Christians hail law on 'racist' caste system

Christian and dalit groups say that a new British law, which equates
caste discrimination with racism and thus punishable, would help fight
caste prejudices worldwide.

"We need to welcome it," says Father Cosmon Arokiaraj, secretary of
the Indian Catholic bishops' office for people belonging to poor
castes and tribes. He said the British move would help outlaw caste
discrimination.

The Equality Act 2010, which the House of Lords passed on March 24,
aims to place discrimination based on disability, sex, race and other
grounds under one piece of legislation.

The act that treats caste discrimination as an aspect of racism will
become a law in the United Kingdom when the House of Commons passes
it.

Father Arokiaraj said the law will help "internationalize" the issue
of caste discrimination suffered by millions of socially and
economically underprivileged Indians for generations.

Indian society is divided into four major castes and all those born
outside these are regarded as outcastes and "untouchables." These
groups are together called dalit (oppressed). Although outlawed,
Indian villages continue to discriminate against dalit people.

In 2002, the UN Committee on the Elimination of Racial Discrimination
(CERD) called all member states of the International Convention on the
Elimination of All Forms of Racial Discrimination (ICERD), including
India and the UK, to enact laws aiming to end descent-based
discrimination.

'Punish those who practice discrimination'

India maintains that caste is not a form of racial discrimination and
has been successful in keeping caste out of the resolution adopted at
the 2001 Durban conference on racism.

All India Catholic Union secretary John Dayal said caste
discrimination should be considered "as bad as" racism and "people who
practice it should be punished."

He said his organization is "quite happy with the British move. We
have been camping for this in the UN Committee on the Elimination of
Racial Discrimination," he said.

Dayal said that the Indian government is resisting the move because of
"the hold of the upper caste" in the government. He said they know
"how seriously they would be affected by international condemnation of
caste."

Dalit leaders say although caste discrimination is predominately a
South Asian social phenomenon, millions suffer its adverse effects
because there are more dalit people than those with caste.

Udit Raj, who heads a confederation of dalit and tribal organizations,
said he also "supports" the new British law. "It has been our long
standing demand," he said.

This note pleads: (1) Clause (3) of Constitution (Scheduled Castes) Order 1950 must be deleted in order to abolish religious discrimination against Muslim and Christian Dalits, (2) All the groups of Muslims and Christians which traditionally share the professions which are carried on by Hindu, Sikh or Buddhist Scheduled Castes must be treated at par with their counterpart Hindu Schedule Castes. (3) No reservation should be extended to all the Muslims just as it should not be extended to all the Hindus. Reservation benefits must be restricted only to socially and educationally backward classes of Muslims and Christians. (4) No division of OBC quota of 27% should be done on religious basis. However mechanisms should be made to ensure that Muslim OBCs get proportionate benefits in OBC quota. (5) To ensure that Muslim OBCs get their due share, Bihar model can be adopted wherein Muslim OBCs are grouped with most backward Hindu groups. (6) To ensure social and educational development of OBCs , on the pattern of Special Component Plan for Schedule Caste and Schedule Tribes, 27% of Plan Budget should be earmarked for OBCs which will benefit Muslim OBCs also.

The root cause of decline of Muslims in India after independence is their under-representation in the political institutions and bodies of governance such as Parliament, Assemblies, Govts. and Panchayats etc. To rectify this situation, following suggestions are made:-

1. Clause (3) of Constitution (Scheduled Castes) Order 1950 makes it obligatory that a member of Schedule Castes as listed under Article 341 of Constitution must be a Hindu, a Sikh or a neo-Buddhist. This clause bars Muslim and Christian dalits from sharing the benefits of reservation policy both at the Central and the State levels. Specially, this clause results in making Muslim and Christian dalits ineligible for contesting on the seats reserved in Parliament and Assemblies for Schedule Castes. Out of 119 seats reserved in Parliament for Schedule Castes, 36 reserved seats have substantial or majority Muslim population. Similarly, about 200 reserved Assembly seats would have similar population share of Muslims in them. Thus, if clause (3) were deleted, Muslims can almost double their representation in Parliament from the present level of 28 MPs to 28+36=64 MPs. Their representation in Assemblies too can increase by additional 200 seats. Muslims constitute more than 15% of the total population in the country. In the Indian Parliament having about 550 seats, Muslims' share should not be less than 15% of 550 MP seats i.e. more than 80 seats.

