have announced that they will not
come down to their village until the Madurai Bench of the Madras High
Court resolved the dispute.

Lucknow Despite her prickly relationship with the Centre, Uttar
Pradesh Chief Minister Mayawati believes in never putting the lid on
dialogue. In the 36 months since coming to power in May 2007, she has
written 100 letters to Prime Minister Manmohan Singh, averaging one
every eleventh day.
Which would make her, in all likelihood, not just the PM's most
prolific correspondent among chief ministers, but possibly among all
major leaders in the country.

In her letters, Mayawati has put forward her demands and requests for
UP, and her views on a range of issues. The last letter she wrote, her
hundredth, on May 15, contained her views on the inclusion of caste in
the census, sources in the Chief Minister's office said.

"Successive governments at the Centre deliberately avoided a
caste-based census in order to deprive the biggest section of the
country's population of their constitutional rights," the CM wrote,
according to a release issued by the state government.

Mayawati begins her communications to the PM with the salutation
"Aadarniya Pradhan Mantriji", and signs off with "Bhavadiya,
Mayawati". In her first letter, written on May 21, 2007, a week after
she took charge in Lucknow, the CM expressed regret for not being able
to attend a party hosted by the PM on the completion of three years of
the UPA-I government.

Subsequently, over the next three years, she raised issues ranging
from a Bharat Ratna for BSP founder Kanshi Ram (in January 2008) to
piracy off the coast of Somalia (in February 2009).

In May 2009, Mayawati wrote to the PM about the murder of Dera Sach
Khand leader Sant Ramanand in Vienna, and four months later, expressed
concern over the security of AICC general secretary Rahul Gandhi.

Earlier, in October 2008, she had raised the issue of attacks on north
Indians in Maharashtra, and in February that year, asked the PM to
consider removing Delhi's Lieutenant Governor Tejendra Khanna for an
alleged remark to the effect that north Indians take pride in breaking
the law.

In an earlier letter, written in December 2007, Mayawati put forth her
views on reservation for the Mochi community in the SC category in
Gujarat. She wrote at least four letters expressing concern over the
lack of development in Bundelkhand; at other times, she discussed the
Right To Education Act, the Justice Dinakaran episode and the women's
reservation Bill.

Her letter on Dinakaran, written on December 19, 2009, began, "Main
aapko yeh patra ek mahatwapoorn prakaran ke sambandh mein likh rahi
hoon (I am writing to you about a very important matter)", and went on
to request the PM to give an opportunity to Dinakaran to present his
side of the story as per the principle of natural justice ("nyaya ka
naisargik siddhant").

In her eight months in power in 2007, Mayawati wrote 14 letters to the
PM. In 2008, she was more prolific, writing 41 letters. In 2009,
despite being busy with the Lok Sabha elections, she found time to
write to the PM 36 times.

Sources close to Mayawati said she writes all important letters
personally. "All letters that have a political tone are written
personally by her. Since she alone decides her party's agenda, the
topics she writes on are also entirely of her own choosing," said a
top source.

A BSP leader the CM's letters would stand as a "historical record" for
the party. "This is necessary for future generations to know the BSP's
views on all these issues," said the leader.

NEW DELHI: The social justice ministry is unhappy with the lack of
movement in bringing affirmative action to the private sector, a
flagship promise of Congress in UPA-1.

Social justice minister Mukul Wasnik has written to Prime Minister
Manmohan Singh seeking a review of efforts made in this direction. In
his letter, he outlined steps taken to persuade industry to accept
preferential employment policies for SCs/STs which essentially have
not counted for much.

The PM on Monday told reporters that there was a need to create an
atmosphere which would let industry and trade help the government in
affirmative action. The comment, however, came in the backdrop of the
Centre's failure to bring industry around to join in positive
discrimination despite the big assurance of not imposing job
reservations by legislation.

Sources said Wasnik's letter underlined the need for a fresh
initiative, a clear sign that the sensitive issue — which had
unleashed an offensive from dalit experts and activists in UPA-1 — has
to be addressed. While putting the issue on the backburner, the UPA
has taken refuge in the argument that the common minimum programme did
not promise reservations but only talked of affirmative action. But
there is concern that this could lead a strong section of dalit
opinion-makers to feel that the Congress has gone back on its promise.

Observers feel that while the government lacked initiative, it was
also handicapped by global slowdown when the priority was economic
recovery. An industry expert said the PM's fresh statement coincided
with signs of a crisis in Europe and it was unlikely that fresh ground
could be broken now.