This enhanced level of representation of Muslims in Parliament and Assemblies can be secured without any constitutional amendment. The Constitution (Scheduled Castes) Order of 1950 is an executive proclamation issued by President of India but approved by Parliament. Clause (3) of this Order can be deleted by a simple majority in Parliament.

Clause (3) of the above Order is plainly arbitrary, unconstitutional and unfair. This view has been taken by Rangnath Mishra Commission which was set up by Congress Government at the Centre. The demand for the deletion of clause (3) is based on the very sound principle of Indian Constitution that no citizen can be discriminated against on the basis of religion, race, caste and sex etc. This clause discriminates against Muslim and Christian dalits on the basis of their religion in as much as members of Hindu, Sikh and Buddhist Schedule Castes obtain benefits of reservation in different fields but Muslim and Christian dalits carrying on the same traditional, caste occupations such as washer-men (Dhobi) Sweepers (Lal Begis) Nat etc. are denied these benefits just because they follow Islam or Christianity.

2. Steps should be taken to abolish clause (3) of this Order and to include all those groups of Dalit Muslims and Christians as Scheduled Castes whose traditional occupations correspond to those carried on by Hindu, Sikh or Buddhist Schedule Castes. To illustrate, Muslim butchers, weavers, sweepers, vegetable seller etc. must not be treated differently from the same groups of people in Hindu, Sikh and Buddhist communities. Rangnath Mishra Commission made this recommendation very clearly. If the Indian society desires that Muslim poor should participate equally in the development of the country the above religious discrimination must be ended up forthwith.

3. A few Muslims are demanding reservation for all the Muslims. Muslims should be well advised not to press for this demand and Indian society should be wise enough to reject their demand outright. Under Article 15(3) of the constitution, State can make special provisions for socially and educationally background classes of citizens for educational purposes. Under Article 16(4) backward classes of citizens who are inadequately represented in public employment can be given reservation. Under the Indian Constitution all the Hindus cannot be given reservation because not all the Hindus belong to socially and educationally backward classes of citizens. If all the Hindus, who are 82% of the Indian population, per se cannot get reservation, how can all the Muslims be given reservation while they are only 15% of the population. It will be untrue to claim that all the Muslims of the country are socially and educationally backward. Attempt should be made to pick out those sections of Muslims and Christians who are socially and educationally backward and only they should be brought under the reservation safety net. This proposition, besides being unassailable under the Constitution, is also a non-communal approach to mitigating the under-representation of Muslim poor in the structure of governance. Any effort to raise a communal demand will ultimately be misused by the communal forces against Muslims presently lying low. Both before and after the partition of the country, Indian Muslims were damaged due to communal strategies adopted by the leaders. Present and future generations of Muslim must reject any communal strategy for improving their lot in the country.

Pursuing a non-communal approach would be more beneficial to the Muslims for two reasons. Muslims are only about 15% in the country. If they want their voice to be heard they must build up bridges of amity and goodwill with Hindus and other communities to obtain support of atleast 51% of the population. Secondly, Prophet Mohammad observed that love of the country is part of the faith of Muslims. Thus, it is a religions duty of Muslims to have amicable relations with the countrymen of other religions also in order to be good practicing Muslims.

4. In some quarters, a suggestion has been made that out of 27% quota reserved for other backward classes (OBCs), about 1/3 of 27% i.e. 9% quota should be created for Muslims. This is also not a wise suggestion. This suggestion implies that all the Muslims should get benefits of reservation even if they do not belong to socially and educationally backward classes of the society. It has already been clarified in the beginning that like all Hindus all Muslims cannot claim and should not be given the benefits of reservation.

5. Sometimes it is suggested that about one third of 27% i.e. 9% quota may be reserved for Muslim OBCs. Rangnath Mishra Commission has recommended that out of 27% reservation for OBCs, 6% should be reserved for Muslim OBCs In the long run, this suggestion will also damage Muslim poor because this suggestion amounts to separating Muslim OBCs from Hindu OBCs on religious lines. It is agreed that Muslim OBCs so far have not been able to secure even 1/3rd out of 27% of jobs reserved for OBCs. But to achieve this objective, creating a divide among OBCs on the basis of their religion would be harmful both to the Muslim OBCs and to the OBCs in general. Muslim OBCs and Hindu OBCs combined can fight out the ill-effects of social downgrading inflicted by casteist groups more effectively by working together rather than working separately as Muslim OBCs and Hindu OBCs.

6. A better strategy to ensure Muslim OBCs get their due share would be to adopt Bihar model. In Bihar, OBCs have been divided into 2 groups : Backwards and Most Backwards. Most Backwards include Muslim OBCs also. Most Backwards get higher quota than Backwards. This is a non-communal approach which will be more beneficial to the Muslim OBCs.

7. To ensure social and economic development of members of Schedule Caste & Schedule Tribes Government of India earmarks about 21% of Plan Budget as Special Component Plan every year. This amount is utilized for construction of pakka roads, school buildings, power, hand pumps, drainage, centres of public health and scholarship etc. for the areas pre dominated by these communities. If a similar provision is made for OBCs by earmarking 27% Plan funds, it will benefit Muslim poor in a big way. Roughly speaking every year 2.5 lakh crores are budgeted as plan expenditure in the country. 27% of this amount (Rs. 67,500 crores) is a big amount. Even if one third of this amount reaches Muslim OBCs, every year about Rs. 22,500 crores would be available for improving their condition. One important aspect of this suggestion is that as this demand is based purely on social and educational backwardness of the OBCs, any effort to give it a communal colour is likely to fail. Even small segment of those persons who keep raising artificially the issue of appeasement of Muslims would not be able to come out against this demand because this demand is in favour of more than half of India's population which is included in OBC category. In a democratic set up to oppose more than half the population would be like hitting oneself with one's axe.

Uttar Pradesh Congress chief Rita Bahuguna Joshi has landed in a
controversy following her remarks against state Chief Minister
Mayawati.

At a meeting of party workers in Basti area of the state on Wednesday,
Joshi attacked Mayawati for her statue-building spree and went to the
extent of commenting on her complexion.

"She got her statue worth Rs 5.5 crore made, and that too a dark one.
One has to see how its nose and ears are. One of her statues fell
short in height than Ambedkar's so she got it replaced. Is she trying
to measure up to Ambedkar's stature?" Joshi said. Mayawati and Joshi
have been at war since Joshi took over as chief of the Congress in
Uttar Pradesh.

Joshi had earlier made the infamous rape remark against Mayawati
following which BSP workers attacked her house and set it afire.

New Delhi: The general category seats at the All India Institute of
Medical Sciences (AIIMS) continue to suffer, despite the government
announcing a mandatory 27% quota for the Other Backward Classes (OBCs)
three years ago across the educational institutions in the country.

The problem, as revealed by the result of a Right to Information (RTI)
application filed by the father of an MBBS aspirant is that the seats
from the general category at AIIMS are also being given to students
from the OBC category.

The father demanding names, ranks and categories of all students
admitted in the MBBS programme in the premier medical institution for
the year 2009 filed the RTI application on January 13 and the reply
revealed that the AIIMS registrar had admitted 3 students under the
'others' category where the entrance test information bulletin
mentions only general, Scheduled Caste (SC)/ Scheduled Tribe (ST),
OBC, orthopaedic physically handicapped as the only eligible
categories for admission.

Three years down the lane, it has been observed that the OBC quota has
still not been implemented successfully at AIIMS as it fails to
provide OBC seats in the reserved category.