There was a big push for reservations in private sector in UPA-1, with
the government holding discussions with industry and then social
justice minister Meira Kumar even threatening to enact it by law. The
issue, however, petered out as the PM virtually took it away from
social justice ministry and handed it over to a committee headed by
principal secretary to PM T K A Nair.

A sub-committee under Department of Industrial Policy and Promotion
has since been holding discussions with industry. There has not been
much headway once the government made it clear that industry's bugbear
— job reservations — was off the table. Only a 'code of conduct' has
been accepted by the principal chambers of industry which the members
follow on voluntary basis.

The DIPP proposal has not enthused many either. It spoke of the
possibility of industry taking investment to backward regions in
return for concessions to create opportunities for SCs and STs. It is
felt the government has for too long tried to lure industry with
concessions but without yielding results.

Cabinet to discuss caste-based census

As several political parties make a pitch for conducting caste-based
census, the Union Cabinet is set to discuss the issue on Thursday.

Differing views within the government on the issue had come to the
fore at a meeting of the cabinet earlier this month when Prime
Minister Manmohan Singh had decided to continue discussion on the
matter.

Those opposing caste-based census believe that it is a throwback to
the medieval times and the census should be looking at the future and
not the past.

Political parties, including the Samajwadi Party, RJD and JD-U have
been strongly demanding inclusion of caste in the census exercise.

The issue had figured prominently in the just-concluded budget session
of Parliament when the Prime Minister had assured the members that
government would take their views into account before deciding on the
matter.

At his press conference on Monday, the Prime Minister said that he
would ask the Cabinet to consider the views expressed in Parliament.

"I made a statement in Parliament in which I said that we shall take
into account the views expressed in Parliament by various sections...
and that I will ask the Cabinet to consider them. That process is on,"
Mr. Singh had said replying to a question on the issue.

Caste-based census was last conducted in the country in the year 1931.

Sanjay Dutt now knows that "jadu ki jhappis" can make friends of foes
only on screen. Off it, the magical hugs could invite trouble and
long-drawn court trials.


The actor, being tried in a Uttar Pradesh court for saying he wouldn't
mind giving 'jadu ki jhappis' to Chief Minister Mayawati, has been
asked to be present in the Pratapgarh district court on June 9, when
it hears the case next. The case hearing was scheduled for Monday. But
Dutt was not present, as he was not served the summons. The chief
judicial magistrate then wrote to the Mumbai police commissioner to
serve summons on Dutt, so that he could be present for the June 9
hearing.

On April 16 last year, Dutt had offered to give 'jadu ki jhappis' to
Mayawati, if she didn't mind it, during an election rally at
Pratapgarh, while campaigning for Samajwadi Party in the 2009 general
election. Finding the remarks "objectionable" police registered a case
against him. Similar remarks on the BSP Supremo landed him in trouble
in Barabanki and Mau, too. Sanjay Dutt later explained that he had
made the remarks in a lighter vein and expressed regret if they hurt
Mayawati.

Allahabad, May 25 (PTI) The Allahabad High Court today stayed a single
judge order whereby a circular of Uttar Pradesh government, relaxing
the system of negative marking for ST and SC candidates in PG medical
entrance examinations, was quashed.

A Division Bench comprising justices Prakash Chandra Verma and Ram
Autar Singh passed the interim order on a special appeal of the Uttar
Pradesh government challenging the May 20 order which had quashed the
circular whereby a provision was made for adding marks, deducted
because of negative marking, to the final tally of SC/ST candidates.

The April 6 circular had stated "sufficient number of reserved
candidates were not available for filling up all the vacant
seats...Thus the government had taken a decision that for SC/ST
candidates, the marks deducted by negative marking shall be added to
the marks obtained by them for determining their eligibility".

Mayawati files papers for Legislative Council polls

PTI Uttar Pradesh Chief Minister Mayawati files her papers for the
Legislative Council elections in Lucknow on Wednesday.
Uttar Pradesh Chief Minister Mayawati on Wednesday filed her
nomination papers for the biennial election for the State Legislative
Council, scheduled to be held on June 10.

The BSP supremo is currently a member of the Legislative Council and
her term would expire on July 6.

Ms. Mayawati, who reached the Tandon Hall of Vidhan Bhawan along with
senior Cabinet Ministers Naseemuddin Siddiqui and Satish Chandra
Mishra, filed her nomination papers before the returning officer.

Besides, Ms. Mayawati other candidates of the BSP also filed their nomination.

Other candidates include Rishipal Gautam, Satish Chandra Jatav, Ram
Kumar Kureel, Subodh Kumar Parashar, Mohammad Athar Khan, Vinod
Chauhan and Lal Chand Nishad.