The father filing the second RTI query on February 23, asked the Dean
of examination to elaborate on the 'others' category to which the
response as on March 17 stated a list released by him adjusting those
three students under the general category.

A senior official later said that, "Those OBC candidates must be
belonging to the creamy later who later took admission through the
general category."

It has been revealed that most of the high-ranking OBC students are
accommodated in the general category alone whereas students already
from the general category get fewer seats.

Dr. Y.K. Gupta, Public Relations Officer at AIIMS said that
meritorious students automatically get admitted to AIIMS through the
general quota. Another senior doctor said that students on the merit
list automatically get listed within the general category.

The reservation rules as per the government's directive imply that 50
percent of the seats have to be occupied by general students, 15
percent by SC, 7.5 percent by the ST and 27 percent by the OBC.

The number of seats available for the MBBS programme at AIIMS every
year is 77, out of which 36 seats are open for general students, 11
for SC, 6 for ST and 19 for OBC.

Lucknow : The Saharanpur police lodged an FIR against former Samajwadi
Party MP Rashid Masood on Wednesday, for his alleged derogatory
remarks against Chief Minister Mayawati, made during a rally on
Tuesday.
Masood has been booked under Sections 188, 189 and 505 of the IPC,
which includes disobedience to order duly promulgated by the public
servant, threat of injury to public servant and statement causing
public mischief.

The FIR has been lodged at Kutubsher police station in Saharanpur city
by Station Officer Muneesh Kumar.

Masood, however, denied all allegations. "It is an act of political
vendetta against me and my family. During the last three years, over
three dozen cases have been lodged against me and my relatives,
including my wife and daughter-in-law," he said.

"I did not say anything unparliamentarily or disrespectful about the
chief minister. I just referred to a popular Urdu phrase explaining
why I have no intention of meeting Mayawati, because a BSP leader had
recently conveyed to me that all my problems would end if I met her,"
he added.

"Ever since Mayawati came to power in 2007, the UP government has
unleashed a reign of terror against me and my family. We are under
pressure to join the Bahujan Samaj Party," Masood alleged.

According to Masood, the state government had upgraded the Saharanpur
Nagarpalika to Nagar Nigam only to remove his nephew Imran Masood, who
was the chairman there. Earlier, the government had removed Imran, but
its action was stayed by the High Court, Masood added.

Jagdish Singh Rana, BSP MP from Saharanpur, denied that Masood was
being victimised.

Rana, once an acolyte of Masood, was a Cabinet minister in the
Samajwadi Party-led government from 2003 to May 2007. He later
switched sides, joined the BSP and was elected to the Lok Sabha in May
2009.

"The BSP or the state government has nothing to do with the FIR. The
law is taking its own course. Rashid Masood had made intemperate
remarks against the chief minister and the police have taken suo motu
cognizance of the matter," said Rana.

SANGAREDDY/WARANGAL: Minister for Tourism and Information J Geeta
Reddy has said that the government would extend loans with 35 per cent
subsidy to enthusiastic SC and ST entrepreneurs for setting up
industries. For women, an additional subsidy of five per cent will be
given, she said.


The Minister was participating in the birth anniversary celebration of
Babu Jagjivan Ram held under the aegis of the District Social Weflare
Department. She garlanded the statue of Jagjivan Ram at the new bus
station and later addressed a public meeting. District in charge
Collector Vijay Kumar was also present.

The Congress Government, she said, had introduced several progeramme
for the welfare of the SCs and STs. The government has decided to
extend loans with subsidy for the welfare of unemployed youth. She
urged the youth to make use of the schemes.

Late chief minister YS Rajasekhara Reddy had organised `Sankshema
Bata' for taking up repairs and to ensure development of welfare
hostels. He had sanctioned Rs 2.60 crore, she recalled and stated that
Rs 1.45 lakh of the funds has already been released. Over 72 works
have been completed with the funds and another 55 works are in various
stages of completion, she said.

The Congress Government, she said, has decided to organise 'Praja
Patham' this month with an aim to find out the problems being faced by
the people in summer and resolve them soon. She directed the in charge
collector to begin the programme from SC colonies in villages.

With regard to the distribution of land to the poor scheduled to begin
on April 14, she directed the officials to get the consent for the
list of beneficiaries in the assignment committee meetings. Hailing
the services of Babu Jagjivan Ram for the upliftment of Dalits, she
said all Dalits should tread the path of prosperity taking Ram as an
ideal.

She also directed the in charge collector to appoint chairman for the

A Patna court on Wednesday sent 16 persons to the gallows and awarded
life imprisonment to 10 others for killing 58 people in 1997.

The court also imposed a fine of Rs 50,000 each on those who were
sentenced to life imprisonment. Nineteen persons were acquitted for
want of evidence.

The sentence came 13 years after the massacre by the Ranvir Sena, a
private militia raised by upper-caste landlords of central Bihar, on
December 1, 1997 at Laxmanpur Bathe village in Jehanabad district -
now part of Arwal — about 105 km southwest from here.

The massacre is considered to be the worst-ever in the state. Among
the dead were 21 men, 27 women and 10 children. Four families were
completely wiped out.

The dispute was over the ownership of a large piece of unused land
belonging to the state.

Announcing the judgment, Additional District and Sessions Judge Vijay
Prakash Mishra handed over the copies of the quantum of punishment
separately to all the 26 accused.

On December 24, 2008, the police framed charges of unlawful assembly
with prohibited weapons, with the sole objective to kill against 44 of
the 47 accused — three absconding since.

Of them, three died during the trial period. The rest 41 accused were
present in the court to receive the verdict.

All the accused, who were held guilty on March 31, were earlier
brought to the court from Beur Central Jail.

And the court premises had been turned into a fortress.

A large number of people, including the relatives of the victims, were
also present in the court at the time of

pronouncement of the verdict.

Altogether, 14 senior lawyers, nine from the prosecution and four from
the defence, appeared before the trial court.

While the prosecution

produced 91 out of 152 witnesses listed, nine witnesses deposed on
behalf of the defence.

The case was first lodged with Mehendia police station in Jehanabad
district — now part of Arwal district — on the

basis of a statement of Binod Paswan, who survived the attack.

Later, the trial of the case was shifted to Patna from Jehanabad on
the directive of the Patna High Court.

The Congress was stone Hearted for 63 years ! Now they have realise that next Ms. Mayawati will be the next Prime Minister and that there would not be any fund crunch to implement RTE which is the Constitutional Right. If the congress was really interested in implementing the same, they would not have put the burden on the State Government.They are also scared if it is implemented, the untouchables would get educated and empower the SC STs as desired by the father of the Constitution.

The Congress Monday lashed out at Uttar Pradesh Chief Minister
Mayawati for seeking funds for implementing Right to Education Act in
the state, calling her a stone-hearted 'murti-devi' (statue).

'Murtidevi Mayawati is saying like stone-hearted statues that there is
no money for education of children,' Congress spokesperson Abhishek
Manu Singhvi told reporters here.

'She has raised statues worth crores and is now raising a force for
their protection.. . but she has no money to spend on education of
children. This reflects the thinking of Murti-devi Mayawati who is
anti-people, anti-children and against empowerment of people,' he
added.

The Right to Education Act came into force April 1 and promises free
and compulsory education up to Class 8 in the country.

Singhvi said: 'It's a political mindset that injects politics into
welfare of Uttar Pradesh children.' Mayawati fears that if 'people
become educated and start thinking properly, they would start
questioning her decisions about constructing her own statues,' he
added.

Singhvi said implementing the Right to Education countrywide would
require Rs. 1.7 lakh crore in the first five years, of which 55 per
cent would be provided by the central government and 45 per cent by
states.

The state government is required to provide less than half of
Rs.18,000 crore to implement it, he said, adding that of the 90 lakh
to 95 lakh children out of school in the country, one-third are in
Uttar Pradesh.

The act provides for education to students in the age group of 6-14
and specially focuses on bringing 8.1 million children of this age
group back to classrooms.
